Abstract

Perjanjian perkawinan (prenuptial agreement) merupakan instrumen hukum yang memiliki peran strategis dalam memberikan perlindungan hukum terhadap pengaturan harta kekayaan pasangan suami istri. Penelitian ini bertujuan untuk menganalisis kedudukan hukum perjanjian perkawinan dalam sistem hukum perdata Indonesia serta implikasinya terhadap harta perkawinan setelah Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa perjanjian perkawinan memiliki dasar hukum yang kuat berdasarkan KUH Perdata dan UU Perkawinan, serta kini dapat dibuat tidak hanya sebelum, tetapi juga setelah perkawinan berlangsung. Secara yuridis, perjanjian ini memberikan perlindungan terhadap harta bawaan dan harta bersama, serta menghindarkan pasangan dari risiko hukum yang timbul akibat utang salah satu pihak. Namun demikian, implementasinya masih menghadapi kendala administratif dan sosial, termasuk rendahnya kesadaran hukum masyarakat serta potensi penyalahgunaan untuk tujuan melawan hukum. Oleh sebab itu, diperlukan harmonisasi regulasi dan peningkatan pemahaman publik agar perjanjian perkawinan benar-benar menjadi instrumen hukum yang efektif, adil, dan berfungsi sesuai dengan tujuan pembentukannya dalam sistem hukum keluarga Indonesia.

Abstract

Praktik eksekusi jaminan fidusia dalam pembiayaan konsumen masih kerap menimbulkan permasalahan hukum khususnya ketika dilakukan secara sepihak oleh penerima fidusia melalui pihak ketiga tanpa prosedur hukum yang sah. Kondisi ini semakin relevan untuk dikaji setelah adanya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 yang menegaskan bahwa eksekusi jaminan fidusia tidak dapat dilakukan secara serta merta tanpa kesepakatan mengenai wanprestasi dan penyerahan objek jaminan secara sukarela atau tanpa penetapan pengadilan. Penelitian ini bertujuan untuk menganalisis batas kewenangan penerima fidusia dalam melakukan eksekusi jaminan fidusia serta bentuk tanggung jawab hukum yang timbul akibat eksekusi yang melampaui kewenangan dengan studi kasus Putusan Pengadilan Negeri Mataram Nomor 8/Pdt.G.S/2024/PN.Mtr. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan konseptual dan kasus. Hasil penelitian menunjukkan bahwa eksekusi jaminan fidusia yang dilakukan tanpa memenuhi syarat hukum merupakan perbuatan melawan hukum yang menimbulkan tanggung jawab perdata bagi penerima fidusia termasuk tanggung jawab atas tindakan debt collector sebagai perpanjangan tangan kreditur. Putusan a quo memperkuat perlindungan hukum bagi debitur dan menegaskan bahwa efisiensi pembiayaan tidak dapat mengesampingkan prinsip due process of law dalam hukum perdata.

Abstract

Disparitas putusan dalam perkara tindak pidana narkotika telah menjadi permasalahan krusial yang mengancam prinsip kepastian hukum dan keadilan di Indonesia. Penelitian ini menganalisis fenomena disparitas melalui studi komparatif terhadap dua putusan Pengadilan Negeri Medan yang memiliki karakteristik serupa namun menghasilkan vonis berbeda secara signifikan, yakni Putusan Nomor 2202/Pid.Sus/2023/PN.Mdn dengan hukuman 6 tahun penjara dan Putusan Nomor 2184/Pid.Sus/2024/PN.Mdn dengan hukuman 2 tahun penjara. Kedua terdakwa sama-sama didakwa melanggar Pasal 112 ayat (1) UU No. 35 Tahun 2009 tentang Narkotika dengan barang bukti narkotika jenis sabu-sabu dalam jumlah yang tidak jauh berbeda. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa disparitas terjadi karena tidak adanya pedoman pemidanaan yang bersifat mengikat, ruang diskresi hakim yang sangat luas, serta perbedaan dalam mempertimbangkan faktor-faktor yuridis dan non-yuridis seperti kehadiran atau ketiadaan penasihat hukum. Disparitas semacam ini berpotensi mengikis kepercayaan publik terhadap sistem peradilan dan mencederai asas persamaan di hadapan hukum sebagaimana diamanatkan dalam Pasal 27 ayat (1) UUD 1945. Penelitian merekomendasikan pembentukan pedoman pemidanaan nasional yang lebih konkret, peningkatan kapasitas hakim dalam memahami aspek substantif keadilan, serta penjaminan hak pendampingan hukum bagi setiap terdakwa guna mewujudkan peradilan yang adil dan konsisten.

