Abstract

The Indonesian criminal justice system faces critical issues with the repeated designation of individuals as suspects, which compromises legal certainty and the protection of human rights. This study provides a critical analysis of the procedural and ethical consequences of repeated suspect designations within the framework of Indonesia's Criminal Procedure Code. This study employs a doctrinal legal research methodology, incorporating statute, case and conceptual approaches. The results show that pretrial judges assess the validity of suspect designations based on procedural and formal principles. Their authority is confined to reviewing formal aspects. These limitations underscore that pretrial proceedings focus solely on administrative and procedural compliance rather than the substantive merits of the case. This formalist perspective follows civil procedural principles, emphasizing procedural correctness over material truth. While pretrial judges can annul a suspect designation, investigators can re-designate the person as a suspect if new evidence is presented. Such a reform would ensure a more balanced relationship between judicial oversight and investigative authority, minimizing arbitrary practices and enhancing procedural fairness. However, the recurring practice of re-designating suspects raises a significant flaw in the system, undermining legal certainty and eroding public trust.

Abstract

In an effort to produce a quality lesson that is run by teachers, the steps taken in the education system is an intense and continuous coaching in the form of academic supervision given to teachers to improve their ability to run a quality learning process. Guidance to the teacher's essence is an act of giving assistance to improve his ability in running the learning process. The reason for coaching is given to the teacher is that the ability of the teacher must always be improved especially in the techniques related to the learning process that must be executed. The failure of teachers in the learning process is more due to the ability of teachers who are still low in the science of teaching. It may be that the teacher has had enough qualifications or even master's degrees, but is still weak in his teaching. So the ability of teachers in running a quality learning process is still low. Suharsimi Arikunto asserted that the main activity of supervision is to provide guidance to the school/madrasah in general and especially to the teachers for better learning quality, which in turn improves students' learning achievement. in the Government Regulation Number 19 Year 2005 on Education Standards specially contained in Chapter IV Article 19 paragraph (3) states that every year education performs planning of learning process, implementation of learning process, assessment of learning activity, and supervision of learning process for the implementation of effective learning process and efficient.

Abstract

Dikalangan ahli hukum Islam banyak yang konsen terhadap maqasid syariah dari lintas mazhab, seperti Izz al-Din ibn ’Abd al-Salam dari mazhab Syafi’i, Ibnu Qayyim al-Jauziyah dari mazhab Hambali, Abu Ishaq Al-Syâthibi dari mazhab Maliki dan lain-lain yang telah menulis karangan-karangan mengenai teori hukum Islam dan tujuannya, seperti prinsip kemaslahatan dan mengenai sebab-musabab yang didasarkan kepada syari’at. Maqasid syariah adalah masalah kemaslahatan hidup dunia. Artikel ini menjelaskan posisi dan peran maqasid al syariah itu sendiri dalam merekonsiderasi pemberlakuan hukum islam bagi masyarakat muslim dan mengungkapkan tata kerja maqasid syariah yakni dijadikan sebagai pendekatan penentuan hukum dan dijadikan dasar pemberlakuan dan terwujudnya kemaslahatan pada muslim. Makalah ini disusun dengan menerapkan metode penelitian library research. Sumber utama penelitian ini adalah berbagai literatur Maqashid Syariah dalam bentuk kitab rujukan asli. Maqasid syariah mencerminkan perkembangan cukup besar dari eksistensinya sebagai konsep menuju eksistensti sebagai metode pendekatan. Sebagai konsep maqasid syariah di pahami sebagai nilai yang pasti terkandung dalam setiap ketentuan syariah. Nilai nilai yang berkembang mulai dari konsep klasik yang terbatas pada lima nilai utama, menjaga agama, jiwa, akal, keturunan dan harta dan pada konsep modern selain lima nilai tersebut pada akhirnya masuk pada nilai keadilan, kebebasan, dan hak asasi manusia dan lai-lain.

