Abstract

Law No. 32/2009 is indeed better and more perfect when compared to the previous law, so it can be said that Law No. 32/2009 is perfect in terms of legal material regulating the environment. However, can law enforcement of this law be implemented properly, because so far there have been no government regulations or other implementing regulations, so that it will cause indecisiveness against perpetrators of environmental pollution and destruction. This is where the problem lies with the existence of Law No. 32/2009 in terms of its enforcement, so that it is a warning for law enforcement officials to carry out their obligations towards perpetrators of environmental pollution and destruction in accordance with the rules that have been clearly regulated in Law No. 32/2009. The type of legal research that the author uses in compiling this legal writing is the normative juridical research type. Environmental law enforcement can also be done through civil law. This path is not popular in Indonesia because of the protracted process in court. Almost all civil cases are attempted to the highest court for cassation because the losing parties are always dissatisfied. In fact, there is a tendency for people to deliberately delay time by always using legal efforts, even though it is unreasonable, it is usually continued with a judicial review. After the decision is made, it is still often difficult to implement. Indonesian society is in reality more familiar with its natural environment than the application of technology. The development of technology that manages natural resources must provide the greatest possible benefits for the welfare of the people, while still paying attention to its balance and sustainability so that it remains beneficial for future generations. By paying attention to the quality of nature, social, culture, and economy as a commodity of the local community that is subsystem. Only human actions make it seem as if they are able to control nature so that almost all living environments have been touched by human life. Environmental law enforcement can be carried out by imposing sanctions in the form of administrative sanctions.

Abstract

There are at least four dimensions that can affect the quality of environmental law enforcement, namely the existence of real environmental laws, violators of the law themselves, victims (society), and law enforcement officers, where the four dimensions are mutually influential and take place in a single political, social, economic, and cultural structure in certain circumstances. Environmental problems are complex and interesting problems to study in depth, this is what attracts the author to conduct research on criminal policies that exist in efforts to enforce environmental law in Indonesia. The type of legal research that the author uses in compiling this legal writing is the normative juridical research type. In the context of environmental management based on the Law on Environmental Protection and Management, environmental law enforcement can be carried out in two ways, namely preventively and repressively. Preventive environmental law enforcement is carried out through supervision, while repressive law enforcement is carried out through the application of sanctions. Supervision and the application of sanctions are aimed at achieving community compliance with environmental legal norms

