Abstract

The environmental permit dispute between the Awyu Indigenous People and PT Indo Asiana Lestari highlights challenges in protecting indigenous rights and environmental justice in the Administrative Court. The main issue lies in the legal paradigm that prioritizes procedural aspects and material losses, while neglecting local wisdom, community participation, and long-term ecological impacts. This study aims to analyze the judicial paradigm in Administrative Court rulings and its implications for the protection of indigenous rights and environmental sustainability. Using normative legal research and the critical legal studies approach, the findings indicate that administrative court decisions reinforce structural injustice by limiting the definition of harm to material losses, without considering social and ecological damages. As long as the law remains unchanged, judges will continue to adhere to a procedural and formalistic approach. Therefore, legal reform is necessary, particularly a review of Article 53(1) of the Law on Administrative Court, to enable judges to consider social and ecological impacts in their decisions.

Abstract

The advancement of wireless network technology has improved communication efficiency but also increased the risk of data security breaches. One significant threat to Wi-Fi networks is the use of tools like Nethercap to conduct Man-in-the-Middle (MitM) attacks. This study aims to explore in depth how Nethercap is used to steal Wi-Fi credentials, evaluate its impact on information security, and propose mitigation strategies. However, the convenience and flexibility offered by WiFi does not come without risks. Due to its radio wave-based nature and wide signal spread, WiFi networks are vulnerable to various security threats. In many cases, users or network administrators often neglect security aspects or are unaware of loopholes that could be exploited by malicious parties. As a result, sensitive information can be leaked, illegal access to the network can be gained, or even malicious activities can be carried out through a compromised network. Therefore, it is very important for anyone who manages or uses a WiFi network to understand the types of threats that may occur and implement appropriate solutions to maintain network security. The research method employed is descriptive qualitative with a case study approach. The analysis results show that Nethercap exploits vulnerabilities in wireless protocols, potentially leading to data theft, privacy violations, and organizational losses. Mitigation strategies include the implementation of WPA3, network segmentation, deployment of SIEM systems, and enhanced cybersecurity awareness.

Abstract

Abstract

The malpractice is still far from the reach of criminal procedure. There are no specific regulations on malpractice and there are problems in proving criminal acts of malpractice so that this article uses the theory of evidence to provide legal certainty to fulfill the elements of error and criminal responsibility. This study uses a normative method to answer this problem so that the statute approach and case approach are used. The results of the study show that the problems in proving criminal acts of malpractice and the difficulty of collecting evidence (unus testis nullus testis) are obstacles to assisting the legal process, the complexity of proof in criminal law which is material and problematic in the legal vacuum space limited to the Criminal Code. Contextually, criminal responsibility for malpractice is not specifically regulated in the Criminal Code or medical malpractice, but after the enactment of Law 17 of 2023 concerning Health, it provides hope in protection and helps victims in seeking justice even though cases reported by victims are often in SP3 (Investigation Termination Order).
