Abstract

This study examines communication strategies in promoting national values ​​in the era of social media which has a very important role in building collective awareness and strengthening the sense of national unity. Social media, as a fast and broad means of communication, offers challenges as well as opportunities for efforts to strengthen nationality. In this context, an effective communication strategy must utilize digital platforms to disseminate inclusive national messages, prioritize tolerance, and strengthen national identity. The approaches used can be in the form of utilizing visual content, narratives that touch emotions, and collaboration with influencers and public figures to create a greater impact. In addition, it is important to pay attention to the aspects of speed and accuracy of information, so that the message conveyed is not easily distorted or misinterpreted. This study uses method a qualitative approach with a case study design to understand communication strategies in promoting national values ​​in the era of social media. The qualitative approach was chosen because it allows researchers to explore in depth the communication phenomena that occur in society, especially on social media. This study discusses various communication techniques and models that can be used to convey national values ​​to the younger generation, as well as the challenges faced in managing information amidst the diversity of opinions on social media. The results of this study to contribute to the development of more effective communication strategies in promoting national values ​​in the digital era.

Abstract

Tidak sedikit pergaulan lolos-serta seks lolos ini membuat dikarenakan banyaknya pemain pengguguran yang terdapat di Indonesia. Dalam pemberlakuan hukum yang diatur dalam KUHP (wacana Unsertag-unsertag Hukum kriminalitas) perihal pengguguran telah sungguh jelas sebetulnya menggugurkan lembaga dilarang sedemikian itu serta dalam perspektif hukum Islam mencegah buat menggugurkan lembaga melainkan terdapat penyebab kedokteran yang benar patut dilakoni pengguguran. hendak tapi dalam pandangan Madzhab tengah terdapat kategorisasi diperbolehkannya saat sebelum peniupan arwah serta Para ustaz seia sekata liar normanya jikalau menggugurkan lembaga kala sehabis peniupan arwah. tentang hal pendekatan riset yang dibubuhkan dalam riset ini sistem studi Hukum Yuridis Normatif, ialah sistem pendekatan yang digunakan dalam riset ini yakni prosedur pendekatan yuridis normatif ataupun riset hukum doktrinal, ialah sesuatu riset hukum yang mempergunakan pangkal data subordinat. Metode Penelitian ini menggunakan penelitian terdahulu oleh Nasuha7 hukum doktrinal adalah proses untuk menemukan aturan, prinsip, dan doktrin untuk menyelesaikan masalah. Penelitian ini bersifat preskriptif. Penelitian normatif, doktrinal, dan kepustakaan adalah jenis penelitian yang menggunakan sumber daya pustaka seperti buku, hukum, kitab agama, dan majalah. Hasil penelitian ini bertujuan untuk memberi pembaca pemahaman yang lebih baik tentang arti pengguguran dan pengampunan yang diberikan kepada mereka yang melakukan pelanggaran pengguguran positif dari sudut pandang hukum positif dan hukum kejahatan Islam. Untuk menemukan hubungan antara hukuman yang diberikan oleh hukum positif dan hukum kejahatan Islam, terdapat batas usia lembaga yang berlaku dalam isi hukuman, dan hukuman yang diberikan oleh hukum kejahatan Islam adalah dengan melanggar undang-undang.

Abstract

Praktik tindak pidana korupsi masih kerap terjadi di Indonesia. Perundang-undangan dan badan yang mengatur pemberantasan tindak pidana korupsi seakan tidak memiliki kekuatan dalam memberikan efek jera bagi koruptor. Hal ini disebabkan karena pemberian hukuman bagi pelaku tindak pidana korupsi yang dinilai masih tidak maksimal sehingga korupsi masih menjadi salah satu akar permasalahan di negeri ini yang sulit untuk diselesaikan. Jenis-jenis hukuman bagi pelaku tindak pidana korupsi ini memiliki perbedaan. Pada hukum Islam, jumhur ulama bersepakat bahwa korupsi dapat dihukumi dengan potong tangan, sedangkan pada hukum positif di Indonesia koruptor dapat dihukumi dengan pidana mati, penjara, kurungan, dan denda. Terdapat kontroversi terhadap hukuman mati yang dianut oleh Indonesia terhadap pelaku tindak pidana korupsi. Masyarakat yang kontra dengan hal tersebut meyakini bahwa hukuman mati merupakan perlanggaran terhadap hak asasi manusia. Namun, bila hukuman ini tidak dimasukan dalam peraturan tindak pidana korupsi, maka kasus korupsi akan selalu menjadi permasalahan yang tidak ada akhirnya. Penelitian ini menggunakan metode analisis hukum normatif. Penelitian ini bertujuan untuk membandingkan hukuman pelaku tindak pidana korupsi antara hukum Islam dengan hukum positif serta kontroversi yang mengikutinya.

