Abstract

Pasca penandatanganan Memorandum of Understanding (MOU) Helsinki pada 2005, Aceh mengalami transformasi signifikan dengan penguatan otonomi khusus, termasuk penerapan syariat Islam dalam aspek ekonomi. Artikel ini menganalisis pengaruh budaya dan adat istiadat Aceh terhadap implementasi dan penyelesaian sengketa dalam sistem ekonomi syariah. Dalam konteks ini, lembaga adat seperti Majelis Adat Aceh (MAA) dan tokoh adat berperan penting dalam mediasi konflik, bekerja sama dengan lembaga syariah seperti Mahkamah Syar'iyah. Pendekatan mediasi dan musyawarah yang mengintegrasikan nilai-nilai adat dan syariah menunjukkan efektivitas dalam menyelesaikan sengketa ekonomi. Studi kasus spesifik di Aceh mengilustrasikan bagaimana konflik bisnis dan keuangan dapat diselesaikan secara damai melalui intervensi adat dan ulama. Hasil analisis menunjukkan bahwa pendekatan yang menggabungkan nilai-nilai lokal dengan prinsip-prinsip Islam menciptakan sistem penyelesaian sengketa yang adil dan berkelanjutan. Meskipun menghadapi tantangan seperti potensi konflik dengan hukum nasional dan perbedaan interpretasi syariah, model Aceh menawarkan pelajaran penting bagi wilayah lain dalam mengharmonisasikan modernisasi ekonomi dengan identitas kultural dan religius. Integrasi budaya dan adat dalam hukum syariah di Aceh pasca-MOU Helsinki membuktikan relevansi dan keberlanjutannya dalam konteks kontemporer.

Abstract

Itsbat nikah carried out by the Aceh Government are regulated in Aceh Governor Regulation Number 25 of 2017 which states that the Implementation of Marriage Legalization (Itsbat Nikah) is carried out with the aim of helping people in Aceh who marry during the conflict, tsunami disaster and poor communities in obtaining marriage certificates. However, the imple mentation of itsbat nikah carried out by the Government has not been carried out according to the target. Especially in North Aceh Regency, there are still many married couples who have not yet been married. So this will greatly affect the legal protection of the wife. Therefore, researcher is interested in examining how the procedure for implementing itsbat nikah in North Aceh Regency is, what are the inhibiting factors for the in effectiveness of itsbat nikah in North Aceh Regency, and how the impact of implementing itsbat nikah as an effort to protect wives in North Aceh Regency is. The research method of this study used field research with an empirical juridical approach. The results of this study stated that the procedure for implementing an integrated itsbat nikah in North Aceh Regency started from registration at the District KUA, verifying files and then being tried by the Syar'iyah Court and after that the decision was issued. As for itsbat independent marriage, the procedure is the same as in other civil cases. Based on data on the itsbat nikah case in North Aceh Regency in 2015-2021 that the implementation of itsbat nikah in North Aceh Regency has not been effective, because it is not in accordance with the targets that have been determined at the beginning, there are still 24.82% who have not been certified for marriage. This is due to the limited budget from the Government and the Covid-19 that has occurred in Indonesia. So that the implementation of the itsbat nikah greatly impacts the legal protection of the wife, such as the wife's rights in terms of livelihood, inheritance, joint property, and so on.

Abstract

This study examines the challenges of child-rearing within Muslim families in the digital era, focusing specifically on the perspective of Islamic family law. The research addresses Muslim parents' complex issues in adapting Islamic family law principles to parenting practices compatible with digital realities. The study aims to identify significant challenges encountered in digital parenting and to propose relevant legal recommendations to support Muslim families. Using a qualitative approach with data collection techniques such as in-depth interviews, observations, and focus group discussions, the study involved 30 Muslim families, Islamic scholars, and legal experts. The findings reveal that critical challenges include difficulties in the digital supervision of children, low digital literacy among parents, and value conflicts between Islam and digital culture. The study highlights the need for supportive legal adaptations that preserve Islamic character education within the digital context, helping safeguard children's ethics and morals. Effective strategies include balanced surveillance technology aligning with Islamic values and implementing digital use guidelines. The study's implications emphasize the importance of collaboration among legal experts, policymakers, and stakeholders to establish a responsive legal framework addressing digital challenges and supporting Muslim families in integrating child-rearing with religious teachings.

Abstract

Anti-drug counseling in schools is a strategic step in preventing drug abuse among teenagers. This activity aims to increase students' awareness of the dangers of drugs, build anti-drug attitudes, and develop social skills to deal with environmental pressure. Evaluation showed a significant increase in knowledge and changes in students' attitudes towards drug use. The implementation of methods such as presentations, discussions, simulations, and role plays proved effective in conveying the anti-drug message. Active support from the school and parents strengthened the impact of the counseling. The development of additional materials such as brochures and posters also expanded the reach of information. The results of this activity emphasize the importance of program sustainability and collaboration with various parties to shape a drug-free young generation. With a holistic approach, this activity contributes to efforts to create a safe and healthy school environment.