Abstract

Abstrack: The current development of information and communication technology has led humans to use the assistance of Generative AI (artificial intelligence) technology to produce various new works, including cinematographic works circulating on social media. However, the emergence of Generative AI has raised new legal issues, because in its use many works have the potential to violate copyright, especially when this technology is used to modify cinematographic works owned by other parties on social media platforms. This study aims to analyze legal certainty, the form of legal liability for the use of Generative AI, and review the form of legal protection for cinematographic works modified using Generative AI on social media without permission. This research is a normative juridical legal research with a descriptive analytical nature. The data used are secondary data consisting of primary, secondary, and tertiary legal materials. Data collection techniques and data were carried out through literature studies. Data analysis used normative analysis methods. The results of the study indicate that legal certainty in the use of Generative AI is currently still not achieved because the Copyright Law is still oriented towards humans as creators. The forms of legal liability that can be applied include civil, criminal, and administrative aspects, while legal protection is provided preventively through takedown mechanisms and repressively through compensation lawsuits and criminal sanctions. The conclusion of this study is that the protection of copyright in cinematographic works for the use of Generative AI on social media platforms creates legal uncertainty that needs to be addressed immediately through regulatory updates and strengthening copyright enforcement policies in the digital era. The formation of specific regulations regarding liability for works involving Generative AI technology is an important step towards realizing legal certainty, justice, and benefits for all parties involved.Keyword: Copyright, Cinematographic Works, Generative AI, Social Media, Legal Protection.Abstrak: Perkembangan teknologi informasi dan komunikasi saat ini membuat manusia menggunakan bantuan teknologi AI Generatif (kecerdasan buatan) dalam menghasilkan berbagai karya baru, termasuk karya sinematografi yang beredar di media sosial. Namun, kemunculan AI Generatif telah menimbulkan persoalan hukum baru, karena dalam penggunaannya banyak karya yang berpotensi melanggar hak cipta terutama ketika teknologi ini digunakan untuk memodifikasi karya sinematografi milik pihak lain di platform media sosial. Penelitian ini bertujuan untuk menganalisis kepastian hukum, bentuk tanjung jawab hukum atas penggunaan AI Generatif serta meninjau bentuk perlindungan hukum terhadap karya sinematografi yang dimodifikasi menggunakan AI Generatif di media sosial tanpa izin. Penelitian ini adalah penelitian hukum yuridis normatif dengan sifat penelitian dekskriptif analitis. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Teknik dan pengumpulan data dilakukan dengan studi kepustakaan. Analisis data menggunakan metode analisis normatif. Hasil penelitian menunjukkan bahwa kepastian hukum dalam penggunaan AI Generatif saat ini masih belum tercapai karena dalam UUHC masih berorientasi pada manusia sebagai pencipta. Bentuk tanggung jawab hukum yang dapat diterapkan meliputi aspek perdata, pidana serta administratif, sementara perlindungan hukum diberikan secara preventif melalui mekanisme takedown dan represif melalui gugatan ganti rugi maupun sanksi pidana. Kesimpulan dari penelitian ini adalah pelindungan hak cipta karya sinematografi atas penggunaan AI Generatif di platform media sosial menimpulkan ketidakpastian hukum yang perlu segera diatasi melalu pembaruan regulasi dan penguatan kebijakan penegakan hak cipta di era digital. Pembentukan aturan khusus mengenai tanggung jawab atas karya yang melibatkan teknologi AI Generatif menjadi langkah penting untuk mewujudkan kepastian, keadilan dan kemanfaatan hukum bagi seluruh pihak terkait.Kata kunci: Hak Cipta, Karya Sinematografi, AI Generatif, Media Sosial, Pelindungan Hukum.

Abstract

Abstract: The problem in this study stems from the existence of unfair business competition arising from trademark registration applications in bad faith. The element of good faith has an important role in the trademark legal system in Indonesia to prevent disputes in the future. This study specifically analyzes the trademark dispute in the Medan District Court Decision Number 4 / Pdt.Sus-HKI / Merek / 2019 / PN Niaga Medan, which involves the registration of the KANDUI and KANDUI VILLAS trademarks by the defendant, even though the trademark has been previously used by the plaintiff, even the defendant himself is a manager at the plaintiff's lodging business. This study uses a normative juridical method with a statutory approach and a case approach. The issues studied include: (1) legal protection of trademarks according to the principle of good faith to prevent unfair business competition; (2) indications of unfair business competition practices in the KANDUI trademark dispute; and (3) the suitability of the judge's considerations in the decision with Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The results of the study indicate that the judge in the decision only emphasized the first to file principle as regulated in Article 3 of Law Number 20 of 2016, but was inconsistent with his considerations which had acknowledged the relevance of the first to use principle. In addition, the judge did not thoroughly examine the defendant's bad faith as stated in the plaintiff's petitum. Thus, although the judge's decision was formally in accordance with regulations, there were still weaknesses in upholding the principle of good faith which is an important instrument to prevent unfair business competition in the trademark legal regime.Keyword: Business competition, Brand, Bad faith Abstrak: Permasalahan dalam penelitian ini berangkat dari adanya persaingan usaha tidak sehat yang timbul akibat permohonan pendaftaran merek dengan iktikad tidak baik. Unsur iktikad baik memiliki peran penting dalam sistem hukum merek di Indonesia agar tidak menimbulkan sengketa di kemudian hari. Penelitian ini secara khusus menganalisis sengketa merek pada Putusan Pengadilan Negeri Medan Nomor 4/Pdt.Sus-HKI/Merek/2019/PN Niaga Medan, yang melibatkan pendaftaran merekKANDUIdanKANDUI VILLASoleh tergugat, padahal merek tersebut telah lebih dahulu digunakan oleh penggugat, bahkan tergugat sendiri merupakan pengurus pada usaha penginapan milik penggugat. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Permasalahan yang dikaji meliputi: (1) perlindungan hukum terhadap merek menurut prinsip iktikad baik untuk mencegah persaingan usaha tidak sehat; (2) indikasi praktik persaingan usaha tidak sehat dalam sengketa merekKANDUI; serta (3) kesesuaian pertimbangan hakim dalam putusan tersebut dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Hasil penelitian menunjukkan bahwa hakim dalam putusan tersebut hanya menekankan asasfirst to filesebagaimana diatur dalam Pasal 3 Undang-Undang Nomor 20 Tahun 2016, namun tidak konsisten dengan pertimbangannya yang sempat mengakui relevansi asasfirst to use. Selain itu, hakim tidak secara mendalam mengkaji iktikad tidak baik tergugat sebagaimana petitum penggugat. Abstract

