Abstract

Pancasila, as the ideological basis of the Republic of Indonesia, plays a fundamental role in the formation and application of constitutional law, especially in the reform era that began in the late 1990s. Major transformations in Indonesia's political and legal system during this period, including the amendment of the 1945 Constitution, the renewal of laws, and the reform of state institutions, posed challenges in maintaining the relevance and application of Pancasila principles. This research aims to explore how Pancasila was integrated in the new legal and constitutional policies and to assess the impact of legal reforms on the implementation of Pancasila values. Using academic sources, empirical data, and up-to-date theoretical analyses, this research identifies the challenges faced and possible solutions to ensure Pancasila principles remain relevant and effective. The results show that although Pancasila faces various challenges, it remains a vital ideological foundation in Indonesia's legal system. In conclusion, Pancasila as an ideological foundation cannot be separated from the life of society and the state.

Abstract

This study aims to analyze the harmonization between Indonesian citizenship law and Islamic legal principles. Indonesian citizenship law is governed by Law No. 12 of 2006, which outlines various aspects of citizenship administration, while Islamic legal principles encompass teachings from the Qur'an and Hadith regarding individual responsibilities and rights within a state community. This research employs a qualitative approach with methods including document analysis, interviews, and observations to evaluate the alignment and misalignment between the two legal systems. Findings indicate alignment in principles such as trust and equality of rights, yet highlight discrepancies concerning dual citizenship and certain provisions that diverge from Sharia principles. To address these issues, it is recommended to revise policies, foster dialogue between policymakers and scholars, and enhance legal education and outreach. This study aims to contribute to achieving a harmonious balance between Indonesian citizenship law and Islamic legal principles.

Abstract

Pancasila as the foundation of the Indonesian state plays a key role in building a legal order that reflects the noble values of the nation. As the basis of constitutional law, Pancasila is not only an ideological symbol, but also a normative foundation that influences legislation, government systems, and national policy-making. This article aims to analyze the philosophical and juridical implications of Pancasila as the basis of law in Indonesia’s constitutional system and outline the application of its values in a dynamic legal context. Through a comprehensive literature review approach, the article identifies how Pancasila influences policy formation, law implementation and creates a balance between national stability and the principles of social justice, humanity and democracy. It also examines the challenges and constraints in implementing Pancasila values amidst socio-political dynamics as well as the need for legal reforms that are in line with changing times. Thus, this discussion provides insight into the continuing relevance of Pancasila in shaping a just and democratic legal framework to realize the ideals of the nation.

Abstract

Islamic law provides a comprehensive framework that regulates the rights and obligations of individuals in their relationships with God, fellow humans, and the state. The integration of Islamic law into public affairs in Indonesia, a predominantly Muslim country, presents the challenge of aligning the principles of this religion with the country's pluralistic legal framework. This research explores how Islamic legal principles regarding the rights and responsibilities of citizens interact with the Indonesian legal system, which is based on the principles of Pancasila and the national constitution. This research uses the research methodology of a legislative approach (law approach), legal cases (case approach), conceptual analysis (conceptual approach), historical perspective (historical approach), and comparative. The research results show that although there is potential conflict between Islamic law and national law, proper integration can strengthen social order and justice. This research also highlights the importance of dialogue between stakeholders to formulate legal policies that are inclusive and fair, and support the supremacy of law in Indonesia. This research provides a critical assessment of the application of Islamic law in Indonesia, especially in the context of citizenship, and proposes several solutions to overcome potential conflicts between legal systems. By highlighting real cases in several regions that strictly apply Sharia law, this research concludes that harmonization of Islamic law with the national legal system is not only important to maintain the religious identity of the majority of Indonesian society, but also to maintain the integrity of the nation in the midst of diversity.

Abstract

Pancasila as the foundation of the state and the ideology of the Indonesian nation has a fundamental role in law enforcement, including in eradicating corruption. As an extraordinary crime, corruption not only harms state finances but also erodes moral values and public trust in state institutions. The principles of Pancasila, such as social justice, just and civilized humanity, and the supremacy of law, provide a normative basis for efforts to eradicate corruption. Law enforcement against corruption in Indonesia has been attempted through institutions such as the Corruption Eradication Commission (KPK), the Prosecutor’s Office, and the Police, as well as through legal instruments such as Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 concerning the Eradication of Corruption. However, challenges such as political intervention, weak integrity of law enforcers, and the complexity of corruption cases still hamper the effectiveness of law enforcement. To strengthen the eradication of corruption, it is necessary to strengthen the anti-corruption culture based on Pancasila values, institutional reform, and a joint commitment from all elements of the nation. By implementing Pancasila as an ethical and practical guideline, it is hoped that a just legal system and a more responsible society will be created in maintaining the integrity of the nation. This abstract underlines the importance of collaboration between the values of Pancasila and the supremacy of law to combat corruption in Indonesia.