Abstract

This article aims to provide an overview of the Muslim minority in Russia not living in a homogeneous environment. The Muslim community in this country is facing old and new problems at the same time. Ancient in the sense that members of this community who identify themselves with Islam have inhabited this vast land for centuries. However, they are considered young because Muslims are part of the modern Russian state. This paper seeks to place the changes experienced by Muslims in Russian society in the context of an actual historical framework. Post-Soviet Union development centered on infrastructure, economy, and society. Now, at a crucial moment, is the time to push intra-Islamic relations to a higher level. Only this allowed Islam to become an integral part of Russia's political identity.

Abstract

As a foreign company, Tiens Group has been successful and well accepted by the people of Banda Aceh, a city known for the implementation of Syariah Islam. This study analysed how the company uses its social capital resulting in its acceptance by the host society that is strongly associated with Syariah Islam. This research uses sosial capital theory by Robert D. Putnam. It is a qualitative reseach. Data were collected through interview and participant observation. This research found that the company has utilized sosial capital and succeeded in achieving its targets and well accepted by the host society. The interplay of the three aspects of sosial capital namely norms, trust and networks have been influential in achieving success of the company. Norms has been a focal point in the formation of group identity. It is the values that give rise to a strong trust among its members. Trust is formed through a strong believe towards values and norms. Network is needed to bridge and help expand the company to people outside the company through new recruits (bridging sosial capital), while at the same time, network within the group, would eventually strengthen the norms and the trust system as well as the sense of solidarity and work ethics among the members (bonding sociap capital).

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh usaha mikro kecil menengah terhadap kesejahteraan masyarakat Gampong Pulo Pande Kecamatan Batee Kabupaten Pidie. Penelitian ini di laksanakan di Gampong Pulo Pande Kecamatan Batee Kabupaten Pidie, dari bulan Januari 2023 sampai bulan April 2023. Sektor pertanian merupakan sektor yang peranannya sangan penting dalam rangka pembangunan ekonomi jangka panjang maupun dalam rangka pemulihan ekonomi. Dalam rangka memenuhi kebutuhan hidup agar menjadi sejahtera masyarakat yang mempunyai kemampuan dan jeli melihat potensi diri serta mampu mengidenfikas lingkungan, dapat menemukan peluang dan membuka peluang usaha bagi masyarakat.Usaha mikro kecil menengah adalah sektor ekonomi nasional yang paling strategis dan menyangkut hajat hidup orang banyak sehingga menjadi tulang punggung perekonomian nasional. Gampong Pulo Pande merupakan daerah yang menjadikan usaha mikro kecil menengah sebagai sentra kegiatan perekonomian. Keberadaan usaha mikro kecil menengah telah banyak memberikan pengaruh terhadap peningkatan tarif hidup dan kesejahteraan masyarakat. Penelitian ini bertujuan untuk melihat tingkat kesejahteraan masyarakat yang di sebabkan oleh usaha mikro kecil menengah di Gampong Pulo Pande Kecamatan Batee Kabupaten Pidie. Data primer di ambil dari usaha mikro kecil menengah dengan menggunakan pedoman kuesioner. Indikator kesejahteraan yang memberikan pengaruh atau dampak positif setelah adanya usaha mikro kecil menengah yaitu, Membuka lapangan pekerjaan baru, meningkatkan kesejahteraan masyarakat, akses teknologi informasi dan komunikasi.

Abstract

The role of village-owned enterprisesis an institution managed by the government and the village community which aims to strengthen the village economy. This research was conducted for see the impact of village-owned enterprises in overcoming poverty in Peunaga Pasi village, Meureubo sub-district, West Aceh district year 2020. This study aims to determine the impact of village-owned enterprises in overcoming poverty. The analytical method used is descriptive qualitative, using a sample of 22 respondents.the results of this study indicate that village-owned enterprises have a positive impact on poverty. the existence of village-owned enterprises has reduced the poverty level of the community in the village of Peunaga Pasi, Meureubo sub- district, West Aceh district

Abstract

This research aims to analyze the condition of the mangrove ecosystem due to the activities of Vaname shrimp ponds in the Tarusan area, Pesisir Selatan, West Sumatra. This research was conducted in Tarusan, Pesisir Selatan Regency, West Sumatra. The sampling location points are three stations. The method used is survey and field observation. Physical sampling procedures using water quality tools. Chemical sampling is carried out using a sterile sample bottle and then filled completely with water. The data analysis used in this research is descriptive data analysis, which is a data analysis technique for analyzing data by creating pictures or tables from the results of the data that has been collected. Based on this data, there are indications of significant water pollution in the mangrove areas adjacent to vaname shrimp ponds, mainly caused by high concentrations of organic matter, copper, lead and zinc.Keywords: Mangroves; Shrimp; Vanname; Water Quality

Abstract

Ulama salaf does not allow Muslim men to marry non-Muslim women absolutely, and others allow marrying kitabiyah (people of the Book), namely Yahudi and Christian women In objective reality, marriage of different religions in Indonesia today has more negative effects than positive effects, such as the problem of family harmony and the future of child religiousness. Sometimes some speculate that the problem can be solved by cultivating tolerance and developing a "climate of freedom" in the family. But, again, it is only an ideal desire then in the legislation it is clear that the constitutional court itself has decided to reject marriages of different religions.