Color protection as trademark faces harmonization challenges between international and national legal standards. The TRIPS Agreement recognizes color combinations with requirements of distinctiveness through secondary meaning and non-functionality, where developed countries like the United States and Australia even protect single colors as demonstrated in cases like Louboutin v. YSL. However, Indonesia through Law No. 20 of 2016 only recognizes "color arrangements" interpreted as combinations, hindering single color registration. Main obstacles include absence of technical guidelines for proving secondary meaning, imprecise color representation standards, high examiner discretion, and minimal jurisprudence. This creates legal vacuum and uncertainty for businesses, necessitating regulatory reform to recognize both single and combination color registration to provide legal certainty while aligning with international best practices.

Abstract

Copyright and trademarks can intersect in a single court case in business practice, particularly when a trademark in the form of a painting registered by one party is subsequently registered as copyright by another. This is reflected in the copyright dispute in Decision Number 40/Pdt.Sus- HakCipta/2024/PN.Niaga.Jkt.Pst. This normative juridical research with descriptive-analytical characteristics uses secondary data obtained through library and document studies. The results show that the Copyright Law and Trademark Law provide different forms of protection according to their respective regimes. Article 65 of the Copyright Law reflects legal certainty by providing firm limitations. The judge's legal considerations in the decision were appropriate, providing justice and legal certainty.

Abstract

Song commercialization on YouTube often violates copyright as unauthorized reproduction disregards creators' moral and economic rights. This normative descriptive research examines legal protection, perpetrator liability, and legal considerations in Decision 913K/Pdt.Sus-HKI/2022. Legal protection is implemented preventively through copyright registration and repressively through compensation claims and criminal charges. Unauthorized reproduction perpetrators face criminal sanctions up to 10 years imprisonment or Rp4 billion fine. The court's decision is deemed disproportionate in depicting creators' losses and inadequately reflects principles of justice and legal certainty.

Abstract

Penelitian ini bertujuan untuk menganalisis pelindungan hukum terhadap pencipta lagu dalam perolehan hak royalti pada platform digital berdasarkan peraturan perundang-undangan di Indonesia, mengkaji implikasi hukum perbedaan pengaturan royalti antara Undang-Undang Hak Cipta dan kebijakan platform digital, serta menelaah implementasi pelindungan hukum tersebut melalui studi kasus pencipta lagu Reina dengan judul Stuck in 17. Penelitian ini menggunakan metode penelitian hukum normatif yang bersifat deskriptif-analitis dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa secara normatif pelindungan hak royalti pencipta lagu telah diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Peraturan Pemerintah Nomor 56 Tahun 2021, namun dalam praktik masih ditemukan permasalahan berupa kurangnya transparansi perhitungan royalti, perbedaan kebijakan platform digital dengan regulasi nasional, serta minimnya pemahaman pencipta lagu terhadap mekanisme hak cipta. Penelitian ini menyimpulkan bahwa pelindungan hukum terhadap pencipta lagu di era digital belum sepenuhnya memberikan kepastian hukum dan keadilan.

