Abstract

The installation of speed bumps must be carried out by units/institutions determined in accordance with Minister of Transportation Regulation Number 82 of 2018, so that they do not cause accidents and have negative consequences for road users. The aim of this research is to find out the law on installing speed bumps on public roads, both in terms of positive law and Islamic law. Apart from that, it is also to find out the sanctions obtained from installing speed bumps that do not comply with the regulations. This research is library research. This research was carried out by searching, reading, collecting and analyzing several sources related to the existing problem. The results of this research are that the basis for installing speed bumps is regulated in Law No. 14 of 2021, Amendments to Regulation of the Minister of Transportation No. 82 of 2018 concerning Road User Control and Safety Devices. These regulations explain the standards for installing speed bumps. Meanwhile, from an Islamic legal perspective, installing speed bumps can be considered a preventive measure to regulate vehicle speed and maintain the safety of drivers and pedestrians in certain locations. This is in line with the principle of maslahah (general goodness) in maintaining life and order.

Abstract

This study examines perspectives on gender transition from three viewpoints: students of the Islamic Education Program (PAI) at UIN Maulana Malik Ibrahim Malang, Indonesian positive law, and Islamic law. Using a qualitative narrative approach, interviews with ten PAI students revealed that the majority adhere to Islamic teachings, considering gender identity as a divine destiny that should not be altered, except in certain medical conditions. In Indonesian positive law, the process of gender transition is recognized through the court system with medical evidence. Meanwhile, in Islamic law, gender transition is generally rejected, except in cases of intersex. The Fatwa of the Indonesian Ulema Council (MUI) states that gender transition for individuals with a clear gender is haram but permissible in certain medical cases. This study concludes that the issue of gender transition is a complex debate involving religious, social, and legal aspects.

Abstract

The purpose of writing this article is to find out how to analyze the internalization of religious moderation from a contemporary fiqh perspective and what the implications of religious moderation from a contemporary fiqh perspective are that occur in the village of Tramok Kokop Bangkalan. This method uses a descriptive qualitative approach carried out with data analysis which is used as a process of collecting data, presenting data, drawing conclusions. The type of research in this article uses a case study type by focusing on a problem that you want to know and understand in depth and universally. The results of this research reveal that the internalization of religious moderation from the perspective of contemporary jurisprudence concludes that the process of internalization of religious moderation from the perspective of contemporary jurisprudence is more inclined towards the social attitudes of local communities with various social, religious and customary activities by prioritizing adab rather than ego, both among local communities and outside communities and The implications of religious moderation from contemporary Islamic jurisprudence perspectives that occur in society can build and establish stronger social relations so as to create peaceful, safe, secure and prosperous social life between communities and religion.

Abstract

This research aims to analyze the validity of online marriage contracts according to Islamic law by examining the perspectives of various schools of fiqh and Indonesian positive law. The research method used is qualitative with a descriptive approach. Data collection was carried out through interviews and observations. To enhance data validity, the researcher used source triangulation. The findings show that scholars differ in their opinions regarding the validity of online marriage. The Shafi'i, Maliki, and Hanbali schools reject it due to the emphasis on physical presence, while the Hanafi school permits it as long as the offer and acceptance are conducted simultaneously, even if from different locations. In Indonesia, online marriage is not yet regulated by law, but the Indonesian Ulema Council (MUI) allows it if a representative is used. These findings reflect that, although technology allows for online marriage contracts, caution in adhering to the essential conditions of the contract remains a primary concern.

Abstract

Pappaseng lempu (jujur) sebagai kearifan lokal yang mengakar dalam tatanan kehidupan masyarakat bugis menjadi suatu pijakan dalam melaksanakan pekerjaan khususnya dalam pengelolaan keuangan di lembaga pendidikan. Malempu (berperilaku jujur) juga dianjurkan dalam Al-Qur’an dan Hadits oleh karena itu penelitian ini bertujuan untuk mendeskripsikan perspektif Al-Qur’an dan Hadits dalam mengaktualisasikan nilai-nilai pappaseng lempu pada pengelolaan keuangan pendidikan. Studi literatur menjadi metode penelitian yang digunakan dengan mengumpulkan berbagai artikel ilmiah dan ayat-ayat Al-Qur’an serta tafsir-tasir Al-Qur’an dan Hadits yang berkaitan dengan penelitian kemudian dianalisis untuk memperoleh kesimpulan. Hasil penelusuran menginformasikan bahwa ada-ada pappaseng lempu (pesan-pesan berperilaku jujur) menjadi pengingat bagi pengelola keuangan pendidikan untuk senantiasa mengedepankan prinsip transparansi, akuntabilitas, efesiensi, dan efektivitas dalam kegiatan pengelolaan keuangan. Berperilaku jujur dalam aktivitas budgeting (penganggaran) untuk mengedepankan prinsip efesiensi dan efektivitas sudah dicontohkan dalam QS. Yusuf ayat 47-49 berdasarkan tafsir Al-Misan; aktivitas accounting (pembukuan) pada QS.Al-Infithar ayat 10-12 dan QS Al-Baqarah ayat 282 berdasarkan tafsir Al-Misan untuk senantiasa mengedepankan prinsip transparansi dan akuntabilitas; aktivitas auditing (pengawasan) pada QS. Al-Nahl ayat 90 berdasarkan tafsir Al-Muyassar dan HR. Tirmidzi No.2417 untuk senantiasa mengedepankan perilaku obyektif dan berani mengungkapkan kebenaran.

