Abstract

Perubahan regulasi ketenagakerjaan melalui Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (Omnibus Law) telah memicu perdebatan luas, khususnya terkait perlindungan hukum terhadap pekerja kontrak. Penelitian ini bertujuan untuk menganalisis perbedaan pengaturan hukum terhadap pekerja kontrak sebelum dan sesudah diberlakukannya Omnibus Law, serta menelaah implikasi regulasi baru tersebut terhadap jaminan hak normatif pekerja. Penelitian ini menggunakan pendekatan hukum normatif dengan metode studi pustaka yang menganalisis bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum sekunder dari buku serta artikel ilmiah. Hasil penelitian menunjukkan bahwa meskipun Omnibus Law memberikan fleksibilitas bagi dunia usaha dan kemudahan dalam perekrutan tenaga kerja, namun hal ini berdampak pada melemahnya perlindungan hukum terhadap pekerja kontrak. Penghapusan batas maksimal perpanjangan kontrak, perubahan sistem pesangon, dan fleksibilitas hak cuti menjadi sumber ketidakpastian status kerja dan penurunan posisi tawar pekerja. Oleh karena itu, diperlukan regulasi turunan yang tegas serta pengawasan yang intensif dari pemerintah guna menyeimbangkan antara kepentingan investasi dan keadilan sosial bagi pekerja kontrak.

Abstract

This research analyzes the legal provisions regarding the obligation to pay overtime wages and legal options for workers if the company fails to provide overtime compensation. Overtime wages are the right of workers regulated in Law No. 13 of 2003 concerning Manpower which has been amended by Law No. 6 of 2023 and Government Regulation No. 35 of 2021. This study uses a case analysis of PT X in Semarang, which was accused of not paying overtime wages in full to its employees. The findings show that despite clear legal regulations, implementation faces various obstacles, such as inadequate supervision and lack of legal awareness. Employees whose rights are not met can pursue out-of-court (e.g. bipartite negotiation, mediation, conciliation, arbitration) and court channels through the labor court. Non-compliance with regulations on overtime pay not only impacts the economic situation of employees, but also causes imbalances in labor relations. This research recommends strengthening the labor inspection system, increasing transparency in the handling of working hours, increasing legal awareness among employees, and developing a more accurate time recording system to ensure the fulfillment of employee rights according to the applicable regulations.

Abstract

Gender equality in the workforce is a fundamental issue closely linked to human rights and sustainable economic development. This study examines the paradox in the implementation of maternity leave rights as part of the legal protection for female workers—where a right intended to provide protection instead becomes a barrier during recruitment processes. The aim of this research is to analyze the relationship between the provisions on maternity leave rights and the principle of legal equality in the workplace, as well as to identify efforts that companies can undertake to protect female workers from discrimination and to promote gender equality. This study employs normative legal research methods with a qualitative approach by analyzing various national and international regulations related to the protection of female workers. Primary data were obtained through an in-depth review of Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, and their implementing regulations, as well as international conventions such as CEDAW and ILO standards. The analysis was carried out using a deductive approach to identify the gap between legal norms and the reality of their implementation in practice.

Abstract

Kejadian yang tak terduga seringkali timbul dan mengakibatkan kerugian. Oleh karena itu, peran utama asuransi adalah mengganti kerugian yang diakibatkan oleh peristiwa tak terduga dan mengembalikan keadaan ke posisi semula sebelum risiko terjadi. Ketentuan mengenai asuransi diatur dalam Undang-Undang Perasuransian Nomor 40 Tahun 2014 serta peraturan yang dikeluarkan oleh Otoritas Jasa Keuangan. Meskipun demikian, masih terdapat banyak permasalahan terkait asuransi. Proses pengajuan asuransi bukan hanya sebatas tanda tangan kontrak asuransi, melainkan juga melibatkan penerapan prinsip itikad baik, termasuk data kesehatan dalam formulir permohonan asuransi jiwa (SPAJ). Penanggung dan calon nasabah asuransi wajib melaksanakan hak dan tanggung jawab masing-masing, termasuk kewajiban bagi calon nasabah untuk memberikan informasi kesehatan yang akurat, sehingga premi dan manfaat asuransi yang diberikan sesuai dengan kondisi. Artikel ini menjelaskan tentang persyaratan SPAJ serta pentingnya menunjukkan itikad baik terhadap SPAJ dalam kontrak asuransi, serta dampak hukum jika pemegang polis memalsukan data dalam SPAJ. Metode penelitian yang diterapkan dalam penulisan artikel ini adalah pendekatan hukum yuridis normatif, yang berarti artikel ini disusun dengan mengacu pada teori, konsep, prinsip hukum, dan regulasi yang berlaku. Penelitian ini bertujuan untuk meningkatkan pemahaman pembaca dan penulis mengenai konsekuensi hukum dari pemalsuan data yang disebabkan ketidakakuratan informasi yang diberikan oleh pemegang polis.

Abstract

This research aims to analyze the effectiveness of developments in the implementation of Trias Politica principles in the performance of high state institutions in Indonesia. Trias Politica, which refers to the separation of powers into executive, legislative and judiciary, is an important foundation in a democratic government system. Through a qualitative approach, this research evaluates how the division of power has transformed since the implementation of political reform in Indonesia, as well as its impact on the performance of state institutions in carrying out their duties and functions. The research results show that although there have been significant developments in the implementation of Trias Politica, several challenges such as overlapping authority, lack of synergy between institutions, and political influence remain obstacles. However, the application of the principle of separation of powers has generally increased accountability, transparency and efficiency in the performance of high state institutions. This research recommends strengthening coordination between institutions and more stringent legal reforms to improve the performance of state institutions as a whole.

Abstract

Indonesia is a legal state whose government system is based on applicable regulations. These regulations are carried out by several powers, namely the Executive, Legislative and Judicial powers. The purpose of this division of power is to avoid injustice due to arbitrary power. The judiciary or judicial institution is an institution whose role is to uphold justice, of course this judicial institution is very important because it is one of the basic pillars of the government system in the Republic of Indonesia. In fact, it is clearly regulated in Article 24 paragraph (1) of the 1945 Constitution which In essence, the judiciary is an institution that has independent power to administer justice to uphold justice. In this article the authors will discuss the urgency of the Judicial Institution in the government system in Indonesia and the role and operation of the judiciary in the government system. The discussion uses the Normative Juridical method, namely by studying and paying attention to Values, existing regulations.
