Abstract

Previously, land certificates owned by the Indonesian people were in the form of physical documents such as books or magazines. Unfortunately, these physical documents are more easily damaged by floods, fires and loss. In fact, often these physical land certificates are easily duplicated. This of course makes the owner of the land certificate suffer losses. To overcome this, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) will enforce the use of electronic land certificates starting in 2021. The objective of this research is to examine and analyze legal certainty for electronic land certificates as proof of ownership of land rights in Indonesia; and to review and analyze the legal protection of data on electronic land certificate ownership rights. The approach method used in this study is a normative legal approach. The results of the study show that: (1) Legal certainty of land certificates in the form of electronic documents can be categorized as electronic evidence which has the same evidentiary power as written/written evidence made on paper and the printout as a form of valid proof. (2) Legal protection that can be given to electronic land certificate ownership data consists of: a) Preventive legal protection in the form of guaranteed fulfillment of personal data protection by requiring Electronic System Operators in this case the National Land Agency (BPN) to maintain the confidentiality of public personal data and safeguard it so that there is no leakage. Abstract

This study aims to analyze the notary's responsibility for the loss of a land title certificate and the legal protection provided to clients. A land title certificate is legally binding evidence of land rights, and its loss can lead to legal uncertainty and losses for the rights holder. In notarial practice, notaries often receive and store original documents belonging to the parties, so clarity is needed regarding the notary's responsibility in the event of the loss of such documents. This study uses a sociological juridical research method supported by library research. The sociological juridical approach is used to examine the establishment of legal norms in notarial practice through direct interviews with notaries. Library research is conducted by reviewing laws and regulations, legal literature, legal theories, and Kendari District Court Decision No. 14/pdt. G.S/2020/PN Kdi, which relates to the loss of a client's land ownership certificate. The results of the study indicate that (1) legal protection for customers against the loss of land ownership certificates is provided through preventive and repressive legal protection. (2) notaries are responsible for the loss of ownership certificates if the loss occurs due to negligence in carrying out their duties, with responsibilities that include civil, administrative, and ethical aspects. (3) legal solutions carried out by notaries for the loss of customer ownership certificates in the form of assistance in processing replacement certificates at the land office as a form of professional responsibility and good faith of the notary. In addition, the deed of granting mortgage rights has a close relationship with the ownership certificate as a collateral object, so that the security of the certificate in the process of making and registering mortgage rights is an important obligation of the notary in ensuring legal certainty for the parties.

Abstract

Forgery of power of attorney deeds is a common problem in notarial practice in Indonesia. As authentic evidence, power of attorney deeds should provide legal certainty and protection, but in practice, notaries often make irregularities in their preparation, resulting in discrepancies between the contents of the deed and the legal facts, resulting in disputes and legal uncertainty. This study aims to analyze the notary's responsibility for forged power of attorney deeds and the judge's considerations in Semarang District Court Decision Number 773/Pid.B/2021/PN Smg. The approach used in this study is a normative juridical approach with a type of normative legal research that focuses on the study of laws and court decisions related to the research problem. The data used are secondary data obtained through literature studies, including primary, secondary, and tertiary legal materials. Data analysis was conducted using a qualitative descriptive method by systematically and logically describing and interpreting the data to answer the research problem. The results of the study show that notaries can be held accountable for administrative, civil and criminal matters if they are proven to have been intentional or negligent in carrying out their authority, resulting in the forgery of a power of attorney to sell. The judge considered that the creation of a deed without the presence and signature of the principal fulfilled the elements of forgery of a deed as regulated in Article 264 paragraph (1) of the Criminal Code, which confirms that notaries are not immune to criminal sanctions.

Abstract

This study aims to analyze in depth the effectiveness of supervision carried out by the Notary Supervisory Board (MPN) in Banyumas Regency to prevent malpractice in carrying out notary duties. The main problem studied is how the MPN's supervision is implemented in Banyumas Regency and what factors hinder the effectiveness of such supervision, both from internal and external aspects. The research method used is empirical juridical with a sociological legal approach. The research location was determined in Banyumas Regency, involving informants from the Regional Supervisory Board (MPD) and notary practitioners. The results of the study indicate that supervision has not reached the optimal level of effectiveness as mandated by the Notary Law (UUJN). The main obstacles include limited human resources, minimal operational budget allocation, and psychological obstacles in the form of excessive corps solidarity (ewuh-pakewuh) among fellow notaries. Philosophically-theologically, this supervisory function is a manifestation of the Hisbah concept in Islamic law, where the MPN acts as Muhtasib to ensure that the notary as Al-Katib carries out his duties honestly, transparently and responsibly for the benefit of the people.
