Abstract

This article discusses hoax in the perspective of the Qur'an, attempts to mitigate hoax from the Islamic perspective, the importance of digital literacy to overcome the spread of hoax and the challenges in dealing with the spreading of hoax in the era 5.0. This study used literature review to gather and analyze research findings. The researcher collected various sources such as articles, journals, and previous research result. This study found that the spread of hoax can cause a variety of problems, such as triggering conflict between religious groups, and destroying the unity of nations. Some steps can be taken to prevent hoax, including by checking the truth of information, tawaqquf, and improving the culture of literacy. The main challenge of preventing hoax in the society 5.0 era is the low literacy of society. Other challenges include the lack of preparedness of various parties to deal with the spread of hoax, as well as many hoax spreaders using fake accounts

Abstract

This study examines the social conditions of online gaming and the transactions of virtual property within it from an Islamic perspective. Online gaming has become a global phenomenon impacting various aspects of life, including social, economic, and spiritual dimensions. Transactions involving virtual property such as the purchase of accounts, items, or in-game currencies have emerged as a new trend; raising legal questions in Islamic jurisprudence. This research employs a qualitative approach with a normative literature review to analyse the rulings on online gaming and virtual transactions based on the principles of maqashid syariah. The findings indicate that the original ruling on online gaming is mubah (permissible). However, it can shift to makruh (disliked) or haram (prohibited) if it negatively impacts religious obligations, social relationships, or economic responsibilities. Similarly, the trade of virtual property is considered valid and lawful (halal) as long as it meets the pillars and conditions of trade in Islam; such as clarity of the object, utility, and ownership. This study aims to serve as a reference for understanding the social impacts of online gaming and to provide a contextual Islamic legal framework for addressing developments in digital technology.

Abstract

Abstract: The Legal Istinbath Methodology has a very strong influence on the legal products issued. Not everyone is able to practice an Islamic law because that person is required to master various branches of science, all of which lead to a process of establishing a law. Abdul Qadir Hassan is one of the scholars of Persatuan Islam’s organization (PERSIS) who consistently refers to the Qur'an and as-Sunnah. This study aims to determine the flow of his legal Istinbath methodology in answering various problems especially in salat problem’s in the period 1958-1984. With this research, we can also understand the flow of fatwa determination from the PERSIS Hisbah Council. This study uses a library research method using library materials in the form of articles and books. The analysis technique used is content analysis, which is a research methodology that utilizes a set of procedures to draw appropriate conclusions from a document. The results of the study reveal that the position of the Qur'an and as-Sunnah is the main foundation in determining his law. In understanding a text, it is basically textual as long as there is no other information that turns it away. In addition, the existence of Ijma' Companions and Qiyas are also used in establishing a law, although qiyas in this case is not used in matters of worship. As for the opinion of the imam of the madzhab, he does not use it if he does not find its basis in the Qur'an or as-Sunnah, but is used in its function as a reinforcement of the opinion that he issues. Abdul Qadir Hassan's method indirectly leads us to be critical and distance ourselves from taqlid and also being able to revise legal decisions that have been set by previous scholars.Abstrak: Metodologi Istinbath Hukum memiliki pengaruh yang sangat kuat terhadap produk hukum yang dikeluarkan. Tidak semua orang mampu untuk mengistinbath sebuah hukum karena orang tersebut dituntut untuk menguasai berbagai cabang keilmuan yang semuanya menjurus kepada sebuah proses penetapan hukum. Abdul Qadir Hassan adalah salah seorang ulama organisasi Persatuan Islam (PERSIS) yang secara konsisten merujuk kepada al-Qur’an dan as-Sunnah. Penelitian ini bertujuan untuk mengetahui alur metodologi Istinbath hukum beliau dalam menjawab berbagai persoalan umat khususnya dalam perkara shalat di periode 1958-1984. Dengan adanya penelitian ini juga, kita juga dapat memamahi alur penetapan fatwa dari Dewan Hisbah PERSIS. Penelitian ini menggunakan metode peneltian pustaka dengan menggunakan bahan-bahan-bahan kepustakaan berupa artikel maupun buku. Teknik analisa yang digunakan adalah content analysis, yaitu metodologi penelitian yang memanfaatkan seperangkat prosedur untuk menarik kesimpulan yang tepat dari sebuah dokumen. Hasil penelitian mengungkapkan bahwa kedudukan al-Qur’an dan as-Sunnah menjadi fondasi utama dalam penetapan hukum beliau. Dalam memahami sebuah nash, pada dasarnya ia bersifat tekstualis selama tidak ada keterangan lain yang memalingkannya. Selain itu, keberadaan Ijma’ Sahabat dan Qiyas juga digunakan dalam menetapkan sebuah hukum, meskipun qiyas dalam hal ini tidak digunakan dalam urusan ibadah. Adapun pendapat imam madzhab tidak ia gunakan jika tidak ditemukan dasanya dalam al-Qur’an maupun as-Sunnah, namun digunakan dalam fungsinya sebagai penguat pendapat yang ia keluar­kan. Metode Abdul Qadir Hassan sendiri secara tidak langsung menuntun kita untuk bersikap kritis dan menjauhkan diri dari taqlid buta serta mampu merevisi keputusan-keputusan hukum yang telah ditetapkan oleh ulama sebelumnya.

