Abstract

The Smoke-Free Zone is one of the efforts made by the government to protect the community, including passive smokers, from the dangers of exposure to cigarette smoke. Teaching and learning places (schools and universities) are one of the areas that are included in the category of Non-Smoking Areas (KTR), as well as the UPN "Veteran" Jakarta Campus area. This is supported by the Rector's Regulation Number 11 of 2019 concerning the Prohibition of Smoking in the campus area. However, there are still many students who smoke in various corners of the campus when walking around the campus. This study aims to look at regulations related to the smoking ban in the UPN "Veteran" Jakarta campus environment and the effectiveness of the implementation of Rector's Regulation Number 11 of 2019 concerning Smoking Prohibition for law faculty students of the class of 2022. The method used is empirical legal research (sociolegal research) by looking at the actuality or reality of the application of law in society. The data collection technique is carried out through the distribution of questionnaires and using literature studies. This study uses Descriptive Statistical Techniques as a data analysis technique by describing or describing the data that has been collected without changing the original data results. The results of this study show that the existence of the Jakarta UPN "Veteran" Rector Regulation Number 11 of 2019 has not been implemented in an orderly and effective manner. This is because Law Students of the Class of 2022 are still found smoking around the Faculty of Law area and also the campus environment.

Abstract

Carok, a distinct cultural practice, is deeply entrenched in the societal fabric of the Bangkalan Madura community. Historically, it has been their primary method of resolving intricate issues, particularly those centred on wealth, honour, and disputes involving women. This culturally specific method of conflict resolution prompted an in-depth study. The primary objective was to discern to what extent law enforcement officers in Bangkalan Madura were influenced by Carok, a practice so interwoven into the community’s daily life. Furthermore, it aimed to gauge the impact of the Carok culture specifically on the procedures and perspectives of the local police. The findings from this investigation were enlightening. It became evident that the Carok tradition isn’t merely a fringe cultural practice but is, in fact, acknowledged and recognised by a significant portion of the Bangkalan community as a legitimate approach to problem-solving. This deep-rooted cultural acceptance has ramifications for the legal system. When it comes to upholding the law and seeking justice, both the police force and the prosecutor’s office in Bangkalan face a unique set of challenges, unparalleled in communities without such ingrained traditions. These challenges arise because of the profound respect and recognition that the Carok practice commands. As a result, conventional legal methods, designed without the considerations of such cultural nuances, often fall short. They find themselves rendered ineffective, if not entirely redundant, against Carok practitioners. This tension between cultural respect and legal enforcement is a poignant reflection of the complexities of integrating traditional customs within the modern rule of law.

Abstract

Penelitian ini membahas tinjauan yuridis terkait hukum forensik dalam kasus perlindungan hukum anak. Fokus penelitian adalah peran visum sebagai alat bukti dalam Kitab Undang-Undang Hukum Pidana (KUHP) dan pertimbangan hakim menggunakan visum dalam menjatuhkan hukuman. Artikel ini tergolong dalam penelitian pustaka dengan pendekatan kualitatif. Metodologi yang digunakan adalah studi hukum normatif. Hasil penelitian menunjukkan bahwa kedudukan visum dalam perkara pidana pencabulan dianggap sah dan memiliki nilai pembuktian tinggi. Hakim mempertimbangkan visum bersama dengan keterangan saksi dan menilai keterkaitan keduanya dalam mendukung tindak pidana.

Abstract

This study describes the problems and solutions related to differentiating sentences for the parallel integration of restorative justice in Indonesian courts. This study is normative-legal research using statute, comparative, and conceptual approaches. This study utilizes primary legal materials and secondary legal materials. This study is based on 25 (twenty-five) cases decided by judges in Indonesian courts. The research results indicate that the values of restorative justice are very relevant to the cultural values of gotong royong in Indonesia. Judges must consider the community’s cultural values and the implementation of restorative justice in their decisions. Parallel integration of justice has been re-applied in Indonesian courts. Still, in practice, judges do not have guidelines for parallel integration, so it is very possible that there will be differences in punishment for applying parallel integration. Therefore, as a solution to the problem of differentiation of sentences, the authors propose 2 (two) concepts of court decisions, namely (1) the verdict of the indictment cannot be accepted, and (2) the decision of the public prosecutor cannot be accepted.

Abstract

The corruption case in Indonesia, specifically the BTS project scandal by the Ministry of Communication and Informatics, reflects serious challenges in public financial management. According to information from Transparency International, Indonesia still ranks as a country with a high level of corruption. The BTS project, aimed at improving internet access in remote areas, has been revealed to suffer from budget misuse and corrupt practices by high ranking officials. To address this issue, forensic audits and digital evidence have become crucial tools in uncovering crimes. However, challenges such as a lack of trained human resources, limited technological infrastructure, and inter-agency coordination hinder the effectiveness of law enforcement. Integrated efforts to enhance the capacity of law enforcement and technological infrastructure are needed to effectively combat corruption and create a clean and transparent government.

