Abstract

Marriage involving pregnant women outside wedlock remains a critical socio-cultural and legal phenomenon in Indonesia, particularly in North Halmahera where family honor, religious authority, and customary law strongly influence communal life. This study aimed to explore how such marriages are understood, legitimized, and practiced by families, community leaders, and legal institutions. Using a qualitative case study approach, data were collected through in-depth interviews with religious leaders, adat leaders, government officials, parents, and young women, complemented by participant observation and document analysis, and analyzed with an interactive model of reduction, display, and conclusion drawing. The findings reveal that marriage is primarily arranged to safeguard family honor, with communities regarding it as the only socially acceptable corrective measure, while religious leaders across traditions adopt pragmatic interpretations, invoking public interest or redemption to justify the practice, and customary rituals together with state dispensations further reinforce its legitimacy. Although marriage resolves immediate stigma and reintegrates families socially, it simultaneously generates long-term vulnerabilities, including interrupted education, economic dependence, marital instability, psychological stress, and increased maternal and neonatal health risks. This study contributes to the sociology of law and religion by demonstrating how socio-cultural confinement, Islamic legal pluralism, and adat practices converge in eastern Indonesia, while underscoring the urgent need for holistic interventions that integrate sexuality education, family communication, religious engagement, and legal reform to protect women and children more effectively.

Abstract

Abstrak Penelitian ini bertujuan memahami hukum Islam secara mendalam melalui wahyu Al‑Qur’an dengan dua focus padapendekatan-pendekatan tafsir-ushul yang mencakup hermeneutik mantuq mafhum, analisis struktur naratif‑retorik, serta pendekatan rasional-normatif berdasarkan maqāṣid dan ijtihād; serta tantangan serta relevansi pemahaman hukum Islam kontemporer melalui studi kasus fatwa digital, reformasi keluarga, dan perumusan hukum berbasis kemaslahatan. Menggunakan metode kualitatif-deskriptif, data diperoleh dari analisis teks Al‑Qur’an, literatur klasik & modern, dokumen fatwa, serta regulasi kontemporer. Temuan menunjukkan bahwa integrasi mazhab klasik dengan pendekatan ijtihād‑maḳāṣid mampu menjembatani kesenjangan antara teks wahyu dan kebutuhan hukum modern, khususnya dalam ranah gender, HAM, dan teknologi. Validasi dilakukan melalui triangulasi akademik (diskusi ahli, verifikasi teks, dan peer review). Rekomendasi penelitian ini mendorong pengembangan tafsir hukum yang responsif dan dinamis terhadap permasalahan kekinian. Kata Kunci: hermeneutik; ijtihād‑maqāṣid; fatwa digital; reformasi keluarga; maslahah   Abstract This study aims to deepen the understanding of Islamic law through the revelation of the Qur’an by focusing on two main areas interpretative methodologies including mantuq mafhum hermeneutics, narrative‑rhetorical text analysis, and rational‑normative approaches based on maqāṣid and ijtihād; and challenges and relevance of contemporary Islamic legal understanding through case studies of digital fatwas, family law reform, and benefit-based legal formulation. Employing a qualitative-descriptive method, data were collected from Qur’anic text analysis, classical and modern literature, fatwa documents, and contemporary legal regulations. The results demonstrate that integrating classical legal schools with ijtihād- maqāṣid approaches can bridge the gap between the revealed text and modern legal needs, particularly in areas of gender, human rights, and technology. Validation was conducted through academic triangulation (expert consultation, textual verification, and peer review). Abstract

