Abstract

This article examines the limitation of transparency within the Indonesian House of Representatives (DPR) during the formulation of the Job Creation Act (Law No. 11 of 2020) and its implications for legislative performance and public participation. Transparency represents a fundamental requirement in a democratic legal system as it ensures accountability, public oversight, and the legitimacy of legal products. However, the legislative process of the Job Creation Act demonstrated significant procedural issues, including inconsistent draft versions, restricted access to essential documents, accelerated deliberation, and the marginalization of meaningful public participation. This study highlights how these limitations hinder the public’s constitutional rights, weaken legislative oversight, and create asymmetrical power relations that enable elite dominance in policymaking. The lack of transparency also led to procedural defects acknowledged by the Constitutional Court, reflecting a systemic decline in democratic legislative practices. Using a normative juridical method supported by legislative analysis and doctrinal studies, this paper argues that the absence of transparency not only reduces the quality of participation but also erodes the legitimacy and accountability of the DPR. The findings emphasize the urgent need for open access to legislative documents, inclusive public consultation, and strengthened accountability mechanisms to ensure democratic and lawful policy making.

Abstract

Pemulihan aset pada tindak pidana semakin menjadi perhatian yang penting dalam sistem penegakan hukum yang ada di Indonesia. Fragmentasi pengaturan dalam berbagai aturan sektoral seperti KUHAP, UU Tipikor, dan UU TPPU menimbulkan ketidaksinkronan konseptual, prosedural, dan kelembagaan yang berdampak langsung pada efektivitas penyitaan dan perampasan aset. Setiap undang-undang mengatur definisi aset, mekanisme pembuktian, serta kewenangan aparat secara berbeda, sehingga proses pemulihan aset sering terhambat dan negara kehilangan peluang untuk merampas hasil kejahatan secara optimal. Ketergantungan pada putusan pidana dalam rezim hukum yang berlaku juga menyebabkan Indonesia tidak mampu menerapkan mekanisme Non-Conviction Based Asset Forfeiture (NCBAF) yang sangat dibutuhkan dalam kasus pelaku melarikan diri, meninggal dunia, atau ketika pembuktian pidana tidak dapat ditempuh. Penelitian ini menggunakan pendekatan yuridis normatif untuk menganalisis perbedaan norma pada aturan sektoral dan mengkaji posisi Rancangan Undang-Undang Perampasan Aset sebagai kerangka hukum nasional yang bersifat komprehensif dan terpadu. Hasil penelitian menunjukkan bahwa RUU Perampasan Aset memiliki peran strategis sebagai payung hukum yang memperbaiki kelemahan aturan sektoral, menghadirkan standar pembuktian yang seragam, menyediakan hukum acara khusus perampasan aset, serta memungkinkan penerapan mekanisme perampasan berbasis putusan maupun tanpa putusan. RUU ini juga memperkuat tata kelola pemulihan aset melalui koordinasi antar lembaga serta selaras dengan standar internasional seperti UNCAC. Dengan demikian, keberadaan RUU Perampasan Aset merupakan sebuah kebutuhan mendesak untuk meningkatkan kepastian dalam hukum, efektivitas pemberantasan kejahatan ekonomi, dan mengembalikan kerugian negara maupun masyarakat. Penyelarasan regulasi melalui RUU ini tidak hanya memperkuat integritas sistem hukum nasional, tetapi juga memperkokoh upaya negara dalam memutus aliran ekonomi kejahatan dan mendorong tata kelola pemerintahan yang bersih.

Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code brought fundamental changes to the regulation of the crime of adultery in Indonesia. The expansion of the scope of criminalization, including regulations regarding extramarital relationships, has given rise to debate regarding its compliance with the principles of the formation of laws and regulations and its impact on criminal law enforcement. This study aims to analyze the provisions of the adultery article in the new Criminal Code from the perspective of the principles of the formation of laws and regulations and assess its implications for the effectiveness of the criminal justice system. This study uses a normative legal research method with a legislative and conceptual approach. Legal materials were obtained through literature studies and analyzed qualitatively and juridically. The results show that the regulation of the crime of adultery in the new Criminal Code has a clear normative purpose, but still leaves issues regarding the clarity of formulation, legal certainty, and potential human rights violations. Furthermore, the application of the adultery article has the potential to create obstacles in law enforcement practices, particularly related to evidence, caseload, and the legitimacy of the criminal justice system. Therefore, further evaluation is needed to ensure that these regulations align with the principles of sound legislative development and ensure legal justice.

Abstract

  Penelitian ini membahas mekanisme dan prosedur Mahkamah Konstitusi (MK) dalam menangani sengketa kewenangan antar lembaga negara di Indonesia yang kewenangannya diberikan oleh UUD 1945. Kajian difokuskan pada dinamika ketatanegaraan pasca amandemen UUD 1945, tantangan penyelesaian sengketa, serta masalah ketidakjelasan definisi lembaga negara konstitusional dalam konstitusi. Dengan pendekatan yuridis normatif dan analisis perundang- undangan, penelitian menemukan bahwa prosedur MK dalam menangani sengketa meliputi pengajuan permohonan, pemeriksaan pendahuluan, sidang pleno, hingga pengucapan putusan yang bersifat final dan mengikat. Namun, keberadaan lembaga baru dengan kewenangan berbasis undang-undang menimbulkan kompleksitas dan sering kali menimbulkan penolakan permohonan oleh MK. Oleh karena itu, diperlukan reformasi regulasi dan pembatasan yang jelas terkait lembaga yang berwenang, serta pengembangan mekanisme penyelesaian alternatif untuk memperkuat fungsi MK sebagai pegawai konstitusi

Abstract

Program Makan Bergizi Gratis (MBG) diposisikan sebagai intervensi strategis negara untuk menanggulangi kekurangan gizi, menurunkan angka stunting, dan memperkuat kualitas sumber daya manusia menuju Indonesia Emas 2045. Penelitian ini bertujuan mengevaluasi dinamika implementasi, keberlanjutan fiskal, tata kelola kelembagaan, serta risiko operasional program MBG dengan menggunakan pendekatan yuridis-normatif yang didukung dokumen kebijakan, data statistik, dan laporan lembaga resmi. Hasil analisis menunjukkan bahwa meskipun MBG memiliki kontribusi penting bagi pemerataan gizi dan pembangunan kesehatan nasional, implementasinya menghadapi sejumlah persoalan serius, seperti beban fiskal yang sangat besar, koordinasi lintas lembaga yang belum solid, ketimpangan distribusi wilayah, kelemahan dasar hukum, serta munculnya kasus keamanan pangan. Temuan ini menegaskan perlunya desain fiskal yang hati-hati, penguatan kerangka regulasi, tata kelola yang terintegrasi, serta mekanisme pengawasan yang efektif agar MBG benar-benar berdampak pada peningkatan gizi jangka panjang tanpa memicu instabilitas sosial-ekonomi. Evaluasi ini menekankan bahwa MBG tidak hanya memerlukan ketepatan distribusi pangan, tetapi juga keselarasan kebijakan, transparansi, dan keberlanjutan pelaksanaan.

