Abstract

This research This study aims to analyze the role of civil law in resolving land disputes by emphasizing three main aspects: the construction of lawsuits, evidence, and the implications of court decisions. The focus of the study is directed at how these three aspects are interrelated in providing legal certainty while also ensuring substantive justice for the disputing parties. This article falls under qualitative library research. The methodology applied is a juridical-normative study by examining legislation, legal doctrines, and jurisprudence related to land disputes. The resolution of land disputes through civil law highlights the importance of lawsuit construction, evidence, and court decisions as interdependent stages. Clear lawsuits and consistent evidence serve as the basis for judges to balance legal formalism with substantive justice. Court decisions have broad implications, not only for the legal certainty of land ownership but also for public trust in the legal system and social stability.

Abstract

The study aims to understand the interpretation of relevant Hadith texts in modern contexts, in light of the growing debate over LGBT rights and social acceptance among Muslim communities. The study uses qualitative research methods with the analysis of Hadit texts related to sexual behavior and morality, as well as interviews with scholars. The results of research show that the practice of LGBT people in the Hadith of the Prophet is called a fahisyah because, out of the human fitrah, their respective identities have been embedded. According to fiqh scholars, LGBT practices are unlawful, and the perpetrators must be given strict penalties in accordance with the gravity of the acts committed. In a social and cultural approach, LGBT practices can be accepted on the one hand by considering the human rights aspects and the principles of tolerance and the preservation of peace and well-being, but on the cultural side, people are alien to such practices because they have never been found in the tradition of traditional Muslim society or Indonesian society in general. In Islamic psychology, LGBT practices are mental illnesses caused by the domination of angry impulses, so that the tendency to make mistakes becomes greater and to deny things of a good nature. In health science, LGBT practices are becoming one of the biggest infectious causes of deadly diseases such as HIV/AIDS, gender diseases, and other contagious diseases. Thus, LGBT practices are still becoming a barrier to practice in Indonesian society, which is still traditional and adheres firmly to Islamic principles.

Abstract

This study aims to describe the implementation of Qur’an recitation habituation (tadarus Al-Qur’an) in class IV-A of MI Islamiyah Banjarmlati in shaping the Pancasila Student Profile. The background of this research is based on the importance of character formation through religious activities integrated with Pancasila values. The habituation of Qur’an recitation is considered an effective means of instilling the values of piety, cooperation, discipline, and responsibility among students. This study employs a qualitative approach with a descriptive method. Data collection techniques were carried out through observation, interviews, and documentation. The research subjects included the class IV-A teacher, students, and the head of the madrasah. Data analysis was conducted through data reduction, data presentation, and conclusion drawing. The findings show that the Qur’an recitation habituation is carried out routinely every morning before lessons begin. Teachers serve as guides and motivators, while students demonstrate enthusiasm and active participation. This activity not only improves students’ Qur’an reading skills but also fosters religious attitudes, discipline, and a sense of responsibility. These values are in line with the dimensions of the Pancasila Student Profile. Thus, the habituation of Qur’an recitation contributes significantly to the holistic character formation of students within the madrasah environment.

Abstract

Banditry in Java during the Dutch East Indies period (1885-1930) emerged as a response by peasants to colonial oppression, particularly because of plantation expansion, labor exploitation, low wages, and land rights seizures. This background made banditry not merely a criminal act, but a symbol of social and political resistance. This study aims to determine the background of the emergence of bandits during the Dutch East Indies government, social bandit actions during the Dutch East Indies government in 1885-1930, and the efforts of the Dutch East Indies government in overcoming these bandit actions. This study uses historical research methods by collecting sources (heuristics), verification, interpretation, and historiography. The results of this study are the background of the emergence of Social Bandit actions due to the disappointment and dissatisfaction of peasants with various policies made by the Dutch East Indies government, such as the Forced Cultivation policy, liberal economy, and expansion of plantation companies. The bandits carried out their actions by stealing, burning plantations, and even killing victims. Bandit actions occurred in Surakarta, Yogyakarta, Batavia, Pasuruan, and Probolinggo. To suppress bandit actions, the Dutch East Indies government reorganized the police, held night patrols, and worked with the local government.

