Abstract

Evidence plays a central role in criminal law, as Article 184 of the Criminal Procedure Code establishes it as the basis for judges to determine whether the elements of a crime are proven lawfully and convincingly. In the case of attempted rape against a deaf and mute person with disabilities in Decision Number 72/Pid.B/2021/PN.Pps, the evidentiary process faced challenges due to the victim’s limited communication. This study aims to analyze the role of visum et repertum in proving the elements of attempted rape. Using a normative juridical method with a case approach, this research relies on legislation and court decisions as primary materials, supported by scholarly works. The results show that visum et repertum is written evidence with strong probative value, as it presents objective medical findings indicating physical violence, supporting the elements under Article 285 in conjunction with Article 53 paragraph (1) of the Criminal Code. In this case, visum et repertum strengthened witness testimonies and helped the judge form a conviction that acts leading to rape had occurred, despite no intercourse. It thus functions not only as formal evidence but also as protection for victims’ rights and a means to achieve substantive justice.

Abstract

The article attempts to look at the location and role of victims of crime in the criminal justice system and how the system is manipulated to corner the victims and offer solutions to the victims' problems. The Indonesian criminal justice system places the position of criminal victims as no more than those who assist law enforcement in uncovering crimes. The obstacle that the victim encounters in the criminal justice system is that the victim is only used as an object of evidence alone, not to mention if there is a blacklash from the perpetrator to the perpetrator who goes to jail only for penance. The application of restorative justice is one of the best solutions to how the criminal justice system is run. Involving victims and perpetrators and their families in a balanced and fair way as well as meeting the needs of the victims adapted to the perpetrators' ability to be responsible reflects the kinship character of the kinship culture of the Indonesian people.

Abstract

This study examines the legal position and evidentiary strength of medical record certificates as proof of domestic violence (KDRT) in divorce cases within the Indonesian legal system. Divorce in Indonesia must be based on valid and provable reasons, including domestic violence, which presents complex evidentiary challenges, especially when visum et repertum is unavailable. This research employs a normative legal method using statutory, case, and conceptual approaches, supported by secondary data from legislation, court decisions, and legal literature. The findings indicate that medical record certificates are juridically recognized as written evidence within civil procedural law. However, their evidentiary value is not absolute but categorized as free evidence (vrij bewijs), meaning their strength depends on judicial assessment. Unlike visum et repertum, medical records are not specifically created for legal purposes, which limits their probative value. In judicial practice, judges tend to treat medical records as supporting or circumstantial evidence that must be corroborated by other forms of proof, such as witness testimony or party statements. Court decisions demonstrate that judges prioritize the relevance, consistency, and causal relationship between medical findings and alleged acts of violence. Therefore, medical records cannot stand alone as decisive evidence but play an important role in strengthening the overall evidentiary framework. This study highlights the need for careful judicial consideration and greater clarity regarding the use of medical documents in proving domestic violence in divorce proceedings.

Abstract

Forensic examinations in sexual violence cases are inherently time-sensitive and play a decisive role in ensuring evidentiary effectiveness and the protection of victims’ rights. Delays in forensic examinations significantly reduce the probative value of evidence, thereby weakening the burden of proof and undermining legal certainty within criminal proceedings. In Indonesia, the absence of explicitly regulated forensic examination time limits under the Criminal Procedure Code (KUHAP) and Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS) reveals a normative gap that diminishes the effectiveness of evidence and compromises victim protection. This issue is directly relevant to the achievement of the Sustainable Development Goals (SDGs), particularly SDG 5 (Gender Equality) and SDG 16 (Peace, Justice, and Strong Institutions), as it affects access to justice and institutional accountability in handling sexual violence. This study aims to analyse the regulatory framework governing forensic examinations in sexual violence cases in Indonesia, assess the normative urgency of establishing forensic time limits, and conduct a comparative legal analysis between Indonesia and selected jurisdictions, namely the United Kingdom, the United States, Australia, and South Korea. This study employs normative (doctrinal) legal research, using a statutory approach and a comparative law approach. The analysis is based on primary legal materials, including KUHAP, UU TPKS, health regulations, and forensic standard operating procedures, supported by secondary legal doctrine and forensic guidelines. The findings indicate that the lack of binding forensic timelines in Indonesia contributes to delayed evidence collection and excessive reliance on victim testimony. In contrast, comparison countries, although similarly lacking explicit statutory limits, rely on institutional and healthcare guidelines that establish forensic examination timeframes ranging from 24 hours and 72 hours to a maximum of seven days, thereby enhancing evidentiary reliability. This study contributes original normative insights by linking forensic time regulation with legal certainty, evidentiary theory, and victim-centred justice, and proposes policy-oriented recommendations for strengthening Indonesia’s criminal justice framework.

Abstract

Forensics is the science of scientifically proving evidence found at a crime scene. Forensic medicine, also known as Legal Medicine/Forensic Medicine, is one of the specialised branches of medical science for the purposes of law enforcement and justice (judicial and non-judicial). Normative legal research or library research, with a statutory approach, conceptual approach, comparative approach, and historical approach. The nature of the research used in this research is descriptive-prescriptive, the author uses content analysis. The results of this study The process of proof is an activity that means an attempt to prove something (the object being proven) through evidence that can be used in certain ways to declare what is proven as proven or not according to the law. This forensic medical science is one of the vital references for law enforcement officials in revealing the facts of criminal offences that occur against victims into the light.

Abstract

The purpose of this study is to analyze the married couples engaged in an unregistered marriage and the position of the marriage agreement regarding the property as well as the concept of equal treatment of couples before and after isbat based on the theory of equality. This is important due to the legal gap observed in the norms, especially in relation to the unregistered legal marriages, despite the recognition of religious and registered marriages in Indonesian laws. This is legal research conducted using a conceptual and regulatory approach and the results defined an unregistered marriage as a legal marriage which fulfills the requirements determined by religion. Therefore, the failure to register a marriage does not invalidate its legality but there is a need for the record to be available with the state charged with such responsibility. Moreover, the agreements made concerning properties in unregistered marriages are valid as long as the parties conducted the process voluntarily and fulfill all the elements required. These agreements can also be recognized through the submission of isbat (marriage authorization) which recognizes and stipulates all activities conducted in the marriage before the isbat
