Abstract

Kewajiban sertifikasi halal bagi pelaku usaha pangan sebagaimana diatur dalam Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal menjadi tantangan tersendiri bagi pelaku Usaha Mikro dan Kecil (UMK). Rendahnya literasi hukum dan keterbatasan akses terhadap teknologi informasi menyebabkan banyak UMK belum tersentuh proses sertifikasi halal. Untuk menjawab tantangan tersebut, kegiatan pengabdian ini dilaksanakan dengan tujuan mendampingi pelaku UMK dalam memperoleh sertifikat halal melalui skema self-declare berbasis sistem SIHALAL yang dikembangkan oleh BPJPH. Pendampingan dilakukan secara intensif kepada pelaku usaha roti rumahan Dapur Zya yang memproduksi kue kering, mochi buah, dan camilan lainnya. Seluruh bahan yang digunakan telah memenuhi prinsip halal dan premium. Kegiatan meliputi sosialisasi regulasi, aktivasi akun SIHALAL, input data produk dan komposisi, serta pembimbingan unggah dokumen hingga pengajuan sertifikat. Meskipun menghadapi sejumlah tantangan teknis, proses pendampingan berhasil menjembatani pelaku usaha dengan sistem digital dan meningkatkan kesadaran akan pentingnya legalitas produk. Kegiatan ini menunjukkan bahwa sertifikasi halal dapat diakses oleh UMK dengan dukungan pendampingan yang adaptif. Selain itu, program ini berkontribusi terhadap pencapaian tujuan pembangunan berkelanjutan, khususnya dalam aspek perlindungan konsumen, pertumbuhan ekonomi inklusif, dan transformasi digital layanan publik. Pendekatan ini dapat direplikasi secara luas untuk mempercepat sertifikasi halal di kalangan UMK.

Abstract

This study examines the differences in child adoption regulations between Indonesia and Malaysia, and their impact on the legal protection of children adopted by Indonesian migrant workers in Malaysia. Employing a socio-legal approach, this study analyzes the regulations in both countries as well as relevant literature on child protection and international migration. The findings reveal that discrepancies in regulations, particularly regarding adoption procedures and recognition of citizenship, result in legal uncertainties for adopted children. These children often face difficulties in obtaining birth certificates, legal identity, and access to basic rights such as education and health. This study highlights the importance of harmonizing regulations between the two countries and strengthening international cooperation to protect the rights of children adopted by migrant workers. The practical implications of this research include the need for more comprehensive policies to protect cross-border children and to raise public awareness of the importance of child protection.

Abstract

This study aims to analyze law enforcement efforts against under-aged marriages in Indonesia, identify factors that cause under-aged marriages in Indonesia, and find out the implications of law enforcement efforts against under-aged marriages on child birth certificate registration. The research method used in this article is normative legal research which is analyzed qualitatively with a statutory approach and a case approach. The results of this study show that marriages that are only carried out based on religious law or beliefs, without being officially registered, are legal in religion, but not in the state. Factors that cause underhanded marriages include economic factors, social factors, psychological factors, and religious factors. The legal consequences caused by underhand marriages are detrimental to women and children resulting from these underhand marriages, one of which is difficulty in managing the registration of children's birth certificates. This study concludes that siri marriage/underhand marriage is recognized as religiously valid in Indonesia, but has no legal force because it is not registered at the KUA/Civil Registry in accordance with Law No. 1 of 1974. As a result, the marriage has no legal consequences for the couple and their children.

Abstract

Perkembangan teknologi yang pesat telah membawa inovasi dalam berbagai bidang, termasuk dalam kemudahan transaksi melalui kartu kredit. Kartu kredit melibatkan dua pihak utama: kreditur (pemberi pinjaman) dan debitur (penerima pinjaman). Kelalaian dalam menunaikan kewajiban dari salah satu pihak dapat dikategorikan sebagai wanprestasi, sebagaimana yang terjadi dalam kasus pada Putusan Pengadilan Negeri Nomor 338/Pdt.G/2023/PN Mdn. Kasus ini melibatkan PT Bank Mandiri (Persero) Tbk. sebagai kreditur yang memberikan pinjaman kepada nasabah, dan nasabah tersebut adalah seorang pemilik sebidang tanah dan seorang pengusaha. Penelitian ini mengkaji implikasi hukum dari wanprestasi dalam perjanjian kredit dan dampaknya terhadap kedua belah pihak, serta peran penting teknologi dalam mendukung pelaksanaan perjanjian kredit. Studi ini bertujuan untuk memahami bagaimana teknologi mempengaruhi dinamika perjanjian kredit dan bagaimana hukum menanggapi isu-isu yang timbul dari perkembangan teknologi tersebut.