Abstract

Tujuan pelatihan pada program pengabdian kepada masyarakat ini yaitu; untuk memberikan pemahaman dan melatih guru SDN melalui pelatihan Pengembangan Pembelajaran Berorientasi Higher Order Thinking Skills (HOTS) Bagi Guru SDN Kecamatan Banjarmasin Utara, dimana masa setelah pandemi Covid 19, terjadi penurunan kinerja guru dalam pembelajaran. Upaya mengembalikan meningkatkan kualitas pembelajaran dapat dengan melibatkan peserta didik mencapai tingkat berpikir yang lebih tinggi. Metode yang digunakan berupa pelatihan pengembangan pembelajaran berorientasi HOTS bagi guru SDN Kecamatan Banjarmasin Utara. Dalam pelatihan ini guru secara mandiri dibekali pengetahuan dan dilatih membuat persiapan, melaksanakan dan evaluasi pembelajaran berorientasi HOTS. Teknik analisis data skor pengetahuan peserta pada pretest dan posttest, serta dari hasil observasi selama praktik oleh peserta pelatihan. Hasil pelaksanaan kegiatan diperoleh bahwa pelatihan memberikan manfaat dalam meningkatkan pengetahuan guru-guru di SDN Kecamatan Banjarmasin Utara. Rata-rata nilai pretest adalah 59,72 dan rata-rata hasil posttest adalah 83,33. Persentase peningkatan sebesar 42,58% pembelajaran berorientasi HOTS dapat terlaksana sekolah dasar untuk membuat siswa terbiasa dengan cara berpikir membuat siswa mampu menyampaikan ide-ide argumentatif, logis, dan percaya diri, baik tertulis, lisan, dan bekal siswa di tingkat pendidikan berikutnya.Abstract. The objectives of the training in this community service program are; to provide understanding and train SDN teachers through training on Higher Order Thinking Skills (HOTS) Oriented Learning Development for SDN Teachers in North Banjarmasin District, where after the covid 19 pandemic, teacher performance decreased in learning. Efforts to improve the quality of learning can be restored by involving students to reach a higher level of thinking. The method used is in the form of HOTS-oriented learning development training for SDN teachers in North Banjarmasin District. In this training, teachers are independently provided with knowledge and trained to prepare, implement and evaluate HOTS-oriented learning. The data analysis technique of participants' knowledge scores in the pre-test and post-test, as well as from the results of observations during practice by training participants. The results of the implementation of the activity showed that the training provided benefits in increasing the knowledge of teachers at SDN, North Banjarmasin District. The average pre-test score was 59.72 and the post-test average was 83.33. The percentage increase of 42.58% HOTS-oriented learning can be carried out in elementary schools to make students familiar with the way of thinking so that students are able to convey argumentative, logical, and confident ideas, both written, oral, and provided for students at the next level of education. Abstract

Tujuan pelatihan pada program pengabdian kepada masyarakat untuk memberikan pemahaman dan melatih guru SDN melalui Pelatihan Penerapan menerapkan model PBL di kombinasikan dengan NHT dalam pembelajaran SDN di Lahan Basah Kecamatan Banjarmasin Utara Permasalahan yang ditemui adalah rendahnya aktivitas, keterampilan kerjasama siswa dan hasil belajar siswa pada SDN yang disebabkan oleh pembelajaran cenderung satu arah, siswa belum memiliki kesiapan untuk belajar serta kerjasama dan komunikasi siswa rendah. Upaya untuk mengatasi permasalahan tersebut adalah dengan menerapkan model PBL di kombinasikan dengan NHT dalam pembelajaran. Pelatihan ini bertujuan untuk mendeskripsikan aktivitas guru, menganalisis aktivitas siswa, keterampilan kerjasama siswa dan hasil belajar siswa. Pelatihan ini menggunakan pendekatan kualitatif dengan mendemontrasikan dan melatihan guru mengunakan model pembelajaran. Data dianalisis berdasarkan hasil observasi aktivitas guru dengan teknik deskriptif yang digambarkan dalam bentuk tabel dan grafik, diinterpretasikan menggunakan kriteria masing-masing indikator keberhasilan aktivitas guru. Hasil pelatihan ini menunjukkan bahwa aktivitas guru meningkat dengan perolehan skor 36 dan mendapat kriteria sangat baik. Berdasarkan hasil pelatihan, dapat disimpulkan bahwa penggunaan model PBL di kombinasikan dengan NHT.

Abstract

Concrete is a composite material consisting of a mixture of aggregates and cement as a binder. One special type of concrete is waterproof concrete, which is commonly used in structures located in wet environments, such as bridge foundations, basement walls, swimming pools, and concrete roofs. To enhance water resistance, an additional layer of waterproofing mortar is applied. This study aims to determine the effect of adding waterproofing mortar on the water resistance of K-250 concrete immersed in both fresh water and seawater. The compressive strength test results showed average values of 252.64 MPa for normal concrete (BN), 287.08 MPa for concrete with waterproofing mortar in fresh water (BRAB), and 269.46 MPa in seawater (BNAL). The absorption test results were 3.281 for BN, 2.842 for BRAB, and 2.667 for BNAL. These findings indicate that waterproofing mortar increases compressive strength and reduces water absorption, making it effective in enhancing the durability of concrete against water penetration.

