Abstract

The prenuptial agreement is regulated under Article 29 of Law Number 1 of 1974. This agreement is made either during or before the marriage takes place. The prenuptial agreement must be made and legalized in the presence of a lawyer or notary, and then ratified by the Religious Affairs Office (KUA) or Civil Registration Office. The research method used in this study is a normative juridical approach, focusing on issues within the scope of prenuptial agreement. The principle of balance is crucial to emphasize in order to ensure equality between the rights and obligations of the parties involved. A prenuptial agreement typically includes main clauses concerning property division, rights and obligations, child protection, and dispute resolution. The Indonesia government need to provide education to the public about the principle of balance in prenuptial agreements. The government should also establish standard clauses that accurately reflect this principle of balance, and should cover all important matters typically included in such agreements.

Abstract

This researches aims to see the position of a creation registration letter of art painting as a form of legal protection for painting works in the face of the principle of automatic protection adhered to in Law no. 28 of 2014 concerning Copyright. The research method in this study is juridical-normative with an analytical descriptive approach. The results of the research show that a creation registration letter can be one of the perfect initial proofs if the painter as the creator will make efforts to protect the law against his work either through criminal law remedies and/or filing civil lawsuits. Therefore, the registration of creation through the registration of creation of a painting is important for every painter to obtain a creation registration letter from the state, this is an effort to protect their intellectual property rights.

Abstract

This study critically examines the implementation of marriage dispensation policies in Indonesia and their implications for women's empowerment, particularly in the context of achieving Sustainable Development Goal (SDG) 5 and its target 5.3, which emphasizes the elimination of child marriage. Although Indonesia revised the minimum legal age of marriage to 19 for both men and women through Law No. 16 of 2019, the continued application of marriage dispensations, as permitted under Article 7(2) of the Marriage Law and further regulated by Supreme Court Regulation No. 5 of 2019, still legitimizes early marriage based on the broadly interpreted notion of "urgent necessity." Employing a normative juridical methodology, this study utilizes secondary data comprising statutory regulations, legal doctrines, judicial decisions, and relevant international instruments. This analysis is further supported by an empirical case study involving the marriage of two junior high school students in Pemalang Regency, which illustrates the real-world implications of these policies. The findings reveal that legal ambiguities and insufficient oversight within the dispensation framework perpetuate the practice of child marriage, thereby restricting girls’ access to education, healthcare, and economic opportunities. Using a feminist legal approach and a child rights-based perspective, this study underscores the urgent need for legal reform, gender-responsive policy development, and cross-sectoral collaboration to eliminate child marriage. The study contributes to strengthening Indonesia's national legal framework in fulfilling its global commitment to achieving a gender-equitable development agenda.

Abstract

Marriages between Indonesian citizens and foreign nationals create complex legal consequences, particularly regarding the regulation of joint property and the legal status of the parties involved. A prenuptial agreement serves as an essential legal instrument to provide legal certainty and protection for the rights and obligations of both spouses. This study aims to analyze the differences in the regulation of prenuptial agreements for couples with different nationalities between Indonesia and the Netherlands, as well as to examine their implications for the recognition and enforcement of such agreements in both countries. The research employs a normative juridical method with statutory and comparative approaches, using primary legal materials such as the Indonesian Civil Code and the Dutch Burgerlijk Wetboek, along with secondary materials including legal literature and academic journals. The findings reveal that Indonesia still applies the joint property system as the default rule under Law Number 1 of 1974 on Marriage, whereas the Netherlands, since 2018, has adopted the limited community of property system, which establishes the separation of personal property as the legal foundation. Moreover, the Netherlands grants couples with different nationalities the freedom to choose the applicable law through the choice of law mechanism as regulated in Council Regulation (EU) No. 2016/1103, while Indonesia does not yet have a clear mechanism in this regard. These differences have implications for legal certainty, regulatory flexibility, and the protection of spousal rights in mixed marriages

Abstract

This study examines corporate civil liability for employees’ non-procedural gold trading activities based on the Supreme Court Decision No. 1666 K/Pdt/2022. The analysis focuses on the application of Articles 1365 and 1367 of the Indonesian Civil Code to determine the extent of a company’s responsibility when an employee commits an unlawful act within the scope of employment. Employing a normative juridical approach through statutory analysis, doctrinal review, and judicial reasoning assessment, this research reveals that the Supreme Court upheld joint and several liability between PT AT Tbk. and its employees for losses arising from an improper gold transaction, affirming that the corporation remains liable for wrongful acts committed by its staff during the execution of their official duties. The ruling strengthens the legal concept of vicarious liability in modern corporate practice and constitutes an important precedent for consumer protection and legal certainty in high-value commercial transactions.

Abstract

This article analyzes the relationship between breach of contract (wanprestasi) and the enforcement of non-competition clauses in employment agreements, using the Supreme Court Decision Number 1785 K/Pdt/2023 as the main reference. The research aims to examine three core aspects: (1) the legal status of post-employment obligations as binding performance, (2) the determination of prohibited actions within non-competition clauses, and (3) the limitation of contractual liability only to parties who expressly bind themselves under the principle of privity of contract. The method used is normative juridical analysis through statutory interpretation, judicial reasoning, and doctrinal review. The study finds that non-competition clauses constitute negative performance that continues to bind workers even after the employment relationship ends, as long as the clause is clearly formulated and mutually agreed upon. The Supreme Court affirms that any form of involvement direct or indirect with a competitor within the agreed period constitutes breach of contract. However, contractual liability cannot be extended to third parties unless they actively participate in the breach. The findings highlight the need for proportionality, clarity of scope, and fairness in enforcing non-competition clauses within Indonesia’s legal framework.