Abstract

Dengan menggunakan Teori Hirarki Kebutuhan Maslow sebagai kerangka kerja, penelitianini mengkaji bagaimana Unit Pelaksana Teknis Daerah Balai Latihan Kerja (UPTD BLK)berkontribusi dalam meningkatkan kualitas dan daya saing angkatan kerja, khususnyadalam mengurangi pengangguran di Indonesia. Sebagai lembaga penting yangmenawarkan pelatihan kejuruan, UPTD BLK sangat penting dalam membantu pesertadidik mencapai kebutuhan dasar mereka dan mencapai potensi penuh mereka. Berdasarkantahapan Maslow, penelitian ini menunjukkan bagaimana infrastruktur, program pelatihan,dan fasilitas BLK dapat memenuhi kebutuhan fisiologis, keamanan, sosial, penghargaan,dan aktualisasi diri para peserta. Sebagaimana dibuktikan dengan peningkatan kesempatankerja, pendapatan, dan partisipasi sosial, hasil pelatihan tidak hanya meningkatkanketerampilan teknis tetapi juga berdampak positif pada kesejahteraan ekonomi, sosial, danpsikologis peserta. Pelatihan kejuruan di UPTD BLK dengan demikian telah menunjukkandirinya sebagai alat yang berhasil untuk pengembangan sumber daya manusia jangkapanjang yang sesuai dengan tuntutan pasar tenaga kerja.Kata Kunci : UPTD BLK, Angkatan Kerja, Teori Hierarki Kebutuhan Maslow

Abstract

General elections or elections that occur in Indonesia are held regularly every 5 years, in which the general election is held in 2024, in general elections the people give their aspirations to vote to elect members of the executive and legislative members, so that members of the legislative and executive candidates register themselves with the General Election Commission (KPU) thus prospective legislative and executive members must follow the regulations issued by the KPU. Through the normative juridical research method, the approach is very relevant in examining campaign implementation deviations from the perspective of administrative law and criminal law. The practice of legislative elections still has deviations from the law by legislative and executive candidates thus the consequences obtained by the candidates and also the role of Bawaslu must be for the affirmation of deviations in the 2024 general election.

Abstract

As legal politics is used as a fundamental guideline in the process of identifying values, establishing, shaping and developing national law in Indonesia, it plays a significant role in the formation of Indonesian legislation and national law. Given the relationship between Constitutional Law and the development of society, it is clear that understanding Constitutional Law involves not only the study of the Constitution, but should also focus more on the occurrence of the Constitution itself. In this context, it is very important to do renewal and awareness in thinking in the field of Constitutional Law. To maintain its dynamic nature, Constitutional Law considers both formal and functional viewpoints. The role of legal politics in achieving state goals is the basic policy of state governance that will be, is, and is legal according to the law with the goals to be achieved by the state are goals that are in line with current legal policies, which can change and are closely related to legal policies and the direction of national development

Abstract

This research tries to analyze the influence of President Jokowi in the decision of Case number 90/PUU-XXI/2023 regarding the minimum age of presidential candidates and vice presidential candidates. We know that President Jokowi's name has recently become a topic of conversation, with rumors that he wants to nominate his son. became vice president, but in this case President Jokowi experienced a constitutional obstacle, namely that his son, Gibran, was still 36 years old. Who cannot be nominated because the requirement to become vice president in the 2024 presidential election must be 40 years old. This is an obstacle for President Jokowi to nominate his son to be vice president, who according to rumors has emerged as a pair with Prabowo Subianto. This research tries to understand how much influence there is in political intervention on the State Administration system and the influence of the family in the Constitutional Court's decision Number 90/PUU-XXI/2023. The results of the research show that the Constitutional Court's decision regarding the age limit for presidential and vice presidential candidates in October 2023 is a judicial decision that shows the family's interests because first, the discussion of the judicial review of the law is procedurally flawed

Abstract

The position of the prosecutor's office in the Indonesian constitutional system is a law enforcement agency whose role is as a prosecutor in the justice system, which is also related to the legal system. However, this is not stated in the 1945 Constitution of the Republic of Indonesia. The position of the Corruption Commission (KPK) in the Indonesian constitutional system is often discussed, the Constitutional Court decided differently on several occasions in its (KPK) decisions regarding the position of the Indonesian constitutional system in that system. The Constitutional Court once considered that the Corruption Eradication Committee (KPK) is an independent state institution that is not included in the executive powers of parliament and the judiciary.
