Abstract

Penelitian ini mengkaji permasalahan struktural dalam sistem pembentukan peraturan perundang-undangan di Indonesia, dengan fokus pada tahapan pra-legislasi sebelum pembahasan Rancangan Undang-Undang (RUU) di Dewan Perwakilan Rakyat (DPR). Dalam praktiknya, proses pembentukan regulasi pada tahap awal meliputi pembulatan konsepsi, harmonisasi, dan evaluasi yang melibatkan berbagai kementerian dan lembaga negara dengan kewenangan yang tersebar dan tidak terintegrasi. Kondisi tersebut menimbulkan fragmentasi kewenangan yang berdampak pada lemahnya pengendalian kualitas legislasi sejak tahap awal pembentukannya. Fragmentasi ini semakin diperparah oleh penerapan prinsip kehati-hatian oleh masing-masing lembaga, yang mendorong setiap institusi untuk berfokus pada tugas pokok dan fungsi normatifnya masing-masing, sehingga membatasi intervensi lintas sektor dan menyebabkan tidak adanya lembaga yang memiliki kewenangan final terhadap kualitas substansi RUU. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual, melalui analisis terhadap peraturan pembentukan peraturan perundang-undangan, doktrin hukum, serta studi perbandingan kelembagaan. Hasil penelitian menunjukkan bahwa mekanisme harmonisasi regulasi yang saat ini dijalankan oleh berbagai lembaga masih bersifat koordinatif dan administratif, sehingga belum mampu menjamin konsistensi norma, kepastian hukum, dan efektivitas kebijakan secara optimal. Oleh karena itu, pembentukan Badan Regulasi Nasional sebagai lembaga terpusat dengan mandat pengendalian kualitas regulasi, termasuk perencanaan, harmonisasi substantif, evaluasi, serta penerapan regulatory impact assessment, merupakan solusi guna mewujudkan sistem legislasi nasional yang terintegrasi, efisien, dan selaras dengan prinsip good regulatory governance.

Abstract

This study examines the integration of Sustainable Development Goals (SDGs), particularly Goal 5 (Gender Equality) and Goal 11 (Sustainable Cities and Communities), into gender-responsive spatial planning in Lhokseumawe City, Indonesia. Despite national mandates to mainstream SDGs in regional planning, spatial policies at the local level remain largely gender-neutral and insufficiently address socio-ecological vulnerabilities. This research aims to analyze the extent of SDG integration in spatial planning policies and to identify gaps in their implementation. Using a qualitative socio-legal approach, data were collected through in-depth interviews, focus group discussions, and analysis of policy documents, including the Regional Spatial Planning (RTRW) and related regulations. The findings reveal that while normative frameworks for gender mainstreaming exist, their operationalization in spatial planning remains partial, fragmented, and weakly institutionalized. Key challenges include limited gender-responsive budgeting, insufficient technical guidelines, and weak cross-sectoral coordination. Additionally, environmental pressures, particularly in coastal and water catchment areas, exacerbate spatial inequalities affecting vulnerable groups, especially women. This study contributes to the literature by reconceptualizing spatial planning as a transformative instrument that integrates gender justice and ecological sustainability within the SDG framework. It proposes a policy-oriented framework that embeds gender indicators into spatial planning instruments, strengthens participatory governance, and aligns local planning practices with global sustainability targets. The findings highlight the urgency of shifting from gender-neutral to gender-responsive spatial governance to achieve inclusive and sustainable urban development.

Abstract

Perkembangan teknologi digital melahirkan bentuk aset tidak berwujud yang memiliki nilai ekonomi, seperti cryptocurrency dan dompet digital (DANA, GoPay, OVO, dan ShopeePay), namun belum diimbangi dengan pengaturan hukum yang jelas dalam konteks kewarisan. Kondisi menimbulkan ketidakpastian hukum bagi ahli waris dalam hukum Islam maupun hukum positif Indonesia. Penelitian ini bertujuan menganalisis kedudukan aset digital sebagai harta waris serta mengidentifikasi kesenjangan pengaturannya dalam sistem hukum. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum. Bahan hukum diperoleh melalui studi kepustakaan dan dianalisis kualitatif dengan metode deskriptif-analitis dan komparatif. Hasil penelitian menunjukkan bahwa dalam perspektif hukum Islam, aset digital dapat dikualifikasikan sebagai harta (māl) sepanjang tidak bertentangan dengan prinsip syariah dan wajib dimasukkan ke dalam harta peninggalan pewaris. Sementara itu, hukum positif Indonesia belum mengatur aset digital secara eksplisit sebagai objek waris, sehingga diperlukan harmonisasi.