Abstract

This article examines the civil liability of hospitals in cases of swapped babies through a comparative analysis between Indonesia and Malaysia, focusing on the formulation of the elements of unlawful acts and the forms of responsibility of both countries. This issue is important because negligence in infant identification not only causes material and psychological losses but also impacts children's civil rights and reduces public trust in health services. The research method used is normative juridical research with a comparative legal approach. The main findings of this paper indicate that Indonesia assesses cases of swapped babies through the elements of unlawful acts, while Malaysia uses the tort of negligence approach. This difference gives rise to practical liability, where Indonesia tends to emphasize proving the elements of unlawful acts formally, while Malaysia provides broader scope for the standard of care test through jurisprudence. Furthermore, Malaysia has a more varied scope of compensation, while Indonesia limits the form of compensation to material and non-material losses within the limits of propriety. These findings are important for strengthening patient safety standards and hospital accountability mechanisms to be more adaptive to complex immaterial losses. The results of this study can also be used as a guideline for further research.

Abstract

This study examines the implementation of marriage recognition for followers of indigenous religions, including those formally recognised by the State and those not recognised, and the legal consequences in certain situations. In Indonesia, interfaith marriages are often considered valid under their respective traditions and beliefs. Still, they are not officially recognised by the State, as Marriage Law Number 1 of 1974 recognised only six religions. This difference has led to various legal issues, including uncertainty about the couple’s marital status and their children, loss of inheritance rights, and obstacles to using public facilities and administrative processes. This study employs a normative legal approach, with a specific focus on the Constitutional Court’s decisions. The results of marriages show that legal recognition of marriages between members of indigenous religions remains limited and does not guarantee legal equality. According to the analysis, amending the Marriage Law and Population Administration Law to promote greater inclusivity regarding customary belief systems is a viable solution. The novelty of this research lies in the conflict between Article 2 paragraph (1) of the Marriage Law and Constitutional Court Decision Number: 146/PUU-XXII/2024, which states that believers are entitled to administrative recognition if their teachings and worship practices are deemed similar or closest to one of the religions recognised by the State. Thus, legal equality cannot be achieved through court decisions in a civil law system.

Abstract

This study analyzes the legal implications and dispute resolution mechanisms concerning the division of joint marital property following the recognition of postnuptial agreements made during marriage after Constitutional Court Decision No. 69/PUU-XIII/2015. The decision marked a significant shift in Indonesian marriage law by allowing spouses to conclude marital agreements not only before or at the time of marriage but also during the subsistence of marriage, thereby introducing greater contractual flexibility in property arrangements. Employing a normative juridical research method with statutory, case, and conceptual approaches, this study examines the legal force of postnuptial agreements and their consequences for spouses and third parties. The findings indicate that postnuptial agreements are legally valid instruments for separating joint property only if they are formally registered; otherwise, they bind the spouses internally and do not affect third parties such as creditors. Disputes arising from joint property separation may be resolved through litigation, which offers stronger legal certainty, or through non-litigation mechanisms that emphasize efficiency and amicable settlement. The novelty of this study lies in its focused analysis of dispute resolution models arising specifically from postnuptial agreements, highlighting the crucial role of registration and notarial involvement in ensuring legal certainty, fairness, and balanced protection for all parties within Indonesia’s marital property regime.   Penelitian ini menganalisis implikasi hukum serta mekanisme penyelesaian sengketa pemisahan harta bersama akibat pembuatan perjanjian kawin dalam masa perkawinan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015. Putusan tersebut menandai perubahan mendasar dalam hukum perkawinan Indonesia dengan memberikan ruang bagi suami istri untuk menyusun perjanjian perkawinan tidak hanya sebelum atau pada saat perkawinan, tetapi juga selama perkawinan berlangsung, sehingga meningkatkan fleksibilitas pengaturan harta. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, kasus, dan konseptual untuk mengkaji kekuatan hukum perjanjian kawin pascanikah serta dampaknya terhadap para pihak dan pihak ketiga. Hasil penelitian menunjukkan bahwa perjanjian kawin yang dibuat dalam masa perkawinan hanya memiliki kekuatan hukum penuh apabila dicatatkan secara resmi; tanpa pencatatan, perjanjian tersebut hanya mengikat secara internal dan tidak berlaku terhadap pihak ketiga seperti kreditur. Sengketa yang timbul dapat diselesaikan melalui jalur litigasi yang memberikan kepastian hukum lebih kuat atau melalui non-litigasi yang lebih efisien dan berorientasi pada perdamaian. Kebaruan penelitian ini terletak pada penekanan mekanisme penyelesaian sengketa yang secara spesifik timbul dari perjanjian kawin pascanikah serta pentingnya peran pencatatan dan notaris dalam menjamin kepastian hukum, keadilan, dan keseimbangan perlindungan bagi seluruh pihak dalam rezim harta perkawinan di Indonesia.