Abstract

Pesantren is a traditional educational environment where students live together and study under the guidance of a teacher who is better known as a kiai. This paper aims to add a special study related to impact of existence in Bahrul Ulum Islamic Boarding School Tambakberas, Jombang, on the Behavior or Attitude the Religious Ethic of Surrounding Community. This paper uses a qualitative research type. And is the result of field research, And is the result of field research, the use of Sociological and Anthropological approaches by understanding socio-religious practices, this writing uses the Theory of Use of Religious Theory as a Cultural System from Clifford Geertz, to see the culture of community around in pesantren. The Bahrul Ulum Tambakberas Jombang as one of subcultural institutions introduced the idea of village Development and a center for community learning activities with Islamic principles that deal directly with all kinds of community problems. The results of writing show that pesantren play a very effective role in empowering and transforming society. Islamic boarding schools were born to respond to the situation and social conditions of a society which is being faced with the collapse of moral foundations, through the transformation of the values offered.

Abstract

Islamic inheritance law is a critical subject within legal education, particularly for prospective lawyers and Muslim communities. However, many students at Universitas Brawijaya perceive this subject as complex and difficult to master. This study aims to explore students' perceptions of Islamic inheritance law and identify the key challenges they face in understanding it. A mixed-method approach was employed, combining quantitative data from Likert-scale questionnaires and qualitative input from open-ended responses. The study involved 182 active law students selected using the Isaac and Michael sampling formula. Results indicate that while students generally acknowledge the importance of the subject, they struggle with its complexity, abstract terminology, mathematical calculations, unstructured content, lack of Arabic proficiency, inadequate instructional strategies, and limited media support. Despite these barriers, a significant portion of students remain optimistic about mastering the subject. The findings highlight the need for empirically designed instructional models, practical learning tools, and improved pedagogical strategies. The implications of this study are essential for legal education reform, particularly in enhancing teaching effectiveness, student engagement, and professional competence in dealing with Islamic inheritance disputes.

Abstract

Islamic law in Indonesia is developing rapidly, including wasiat wajibah in the KHI, which is the mandatory transfer of property between parents and adopted children through a court decision. This study is normative in nature, employing the maqasid syari’ah approach of Ibn Asyur. The study aims to analyze the concept of wasiat wajibah as stipulated in the KHI, comparing it with the Egyptian Qanun to determine whether it aligns with the objectives of Islamic law.  This study found several results: 1) Mandatory wills in the KHI are given to adopted children and adoptive parents, with a maximum of 1/3 of the estate. In the Egyptian Qanun, wills are given to grandchildren whose fathers died while their grandparents were still alive and who are prevented from inheriting. 2) In Indonesia, the concept of mandatory bequests has been expanded through a Supreme Court ruling to include adopted children, adoptive parents, and relatives barred from inheritance such as non-Muslims, stepchildren, and children born out of wedlock. In Egypt, according to a ruling by Darul al-Ifta, mandatory bequests are given to grandchildren if their father dies before their grandfather or grandmother. 3) According to Ibn Asyur's maqasid Syariah, the reformulation of Article 209 of the KHI regarding wasiat wajibah is in line with maqasid syariah because it preserves lineage, regulates inheritance proportionally, and creates clarity and peace between heirs and recipients of wasiat wajibah. Abstrak Hukum Islam di Indonesia berkembang pesat, termasuk wasiat wajibah dalam KHI, yaitu pemberian harta secara wajib antara orang tua dan anak angkat melalui putusan pengadilan. Penelitian ini bersifat normatif dengan pendekatan maqasid syari’ah Ibnu Asyur.Penelitian ini bertujuan untuk menganalisis konsep wasiat wajibah yang tercantum dalam KHI yang dibandingkan dengan Qanun negara Mesir sudahkah sesuai dengan tujuan syariat Islam.  Penelitian ini menemukan beberapa hasil penelitian 1) Wasiat wajibah dalam KHI diberikan terhadap anak angkat, dan orang tua angkat maksimal 1/3 dari harta peninggalan, Sedangkan dalam Qanun Mesir wasiat diberikan kepada cucu yang ayahnya meninggal dunia sewaktu kakek atau neneknya masih hidup dan cucu tersebut tehalang untuk mendapatkan warisan. 2) Di Indonesia, konsep wasiat wajibah diperluas melalui putusan Mahkamah Agung, mencakup anak angkat, orang tua angkat, serta kerabat terhalang warisan seperti non-Muslim, anak tiri, dan anak hasil zina. Di Mesir, menurut putusan Darul al-Ifta, wasiat wajibah diberikan kepada cucu jika ayahnya meninggal sebelum kakek atau neneknya. 3) Menurut maqasid Syariah Ibnu Asyur, reformulasi Pasal 209 KHI tentang wasiat wajibah selaras dengan maqasid syariah karena menjaga nasab, mengatur warisan secara proporsional, serta menciptakan kejelasan dan kedamaian antara ahli waris dan penerima wasiat wajibah. Abstract