Abstract

Researchers will examine the legal protection of the rights of children who enter into underage marriages. The purpose of this study is to show the impact of the ease of granting marital dispensation on children's development rights, namely how the legal protection of children's self-development rights is due to marital dispensation. The type of research used is normative legal research. The research approach used is the statutory approach and the comparative approach. The type of data in normative research is secondary data obtained through library research or documentation studies. Based on the results of the research, it turns out that there are still many parents who apply for marriage dispensation for children who are underage so they can get married. Therefore it is necessary to take action as an effort to provide legal protection to children. First, the government needs to review the Marriage Law, namely the need to add an article that regulates in detail the reasons for applying for a marriage dispensation. Second, it is necessary for the community to gain an understanding of the bad consequences that arise from underage marriages based on marriage dispensation.

Abstract

The prenuptial agreement is regulated under Article 29 of Law Number 1 of 1974. This agreement is made either during or before the marriage takes place. The prenuptial agreement must be made and legalized in the presence of a lawyer or notary, and then ratified by the Religious Affairs Office (KUA) or Civil Registration Office. The research method used in this study is a normative juridical approach, focusing on issues within the scope of prenuptial agreement. The principle of balance is crucial to emphasize in order to ensure equality between the rights and obligations of the parties involved. A prenuptial agreement typically includes main clauses concerning property division, rights and obligations, child protection, and dispute resolution. The Indonesia government need to provide education to the public about the principle of balance in prenuptial agreements. The government should also establish standard clauses that accurately reflect this principle of balance, and should cover all important matters typically included in such agreements.

Abstract

This researches aims to see the position of a creation registration letter of art painting as a form of legal protection for painting works in the face of the principle of automatic protection adhered to in Law no. 28 of 2014 concerning Copyright. The research method in this study is juridical-normative with an analytical descriptive approach. The results of the research show that a creation registration letter can be one of the perfect initial proofs if the painter as the creator will make efforts to protect the law against his work either through criminal law remedies and/or filing civil lawsuits. Therefore, the registration of creation through the registration of creation of a painting is important for every painter to obtain a creation registration letter from the state, this is an effort to protect their intellectual property rights.

Abstract

This study critically examines the implementation of marriage dispensation policies in Indonesia and their implications for women's empowerment, particularly in the context of achieving Sustainable Development Goal (SDG) 5 and its target 5.3, which emphasizes the elimination of child marriage. Although Indonesia revised the minimum legal age of marriage to 19 for both men and women through Law No. 16 of 2019, the continued application of marriage dispensations, as permitted under Article 7(2) of the Marriage Law and further regulated by Supreme Court Regulation No. 5 of 2019, still legitimizes early marriage based on the broadly interpreted notion of "urgent necessity." Employing a normative juridical methodology, this study utilizes secondary data comprising statutory regulations, legal doctrines, judicial decisions, and relevant international instruments. This analysis is further supported by an empirical case study involving the marriage of two junior high school students in Pemalang Regency, which illustrates the real-world implications of these policies. The findings reveal that legal ambiguities and insufficient oversight within the dispensation framework perpetuate the practice of child marriage, thereby restricting girls’ access to education, healthcare, and economic opportunities. Using a feminist legal approach and a child rights-based perspective, this study underscores the urgent need for legal reform, gender-responsive policy development, and cross-sectoral collaboration to eliminate child marriage. The study contributes to strengthening Indonesia's national legal framework in fulfilling its global commitment to achieving a gender-equitable development agenda.

Abstract

Marriages between Indonesian citizens and foreign nationals create complex legal consequences, particularly regarding the regulation of joint property and the legal status of the parties involved. A prenuptial agreement serves as an essential legal instrument to provide legal certainty and protection for the rights and obligations of both spouses. This study aims to analyze the differences in the regulation of prenuptial agreements for couples with different nationalities between Indonesia and the Netherlands, as well as to examine their implications for the recognition and enforcement of such agreements in both countries. The research employs a normative juridical method with statutory and comparative approaches, using primary legal materials such as the Indonesian Civil Code and the Dutch Burgerlijk Wetboek, along with secondary materials including legal literature and academic journals. The findings reveal that Indonesia still applies the joint property system as the default rule under Law Number 1 of 1974 on Marriage, whereas the Netherlands, since 2018, has adopted the limited community of property system, which establishes the separation of personal property as the legal foundation. Moreover, the Netherlands grants couples with different nationalities the freedom to choose the applicable law through the choice of law mechanism as regulated in Council Regulation (EU) No. 2016/1103, while Indonesia does not yet have a clear mechanism in this regard. These differences have implications for legal certainty, regulatory flexibility, and the protection of spousal rights in mixed marriages

Abstract

This study examines corporate civil liability for employees’ non-procedural gold trading activities based on the Supreme Court Decision No. 1666 K/Pdt/2022. The analysis focuses on the application of Articles 1365 and 1367 of the Indonesian Civil Code to determine the extent of a company’s responsibility when an employee commits an unlawful act within the scope of employment. Employing a normative juridical approach through statutory analysis, doctrinal review, and judicial reasoning assessment, this research reveals that the Supreme Court upheld joint and several liability between PT AT Tbk. and its employees for losses arising from an improper gold transaction, affirming that the corporation remains liable for wrongful acts committed by its staff during the execution of their official duties. The ruling strengthens the legal concept of vicarious liability in modern corporate practice and constitutes an important precedent for consumer protection and legal certainty in high-value commercial transactions.