Abstract

The digital transformation of education in Indonesia presents both strategic opportunities and significant ethical challenges. On the one hand, technological innovation expands access, effectiveness, and quality of learning; on the other hand, it risks creating social disparities, the commercialization of education, and the reduction of human values. In this context, Pancasila is considered relevant as an ethical paradigm that guides the direction of digital transformation to remain grounded in humanity, social justice, and sustainability. This study aims to analyze Pancasila as an ethical framework for directing the development of educational technology in Indonesia. The method employed is a literature review with a qualitative-descriptive approach, drawing on philosophical sources, educational policy documents, and practices of digital technology implementation at various educational levels. The analysis reveals that the values of Pancasila, particularly the second and fifth principles, can serve as normative foundations for shaping policies, design, and practices of educational technology that are humanistic, inclusive, and equitable. The study concludes that integrating the Pancasila paradigm is not only ideologically essential but also strategically significant in ensuring that the digital transformation of education in Indonesia aligns with national objectives and human dignity.

Abstract

This research examines Law of the Republic of Indonesia Number 1 year 1974 concerning Marriage in terms of Comparative Fiqh of Schools. There are several marriages that are prohibited in Indonesia, for example marrying parents in-laws, marrying daughters-in-law and so on. Marriage is one part of the Shari'a which is discussed in Kutubul Mu'tabarah. Especially the four schools of thought. So it is very important for us to know the opinions of the mazhab scholars to enrich the references in order to provide justice and utilitarian law to all Indonesian citizens. This research is a normative legal research, is normative. The approach used is a normative juridical approach. The types of data used include primary data, namely:1945 Constitution of the Republic of Indonesia and in particular Law of the Republic of Indonesia Number 1 year 1974 concerning Marriage in the part of marriage that is prohibited,and secondary data, namely library data which includes official documents, books of the salaf scholars, research books, scientific journals and so on. And tertiary data taken from excyclopedias and dictionaries. The data obtained is then analyzed using the Content Analysis method (content analysis) against the laws and regulations which are primary data. From this research it was found that Based on the research and analysis conducted, it is concluded that knowledge about marriages that are prohibited from being reviewed in Cross-Mazhab is very important to be studied by legal experts and scientists in Indonesia and the world in general. Penelitian ini meneliti tentang Undang-Undang Republik Indonesia Nomor 1 Tahun 1974 Tentang Perkawinan ditinjau Dari Fiqih Perbandingan Mazhab. Ada beberapa perkawinan yang dilarang di Indonesia mislanya menikahi mertua, menikahi menantu dan lain sebagainya. Perkawinan merupakan salah satu bagian dari syariat yang dibahas didalam Kutubul Mu’tabarah. Khususnya Mazhab empat. Maka perlu sekali kita mengetahui pendapat para ulama mazhab untuk memperkaya referensi dalam rangka memberikan keadilan dan utilitarian hukum kepada seluruh warga negara Indonesia. Penelitian ini merupakan merupakan penelitian hukum normatif, bersifat normatif. Pendekatan yang digunakan menggunakan metode pendekatan yuridis normatif. Jenis data yang digunakan adalah meliputi data primer yaitu Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan khususnya Undang-Undang Republik Indonesia Nomor 1 Tahun 1974 Tentang Perkawinan pada bagian bagian perkawinan yang dilarang, dan data sekunder yaitu data pustaka yang mencakup dokumen-dokumen resmi, Kitab-kitab para ulama salaf, buku-buku hasil penelitian, jurnal ilmiah dan sebagainya. Dan data tersier yang diambil dari eksiklopedi dan kamus. Data yang diperoleh kemudian dianalisis menggunakan cara Content Analiysis ( analisis isi ) terhadap peraturan perundang-undangan yang merupakan data primer. Dari penelitian ini didapatkan bahwa berdasarkan penelitian dan analisis yang dilakukan, dihasilkan kesimpulan bahwa Islam dalam menjalankan syariatnya memiliki banyak sekali mazhab Fiqih. Maka pengetahuan tentang Perkawinan-perkawinan yang dilarang ditinjau dalam Lintas Mazhab ini sangat penting untuk dipelajari oleh para Ahli Hukum dan Ilmuan di Indonesia dan dunia umumnya. Karena tidak menutup kemungkinan akan terjadi Revisi Undang-undang Perkawinan yang mana pembuat aturan perlu juga memperhatikan perbedaan pendapat diantara para Ulama Fiqih.