The rules of fiqh are fundamental principles in Islamic law that provide guidance in resolving complex legal issues, especially in modern social, economic, and political contexts. This article examines the relevance of four main rules of fiqh, namely: (1) If halal and haram come together, then haram defeats halal; (2) If two mafsadat conflict, then the lesser harmful one is prioritized; (3) Policies towards the people must be based on the public interest; (4) The easy is not defeated by the difficult. This study attempts to analyze the application of these rules in a contemporary context through an analytical-descriptive approach to classical and modern literature. The results of the study show that these rules are not only universal, but also adaptive in facing the dynamics of the times. The first rule is relevant in the regulation of halal-haram in the halal industry and sharia economy. The second rule contributes to mafsadat mitigation policies on health issues and public law. The third rule provides a normative basis for policies based on public interest, such as the distribution of zakat and productive waqf. The fourth principle reflects the flexibility of sharia in the obligation of worship and muamalah. The novelty of this article lies in the integration of fiqh principles with specific case studies in the modern era and the offering of an applicative framework based on maqashid sharia that is in line with the sustainable development goals (SDGs). These findings are expected to contribute to the development of Islamic law that is relevant and responsive to global needs.

Abstract

It is very important for Muslims to help resolve the legal problems they face every day. If they don't know where to go, they can't know how far something can go or what is more important to do or leave out. In acting or behaving, they are bound by the rules and values ​​they adhere to, which come from religious teachings and good habits. This research is included in the type of normative research. This type of research is a type of research that uses data from library studies, such as books, journals, and other literary sources, as well as previous research findings related to the research topic. Fiqh rules are general rules, cover a number of fiqh issues, and can be known. legal fiqh issues that fall within its scope. This fiqh rule can be used as an independent argument in establishing law, if there is no text argument. The history of the development of qawaidhul Fiqhiyyah is divided into 3 periods starting with the Prophet Muhammad then continued by the companions and tabiin with evidence of the jawamiul kalim hadith. and the existence of these 5 rules as main rules and used as a benchmark in determining fatwas. The 5 rules include: al Umuru bi Maqishidiha, al-Yaqinu La Yuzalu bi Syak, al-Masyaqqoh Tajlibu at-Taysir, ad-Dhororu Yuzalu, al-'Adatu Muhakkamah.

Abstract

One of the issues that often arises in the context of marriage is the case of "missing husband/wife."This term refers to a situation where the husband is absent or not present in the household for a long time, causing the marriage to be halted or threatened.In the Indonesian marriage law system, this issue refers to UUP No. 01 of 1974 Article 39 and KHI Article 116 point b.This type of research is normative with a legal, comparative, and conceptual approach.This research examines the urgency of reformulating the provisions for a missing husband in the Indonesian marriage law system through the perspective of maslahah al-Buthi.The analysis shows that the two-year waiting period as regulated in KHI Article 116 b and UUP No. 01 of 1974 Article 39 creates serious legal uncertainty for the wife and children, negatively impacting inheritance rights, economic and psychological well-being, and violating the principle of distributive justice.Based on the principle of maslahah al-Buthi, it is recommended to reduce the waiting period to one year to expedite dispute resolution and minimize harm.This reformulation aligns with the goals of national law—human rights protection, gender justice, and legal certainty—while creating synergy between progressive Islamic legal values and modern norms.The implementation of this proposal is expected to achieve a faster determination of marital status, improve economic access for wives, and prevent family poverty, thereby supporting the attainment of family welfare and harmony.

Penelitian ini bersifat normatif dengan pendekatan maqasid syari’ah Ibnu Asyur.Penelitian ini bertujuan untuk menganalisis konsep wasiat wajibah yang tercantum dalam KHI yang dibandingkan dengan Qanun negara Mesir sudahkah sesuai dengan tujuan syariat Islam.  Penelitian ini menemukan beberapa hasil penelitian 1) Wasiat wajibah dalam KHI diberikan terhadap anak angkat, dan orang tua angkat maksimal 1/3 dari harta peninggalan, Sedangkan dalam Qanun Mesir wasiat diberikan kepada cucu yang ayahnya meninggal dunia sewaktu kakek atau neneknya masih hidup dan cucu tersebut tehalang untuk mendapatkan warisan. 2) Di Indonesia, konsep wasiat wajibah diperluas melalui putusan Mahkamah Agung, mencakup anak angkat, orang tua angkat, serta kerabat terhalang warisan seperti non-Muslim, anak tiri, dan anak hasil zina. Di Mesir, menurut putusan Darul al-Ifta, wasiat wajibah diberikan kepada cucu jika ayahnya meninggal sebelum kakek atau neneknya. 3) Menurut maqasid Syariah Ibnu Asyur, reformulasi Pasal 209 KHI tentang wasiat wajibah selaras dengan maqasid syariah karena menjaga nasab, mengatur warisan secara proporsional, serta menciptakan kejelasan dan kedamaian antara ahli waris dan penerima wasiat wajibah.