Abstract

Tindak pidana pembunuhan diformulasikan sebagai delik materiil yang berakibat terhadap hilangnya nyawa seseorang yang merupakan unsur delik oleh karena itu, hubungan kausal antara sebab perbuatan terdakwa yang berakibat kematian korban harus dapat dibuktikan. Negara melalui organ-organnya memilki kewenangan untuk menjatuhkan pidana (ius puniendi). Penelitian ini menggunakan metode normatif dengan pendekatan taraf sinkronisasi hukum. Penelitian hukum normatif didefinisikan penelitian yang mengacu kepada norma-norma hukum yang terdapat dalam peraturan perundang-undangan maupun putusan pengadilan. Penelitian hukum normatif bisa juga disebut sebagai penelitian hukum doktrinal. Hasil dari penelitian ini menegaskan bahwa Urgensitas ilmu forensik sebagai bahan hukum pidana terletak pada potensi dalam menyajikan informasi perihal suatu kejahatan dilakukan beserta subjeknya melalui bukti-bukti yang terkumpulkan sebagaimana Bukti yang kuat dan tidak terbantahkan adalah bukti yang ideal dalam menentukan seseorang telah bersalah atau tidak.

Abstract

That the Earth of Indonesia has very extensive forests and dense trees, the International World calls Indonesia the lungs of the world because it can release oxygen from so many trees. Whereas furthermore, with this large number of trees as State forests, protection must be made with the Forestry Law and the Prevention and Eradication of Forest Damage so that the community in general can be protected both from environmental pollution and natural erosion, floods and/or landslides.The fact is that up to now there are still many perpetrators of forest destruction crimes which result in losses to the state, society and the surrounding environment. Normative legal research or library legal research, with a statutory approach, a conceptual approach, a comparative approach, a historical approach. The nature of the research used in this research is descriptive-prescriptive, the author uses content analysis. That protection for the community against forest damage in general already exists in Law Number 32 of 2009 concerning Environmental Protection and Management Jo. Law 31 of 1999 concerning forestry Jo. Law number 18 of 2013 concerning the prevention and eradication of forests, but implementation regarding law enforcement by Forestry Law Enforcers is less than optimal and there are also legal loopholes in the law, so there is a need for cooperation between the community and the government.

Abstract

When it comes to crime, evidence is an issue that plays an important role in the legal process. This evidence determines the fate of the accused. In the event that the results of the examination of evidence based on the evidence provided by law are not sufficient to prove the guilt of the accused, if the guilt of the accused can be proven based on evidence, the accused is acquitted. According to Article 184 of the Criminal Procedure Code, a defendant must be punished first before being sentenced. Expert testimony is valid evidence, and Visum et Repertum can also be used as evidence to replace a manuscript in the form of a letter because Visum et Repertum is one aspect of the role of experts and/or expert testimony, so the relationship between the two cannot be separated. This study aims to determine the role of forensic legal experts in proving the cause of death and the position of evidence to reveal the cause of death of the victim. The method used in this study is normative legal research, using a statute approach and a case approach. The results of this study indicate that the role of forensic legal experts and the regulation of criminal law based on the evidentiary power of the visum et repertum in proving the cause of the victim's death.

Abstract

Digital Forensics in Uncovering Social Media Hacking Events as a Tool to Help the Police to Fulfil Evidence. Normative legal research or library research, with a statute approach, conceptual approach, comparative approach, historical approach. The nature of the research used in this research is descriptive-prescriptive, the author uses content analysis. The role of digital forensics in finding scientific and objective results as a solid foundation that the police must have from the beginning of the legal process according to researchers is quite important. Because digital forensics is the basis, guidelines and reference for the forensic laboratory centre in acting to examine evidence in the form of speech or invitations made by Ravio Patra's social media account whether it is true that he himself did it or whether there is a hacking factor.

Abstract

The aims of writing this article is to understand the operation of forensic psychology as a field of psychology or belief emphasizing the application of methods, scientific evidence and psychological concepts in trials by the judiciary in the Indonesian law enforcement. Forensic psychology is a combination of the fields of clinical psychology, social psychology and cognitive psychology, as well as the psychology of the accused himself. In this research the author uses normative legal research methods, namely conducting library research. The problem in this article is how the role of forensic psychology operations can be applied in the trial of certain case in the form of the Angeline murder case in the Indonesian legal system. Then, people involved in forensic psychology are divided into two, the first is forensic psychology scientists and the second is forensic psychology practitioners. While for operational purposes, forensic psychologists are tasked with conducting psychological autopsies, investigative interviews with perpetrators of crimes, interviews with witnesses and families of victims, and identifying perpetrators of crimes. In criminal law in Indonesia, forensic psychologists have contributed as expert witnesses, as expert advisors outside the court or as ad hoc judges, and as educators for criminal justice actors. Although they have different uses or purposes to facilitate the investigation of cases, forensic psychologists have limited purposes in their use in court.
