Abstract

The purpose of this study is to find out the various factors that cause divorce due to domestic violence in Sinjai Regency and to describe how to resolve divorce due to domestic violence in Sinjai Regency and to elaborate on how divorce due to domestic violence is from an Islamic legal perspective. This research is a qualitative descriptive field research, taking place in Sinjai Regency. The approach used is a normative theological approach, a juridical approach and a sociological approach. The data collection obtained in the field with the technique of observation, interviews / interviews and documentation. The collected data is then processed using data reduction analysis, data presentation and conclusion drawing. Furthermore, by linking one of the theories of Islamic law, namely the theory of existence and competence of religious courts, the process of resolving divorce cases due to domestic violence in Sinjai Regency, which in this case is the authorized and entitled institution in resolving it, namely the Sinjai level I religious court, goes through several stages. namely through table I, table II and table III. However, before the plaintiffs and defendants seek justice, the panel of judges first has the obligation to mediate/advise both parties, in which the panel of judges makes every effort to provide the best advice or solution to the plaintiff or defendant. And Islamic law does not legalize violence against wives. Beating a wife who does nusyuz as contained in QS al-Nisa` verse 34 should be interpreted as an act to teach a lesson / for obedience, not to hurt or even do violence. The beatings carried out in the case of nusyuz basically should not injure. Meanwhile, the husband's act of hitting his wife until he is injured or the husband's violence against his wife can be declared as nusyuz of the husband against his wife. Furthermore, related to divorce due to domestic violence in Sinjai Regency which is analyzed from the perspective of Islamic law, the researcher connects one of the theories of Islamic law that applies in Indonesia to date, namely the theory of existence and competence of the Sinjai religious court which refers to the compilation of Islamic law or Islamic law. Abstract

This paper elaborates the social relationships in congregational prayers toward the social life in Makassar City during Covid 19 pandemic. The study used qualitative method and took place in Makassar City, South Sulawesi Province. The researchers applied phenomenological, normative, and anthropological approaches and used in-depth interviews, non-participatory observation, and documentation for data collection. The research instrument was interview guide and observation guide. After the data was collected, it was analyzed through three stages; data reduction, data presentation, and data verification/ conclusions drawing. The data triangulation involved credibility, dependability, confirmability, and transparency criteria. The results show that the role of congregational prayers on social problems in Makassar city during the Covid-19 pandemic is to educate the public directly to face the pandemic, encourage more self-reflection in interpreting the pandemic, and take wisdom from the situation.

Abstract

Background: triage is a complex decision-making process in order to determine which patients are at risk of death, disabilities, poor clinical situation deteriorates, and safe patient for waiting. One of the principles of response time is generally about handling emergency patients who should be treated later than five (5) minutes after arriving at the Emergency Room.Purpose: The objective is to know the relationship between the Response Time Validity triage the nurse.Methods: The study design was observational analytic with cross sectional approach to sampling using Accidental Sampling based on inclusion and exclusion criteria with the number of 18 respondents. Univariate test results obtained from 11 respondents do Triage with appropriate and quick response time doing about 8 respondent. To determine the relationship between the validity of triage and response time by using Spearman rank test test at the significance level of 95%, which gained significant value of p = 0.000 or less than 0.05 (0.000 <0.05).Results: The results of this study to indicate there is a relationship between the validity Triage and Response Time Hospital emergency room nurse in Sheikh Yusuf Gowa Hospital. Conclusion: It is expected that this study can be used as a reference for educational institutions and health care institutions.

Abstract

Penelitian untuk mengetahui dan memahami korupsi dari perpektif teori dan prinsip-prinsip dasar fiqh jinayah yang berhubungan dengan tindak pidana korupsi. Metode analisis yang digunakan adalah dengan menggunakan studi normatif yang berasal dari berbagai referensi buku dan jurnal secara online serta beberapa referensi yang relevan. Pembahasan yang dihasilkan adalah konsepsi korupsi yang diungkapkan atau pandangan beberapa ahli, tindak pidana korupsi, dasar hukum korupsi, bentuk-bentuk istilah dalam hukum Islam yang identik dengan korupsi, dan upaya-upaya yang dilakukan dalam pemberantasan korupsi di Indonesia.

Abstract

Larangan memakan harta anak yatim merupakan prinsip fundamental dalam hukum Islam yang bertujuan untuk melindungi hak-hak anak-anak yang kehilangan orang tua. Penelitian ini bertujuan untuk mengkaji larangan memakan harta anak yatim dalam perspektif hukum Islam, serta dampak sosial dan psikologis yang ditimbulkan dari penyalahgunaan hak-hak mereka. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan analisis literatur dari Al-Qur'an, Hadis, dan kajian akademis terkait. Hasil penelitian menunjukkan bahwa pengelolaan harta anak yatim sebagai amanah harus dilakukan dengan transparansi dan bertanggung jawab. Selain itu, masyarakat memiliki peran penting dalam mendukung kesejahteraan anak yatim, yang dapat mengurangi ketidakadilan sosial dan meningkatkan kualitas hidup mereka. Penelitian ini juga mengungkapkan bahwa ketidakadilan yang dialami anak yatim berpotensi menimbulkan dampak psikologis yang negatif, sehingga perlindungan dan perhatian terhadap mereka menjadi sangat krusial.

