Abstract

Registration of interfaith marriages in Indonesia has become an interesting legal issue to study, especially after the publication of Supreme Court Circular Letter (SEMA) No. 2 of 2023. This SEMA provides confirmation that unregistered interfaith marriages will not be recognized by the state, causing the emergence of legal conflicts related to the legal status of previously executed marriages. This research aims to analyze the differences in the perception of marriage before and after SEM|A No . 2 YEAR 2023, as well as legal impacts arising from SEM provisions A. The research method used is a normative research method with a short form of quantitative action, a short form of legislation draft by analyzing various regulations related to research issues. The research results reveal that although SEMA No. 2 of 2023 does not apply retroactively, couples who were married before the issuance of SEMA will still have their marriage recognized as valid by the state. However, couples who marry after the SEMA has been issued and cannot register their marriage face legal uncertainty, which impacts inheritance rights, the legal status of the marriage, and the protection of children born from the marriage.

Abstract

Edukasi ini bertujuan untuk memberikan pengetahuan berupa informasi-informasi hukum dalam kerangka konsultasi hukum kepada para tahanan dan warga binaan yang berada di Rutan Kelas I Depok. Terkhusunya bagi perlindungan hak atas akses bantuan hukum yang dapat diperoleh secara cuma-cuma oleh masyarakat yang membutuhkan. Adapun metode yang digunakan dalam bentuk ceramah kemudian dilanjutkan dengan diskusi atau tanya jawab terkait masalah-masalah hukum yang sedang dihadapi oleh para warga binaan dan para tahanan di dalam proses hukum yang sedang berjalan. Dari kegiatan ini diharapkan dapat memberikan pencerahan hukum sebagai bentuk pelayanan bantuan hukum yang bisa diakses oleh semua lapisan masyarakat terutama bagi mereka yang memiliki keterbatasan ekonomi. Kegiatan ini, juga sebagai sarana guna mendukung program pemerintah dalam rangka memberikan jaminan perlindungan hak atas keadilan bagi setiap warga negara yang merupakan bagian dari kewajiban negara.

Abstract

In a contractual agreement, problems often arise due to default or unlawful acts by one party that result in losses to the other party. As in the case that will be discussed in this article, the occurrence of unlawful acts caused by creditors that cause major losses. Leasing or known as Sewa Guna Usaha (SGU) is one method that is often used in Indonesia in the need for funding sources to obtain an asset such as in this case, namely a vehicle. This study aims to analyze case studies of violations of debtor rights in this installment agreement, and what form of responsibility the defendant is for his unlawful acts. The method used in this study uses a normative legal approach, namely analyzing and reviewing the legal issues being raised. In order to anticipate and protect legal interests, a contract must be prepared with clear clauses and is easy to understand. That way, if an action occurs that causes the agreement not to be completed or a loss, the party who is violated has the right to sue the violating party to court by fulfilling the elements of an unlawful act or default.

Abstract

An agreement or other legal event that results in an obligation gives rise to this legal relationship. In the practice of treaty law, problems often arise relating to the debtor's failure to fulfill his obligations to the creditor or his failure to keep his promise. Default, which comes from the Dutch meaning “bad performance”, occurs when a debtor fails to fulfill a promise, whereas performance occurs when a debtor fulfills a contract under civil law. Default means not fulfilling obligations that have been agreed upon in an engagement. Research on default and its settlement in a car rental agreement at Wawa Rental, Sragen Regency, aims to identify various forms of default and how to resolve them in the practice of car rental agreements at Wawa Rental. The results show that there are several forms of default, namely not performing obligations at all, not being able to carry out obligations as promised, being late in carrying out obligations, and taking actions prohibited in the agreement. The settlement of defaults is carried out through deliberation, while court settlement has never been chosen. The default cases discussed in this paper are examples of many similar cases that have occurred in Indonesia. This shows that there are still many Indonesians who ignore the provisions in the agreement that has been agreed upon by both parties.