Abstract

This study applies classical spatial regression models (C-SRM) to analyze the determinants of the Human Development Index (HDI) across 154 cities in Sumatra Island. Unlike standard regression, C-SRM accounts for spatial dependencewhere neighboring regions influence each others development outcomes. Three C-SRM specifications are evaluated: Spatial Autoregressive (SAR), Spatial Error Model (SEM), and Spatial Autoregressive Moving Average (SARMA). HDI, measuring education, income, and health, is inherently spatial due to interregional mobility, infrastructure spillovers, and policy diffusion. Using data from 2019, 2020, and their average (20192020), 13 potential predictors were tested, with variable selection yielding 12, 11, and 11 final variables, respectively. Results show HDI in Sumatra improved steadily from 2010 to 2020, with most cities classified as medium development. Among C-SRMs, the SEM model consistently outperformed SAR and SARMA based on AIC and log-likelihood values, indicating that unobserved spatially correlated factors significantly affect HDI variation. Key significant determinants include poverty rate, poverty gap index, population density, unemployment rate, labor force size, average years of schooling, access to school facilities, sanitation coverage, prevalence of health complaints, and nurse density. The findings confirm that classical spatial models provide a robust, interpretable framework for understanding regional development patterns without requiring complex modern specifications. This study supports the use of SEM as an effective tool for policymakers targeting equitable human development across spatially interconnected regions in Sumatra.

Abstract

Ideally, the banking sector has a legal obligation to safeguard customers’ funds with a high standard of prudence, yet in reality, cases of fund loss still frequently occur, including at Bank BCA. This situation raises doubts about the effectiveness of the legal protection available to customers when their rights are harmed. This study aims to examine the forms of legal protection for customers from the perspective of civil law and to evaluate the role of the Financial Services Authority (OJK) in resolving and restoring losses caused by fund loss in banks. This article falls under library research with a qualitative approach. The methodology used is normative legal research. The findings show that civil law provides a basis for protection through compensation mechanisms arising from breach of contract or unlawful acts, which may be claimed by customers against the bank. On the other hand, OJK serves as a regulator and external supervisor that plays an important role in ensuring justice for customers through regulation, supervision, and alternative dispute resolution mechanisms outside the court via LAPS SJK. The synergy between civil law instruments and the role of OJK has proven to be an essential instrument in providing legal certainty while maintaining public trust in the banking system.

Abstract

This study aims to analyze the efforts of traditionalist Islamic groups within Indonesian universities to counter the growing influence of transnational Islamic movements. Employing a qualitative research methodology, the study provides a comprehensive examination of the dynamics between transnational movements -such as Hizbut Tahrir Indonesia, Jamaah Tarbiyah, and Jamaah Salafi- and traditional Islamic organizations, notably Nahdlatul Ulama (NU) and the Indonesian Islamic Student Movement (PMII), within the context of the University of Yogyakarta. The findings reveal that transnational Islamic movements have strategically utilized existing campus infrastructure to expand their influence. The ideological contestation is accompanied by movement-based tensions, as traditionalist groups actively resist the growing presence of these transnational actors. The study concludes that universities play a critical role in mitigating radicalism by engaging constructively with the ideological frameworks of transnational Islamic movements.

Abstract

The rapid pace of social change in the modern era demands a more adaptive, communicative, and creative approach to Islamic preaching. Traditional one-way da’wah methods are often less effective in meeting the spiritual needs of people living amid technological progress and global information flows. This article aims to examine creative da’wah strategies as an effort to respond to contemporary social dynamics, ensuring that Islamic messages remain relevant and impactful. The study employs a library research method by reviewing literature related to da’wah strategies, Islamic communication theories, and modern social transformation. The findings reveal that creative da’wah enhances the effectiveness of religious message delivery through digital engagement, inspirational storytelling, and participatory two-way communication. Moreover, innovative da’wah formats are proven to be more appealing to younger and urban audiences, aligning with their lifestyle and media habits. The study concludes that creative da’wah strategies are essential to preserve the relevance of Islamic values amid rapid societal changes. This article contributes to developing a new paradigm of Islamic preaching that integrates creativity, technology, and social context to deliver religious messages effectively.
