Abstract

This article discusses strategies for handling money politics in legislative general elections using the Pancasila Democracy approach as a foundation for general elections with integrity. By referring to the principles of Pancasila which emphasize social justice, people's sovereignty,unity and balance between rights and obligations, this article identifies concrete steps that can be taken to overcome the practice of money politics which undermines democracy. Writing is carried out using normative juridical methods, namely research on secondary data or library materials. To realize elections with integrity, primary legal materials will guide the writing of strategies for handling political money in legislative elections based on Pancasila democracy. These steps include law enforcement, political education, financial transparency, independent oversight, active participation, public disclosure of the campaign, and use of technology. By implementing these strategies holistically and based on Pancasila values, it is hoped that Indonesia can overcome the challenges of money politics and strengthen integrity in the legislative election process, as well as build a stronger foundation for a healthy democracy and integrity.

Abstract

Indonesia adheres to a democratic government system that relies on the principle of checks and balances. This principle is inherent in the legislative institution, namely the DPR, which has the right to carry out its duties, one of which is the right to inquiry. In the election context, the right to inquiry can be used to investigate fraud or violations that occur in the election administration process. However, the use of the right to inquiry currently still raises pros and cons among the public. In response to this, this research aims to understand the juridical considerations regarding the right to inquiry in holding elections and analyze the influence of the right to inquiry on elections. The method used in this research is descriptive normative law by studying or reviewing primary and secondary legal materials. This research shows that the DPR’s right to inquiry cannot influence or cancel the election results. However, the DPR’s right to inquiry can be used to request information from the government regarding the implementation of elections.

Abstract

The Ministry of Constitution have a vision on enforcing the Constitution in order to actualize the country of democracy, as well as the ambitions of our state law that is; to create a dignified life of the people and the nation. The purpose of the said vision is so that it can serve as a guideline, to exercise responsible judicial power in accordance with the mandate of the constitution, and independently for the Constitutional Court. The role of the Honorary Council of the Constitutional Court is to maintain and supervise the behavior of the Constitutional Court using descriptive research methods that are quantitative or non-quantitative. directly by conducting a literature review taken from search and normative results. The Honorary Council of the Constitutional Court is an institution that plays a role in monitoring and examining the actions of judges in the constitutional court which are suspected of violating the constitution. The authority of the Honorary Council according is to examine and make decisions on reports and information that the respondent judge is suspected of committing serious violations. The decision of the Honorary Council of the Constitutional Court as a means of enforcing the code, ethics and behavior of Constitutional judges is final and binding. Abstract

Human rights are fundamental rights inherent in every individual without exception, which must be respected, protected, and fulfilled by the government in accordance with the principles of applicable constitutional law. This study aims to analyze the legal protection of human rights in the context of constitutional law. The research method used is a descriptive analytical approach that discusses the concept of human rights, its relation to constitutional law, as well as concrete steps that can be taken by the government to ensure effective human rights protection. The results showed that legal protection of human rights in constitutional law is very important to maintain a balance between state power and individual rights. A balance between individual freedom and public interest is needed in carrying out government duties in accordance with the constitution and applicable laws and regulations. This research is expected to provide deeper insight into efforts to protect human rights within the framework of constitutional law, and can be a reference for governments, legislative institutions, and law enforcement agencies in improving human rights protection as one of the key aspects in realizing a democratic and just rule of law.

Abstract

Human rights are important, indivisible and fundamental rights that exist in every human being from the moment of birth. In Indonesia, the 1945 Constitution of the Republic of Indonesia (UUD 1945) serves as the constitutional protection of human rights. The purpose of the Indonesian legal system is to defend and defend human rights. This thesis explores how the Indonesian legal system protects human rights by examining how the constitution is applied in democratic practice in everyday society. The basic human rights law contained in the constitution, the mechanism of protecting human rights in the legal system of the Unitary State of the Republic of Indonesia, difficulties in implementing human rights will be discussed in this examination. The analysis shows that the Indonesian constitution provides a strong legal basis for the defense of human rights. Especially in the right to freedom in democracy within the scope of the state seen from a societal point of view..

