Abstract

Fasting in Islam not only demands physical obedience, but also includes spiritual, social and educational dimensions. Apart from being a means of increasing piety, fasting strengthens social awareness and togetherness, both within families and communities. The tradition of parents fasting to pray for their children's success demonstrates the role of this act of worship in supporting spiritual education. However, from a classical fiqh perspective, the intention of fasting should be purely to seek Allah's pleasure, not for worldly purposes. Meanwhile, contemporary scholars emphasize the importance of maintaining a balance between the intention of worship and the reality of life, so that the spiritual essence of fasting is maintained. The research method used is descriptive qualitative with the type of Library Research to understand and examine fasting for children's success from the perspective of contemporary fiqh. The results of this study indicate the importance of maintaining the intention of fasting for the sake of Allah SWT without any intention other than Allah. Contemporary jurisprudence offers a solution by allowing parents to fast with the intention of being sincere to Allah, while increasing other worship such as prayer and almsgiving whose rewards are intended for the success of the child. This approach allows parents to support their children's success spiritually without compromising the virtue of fasting itself.

Abstract

This study proposes ideas for reforming Husein Muhammad’s ushul fiqh to address and deconstruct the gender biases present in some aspects of Islamic law in Indonesia. Using a conceptual research approach through a literature study, this research finds that Husein Muhammad employed the method of reforming ushul fiqh when examining women’s fiqh issues. Husein Muhammad’s approach to tajdid in ushul fiqh includes Tawhid as the fundamental basis for understanding the Qur’an and hadith, interpreting the concept of asbâb al-nuzûl by examining the broader historical context of human traditions at the time of the Qur’an’s revelation, rather than a narrow focus, differentiating between muhkamat verses with universal values and mutasyabihat verses with particular dimensions, considering Makiyyah verses to have a universal dimension, in contrast to Madaniyyah verses which are seen as having specific dimensions, and typologizing verses into those with legal dimensions and those with informative dimensions, as well as distinguishing between legal hadiths and informative hadiths. The renewal of the epistemology of Islamic law proposed by Husein Muhammad aims to produce Islamic legal interpretations that are just and gender-equal, freeing women from the constraints of patriarchal culture and misogynistic fiqh texts.

Kajian ini berawal dari banyaknya persoalan hari ini ialah tentang family yang mana disaat ini memerlukan sebuah respons dari hukum islam tentang bank asi. Kajian ini memakai metode kajian kepustakaan atau library research dan fokus utamanya ialah untuk mengeksplorasi dan menganalisis literatur yang ada mengenai topik penelitian. sasaran dari penelitian ini adalah untuk memahami perkembangan teori, metode, dan temuan terkini dalam bidang sebutkan bidang studi melalui studi kepustakaan. Abstract

The approach of Maqosith Syariah Alal Al-Fashi towards sex by maturation done by married couples through Video Call because long-distance relationships are allowed because in terms of benefits, the law in maturation is still being debated so that ijtihad is needed in determining the law, maximizing reason as an effort of ijtihad is very important to know and weigh the benefits and harms of maturation done by married couples caused by long-distance relationships, so that by combining the theory of Maqosith Alal Al-Fashi, the theory of Islamic Progressive Law and by using the method of sociological empirical research will be obtained a result that Sex by maturation using Video Call due to long-distance relationships is allowed and has more benefits than harms, and the most important thing from this study shows that sex with maturation through Video call husband and wife will create harmony in the family.

Abstract

Monogamy, as a form of marriage between one man and one woman, is widely considered the ideal norm in many cultures as it is associated with stability, commitment, and fidelity. In the Islamic context, monogamy is preferred as it is considered more manageable and conducive to domestic harmony. However, Islam also allows polygamy under certain conditions, which has led to an ongoing scholarly debate regarding its ethical and practical implications. While there has been much discussion regarding monogamy and polygamy in Islam, there has been little research using a maqashid sharia approach, particularly from the perspective of Jamaluddin Athiyyah. This research seeks to do so by assessing how monogamy aligns with the objectives of Islamic law compared to polygamy. This research uses a normative qualitative method with a conceptual approach. Primary data is obtained from Jamaluddin Athiyyah's works on maqashid sharia, while secondary data includes relevant journals, articles, and previous research on monogamy and polygamy. The qualitative analysis evaluates the role of monogamy in fulfilling the values of maqashid sharia, particularly in the domains of personal well-being, family stability, community harmony, and overall human well-being. The findings show that monogamy is more supportive of justice, tranquility, and well-being in family life than polygamy. From the perspective of Jamaluddin Athiyyah's maqashid sharia, monogamy significantly contributes to preserving the soul, reason, religion, honor, and. In addition, monogamy enhances social stability and promotes the welfare of the ummah, which is in line with the basic objectives of Islamic law, which are to achieve prosperity and prevent societal breakdown. Therefore, these findings will be useful for Muslim policymakers, academics, and society in understanding monogamy as a marriage framework that is more supportive of social justice and welfare.