Abstract

A gift is something which is given for free: it is intended to be the solution in the distributing inheritance so that there will be no conflict in practicing it. In reality, however, a gift is not the best solution because there are many disputes about the revocation of deed of gifts as what happens in the Verdict of the Medan PTA (High Religious Court) No.112/Pdt.G/2019/PTA.Mdn because a gift is a joint property and given by the parents to one of their children without any approval from the others heirs. The result is that it causes a conflict among the heirs since they think that it is not fair. This research uses juridical normative research method with descriptive analytical approach. The data consists of secondary data, obtained from primary, secondary, and tertiary legal materials. They are gathered by conducting library research and interviews. The gathered data are analyzed by using qualitative analytical method. The result of the research suggests that the revocation of the deed of gift happens because there is a regulation which has been violated-the gift is more than 1/3 of the property. In making the deed of gift, a PPAT is a responsible for it. He is required to understand the regulation the regulations on distrtribution of gift, let alone if the heirs and the testators are moslems. He has to know how to distribute a gift in the KHI (Complication of the Islamic Laws), and he has to apply the Principle of Prudence in making Deeds of Gift in order to avoid conflicts. The conclusion is that the Deed of Gift No.184/Binjai Kota/2004 issued by PPAT in the Verdict of the Medan PTA (High Religious Court) No.112/Pdt.G/2019/PTA.Mdn does not have any legal force because the deed of gift has violated the Islamic Sharia specified in Article 210 of KHI in which is more than 1/3 of the testator’s property and the distribution of inheritance does not have any approval from the heirs. The consequence is that the receiver loses his right on the gift. The panel of the judges’ decision causes the status of the land and the building becomes the joint property again. The panel of judges’ decision in this Verdict has applied the Principle of Prudence for the whole party since the judges’ do not side with any parties in the litigation, and they recognize the equality of rights and obligations of both parties.

Abstract

Diskriminasi terhadap siswa dari kelompok minoritas sosial, seperti yang terjadi di SMA Swasta Markus Medan, merupakan tantangan serius dalam menciptakan lingkungan pendidikan inklusif dan adil. Ketimpangan perlakuan berdasarkan latar belakang sosial, budaya, atau kemampuan siswa menghambat perkembangan akademis, psikologis, dan hubungan sosial yang sehat. Pendidikan inklusif yang menghargai keberagaman dan memberikan dukungan yang adil sangat diperlukan untuk memastikan setiap siswa berkembang dalam lingkungan aman, nyaman, dan mendukung. Kegiatan pengabdian masyarakat menggunakan metode observasi, presentasi PowerPoint, video edukasi, serta sesi diskusi untuk meningkatkan kesadaran siswa terhadap anti-diskriminasi. Sekolah memiliki tanggung jawab menciptakan lingkungan inklusif di mana keberagaman dihargai dan setiap siswa diperlakukan secara setara. Dengan melibatkan siswa, orang tua, dan masyarakat, pendidikan dapat berperan dalam membangun budaya toleransi dan keadilan sosial. Saran untuk mengatasi isu diskriminasi mencakup penguatan kebijakan inklusif, integrasi pendidikan anti-diskriminasi dalam kurikulum, serta pelatihan rutin bagi guru dan staf sekolah. Dengan langkah-langkah ini, diharapkan diskriminasi dapat ditekan, sehingga semua siswa berkembang secara setara tanpa memandang latar belakang sosial atau budaya mereka.