Abstract

This study aims to analyze the practice of forced marriage in the community of Lamakkaraseng Village, Bone Regency, and to examine its compatibility with Islamic law and Indonesian positive law. This research employs a qualitative approach with a field research design, using observation, in-depth interviews, and documentation as data collection techniques. The findings reveal that both Islamic law and positive law firmly reject the practice of forced marriage, as it contradicts the fundamental principle of consent between the prospective bride and groom. In Islamic law, consent constitutes an essential requirement for the validity of a marriage contract, while in positive law, it is regulated under Law Number 1 of 1974 and Law Number 12 of 2022 on Sexual Violence Crimes, which categorizes forced marriage as a criminal offense. The main contributing factors to this practice include parental dominance, economic pressure, as well as cultural and social legitimization. The impacts are not only social and legal but also psychological, particularly for women as victims. Therefore, strengthening public legal awareness and enhancing the protection of individual rights in choosing a life partner freely are crucial.

Abstract

Childfree in marriage is a contemporary social phenomenon that raises normative debates in the family law system both in the perspective of Islamic law and Indonesian civil law, the decision not to have children is often understood as part of individual freedom and reproductive rights, in other contexts marriage as a legal institution has goals, social functions, and public dimensions that are not fully subject to the private will of the parties. This study aims to analyze and compare the legal status of childfree in marriage, through the formulation of problems regarding: what is the legal status of childfree decisions in marriage jurisprudence according to maqāṣīd al-Syarī’ah, how is the regulation of childfree agreements in family law and what are the meeting points and differences in principles between marriage jurisprudence and civil law related to childfree using normative theological and normative juridical approaches in comparative legal research, analyzed through deductive reasoning and legal syllogism based on maqāṣid shari’ah, prenuptial agreements, and human rights restrictions. The results of this study indicate that, from an Islamic legal perspective, temporary childfree is tolerated as long as it does not negate the right to freedom, while permanent childfree contradicts the purpose of marriage. In Indonesian civil law, prenuptial agreements are not absolute, as they are limited by public order, morality, and the institutional purpose of marriage. The point of agreement between the two lies in the recognition that freedom in marriage is not absolute, but rather limited by social values ​​and institutional goals. The difference is that marital fiqh places offspring as a normative goal that is darūrī, while civil law emphasizes the autonomy of the parties, which is limited by positive law. Thus, reproductive rights in marriage are relational and have normative limits. This research is expected to provide a conceptual contribution in the development of maqāṣid al-Syarī'ah that remains oriented towards the darūrī objectives of sharia. This research is expected to strengthen the integration of Islamic, civil, and human rights law analysis in contemporary marital law studies.

Abstract

Pokok masalah penelitian ini adalah bagaimana implementasi kaidah fikih al-Adatu Muhakkamah dalam tradisi Manre Ade' di Kecamatan Sinjai Selatan serta tinjauannya dalam hukum Islam. Pokok masalah tersebut selanjutnya diturunkan ke dalam beberapa submasalah atau pertanyaan penelitian yaitu: 1) Bagaimana implementasi kaidah Al-‘Adatu Muhakkamah pada tradisi Manre Ade’ di Kecamatan Sinjai Selatan?; 2) Bagaimana penerapan kaidah Al-‘Adatu Muhakkamah pada tradisi Manre Ade’ dalam pernikahan? Jenis penelitian ii tergolong kualitatif dengan pendekatan teologis dan yuridis-normatif. Data diperoleh melalui observasi, dokumentasi, dan wawancara mendalam dengan tokoh adat, pemuka agama, dan masyarakat setempat, serta melalui studi literatur terkait kaidah fikih dan hukum adat. Pengolahan dan analisis data dilakukan dengan melalui tiga tahapan, yaitu: reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa tradisi Manre Ade' memiliki nilai-nilai yang sesuai dengan kaidah al-Adatu Muhakkamah. Tradisi ini mencerminkan semangat kebersamaan, gotong royong, dan rasa syukur yang sejalan dengan ajaran Islam. Namun, terdapat beberapa praktik yang memerlukan penyesuaian, terutama dalam hal prosesi Manre Ade’ seperti perilaku tabdzir atau membuang-buang makanan. Selain itu, keyakinan-keyakinan yang melenceng juga perlu untuk diluruskan agar penyelenggaraan tradisi Manre Ade’ ini bisa sepenuhnya sesuai dengan prinsip syariat Islam.

Abstract

Tujuan pokok penelitian ini adalah mengetahui perceraian akibat gangguan psikologis perspektif Maqa>s|id Syari|’ah (telaah putusan PA Majene Nomor 43/Pdt.G/2023/PA.Mj). Penelitian ini menggunakan penelitian kualitatif dengan jenis penelitian lapangan (field research). Studi lapangan dilaksanakan dengan mengumpulkan data primer melalui observasi, wawancara dan dokumentasi selain data yang diperoleh dari lapangan diperkuat juga dengan data berupa literatur seperti buku dan artikel-artikel ilmiah yang membahas mengenai penelitian ini. Kemudian, teknik pengolahan dan analisis data dilakukan dengan reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa 1) Pengadilan Agama Majene melalui Putusan Nomor 43/Pdt.G/2023/PA.Mj memutuskan perceraian dengan talak satu ba’in sughra atas dasar gangguan psikologis (temperamental) yang dialami suami. 2) Menurut pandangan Hakim, perceraian ini disebabkan oleh ketidakharmonisan rumah tangga akibat gangguan psikologis tergugat yang memiliki sifat temperamental. 3)Perceraian tersebut sejalan dengan prinsip Maqa>s|id Syari|’ah karena kondisi rumah tangga yang ada mengancam pemeliharaan lima unsur pokok.