Penelitian ini bertujuan untuk mengetahui hubungan perdata anak hasil surrogate mother dengan ayah biologis. penelitian ini merupakan penelitian kualitatif dengan metode kepustakaan (library research) dengan menggunakan tiga pendekatan, yakni: pendekatan teologi normatif (syar’i), pendekatan yuridis dan pendekatan filosofis . Sumber data yang digunakan dalam penelitian ini bersumber dari buku-buku, jurnal-jurnal serta artikel-artikel yang berkaitan dengan penelitian. Sedangkan teknik pengelolahan dan analisis data dilakukan melalui tiga tahapan yaitu: reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa anak hasil surrogate mother juga telah memiliki hubungan perdata dengan ayah dan keluarga ayahnya berdasarkan Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 yang dapat dibuktikan dengan DNA (Deoxyribo Nucleic Acid). Anak hasil surrogate mother adalah anak bilogis dari pasangan suami isteri yang sah namun dalam hukum positif dan hukum islam anak hasil surrogate mother anak luar nikah yang digolongkan ke dalam anak zina. Meskipun tidak melalukan perbuatan zina secara langsung, namun esensi dari perbutaan zina terdapat dalam praktik tersebut. maka dari itu hubungan anak hasil surrogate mother dengan ayah biologis terhalang dalam tiga perkara, yaitu tidak boleh menggunakan nama ayah dalam nama anak tersebut, tidak berhak mendapat perwalian ketika ingin menikah, serta tidak berhak mewarisi harta dari orang tuanya. Meski demikian, anak tersebut masih bisa menjadi anak dari pasangan suami isteri tersebut dengan cara pengangkatan anak, dari ibu surrogatenya (ibu kandung) ke orang tua biologis (asal sperma dan ovum) dan mendapatkan hak1) hak perlindungan (elimentasi); 2) hak mendapatkan biaya hidup; 3) hak mendapatkan biaya kesehatan; 4) hak untuk biaya pendidikan, serta 5) wasiat wajibah.

Abstract

This study examines Ismail Al-Zain's fatwa on tajdīd al-nikāh and its relevance to remarriage practices at the Office of Religious Affairs (KUA) in Walenrang District, Luwu Regency, particularly among serial marriage perpetrators requiring official marriage registration. The research employs a field research method, combining a phenomenological approach to explore individual experiences with tajdīd al-nikāh and a normative juridical approach to analyze the issue through Islamic law, including the Qur'an, hadith, fiqh rules, and scholars' opinions. The findings reveal that while Ismail Al-Zain's fatwa permits tajdīd al-nikāh as jawāz (allowed), it should be avoided unless critically necessary. At the KUA of Walenrang, tajdīd al-nikāh is implemented not only to fulfill marriage registration requirements but also to address doubts about the validity of harmony and conditions in serial marriages. This practice is more accurately termed i'ādah al-nikāh, aiming to ensure compliance with Islamic legal requirements and resolve ambiguities associated with serial marriage legality. This study offers original insights into the practical and legal nuances of tajdīd al-nikāh versus i'ādah al-nikāh in the context of marriage registration. The findings underscore the critical role of legal clarity in protecting the rights of spouses and children and preventing future disputes in family law. The research highlights the importance of ensuring correct and legal marriage processes to address legal and social challenges in contemporary Islamic family practices.

Abstract

This research aims to answer how the rule of law and the application of police discretion in the use of firearms at the Makassar Police Headquarters. What is the view of Islamic law in responding to police discretion? The results of this study indicate that: The work of the police everywhere is to maintain law and public order, especially in terms of fighting crime in the community. Even though his duties and powers have been clearly defined by legal procedures, at the same time he is faced with a situation to make decisions that are according to his own judgment, and sometimes this is not in accordance with the applicable legal rules. because if one of them is done based on the rule of law then the other rules and order will be disturbed. Ijtihad and Discretion both have a strong legal basis but the legal position of the implementation of Ijtihad and Discretion has differences. In Ijtihad, if the ijtihad is right then it gets two rewards, and if one gets one reward. Whereas in the application of Discretion, if it is not correct or wrong in giving Discretion, then the Police Member shall bear the legal consequences of giving the Discretion.The implication of this research is that it is hoped that the application of Discretion within the scope of the Indonesian National Police in exercising their authority must act according to applicable regulations and are truly in the interests of police duties and public security. The public should know that the use of firearms is not arbitrarily used by the police outside of the provisions of the law.Keywords: Discretion; Police Cases; Firearms Users; Islamic Law Perspective;

Abstract

This study aims to determine the application of the principles of good governance, especially the principles of legal certainty and accountability in Segeri District, Pangkajene Regency and Islands during the Covid-19 pandemic. This research is a field research with normative theological and empirical juridical theological approaches. Based on the results of the study, it was found that the principle of legal certainty and the principle of accountability as part of the basic principles of good governance have been well applied, synergy between the government and the community is a fairly influential factor. While the Covid-19 pandemic did not have a significant impact, because the Segeri District Government continued to provide services even by making adjustments to implement health protocols, this did not reduce the quality of services to the community.