Abstract

Divorce is currently an increasingly comon phenomenon in urban area, including among Muslims in Indonesia and Malaysia. This phenomenon raises legal, social and psychological challenges that affect family resilience after divorce. Family resilience is not confined solely to the upper-middle-class, but also to all individuals striving to persevere in their daily lives after divorce. This research aims to explore the legal behavior of urban Muslims after divorce, with a focus on how individuals in these two countries deal with issues related to economic, socio-cultural and psychological issues. This is field research that uses qualitative methods related to the dynamics of family resilience in urban Muslim communities in Indonesia and Malaysia. The research was conducted using in-depth interviews. The results of this research are that each post-divorce family has a dynamic process in achieving family resilience. Factors that influence family resilience are not only oneself but also social support. This process needs to be strengthened by government support with strategic policies to ensure the fulfillment of post-divorce rights which can speed up the resilience process. Malaysia is more advanced in dealing with post-divorce family resilience with the existence of Bahagian Sokongan Keluarga (BSK). This research is able to contribute to the study of Islamic law and family resilience after divorce. In addition, this research offers strategic insights for the development of more inclusive policies and an Islamic legal perspective to support social justice and family welfare after divorce in both countries.

Abstract

This study aims to examine the implementation of Islamic-based character education to build morality and ethics in educational institutions by integrating Islamic values into curricula, teaching methods, and extracurricular activities. Using the library research method, data were collected from journals, books, policy documents, and scholarly articles. In-depth analysis identified key concepts, principles, and best practices in Islamic-based character education. The findings reveal that a holistic approach involving teachers, students, parents, and communities is essential for success. Islamic-based character education effectively fosters individuals with strong morality, character resilience, and ethical commitment. The study provides practical recommendations for educators and policymakers to design relevant and effective character education programs that address modern moral challenges.

Abstract

Fasting in Islam not only demands physical obedience, but also includes spiritual, social and educational dimensions. Apart from being a means of increasing piety, fasting strengthens social awareness and togetherness, both within families and communities. The tradition of parents fasting to pray for their children's success demonstrates the role of this act of worship in supporting spiritual education. However, from a classical fiqh perspective, the intention of fasting should be purely to seek Allah's pleasure, not for worldly purposes. Meanwhile, contemporary scholars emphasize the importance of maintaining a balance between the intention of worship and the reality of life, so that the spiritual essence of fasting is maintained. The research method used is descriptive qualitative with the type of Library Research to understand and examine fasting for children's success from the perspective of contemporary fiqh. The results of this study indicate the importance of maintaining the intention of fasting for the sake of Allah SWT without any intention other than Allah. Contemporary jurisprudence offers a solution by allowing parents to fast with the intention of being sincere to Allah, while increasing other worship such as prayer and almsgiving whose rewards are intended for the success of the child. This approach allows parents to support their children's success spiritually without compromising the virtue of fasting itself.

Abstract

This study proposes ideas for reforming Husein Muhammad’s ushul fiqh to address and deconstruct the gender biases present in some aspects of Islamic law in Indonesia. Using a conceptual research approach through a literature study, this research finds that Husein Muhammad employed the method of reforming ushul fiqh when examining women’s fiqh issues. Husein Muhammad’s approach to tajdid in ushul fiqh includes Tawhid as the fundamental basis for understanding the Qur’an and hadith, interpreting the concept of asbâb al-nuzûl by examining the broader historical context of human traditions at the time of the Qur’an’s revelation, rather than a narrow focus, differentiating between muhkamat verses with universal values and mutasyabihat verses with particular dimensions, considering Makiyyah verses to have a universal dimension, in contrast to Madaniyyah verses which are seen as having specific dimensions, and typologizing verses into those with legal dimensions and those with informative dimensions, as well as distinguishing between legal hadiths and informative hadiths. The renewal of the epistemology of Islamic law proposed by Husein Muhammad aims to produce Islamic legal interpretations that are just and gender-equal, freeing women from the constraints of patriarchal culture and misogynistic fiqh texts.

Abstract

Kajian ini berawal dari banyaknya persoalan hari ini ialah tentang family yang mana disaat ini memerlukan sebuah respons dari hukum islam tentang bank asi. Kajian ini memakai metode kajian kepustakaan atau library research dan fokus utamanya ialah untuk mengeksplorasi dan menganalisis literatur yang ada mengenai topik penelitian. sasaran dari penelitian ini adalah untuk memahami perkembangan teori, metode, dan temuan terkini dalam bidang sebutkan bidang studi melalui studi kepustakaan. Hasil dari kajian ini adalah bahwasanya dari eksistensi bank asi ini dibolehkan didalam persepktif islam dengan sebuah ketentuan bahwasanya pengelolahan asi tersebut wajib sama dengan ketentuan kesehatan.