Abstract

The Constitutional Court is a state institution that emerged from the amendments to the 1945 Constitution, as part of the efforts to strengthen the principles of the rule of law and constitutional democracy in Indonesia. This institution plays a crucial role in upholding legal regulations, ensuring proper checks, and balancing the power between institutions and the state. This research aims to examine the position, authority, and contributions of the Constitutional Court within Indonesia's governance system. A normative approach is generally used, along with analyses of laws, Constitutional Court decisions, and various related legal literature. The results of the study show that the Constitutional Court not only acts as the gatekeeper of the structure, but also as the sole translator of the structure, which has an important influence on the dynamics of relations between state institutions and the development of constitutional law in Indonesia. The Constitutional Court participates in the protection of citizens' rights, the improvement of the electoral system, and the upholding of the principles of democracy and real justice.

Abstract

Interfaith marriage is a complex issue in Indonesia, especially when faced with the state ideology Pancasila and constitutional law. Pancasila, as the nation's ideology, prioritises the values of togetherness and harmony, while constitutional law in Law Number 1 Year 1974 on Marriage stipulates that a marriage is considered valid if it is conducted in accordance with the religious laws of each party. In practice, this raises various debates related to human rights, religious freedom, and state legal policy. The research method used is the Normative Juridical Approach method, this method focuses on the study of literature and legal regulations, such as the Anti-Terrorism Law in Indonesia. Researchers usually analyse legislative documents, legal theories, and how Pancasila values are applied in existing legal policies. The results of this study reveal that the role of Pancasila in making anti-terrorism legal policy in Indonesia shows that the philosophical idiological values of Pancasila serve as the foundation for the pol.

Abstract

Pancasila, as the foundation of the state and ideology of the Indonesian nation, plays a crucial role in the formulation of legal policies, including in counter-terrorism efforts. This article discusses how Pancasila values, such as justice, humanity, and unity, are integrated in Indonesia's anti-terrorism legal policy. Pancasila provides a philosophical foundation that ensures the policy is not only effective in maintaining national security, but also respects human rights, prevents discrimination, and strengthens national unity. Thus, the anti-terrorism policy prepared based on Pancasila is expected to realize law enforcement that is just, humanity-based, and supports the integrity of the Indonesian nation. Abstract

In Indonesia, interfaith marriage is often discussed in society and becomes a problem in legal and social contexts. Indonesia is a country with many different religions, with Pancasila as the country's foundation and values of tolerance and pluralism. However, regulations on interfaith marriage often lead to conflicts between state law and religious rules. The method used in this journal is a statutory approach and a case approach and also uses normative research. Analysis of Religious Marriage Regulations in Indonesia, Challenges in Legal Implementation, Recommendations for Legal Reform. The conclusion of this study shows that the legal regulation of interfaith marriage in Indonesia as stipulated in Law No. 1 of 1974, is still not fully in line with the principles of the constitution and the values of Pancasila which emphasise pluralism and freedom of religion. Simplification of legal procedures: It is recommended that administrative procedures related to interfaith marriage such as marriage registration and family status determination be simplified so that married couples can obtain their citizenship rights without obstacles.

Abstract

This study examines the phenomenon of runaway marriages in Indonesia, particularly among communities with strong adherence to traditional customs. Runaway marriages are often seen as a solution for couples who lack family approval or face socio-economic pressures, but they have serious legal implications. Marriages that are not officially registered lack legal standing and negatively impact the legal rights of both the partners and any children born from such unions. Within the framework of Pancasila, runaway marriages conflict with the core values of justice, unity, and respect for the law.The study identifies challenges in enforcing laws related to runaway marriages, including inconsistencies between customary law and state law, inadequate marriage registration in remote areas, and low legal awareness among local communities. The research method involves case analysis, interviews with legal experts and community members, and a review of relevant literature. Recommendations include harmonizing customary law with state law, enhancing legal education, strengthening the role of law enforcement, and utilizing technology in marriage registration systems. These recommendations aim to align marriage practices with Pancasila values and provide fair legal protection for all individuals..