Abstract

The purpose of this research is to investigate the development of citizenship in Indonesia from the perspective of Islamic law, with particular emphasis on how Islamic legal norms influence the formation of civil rights and citizenship identity in Indonesia. The study analyzed the literature and conducted a comparison between Islamic law and national law and found that the Islamic concept of citizenship emphasizes the principles of justice, equality, and human rights. The study also highlights how Indonesia's citizenship policy has changed in the last five years, as well as how Islamic law has contributed to the formation of laws related to naturalization, the rights of foreign nationals, and citizenship. The research found that Islamic law and national law are in constant flux, which enhances the conversation about citizenship rights in Indonesia, especially in the context of migration and globalization.

Abstract

This research examines the implementation of citizenship principles in the formulation of legislation based on Islamic law, focusing on the dynamics and challenges faced in various Muslim-majority countries. Through a comparative analysis of several countries such as Saudi Arabia, Iran, Indonesia, and Malaysia, this study finds that approaches to integrating Islamic law and citizenship vary greatly, depending on the historical, cultural, and political context of each nation. Countries like Saudi Arabia and Iran strictly apply Islamic law as the foundation of their legal systems, often at the expense of modern citizenship principles. In contrast, Indonesia and Malaysia attempt to accommodate Islamic law within a more inclusive national legal framework, although not without controversy and challenges. This research also demonstrates that the successful integration of Islamic law and citizenship principles largely depends on the ability of governments and societies to engage in dialogue and negotiation, as well as on the flexibility of Islamic legal interpretation to respond to the demands of the modern era.

Abstract

The advancement of digital technology has brought significant changes to the patterns of political participation in society. In this context, Civic Education (PKn) plays an essential role in fostering civic technology skills (Civic Tech Skills) to enable citizens to participate actively and responsibly in digital spaces. This study employs a qualitative approach by analyzing various literature sources and relevant social phenomena. The findings show that Civic Education not only provides political knowledge but also nurtures critical thinking, democratic values, and practical skills for digital interaction, particularly through social media. By integrating civic values with technological utilization, this education helps the younger generation express their aspirations, engage in political discussions, and contribute to building an inclusive and adaptive society in response to contemporary developments. Therefore, Civic Education serves as a vital means of shaping digital citizens who are intelligent, ethical, and ready to face the challenges of democracy in the digital era.

Abstract

Amidst rising intolerance, moral decline, low social solidarity, and a national identity crisis, reforming Civics Education (PKn) has become an urgent need to restore the nation's identity based on the values of Pancasila. PKn aims not only to instill an understanding of laws and norms, but also to develop character, integrity, responsibility, and social empathy. This renewal process involves innovations in orientation, methods, and learning practices that are more contextual and interactive, and capable of increasing social awareness and active student involvement in national life. There is a close relationship between the revitalization of Civics and the Sustainable Development Goals (SDGs) because both share the same goal: building a peaceful, just, inclusive, and sustainable society. Civics plays a crucial role in helping achieve several SDG goals, such as quality education, reducing inequality, addressing climate change, and strengthening global peace and cooperation. Through an approach that emphasizes civic engagement, Civics encourages students not only to understand their rights and obligations but also to actively participate in social, political, and environmental issues. The choice of the theme of revitalizing Civics (PKn) to increase civic engagement in the SDGs movement is based on the challenge of declining community participation, especially among the younger generation, who are becoming indifferent to national issues. Furthermore, the development of digitalization has changed moral values and nationalism, so Civics must adapt to create critical and responsible digital citizens. With the revitalization of Civics based on the values of Pancasila and the spirit of the SDGs, education can function as a transformative force in shaping a generation of quality, critical thinkers, empathizers, and committed to peace and social justice both at the national and global levels.

Abstract

The climate crisis is a global issue that demands everyone to take a role and take action towards the environment for its sustainability. Therefore, in this context, civic responsibility is not limited to social and political matters but also encompasses ecological responsibilities and must be internalized in educational practices. This study aims to accelerate the integration of civic education and environmentally conscious citizenship, which is one step to affirm civic responsibility amid the climate crisis. This study uses a qualitative method through a library study that examines several educational institutions, learning practices, and policies related to citizenship, the environment, and environmental learning. The results obtained indicate that civic education has great potential in developing critical awareness, active participation, and responsibility in students towards the environment. By incorporating environmental education into the civic education curriculum, the moral, cognitive, and participatory dimensions of civic responsibility that depend on ecology (ecological citizenship) will be formed. Therefore, the climate crisis, especially in learning activities that implement integrated civic education with the environment.