Abstract

Penyalahgunaan narkotika merupakan persoalan kompleks yang tidak hanya berdimensi hukum pidana, tetapi juga berkaitan erat dengan aspek kesehatan dan sosial. Selama ini, kebijakan hukum pidana narkotika di Indonesia didominasi oleh pendekatan represif yang berorientasi pada pemidanaan penjara, namun terbukti kurang efektif dalam menekan angka penyalahgunaan dan justru menimbulkan berbagai persoalan struktural. Artikel ini bertujuan untuk menganalisis arah politik hukum pengaturan rehabilitasi penyalahgunaan narkotika dalam Undang Undang Nomor 1 Tahun 2023 tentang Kitab Undang Undang Hukum Pidana, mengkaji konstruksi normatif rehabilitasi dalam KUHP baru, serta menilai implikasinya terhadap sistem pemidanaan dan perlindungan hak asasi manusia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang undangan dan konseptual, serta dianalisis secara kualitatif deskriptif dan preskriptif. Hasil penelitian menunjukkan bahwa KUHP 2023 mengandung pergeseran paradigma menuju pendekatan rehabilitatif yang lebih humanis dan responsif dengan menempatkan rehabilitasi sebagai bagian dari sistem pemidanaan non penjara. Meskipun demikian, penguatan regulasi dan harmonisasi kebijakan masih diperlukan agar rehabilitasi benar benar berfungsi sebagai instrumen utama kebijakan kriminal narkotika. Artikel ini menegaskan pentingnya rehabilitasi sebagai wujud hukum pidana yang berkeadilan dan berorientasi pada pemulihan serta perlindungan masyarakat secara berkelanjutan.

Abstract

This study aims to analyze the role of Dayak Bakumpai’s Adat Law in resolving domestic violence (DV) cases. Dayak Bakumpai Adat Law continues to play a significant role in community life, particularly in addressing family conflicts, including DV. Although customary mechanisms are often preferred at the community level for their emphasis on deliberation, reconciliation, and social harmony, they cannot legally replace formal criminal prosecution for DV cases under Indonesian law. Therefore, this study provides a nuanced analysis to avoid implying that customary sanctions, such as fines or community service, constitute a lawful substitute for state-enforced criminal accountability. This study adopts an empirical approach, using a descriptive qualitative method that includes literature reviews and interviews with customary leaders and local community members. Data were also collected through field observations to understand the process of resolving DV cases based on Dayak Bakumpai's Adat Law mechanisms. The study results reveal that Adat Law demonstrates flexibility in handling DV cases through deliberation involving families, customary leaders, and community leaders. This customary resolution mechanism effectively maintains social harmony and prevents conflict escalation. However, the study also identifies challenges arising from inconsistencies between customary and national laws. In some cases, customary sanctions are deemed too lenient for DV perpetrators, raising concerns about the protection of victims, especially women. Still, they hold no authority to terminate or replace criminal liability. Additionally, Adat Law has not been fully recognized within Indonesia's formal legal system, leading to a duality of legal approaches in addressing DV cases. This creates a potential duality in legal approaches and underscores the need to harmonize customary practices with the national criminal justice system to safeguard victims’ rights while respecting local wisdom.

Abstract

This study analyzes the paradigmatic dilemma of Indonesia’s narcotics law: the necessity of strict prosecution against transnational syndicates versus the humanitarian crisis of prison overcrowding caused by the incarceration of addicts. Law Number 35 of 2009 concerning Narcotics embodies a philosophical dualism (retribution vs. rehabilitation), yet its implementation is dominated by a punitive orientation. The purpose of this research is to analyze the philosophical tension within Law 35/2009 and project the implications of its legislative synchronization with the restorative principles in the new Criminal Code (Law 1/2023). The method used is normative juridical with a prescriptive character, utilizing statutory, conceptual, and comparative approaches. The results conclude that the new Criminal Code risks significant failure in resolving the capacity crisis due to restrictions on alternative sanctions for crimes carrying penalties of over five years, which covers the majority of Narcotics cases. The codification attempt also potentially weakens the prosecution of transnational crimes due to the incomplete adoption of special investigation techniques. The primary recommendation is a firm legislative synchronization that separates jurisdiction: the new Criminal Code as lex generalis for minor users, and the Narcotics Law as a strengthened lex specialis to target dealers, supported by the implementation of factual decriminalization based on public health.