Abstract

A franchise is a business system that involves two parties, namely the Franchise Owner (franchisor) and the Franchisee (franchisee), where the Franchise Owner grants licensing rights to the Franchisee based on a written agreement. In order for a business to be categorized as a franchise, the business must meet several criteria, including registering a franchise agreement prospectus and having a Franchise Registration Certificate. However, in the case of Neynis Food, the business has not registered its franchise with the state even though it has claimed to be a franchise business. This research aims to analyze the legal consequences if the Franchise Owner does not register their business, as well as legal protection for the Franchisee. This research uses normative juridical methods, which examine the laws that apply in society and their application in practice. The research results show that the Neynis Food business does not meet the requirements to be categorized as a franchise, and if it continues to claim so, the business can be considered illegal because it does not comply with the provisions in Minister of Trade Regulation No. 71 Years 2019.

Abstract

Lease according to Subekti is when the first party is able and will hand over an object that will be used for a certain period of time to the second party who will agree to pay a predetermined price related to the use for a predetermined time. Leasing is done by making a contract or agreement. An agreement is an agreement between two parties that must be fulfilled by each party. When the debtor does not fulfill his obligations according to the agreement, then it can be called a default. The obligation of one party is to hand over the goods to the other party for use, and the other party is obliged to pay the rental fee. Therefore, the goods are not handed over to be owned as in buying and selling, but are used only to enjoy the benefits. This research was conducted with the aim of knowing how the legal mechanism of the Excavator Lease agreement as stipulated in the Civil Code (KUHPerdata) and various legal remedies related to the settlement of default problems in Excavator rental. The research method used is using a juridical-normative approach.

Abstract

Lansia adalah seseorang yang telah memasuki usia 60 tahun ke atas dan merupakan kelompok umur pada manusia yang telah memasuki tahapan akhir dari fase kehidupannya. Kelompok yang dikategorikan lansia ini akan terjadi suatu proses yang disebut aging process atau proses penuaan sehingga muncul berbagai macam masalah kesehatan yang sering terjadi pada lansia, seperti gangguan pendengaran, nyeri pada punggung dan leher, osteoarthritis, jantung, diabetes militus, kolesterol dan hipertensi. Namun, ketika menghadapi masa tua ini banyak dari mereka yang malah diabaikan oleh keluarganya dengan menitipkan orang tuanya ke panti sosial. Tujuan dari penelitian ini adalah untuk untuk menganalisis dan mengkaji permasalahan yang dihadapi lansia serta mengevaluasi prinsip-prinsip lansia guna merumuskan strategi peningkatan kesejahteraan mereka secara holistik. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan pengumpulan data melalui observasi, wawancara dan juga studi literatur. Hasil penelitian didapatkan bahwa proses penuaan membawa berbagai macam tantangan pada lansia, seperti penurunan Kesehatan fisik, gangguan psikologi keterbatasan aktivitas sosial, dan penurunan ekonomi. Penerpan prinsip-prinsip lansia seperti kemandirian, partisipasi, perawatan, pemenuhan diri dan martabat terbukti dapat membantu meningkatkan kualitas hidup lansia secara menyeluruh. Program pengabdian Masyarakat di Panti Sosial Tresna Werdha Budi Mulia 2 menegaskan pentingnya sinergi antar keluarga, mesyarakat dan pemerintah dalam mendukung kesejahteraan lansia melalui edukasi, dukungan sosial, dan perlindungan hak-hak mereka.

Abstract

This study examines the case of a lawsuit for unlawful acts in buying and selling Coldplay concert tickets in Jakarta. The main focus is on the fraud case committed by Ghisca Debora Aritonang (GDA), who sold fake tickets to consumers. This case is included in the category of default and unlawful acts, with material and non-material losses suffered by the victims. Based on Articles 1365 and 1366 of the Civil Code (KUHPer), victims can claim compensation. This study also discusses the elements of unlawful acts, including unlawful acts, the existence of losses, causal relationships between actions and losses, and the fault or negligence of the perpetrators. The study highlights the importance of tighter scrutiny by concert organisers and increased consumer awareness of buying tickets online to prevent similar incidents in the future.