Abstract

In the Employment Law is not found that the Government may appoint civil servants Candidate (employess) derived from Honorary Workers but then with Government Regulation No. 48 Year 2005 About Appointment of Honorary Workers Being employess has set a policy that the Government may appoint honorary be employess and then amended by Government Regulation No. 43 of 2007 On Amendment of Government Regulation No. 48 Year 2005 concerning the appointment of Honorary Workers Being employess. This study aims to assess the presence of Honorary Workers in the perspective of Employment Law and Legal Implications Power Honorary appointment into employess. This type of research is normative and descriptive analytical study the rules or norms of positive law, relating to the Government's policy to raise the Honorary Workers be employess. The results of this study found that the appointment of Honorary Workers become employess more viscous aspects of public policy rather than juridical aspects. But public policy is then given a legal basis in the form of Government Regulation. Legal implications of the appointment of Honorary be employess conflict between Employment Law with Government Regulations governing, so that under the principles of law should be a higher Regulations beat / disregard the underlying Regulation and this may mean that the implications of the appointment of Honorary Workers into the civil servant is not valid in terms of Legal Aspects

Abstract

As time goes by and the development of the ship industry, international straits also play an important role as vital routes for the movement of ships. UNCLOS 1982 regulates the use of international straits as international navigation routes, affirming the importance of the Strait in global trade. The Strait is a transportation route and a source of significant economic potential, supporting growth and investment in the surrounding area. However, there are often dynamics and conflicts with countries on the edge of the Strait, one of which is the case of the Yemeni militant Hothi, who attacked merchant ships heading to the Americas and Europe or vice versa. Therefore, it is important to know about the rights and obligations of strait states in the context of maritime law and maritime law. This study will examine the regulation of the protection of commercial cargo ships in the peaceful passage of international straits and the protection of commercial cargo ships that have been attacked by a country's military group in international waters, with a legal research method that will analyze and provide a prescriptive view. UNCLOS 1982 regulates the peaceful passage of commercial cargo ships in the international Strait with the principle of freedom of navigation. It guarantees the safety of navigation, but there are restrictions to maintain the peace of coastal states that must still be observed. Ship protection involves the responsibility of coastal states, which must ensure unimpeded peaceful passage and provide hazard notices. Additional regulations such as SOLAS 1974 set minimum safety standards. Military attacks on commercial cargo ships could cause diplomatic tensions and economic losses. International cooperation, strict law enforcement, and mutual security measures are needed to enhance protection. This joint effort, involving coastal states and international cooperation, is expected to create a safe and stable maritime environment.

Abstract

The rapid adoption of algorithmic systems in public governance has transformed decision-making and service delivery, offering promises of efficiency and transparency. Yet, these technologies raise pressing concerns regarding fairness, bias, and social justice. This study investigates the intersection of digital governance, algorithmic decision-making, and social justice, with particular emphasis on emerging democracies. Employing a qualitative socio-legal approach, the research combines normative analysis of governance regulations, case studies of algorithmic applications in public administration, and interviews with policymakers and technology law experts. Comparative analysis across emerging democracies highlights diverse strategies for addressing equity concerns in algorithmic systems. Findings reveal that while algorithmic systems enhance efficiency, they often reinforce existing inequalities due to insufficient safeguards against bias and discrimination. Moreover, regulatory frameworks remain fragmented and inadequate to ensure fairness and accountability. The study proposes the development of adaptive legal frameworks that integrate transparency, accountability, and citizen engagement into AI governance. By embedding social justice principles into algorithmic regulation, governments can foster inclusive policy design and equitable outcomes. This research contributes to ongoing debates on balancing technological innovation with democratic values, emphasizing the need for governance models that prioritize fairness alongside efficiency.