Abstract

General elections or elections that occur in Indonesia are held regularly every 5 years, in which the general election is held in 2024, in general elections the people give their aspirations to vote to elect members of the executive and legislative members, so that members of the legislative and executive candidates register themselves with the General Election Commission (KPU) thus prospective legislative and executive members must follow the regulations issued by the KPU. Through the normative juridical research method, the approach is very relevant in examining campaign implementation deviations from the perspective of administrative law and criminal law. The practice of legislative elections still has deviations from the law by legislative and executive candidates thus the consequences obtained by the candidates and also the role of Bawaslu must be for the affirmation of deviations in the 2024 general election.

Abstract

As legal politics is used as a fundamental guideline in the process of identifying values, establishing, shaping and developing national law in Indonesia, it plays a significant role in the formation of Indonesian legislation and national law. Given the relationship between Constitutional Law and the development of society, it is clear that understanding Constitutional Law involves not only the study of the Constitution, but should also focus more on the occurrence of the Constitution itself. In this context, it is very important to do renewal and awareness in thinking in the field of Constitutional Law. To maintain its dynamic nature, Constitutional Law considers both formal and functional viewpoints. Abstract

This research tries to analyze the influence of President Jokowi in the decision of Case number 90/PUU-XXI/2023 regarding the minimum age of presidential candidates and vice presidential candidates. We know that President Jokowi's name has recently become a topic of conversation, with rumors that he wants to nominate his son. became vice president, but in this case President Jokowi experienced a constitutional obstacle, namely that his son, Gibran, was still 36 years old. Who cannot be nominated because the requirement to become vice president in the 2024 presidential election must be 40 years old. This is an obstacle for President Jokowi to nominate his son to be vice president, who according to rumors has emerged as a pair with Prabowo Subianto. This research tries to understand how much influence there is in political intervention on the State Administration system and the influence of the family in the Constitutional Court's decision Number 90/PUU-XXI/2023. The results of the research show that the Constitutional Court's decision regarding the age limit for presidential and vice presidential candidates in October 2023 is a judicial decision that shows the family's interests because first, the discussion of the judicial review of the law is procedurally flawed

Abstract

Penunjukan Pelaksana Jabatan (PJ) Gubernur menjadi langkah strategis sekaligus krusial untuk mendukung pengimplementasian program-program pemerintah di tingkat daerah. Pada situasi tertentu, Gubernur tidak dapat melaksanakan tugasnya secara tiba-tiba atau dalam konteks peralihan kekuasaan yang stabil, maka dari itulah lahir alasan-alasan penting atau urgensi dari penunjukan penjabat Gubernur dalam pelaksanaan program-program pemerintahan. Dalam penunjukkan ini tentu akan muncul berbagai pertimbangan terkait dampak positif maupun negatif yang akan ditimbulkan, baik dari segi efisiensi maupun efektivitas, kepastian pelaksanaan program yang sesuai dengan perencanaan, serta peran dan dukungan yang diperlukan untuk memastikan kesinambungan dan kesuksesan program-program pemerintah di tingkat daerah. Abstract

The general election is one of the forms of implementing democracy. With general elections, people can directly participate in electing the leader of the country or the person who will sit in parliament. Speaking of general elections. This general election was followed by a political party. Or in other words, these election participants themselves are political parties. In Indonesia itself, general elections are held based on several principles. In its history, Indonesia has passed many elections. From the era of President Soekarno in the old order until now. Elections also have a relationship with state and democracy. The writing of this article, uses normative methods that use legislation to analyze elections, democracy, and constitutionality. The purpose of this research is to be held, so that we know about the electoral system in Indonesia. As the general election is a clear example of democracy. We are in compiling this research, using a normative juridical method approach and the data used is secondary data. The result that we got through this research is that Indonesia holds elections with an open proportional system with an election period of 5 years.