Abstract

This research aims to discuss the statutory regulations of halal certification. The study was performed through literature studies, especially on primary, secondary, and tertiary legal materials that describe legal protections for consumers and consideration of the halal certification. This study showed that micro and small enterprises’ food products are easy to verify about the halal food products, as long as the organization that assists the enterprises are legal entities. Micro and small enterprises (MSEs) should only make a statement letter of the halalness of a product that is verified and get assistance by Islamic social organizations or religious institutions that are legal entities and/or universities, government agencies, or business entities as long as they are partners with legal Islamic community organizations or Islamic religious institutions. However, regulations related to the halal statement of micro and small enterprise actors must still be reviewed and given special attention and supervision. In Indonesia, with the majority of the Muslim community, the guarantee of the halalness of a product and/or service is crucial. Abstract

Krisis ekonomi yang diakibatkan oleh COVID-19 telah berimbas pada kebijakan merumahkan para pekerja/buruh. Tidak kurang dari 1,1 juta pekerja/buruh dirumahkan sejalan dengan pemberlakuan kebijakan lockdown. Kebijakan merumahkan ini bertentangan dengan Undang-undang Ketenagakerjaan, khususnya mengabaikan hak-hak pekerja/buruh. Tujuan tulisan ini melengkapi kekurangan dari studi terdahulu dengan mengkaji secara seksama bagaimana tindakan merumahkan bertentangan dengan nilai-nilai dasar hukum yang mengatur ketenagakerjaan. Metode yang digunakan bersifat kualitatif yang didasarkan pada pemetaan berita-berita online yang dipilih secara random berdasarkan tema berita yang memenuhi kriteria focus penelitian serta data statistic tentang banyaknya perusahaan yang merumahkan pekerja/buruh pada masa pandemic COVID-19. Kemudian diklasifikasikan secara sistematis untuk membuktikan adanya pelanggaran hukum dalam praktik merumahkan pekerja/buruh mengakibatkan pekerja/buruh mengalami tidak dapat menuntut hak-haknya dan disisi lain pengusaha tidak melaksanakan kewajiban hukumnya, berakhirnya kontrak kerja sebelum masanya, dan menghalangi hak pekerja/buruh untuk menyampaikan aspirasinya. Hasil penelitian memperlihatkan bahwa kebijakan pada masa pandemic perlu dievaluasi, karena pengalaman masyarakat menjalani masa pandemic tidak menjadi perhatian dalam membuat kebijakan. Kesimpulan penting dari kajian ini adalah perlunya suatu pemahaman subjektif tentang pekerja/buruh yang mengalami kebijakan dirumahkan, sebagai alternatif pada pemahaman umum dan bersifat top down.The economic crisis caused by COVID-19 has an impact on the policy of laying off workers/laborers. No less than 1.1 million workers/laborers were laid-off in line with the implementation of the lockdown policy. This housing policy is contrary to the Manpower Act, particularly ignoring the rights of workers/laborers. The purpose of this paper is to fill in the deficiencies of previous studies by examining carefully how the act of housing is contrary to the basic legal values governing manpower. The method used is qualitative which is based on mapping online news that is randomly selected based on news themes that meet the research focus criteria as well as statistical data about the number of companies laying off workers/laborers during the COVID-19 pandemic. Then it is classified systematically to prove there is a violation of law in the practice of laying off workers/laborers causing workers/laborers to experience being unable to claim their rights and on the other hand employers not carrying out their legal obligations, ending work contracts prematurely, and hindering workers/laborers' rights to express their aspirations. The results of the study show that policies during a pandemic need to be evaluated because the experience of the community during a pandemic is not a concern in making policies. An important conclusion from this study is the need for a subjective understanding of workers/laborers who have experienced the laid-off policy, as an alternative to general understanding and is top-down.