Abstract

The rapid development of Artificial Intelligence (AI) has brought significant changes to the criminal justice system, particularly in criminal investigations and evidentiary processes, while simultaneously raising complex legal and ethical challenges. Objective: This study aims to analyze the legal implications of the use of AI in criminal investigations, focusing on its benefits, risks, and challenges related to the admissibility of AI-based evidence, as well as the need for regulatory frameworks that ensure fairness, transparency, and accountability. Methods: This research employs a normative qualitative approach through the analysis of legal regulations, a review of legal and technological literature, and a comparative approach across jurisdictions, complemented by case studies of AI applications in law enforcement practices. Results: The findings indicate that AI enhances investigative efficiency through data analysis, crime prediction, and digital forensics; however, it also poses risks such as algorithmic bias, human rights violations, and issues concerning the reliability and transparency of evidence. Furthermore, differences across legal systems result in the absence of uniform standards for the admissibility of AI-based evidence. Therefore, adaptive regulatory frameworks grounded in the principles of fairness, transparency, and accountability are required, along with strengthened human oversight to ensure that the use of AI aligns with the principles of justice and human rights protection.

Abstract

Perkembangan teknologi digital yang pesat telah mendorong transformasi signifikan dalam praktik pemasaran, khususnya melalui pemanfaatan media sosial sebagai sarana promosi. Dalam konteks ini, influencer muncul sebagai aktor kunci yang memiliki kemampuan memengaruhi preferensi dan keputusan konsumsi masyarakat melalui konten yang dipublikasikan. Aktivitas endorsement yang dilakukan influencer menjadi strategi pemasaran yang efektif karena dinilai lebih personal, persuasif, dan memiliki tingkat kepercayaan tinggi dari pengikutnya. Namun, di sisi lain, praktik tersebut tidak jarang mengandung informasi yang tidak akurat, klaim berlebihan, atau bahkan menyesatkan, sehingga berpotensi merugikan konsumen baik secara ekonomi maupun kesehatan. Kondisi ini menimbulkan persoalan hukum, khususnya terkait dengan batasan tanggung jawab influencer dalam menyampaikan informasi komersial kepada publik.Penelitian ini bertujuan untuk menganalisis secara yuridis pertanggungjawaban pidana influencer atas endorsement yang bersifat menyesatkan dalam perspektif hukum perlindungan konsumen di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, dengan mengkaji Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik, serta ketentuan perbuatan melawan hukum dalam KUHPerdata. Hasil penelitian menunjukkan bahwa influencer dapat dimintai pertanggungjawaban pidana apabila terbukti menyebarkan informasi yang tidak benar atau menyesatkan dan menimbulkan kerugian bagi konsumen. Namun, pengaturan hukum yang ada masih bersifat umum dan belum secara spesifik mengatur influencer, sehingga menimbulkan kekosongan norma dan kendala dalam penegakan hukum. Oleh karena itu, diperlukan regulasi yang lebih komprehensif untuk memberikan kepastian hukum serta perlindungan maksimal bagi konsumen.

Abstract

Narcotics law enforcement in Indonesia faces a paradoxical crisis where repressive criminal policies coexist with simplified evidence standards that often overlook the fundamental element of criminal liability: mens rea. Legal practice frequently adopts a de facto strict liability approach, where physical possession of narcotics automatically equates to guilty intent. This creates a substantive injustice, particularly for "instant couriers" who may be victims of deception (innocent agents). This research aims to reconstruct the evidentiary model of mens rea by adopting the "willful blindness" doctrine as an analytical bridge within the framework of the National Penal Code (dolus eventualis). Using a normative legal method with a conceptual and case-based approach, this study proposes a systematic reconstruction through objective indicators known as "Red Flags," such as unreasonable compensation and suspicious delivery patterns. The findings suggest that when a courier deliberately avoids confirming high-probability illegality, they should be held liable under a reconstructed mens rea standard. The implication of this study is the necessity of a standardized judicial guideline to distinguish between honest mistakes and epistemic strategies, ensuring a more proportional and human rights-oriented justice system.

Abstract

This Community service program aims to apply a crossflow water turbine in Daleman Village, Tulung Subdistrict, Klaten Regency. This program, conducted by students from the Mechanical Engineering Education Departments of Sebelas Maret University, primarily seeks to harness the renewable energy potential in the area and raise community awareness. The activities included field surveys, system design, turbine installation, and training for villagers on operation and maintenance. The results show that the program increased the community's awareness and understanding of renewable energy and strengthened their capacity to manage and maintain the implemented technology. The collaboration between students, faculty, and the community throughout the program also fostered positive and sustainable relationships. Overall, this community service initiative significantly contributed to achieving energy self-sufficiency and improving the quality of life for the residents of Daleman Village.