Abstract

Muhammad Arkoun, a controversial liberal Muslim figure, has attracted the attention of many researchers with his innovative approach to understanding revelation through semiotic analysis. This research aims to critically analyse how Arkoun reads Qur'anic texts using a semiotic approach, as well as its impact on religious understanding. The research method used is descriptive qualitative with a critical analysis approach, which combines eclectic approaches, postmodernism, and tafsir science. The results show that Arkoun tries to subjugate the Qur'an within the framework of linguistic analysis that is heavily influenced by western thought. With this approach, he ignores classical and contemporary Islamic methodologies, preferring to focus on the western intellectual way of thinking that separates revelation from its transcendence dimension. Arkoun argues that the reading of the Qur'an should follow global intellectual dynamics, although his views are widely considered incompatible by more conservative circles. This study hopes that Arkoun's thought can provide a new perspective for Muslim academics in the West, especially in criticising the theoretical paradigm imposed by the Western intellectual tradition. However, for ordinary people who study religion with a simpler understanding, Arkoun's thinking tends to be regarded as a dangerous theological heresy. الملخص استقطب محمد أركون، وهو شخصية مسلمة ليبرالية ليبرالية مثيرة للجدل، اهتمام العديد من الباحثين بمنهجه المبتكر لفهم الوحي من خلال التحليل السيميائي. يهدف هذا البحث إلى تحليل نقدي لكيفية قراءة أركون للنصوص القرآنية باستخدام المنهج السيميائي، وكذلك أثره على الفهم الديني. ومنهج البحث المستخدم هو المنهج الوصفي الكيفي مع منهج التحليل النقدي الذي يجمع بين المناهج الانتقائية وما بعد الحداثة وعلم التفسير. وتظهر النتائج أن أركون يحاول إخضاع القرآن في إطار التحليل اللغوي المتأثر بشدة بالفكر الغربي. وهو بهذا المنهج يتجاهل المنهجيات الإسلامية الكلاسيكية والمعاصرة، مفضلاً التركيز على الطريقة الفكرية الغربية في التفكير التي تفصل الوحي عن بعده المتعالي. يجادل أركون بأن قراءة القرآن يجب أن تتبع الديناميات الفكرية العالمية، على الرغم من أن آراءه تعتبرها الأوساط الأكثر تحفظًا غير متوافقة على نطاق واسع. وتأمل هذه الدراسة أن يقدم فكر أركون منظورًا جديدًا للأكاديميين المسلمين في الغرب، خاصة في نقد النموذج النظري الذي يفرضه التقليد الفكري الغربي. ومع ذلك، بالنسبة للأشخاص العاديين الذين يدرسون الدين بفهم أبسط، يميل فكر أركون إلى اعتباره بدعة لاهوتية خطيرة. Abstrak Muhammad Arkoun, seorang tokoh Muslim liberal yang kontroversial, menarik perhatian banyak peneliti dengan pendekatannya yang inovatif dalam memahami wahyu melalui analisis semiotika. Penelitian ini bertujuan untuk menganalisis secara kritis bagaimana Arkoun membaca teks-teks al-Qur’an dengan menggunakan pendekatan semiotika, serta dampaknya terhadap pemahaman keagamaan. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan pendekatan analisis kritis, yang memadukan pendekatan eklektik, postmodernisme, dan ilmu tafsir. Hasil penelitian menunjukkan bahwa Arkoun mencoba menundukkan al-Qur’an dalam kerangka analisis linguistik yang sangat dipengaruhi oleh pemikiran barat. Dengan pendekatan ini, ia mengabaikan metodologi klasik dan kontemporer Islam, lebih memilih untuk fokus pada cara berpikir intelektual barat yang memisahkan wahyu dari dimensi transendensinya. Arkoun berargumen bahwa pembacaan al-Qur’an harus mengikuti dinamika intelektual global, meskipun pandangannya ini banyak dianggap tidak sesuai oleh kalangan yang lebih konservatif. Penelitian ini mengharapkan agar pemikiran Arkoun dapat memberi perspektif baru bagi akademisi Muslim di Barat, khususnya dalam mengkritisi paradigma teori yang dipaksakan oleh tradisi intelektual Barat. Namun, bagi masyarakat awam yang mendalami agama dengan pemahaman yang lebih sederhana, pemikiran Arkoun cenderung dianggap sebagai bid’ah teologis yang berbahaya.

Abstract

The development of the religious sector stands as a crucial component within the national development agenda. The government’s endeavors aim to harmonize development programs within this sector, fostering societal independence amid diversity. This research seeks to formulate alternative policy models for ensuring sustainable Islamic development. Adopting a systems thinking approach with dynamic systems methods. The method used is a dynamic system model, which includes the dimensions of the Muslim population submodel, the santri submodel, and the muallaf population submodel. The study deliberately selected Singkawang City as its research location through purposive sampling. Simulations conducted span the period from 2023 to 2033, revealing scenarios within the Muslim community sub-model. The Muslim population sub-model built in the dynamic system is a population dynamics system or human resources in the Muslim community of Singkawang City. Islamic boarding school students sub-model at religious educational institutions and the Muslim convert population sub-model. The muallaf population submodel is the number of muallaf people in Singkawang City. Policy alternatives emerge as priorities for simulations and scenarios in achieving sustainable development of Islamic practices. The analysis of alternative scenarios emphasizes the necessity for support of religious development policies by both the Singkawang City government and the central government. The rise in the Muslim resident population requires proactive measures, such as increasing the number of Islamic religious instructors and strengthening social and religious institutions dedicated to religious programs. Furthermore, efforts in Islamic religious education are crucial for enhancing human resources. Improved religious programs tailored to the Muslim populace, including religious guidance and convert-based empowerment initiatives, serve as integral components of sustainable Islamic development.

Tolak ukur pimpinan dan manajemen untuk membangun citra adalah melalui teori reputasi. Selain itu komunikasi juga merupakan hal yang utama yang perlu dibangun. Pimpinan merupakan komunikator utama dalam membangun reputasi yang positif. Seorang pemimpin harus memiliki kredibilitas, keterhandalan, kepercayaan dan tanggung jawab sosial.
