Abstract

Data breaches involving bank customers are a critical issue in modern banking, with significant impacts on both customers and the reputation of banks. This study analyzes the legal responsibilities of banks regarding data breaches in Indonesia, focusing on applicable regulations, such as Law No. 10 of 1998 on Banking and Law No. 27 of 2022 on Personal Data Protection (PDP Law). The research employs a normative juridical method to examine banks' obligations to maintain the confidentiality and security of customer data. The findings indicate that banks have a legal duty to protect customer data, including ensuring security systems capable of addressing threats like cyberattacks. Banks found negligent in fulfilling these duties may face administrative sanctions, criminal penalties, or damages. The study also identifies challenges in regulatory implementation, such as non-compliance by banks, weak oversight, and low awareness of data protection in the banking sector.

Abstract

This research proposes a text data security method using a combination of Linear Congruential Generator (LCG), Advanced Encryption Standard (AES) Cipher Block Chaining (CBC) mode, and Least Significant Bit (LSB) steganography technique on digital images. The message scrambling process using LCG produces ASCII characters as noise that is inserted in the original message. After that, the message is encrypted using AES-256 CBC to provide additional security. The encryption result is then hidden in the digital image through LSB steganography technique. Tests were conducted on images with JPEG and BMP formats to measure the visual quality after the data insertion process, as measured by PSNR (Peak Signal-to-Noise Ratio). The test results show a PSNR value of 56.60 dB for JPEG images and 70.84 dB for BMP images. In addition, the insertion process in JPEG images degrades the image quality, mainly due to lossy compression, compared to the lossless BMP format. This study concludes that the proposed combination of methods is effective in hiding messages in images, but is susceptible to compression on lossy formats such as JPEG. The use of lossless image formats such as BMP or PNG is recommended to maintain data integrity.

Abstract

This study aims to analyze the practice of cutting social fund donations by the Dompet Dhuafa Philanthropic Institute of South Sulawesi from the perspective of social fiqh and positive law. The focus of this research includes the mechanisms of fund management by philanthropic institutions, as well as how these practices are normatively reviewed in the context of Islamic law and national regulations. This study uses a qualitative approach with a field study method. Data was collected through observation, in-depth interviews, and documentation, which was then strengthened by literature studies of laws and regulations, scientific literature, and information from the official websites of related institutions. Data analysis is carried out through the stages of data reduction, data presentation, and drawing conclusions. The results of the study show that Dompet Dhuafa South Sulawesi collects funds from ZISWAF and Corporate Social Responsibility (CSR) sources, with an allocation of 12.5% for operational needs and amil rights. From the perspective of social fiqh, the deduction is justified based on the provisions in QS. At-Taubah verse 60 and MUI Fatwa No. 8 of 2011, which stipulates the share of amil at 12.5%, in line with the views of scholars such as KH. Sahal Mahfudh and KH. Ali Yafie who emphasized the importance of optimizing zakat institutions in community empowerment in accordance with the principles of maqāṣid al-syarīʿah. Meanwhile, in the context of positive law, the deduction of social funds by Islamic philanthropic institutions is regulated in Article 67 paragraph (2) of Government Regulation No. 14 of 2014 as a derivative of Law No. 23 of 2011, and strengthened by the Decree of the Ministry of Religion No. 733 of 2018 and BAZNAS Regulation No. 1 of 2016, which allows deductions of up to 20% outside of zakat funds. On the other hand, public philanthropic institutions or Money and Goods Collection Institutions (PUB) are subject to Government Regulation No. 29 of 1980 and Permensos No. 8 of 2021, which limit operational costs to a maximum of 10% without specific regulations regarding the salary of administrators. This research emphasizes the need for regulatory distinction between Islamic and public philanthropic institutions, as well as the strengthening of transparency in the management of social funds to maintain public trust and the effectiveness of aid distribution.

Abstract

The aim of this article is to describe the form of land rescue resolution using normative juridical analysis techniques. Settlements and land-related cases are usually settled through the official legal system and the applicable courts. There are some studies on the settlement of land disputes in Indonesia. This research uses a qualitative descriptive method, namely explaining the phenomenon or relationship of a problem in text form. The data source for this research is obtained through primary and secondary data. Primary data from this research uses legal materials consisting of: 1) the 1945 Constitution; 2) the Civil Code; and 3) Law No. 30 of 1999 regarding arbitration and settlement. The results of this research show that the form of land dispute resolution through arbitration and mediation is very appropriate to use, considering that the costs are not expensive and do not cause losses to the parties in the dispute. Mediation is a dispute settlement process involving third parties as intermediaries to help the parties reach an agreement. Mediation has been used in the settlement of land disputes in various areas of Indonesia, such as Kelurahan Mauliru District of East Sumba and Yogyakarta City. Mediation and arbitration are also methods of dispute resolution involving neutral third parties. The application of mediation and arbitration in the settlement of land disputes is expected to bring about justice and legal certainty.

Abstract

This paper aims to answer the halal value chain phenomenon that is developing in several cities in Indonesia. However, the study focuses only on Purwokerto City, where the city center in Banyumas Raya has succeeded in developing various fields, including economics, education, and industry. One of the exciting things about this development is the potential of the halal value chain, especially in three main aspects: the halal food sector, halal fashion, and Islamic financial institutions. This article uses field research and qualitative descriptive analysis; the research data shows that this development has yet to become a force supported by policy, public understanding, and business actors regarding halal aspects. With a qualitative descriptive nature supported by SWOT analysis, this article provides an overview that, conceptually, Purwokerto City has tremendous and promising potential in developing the halal value chain. However, this potential is still sporadic and has not received attention from policymakers to develop Purwokerto City as a "Halal City Area" in Banyumas Raya, Indonesia.

Abstract

Social conflict can be defined as a battle over values, and claims to limited status, power, and resources in which the opponent's goal is to neutralize, harm, or eliminate their rival. Social conflict also refers to disagreements and tensions that arise between different groups of people in society. This study aimed to explore two categories of social conflict presented in Sandra Cisneros' The House on Mango Street: realistic and nonrealistic conflict. The researcher analyzed the novel using a sociological approach, focusing on social conflict by Lewis Coser as a central theme. Elements such as realistic and nonrealistic conflict are examined in the context of the social struggles faced by the novel's characters. The researcher argues that social conflict has the potential to influence and transform human behavior and attitudes within society. Utilizing qualitative methods, the study investigates the experiences and social realities of the characters. Data were collected from words, phrases, clauses, sentences, and paragraphs related to social conflicts throughout the narrative. The analysis reveals that indirect characterization through dialogue and character behavior is a key feature of the novel, with no direct characterization being evident. The study identifies various social conflicts, particularly between Esperanza, an immigrant, and other characters. The findings indicate that realistic conflicts emerge when Esperanza faces disappointment and sexual harassment from her peers. Additionally, nonrealistic conflicts are portrayed through tension in some situations, such as distrust and jokes from her friends that trigger conflicts.