Abstract

This study examines the effectiveness of national legislative strategies in promoting corporate accountability for industrial pollution and social justice violations. It analyzes a comparative legal framework, focusing on laws, enforcement mechanisms, and corporate liability regimes in countries such as France, Germany, Norway, China, and Australia. The research evaluates how mandatory due diligence laws, judicial measures, and transparency mechanisms help hold corporations accountable for environmental impacts. It compares voluntary compliance models with mandatory legal frameworks, noting the limitations of voluntary agreements in driving substantial environmental changes. Findings show that countries with strong legal frameworks, like the EU and Australia, achieve higher corporate compliance and environmental performance, while voluntary measures struggle to produce meaningful results. The study emphasizes the need for stronger enforcement, higher penalties for violations, and enhanced public transparency. Additionally, it explores integrating environmental justice considerations, such as community participation and fair compensation, into national strategies. The study offers policy recommendations for improving corporate responsibility through better legislation, harmonizing laws across jurisdictions, and fostering collaboration among governments, corporations, and civil society. It also suggests future research directions, including examining the long-term impacts of environmental justice policies in different global contexts.

Abstract

Decision No. 3/PUU-XXII/2024 of the Constitutional Court of the Republic of Indonesia represents a significant development in the trajectory of Indonesian legal politics, particularly in relation to right to education as the constitutional protection enshrined in the 1945 Constitution. Although the ruling carries substantial implications for the interpretation of state obligations in the education sector, scholarly discussion has largely focused on the doctrinal aspects of constitutional adjudication, leaving limited attention to the broader fiscal and political implications of the decision within Indonesia’s governance framework. This study therefore seeks to examine the constitutional meaning and policy consequences of the ruling through a descriptive qualitative approach, with particular attention to the normative structure of the Court’s reasoning and the social justice values underlying its interpretation. The analysis focuses on how the Constitutional Court articulates the relationship between constitutional mandates, state responsibility, and the protection of individual educational rights within the broader framework of Indonesia’s welfare-oriented constitutionalism. The findings indicate that Decision No. 3/PUU-XXII/2024 strengthens the constitutional status of education as a positive right that requires active state intervention. At the same time, the ruling clarifies the scope of governmental obligations in ensuring equitable access to education while implicitly raising questions regarding fiscal allocation, institutional capacity, and policy prioritisation in the implementation of constitutional guarantees. By situating the decision within the broader discourse on the political theory of education law and the adjudication of socio-economic rights, this article contributes to the development of a normative framework that understands education not purely as a matter of public policy but as a constitutionally mandated instrument for achieving social justice. Ultimately, the study argues that the decision reflects a more responsive orientation in Indonesian legal politics, one that seeks to align constitutional interpretation with the pursuit of substantive equality in the national education system.

Abstract

This study aims to analyze the constitutional implications of Constitutional Court Decision Number 135/PUU-XXII/2024 on the term of office of the Regional People's Representative Council (DPRD), democratic legitimacy, and the potential for constitutional deadlock in the Indonesian state system. The main focus of the study lies in the conflicting norms between the principle of a five-year period of power as stipulated in Article 22E of the 1945 Constitution of the Republic of Indonesia and the consequences of the separation of National Elections and Regional Elections which have the potential to extend the term of office of the DPRD without renewing the electoral mandate. This study uses a normative legal research method (normative juridical) with a conceptual approach, a statutory approach, and a case approach. Data were obtained through a literature study of primary legal materials in the form of the 1945 Constitution of the Republic of Indonesia, Law Number 23 of 2014 concerning Regional Government, and Constitutional Court Decision Number 135/PUU-XXII/2024, and secondary legal materials from related literature and scientific journals. The analysis was conducted qualitatively with systematic, grammatical, and teleological interpretation techniques. The research findings indicate that the separation of elections without a clear transitional design creates normative tension between the obligation to implement the Constitutional Court's final and binding rulings and the principles of periodicity of power and legal certainty. This situation has the potential to trigger a crisis of democratic legitimacy within the Regional People's Representative Council (DPRD) and create a constitutional deadlock in regional governance. The implications of this research emphasize the importance of formulating a comprehensive constitutional transition framework and legislative reconstruction to maintain the consistency of constitutional supremacy, the circulation of power, and the quality of local democracy in Indonesia.