Abstract

Today's technological advances require humans to always go hand in hand with technology. One of them is buying and selling activities using an online system. This is considered easier and more efficient than offline transactions. One of the popular shopping applications in Indonesia today is Shopee. In practice, Shopee offers a feature called paylater. This research uses a qualitative descriptive research method to describe the practice of using Shopee Paylater loans from the perspective of Islamic law, while what is used is some research that has been done before. This research was conducted using a normative approach to evaluate the strengths and weaknesses of the issues under consideration. In this case whether the practice of using Shopee Paylater loans is Halal or Haram. Actually, it has been fulfilled by Shopee Paylater from the qardh contract both in terms of akid because of the mutual agreement between the two parties, the main object being traded can be trusted, and also shigat in the paylater system there is already a form of transaction confirmation between the two parties which is in accordance with the qardh contract. However, from another aspect, there are instruments that contain usury, namely in the practice of Shopee Paylater there are additions.

Abstract

In Muslim societies, LGBT issues are often a sensitive and complex debate, with some groups and scholars viewing them as a violation of religious norms, while others seek a more inclusive approach. The understanding of fiqh becomes the main foundation in explaining various aspects related to this controversial sexual identity and orientation. By adopting a qualitative research method, this study involves a literature study of various primary sources of Islamic fiqh. The study also provides an overview of the evolution of LGBT-related fiqh thinking and interpretation throughout Islamic history. The results show the diversity of scholars' approaches to LGBT issues, along with interpretations of scripture and principles of fiqh. The stipulations related to LGBT behavior in fiqh are explained differently in terms of the punishment stipulated based on the legal source. Thus, it can be concluded that the understanding of LGBT in through the dadil sourced from the Qur'an and hadith has formulated fiqh law.

Abstract

This study examines the practice of breast milk donation in a village and its impact on nasab (lineage) status from Yusuf Qaradawi's perspective on breastfeeding regulations. The research aims to analyze how this practice influences mahram relationships in the village community. A qualitative approach with a case study method was used, employing in-depth interviews and documentation. The findings show that 19 residents have participated in breast milk donation. Among them, 10 individuals are considered mahram according to Yusuf Qaradawi’s criteria, having been breastfed more than five times, while eight individuals are not mahram as they were only breastfed once. A unique case was found where a couple unknowingly married their milk sibling, leading to their children performing tajdidunnikah (marriage renewal). The village community believes that a single instance of breastfeeding establishes a mahram relationship, differing from Yusuf Qaradawi’s view. The novelty of this research lies in its analysis of real cases within the context of Islamic family law and its application in rural society. This study contributes to the development of Islamic legal understanding regarding breast milk donation and provides a sociological perspective through Emile Durkheim's Structural Functionalism theory, demonstrating that mechanical solidarity plays a role in shaping legal norms in society.

Abstract

The rules of fiqh are fundamental principles in Islamic law that provide guidance in resolving complex legal issues, especially in modern social, economic, and political contexts. This article examines the relevance of four main rules of fiqh, namely: (1) If halal and haram come together, then haram defeats halal; (2) If two mafsadat conflict, then the lesser harmful one is prioritized; (3) Policies towards the people must be based on the public interest; (4) The easy is not defeated by the difficult. This study attempts to analyze the application of these rules in a contemporary context through an analytical-descriptive approach to classical and modern literature. The results of the study show that these rules are not only universal, but also adaptive in facing the dynamics of the times. The first rule is relevant in the regulation of halal-haram in the halal industry and sharia economy. The second rule contributes to mafsadat mitigation policies on health issues and public law. The third rule provides a normative basis for policies based on public interest, such as the distribution of zakat and productive waqf. The fourth principle reflects the flexibility of sharia in the obligation of worship and muamalah. The novelty of this article lies in the integration of fiqh principles with specific case studies in the modern era and the offering of an applicative framework based on maqashid sharia that is in line with the sustainable development goals (SDGs). These findings are expected to contribute to the development of Islamic law that is relevant and responsive to global needs.

Abstract

It is very important for Muslims to help resolve the legal problems they face every day. If they don't know where to go, they can't know how far something can go or what is more important to do or leave out. In acting or behaving, they are bound by the rules and values ​​they adhere to, which come from religious teachings and good habits. This research is included in the type of normative research. This type of research is a type of research that uses data from library studies, such as books, journals, and other literary sources, as well as previous research findings related to the research topic. Fiqh rules are general rules, cover a number of fiqh issues, and can be known. legal fiqh issues that fall within its scope. This fiqh rule can be used as an independent argument in establishing law, if there is no text argument. The history of the development of qawaidhul Fiqhiyyah is divided into 3 periods starting with the Prophet Muhammad then continued by the companions and tabiin with evidence of the jawamiul kalim hadith. and the existence of these 5 rules as main rules and used as a benchmark in determining fatwas. The 5 rules include: al Umuru bi Maqishidiha, al-Yaqinu La Yuzalu bi Syak, al-Masyaqqoh Tajlibu at-Taysir, ad-Dhororu Yuzalu, al-'Adatu Muhakkamah.
