Abstract

The supervisory function of the Judicial Commission at that time was met with a lot of resistance from judges, which eventually led to the submission of a judicial review of Law No. 22/2004 on the Judicial Commission to the Constitutional Court, which the Constitutional Court granted. With the granting of the judicial review petition, the Judicial Commission's supervisory function over judges ceased to exist. This raises the question of whether the judges will be able to carry out their duties fairly without external supervision. Purpose Study: Can these judges still carry out their duties fairly without external supervision? If so, then what is the role of these dignified judges within the scope of judicial power in Indonesia? This article uses normative legal research that analyzes relevant secondary data related to the role of dignified judges within the scope of judicial power. This research concludes that a dignified judge is a judge who works professionally based on ethical integrity, moral integrity and intellectual integrity. In order for this to be done, it is necessary to have supervision, both internally and externally. This research shows that there are still many judicial mafias in Indonesia, one of which comes from the judges themselves. this shows that there are still judges who do not work professionally by ignoring ethical and moral values so that many decisions are made that harm justice in society

Abstract

Disharmony between taxpayers and the government leads to tax disputes, often caused by differences in calculations regarding the amount of tax payable. Similarly, in land and building sales transactions, tax disputes can arise due to differences in calculations between the seller and buyer and the government (Regional Government) regarding the amount of Income Tax and Land and Building Tax (BPHTB) payable. In practice, tax disputes sometimes arise due to the issuance of a Tax Underpayment Assessment Letter (SKPKB). This study aims to analyze the legal interpretation of the 2021 Tax Court Decision Number PUT-002482.99/2020/PP/MXIVB regarding the BPHTB Lawsuit Case. This research uses a normative legal approach. This research is legal research that uses a legislative and conceptual approach. The results of the study indicate that the tax appeal filed by PT. SAM in the Tax Court contains procedural errors that are not in accordance with legal principles because the principle of filing an appeal, where the description of the BPHTB calculation is not the object of the tax appeal dispute, because the object of the substance of the tax dispute is the decision of the tax collector in the form of objections to SKPDKB, SKPDKBT, SKPDKLB, SKPDN. The settlement of tax disputes at the appeal level has not yet received a decision on tax objections that are contrary to the requirements and procedures for appeal as stipulated in Article 31 and Article 35 of Law Number 14 of 2002 concerning the Tax Court. In conjunction with Article 103 and 104 of Law Number 28 of 2009 concerning PDRD. This fundamental misunderstanding between the object of the lawsuit and the object of the appeal is what causes taxpayers to lose the legal basis to fight for their rights from the outset.

Abstract

This study aims to analyze the transformation of the educational system within the Islamic organization Mathla’ul Anwar (MA) and to examine how da’wah values are integrated into its educational practices. Employing a qualitative approach through library research, this study draws upon primary and secondary sources, including scholarly journals, organizational archives, and historical literature on Islamic education in Indonesia. The findings reveal that since its establishment in 1916 in Menes, Banten, MA has developed an integrative educational model that combines religious and general sciences as a manifestation of da’wah bil-ḥāl, preaching through social and institutional action. The transition from a traditional to a modern educational system is reflected in the implementation of an integrated curriculum, the adoption of a classical classroom structure, and the institutional strengthening up to the university level. Moreover, the values of sincerity, nationalism, and progress serve as the moral foundations for all educational activities within MA. In conclusion, MA’s educational model represents a form of transformative cultural da’wah that harmonizes Islamic values, modern rationality, and national spirit. Through education, MA has positioned itself as a strategic agent of social reform and the development of a progressive Islamic civilization in Indonesia.
