Abstract

In a country, territory is one of the mandatory elements for the establishment of the country. The potential owned by a region will not be utilized optimally if there is no development of the region. This study aims to determine how the construction of regulations in the development of coastal areas by Pandeglang Regency, to determine the effectiveness of the construction of regulations that have been owned by Pandeglang Regency and what problems arise, as well as solutions that can be applied as a solution to these problems. The normative legal research method is carried out by means of a literature study in the form of secondary data as a basic material for research and also by carrying out a qualitative approach. Pandeglang Regency has great potential for the development of coastal tourism. However, to maintain the sustainability of the local environment and culture, regulations are needed that integrate local wisdom in every aspect of tourism development. The results of the study indicate the need for regulations based on local wisdom to ensure sustainable coastal tourism development and provide adequate legal protection for the local community and environment. Abstract

Interfaith marriages often occur in several countries such as Indonesia and Singapore. The regulations applied in each country regarding interfaith marriages often differ, leading individuals who wish to enter into interfaith marriages to change their citizenship or follow their partner who holds citizenship in a country with legal provisions allowing interfaith marriages. This research will discuss the application of comparative law on interfaith marriages between Indonesia and Singapore along with its cases using a normative juridical research method with a qualitative approach consisting of legal, case, and comparative approaches. This research aims to analyze the comparison of applicable laws in Indonesia and Singapore in a specific case. This research will compare the civil law foundations of both countries to identify the strengths and weaknesses of each regarding interfaith marriages occurring among their citizens. Interfaith marriages that occur between Indonesia and Singapore also serve as a guideline in the case study in Indonesia based on judicial decisions and the guidelines for interfaith marriages conducted in Singapore, thereby providing legality with permanent and binding legal force.

Abstract

Dalam konteks hukum perdata Indonesia, perjanjian pemborongan antara PT. Berjaya Group dan Rohadi memunculkan isu penting terkait kedudukan hukum (legal standing yang Penggugat lakukan serta keabsahan suatu perjanjian yang dilakukan secara lisan. Berdasarkan Pasal 1313 Kitab Undang-Undang Hukum Perdata (KUHPerdata) perjanjian adalah suatu tindakan di mana suatu pihak atau lebih mengikat diri terhadap pihak lain. Kasus ini terjadi karena PT. Berjaya Group mengklaim bahwa Rohadi sudah melakukan kegiatan wanprestasi yang menyebabkan kerugian materiil dan immateriil bagi PT. Berjaya Group. Selain itu, artikel ini juga membahas mengenai keabsahan suatu perjanjian pemborongan yang dilakukan secara lisan, dan dampaknya terhadap penyelesaian sengketa. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan statute approach dan case approach. Teknik pengumpulan data meliputi studi dokumen berupa peraturan perundang-undangan terkait, putusan pengadilan, dan literatur hukum. Data analisis secara kualitatif melalui interpretasi sistematis dan teleologis untuk menjawab rumusan masalah.

Abstract

This research discusses the resolution of non-performance disputes in agreements to place Indonesian migrant workers at BP3MI Jakarta, especially the cases of PMI Watini and PT. Main Independent Success. Through normative juridical research and qualitative analysis, BP3MI Jakarta is proven to have an important role in handling disputes and providing legal protection for Indonesian migrant workers. The results show that mediation was successful in resolving the PMI Watini dispute with a refund of fees and a certificate of debt repayment. This research also links the findings with previous research, and suggests evaluating the effectiveness of BP3MI dispute resolution in various regions, analyzing PMI protection policies, international comparative studies, research on the role of stakeholders, other cases of default, developing a monitoring system, and evaluating social and economic impacts.

Abstract

This research discusses the business actors selling sunscreen with fake SPF content that endangers consumers.The purpose of this research is to find out the civil liability of business actors and to find out consumer efforts to obtain such liability.This research uses normative juridical legal research with a case approach and statutory approach.From this research it can be concluded that the actions of business actors are unlawful acts in accordance with article 1365 of the Civil Code and violate the consumer protection law so that they can be held liable in the form of compensation in accordance with applicable regulations.Consumer efforts to obtain their right to compensation can be done in a non-litigation manner.

Abstract

This study of legal implications of determining a missing person in relation to his rights and obligations as a subject of civil law explores the legal consequences of declaring a person missing (afwezigheid) on their civil rights and obligations in Indonesia. The status of missing persons creates legal uncertainty for families and related parties, especially in guardianship, divorce, and asset management matters. Using a normative juridical approach with statutory and case analysis, the research examines relevant laws including the Civil Code, Population Administration Law, Islamic Law Compilation, and court rulings. The results reveal a dual regulatory system between general courts and religious courts, leading to differences in procedures and legal effects. The declaration of missing status significantly affects three civil law areas: first, it allows appointment of guardians for children left behind; second, it serves as grounds for divorce after a specific period; and third, it permits appointing administrators to manage and protect the missing person’s property. The study concludes that harmonizing regulations on missing persons’ status is essential to provide legal certainty and comprehensive protection for all parties involved. Such harmonization would resolve procedural inconsistencies and jurisdictional overlaps, ensuring clearer legal frameworks and better safeguarding of rights and obligations in cases involving missing persons