Abstract

Purpose - This research aims to analyze National Commitment and Religious Tolerance as a factor in shaping people's happiness in Palopo City and analyze the comparison of happiness between the Muslim majority and Christian minority communities in Palopo City. Method - This research uses quantitative research using a questionnaire distributed to 200 respondents. Data were analyzed using SEM PLS. Result - The research results show that national commitment and tolerance have a positive effect on people's happiness in Palopo City. Apart from that, the results of this research show that the happiness of Christian communities is higher than that of Muslim communities in Palopo City. Implication - Policy and Governance Implications, Promoting National Commitment for Well-being: The research demonstrates that national commitment has a significant positive effect on people's happiness. This implies that government and national programs aimed at strengthening Indonesian national values (such as Pancasila and the 1945 Constitution ) should be prioritized as they are foundational to fostering religious moderation and, consequently, improving community happiness levels.

Abstract

Religious intolerance has entered an emergency phase both globally and nationally. Overcoming religious intolerance as an effort to fulfill the right to freedom of religion continues to seek the right formulation with various alternative approaches that are easily accepted by society. This article aims to provide a basic understanding of the formation of official state policies through a cultural values approach that includes values of religious tolerance in Indonesia, especially cultural values of the Bugis and Toraja tribes groups in South Sulawesi Province, Indonesia. The method used is normative legal research with historical and statutory approaches, studying secondary data consisting of primary and secondary legal materials. Data were analyzed descriptively and prescriptively. The results of the study show that in Indonesia, South Sulawesi Province, especially the Bugis and Toraja tribes, there are cultural values that contain the value of religious tolerance. In the Bugis ethnic group, there are cultural values of Siri' Na Pesse and Assimareng which mean mutual cooperation, mutual respect, and respect regardless of socio-religious status, strong solidarity, and empathy for the suffering of others. Furthermore, the value of tolerance for the Toraja tribe is contained in the Longko and Pasomba Tedong values, which mean feeling grateful by blessing and respecting each other, tolerance is expressed in good speech, body language, perspective of others, and not embarrassing other people on the grounds of religious differences, the Toraja tribes believe that looking down on others is the same as embarrassing yourself.

Abstract

This research aims to explore productive waqf on community economic growth in Maros Regency. This type of research is qualitative with a case study approach. The scientific approach used is shar'i-juridical. The informants in this research are the Ministry of Religious Affairs of Maros Regency and the Maros community itself. The techniques used in collecting data are observation, interview, and documentation. Data were processed through stages such as reduction, display, and verification. The results of the research show that: 1) The productive waqf empowerment system in Maros Regency will be effective if public legal awareness regarding the implementation of productive waqf is considered an awareness of the legal subject as a whole. Waqf management requires adequate human resources, so as to produce good quality work, professionalism, and responsibility in carrying out their duties to help the community's economy. 2) Productive waqf empowerment in Maros Regency is influenced by management effectiveness, appropriate asset selection, partnership cooperation, human resource development, wise financial management, and understanding of waqf principles. 3) The strategy to increase the legal awareness of the Maros community towards productive waqf management is through counseling or seminars, cooperation with religious institutions, provision of educational materials, practical training, and collaboration with the government and financial institutions.

Abstract

Yusuf Al-Qardhawi's thoughts have high relevance in dealing with the problems of modern life, especially in the context of the Qur'an as a guide for society and individuals, democracy, Islamic faith, bank interest, Islamic economics, and consumption. However, in-depth studies related to his thoughts are still not systematically integrated in the academic literature, so research is needed to fill this knowledge gap. This research uses descriptive qualitative method to deeply analyze various works and thoughts of Yusuf Al-Qardhawi based on primary and secondary sources. The results showed that Yusuf Al-Qardhawi emphasized the importance of the Qur'an as a comprehensive guide for the life of the people, with a sharia-based approach that rejects bank interest and encourages a just Islamic economic system. In his view on democracy, he integrates Islamic values to support justice and public participation. In addition, his thoughts on consumption emphasize a simple and ethical lifestyle as part of sharia. The implication of this research is to provide an academic and practical foundation in the development of contemporary Islamic studies as well as the preparation of regulations that are relevant to the needs of modern society.