Abstract

Penelitian ini bertujuan untuk menganalisis perbuatan melawan hukum (PMH) dalam konteks kepailitan perusahaan, dengan studi kasus Putusan Pengadilan Niaga Jakarta Pusat No. 226/Pdt.Sus-PKPU/2023/PN.Niaga.Jkt.Pst. Fokus utama penelitian adalah bagaimana pertanggungjawaban hukum dapat dikenakan kepada ahli waris dari pemilik perusahaan yang telah meninggal dunia, dalam sengketa mengenai pembayaran bonus berdasarkan Akta No. 78 Tahun 1998. Dalam kasus ini, permohonan PKPU diajukan terhadap ahli waris tanpa memperhatikan ketentuan hukum yang mengatur subjek hukum dalam kepailitan. Analisis yuridis menunjukkan bahwa Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU tidak mengenal konsep PKPU terhadap ahli waris, serta tidak terdapat hubungan hukum yang jelas antara pemohon dan termohon. Mahkamah Agung melalui putusan kasasi No. 1103 K/Pdt.Sus-Pailit/2024 membatalkan putusan sebelumnya dan menolak permohonan pailit. Hasil penelitian ini menegaskan pentingnya kehati-hatian dalam penerapan hukum PMH terhadap pihak-pihak yang tidak memiliki hubungan hukum langsung serta perlunya pemahaman mendalam mengenai batas subjek dalam perkara kepailitan.

Abstract

The amendment to Marriage Law No. 16 of 2019 sets a minimum age limit to protect children, particularly by reducing maternal and infant mortality rates. In reality, before and after the revision, the existence of marriage dispensations that have been granted continues to impact maternal and child health, as outlined in the Sustainable Development Goals (SDGs) under Goal 3. Therefore, this study aims to analyze the implementation of the marriage age limit and the impact of marriage dispensations on achieving the Sustainable Development Goals (SDGs). The research method used is a legal analysis (normative) approach and a legislative and historical approach based on literature reviews. The research findings reveal that challenges to achieving the SDGs still exist, particularly due to the high number of marriage dispensations granted and the increase in maternal and infant mortality rates. This study shows that there are still differences in the interpretation of urgent reasons because judges consider legal, social, and religious aspects in marriage dispensations, resulting in inconsistencies with the objectives of the law revision. Further study is needed regarding urgent reasons to consistently implement Marriage Law No. 16 of 2019 and Perma No. 5 of 2019. Preventive efforts through education on the negative impacts of early marriage, through inter-institutional collaboration, are also essential to enhance legal understanding and public awareness.

Abstract

Abstract This study aims to examine the position of evidence of suspicion as stipulated in Article 1915  of the Civil Code, especially proof to determine the status of out-of-wedlock children as biological children in civil procedure law, and to explore the extent to which the legal system provides protection for the civil rights of out-of-wedlock children who are determined as biological children without a DNA test. The type of research used is normative juridical which is descriptive-analytical, using a legislative approach and a case approach, with data collection techniques through literature studies, and processing qualitatively analyzed data. The results of the study show that evidence of suspicion is legal according to the law and can be used as a basis for judge's consideration if it is supported by the facts. A civil relationship between a child and a biological father can be recognized without a DNA test, simply with other evidence such as communications, witnesses, or indirect confessions at trial. This ensures the child's access to custody, identity, education, inheritance, and alimony. The state plays a role in protecting the rights of children out of wedlock in an inclusive manner and eliminating birth status discrimination. Suspect evidence needs to be strengthened as an alternative to proof if a DNA test is not carried out. The judge is expected to assess indirect facts wisely for the best interests of the child. Regulation, socialization, and training of law enforcement are needed to ensure that proof without DNA tests guarantees the protection of the civil rights of out-of-wedlock children. Keywords: Evidence of Suspicion, Status of Out-of-wedlock Children, Civil Procedure Law, Civil Rights.

Abstract

Measuring the effectiveness of centralizing coal mineral mining licensing in Indonesia is important for conducting research to measure the success of business actors in obtaining business certainty. There are indications of failure to centralize Indonesian coal mineral mining licensing, which can hamper the business being operated and reduce the trust of business actors in the Indonesian Government. This type of research is normative juridical research using second party data such as articles and laws and regulations up to court decisions which are then presented in descriptive form. The novelty of this research that distinguishes it from previous research is the analysis of ministerial-level regulations and legal processes carried out by several business actors at the State Administrative Court Institution to obtain business certainty. The results showed that several business actors to obtain certainty of license implementation such as PT Perdana Maju Utama, PT Fajar Bahari, PT Mandiri Biofuels, PT Sri Mulya Agung, PT Garuda Agung Perkasa, and CV Siti Maju Sejahtera, did not go well which was marked by filing a lawsuit at the State Administrative Court Institution to the Government of Indonesia, so that the non-implementation of centralization of mineral and coal mining licenses was not only carried out by business actors but also by the State as the licensor.
