Abstract

Environmental crimes pose a significant threat to ecological integrity and public welfare. However, law enforcement utilising retributive justice often fails to address the root causes of environmental damage caused by corporations. Therefore, alternative law enforcement efforts are necessary for more effective outcomes. This research aims to determine the effectiveness of current law enforcement against corporate environmental crimes in Indonesia, examine environmental crime enforcement in other countries, and identify an integrative environmental law enforcement policy model that incorporates the restorative justice approach in handling corporate environmental crimes. This study employs a normative legal research method with three approaches: statutory, conceptual, and comparative. This study finds that, first, law enforcement against corporate environmental crimes in Indonesia remains ineffective due to the difficulties in proving corporate liability, weak coordination and capacity among law enforcement agencies, and low levels of corporate compliance and transparency. Second, compared to Indonesia, Australia, specifically Victoria, has established a more comprehensive restorative justice framework through the Environment Protection Act 2017, whereas New South Wales still relies on judicial practice without an explicit restorative legal basis. Third, Indonesia needs to adopt an ecological restorative justice model that places environmental restoration, community participation, independent oversight, and stringent sanctions at the core of corporate criminal liability to truly realise ecological justice. Therefore, it is necessary to formulate law enforcement policies that incorporate ecological restorative justice principles, prioritising environmental restoration. Corporations should face sanctions and be required to restore damage in a tangible, measurable way, with independent oversight.

Abstract

This study aims to analyze the local wisdom function of customary communities in North Maluku, Indonesia, as a conflict-resolution mechanism that emphasizes reconciliation before the formal criminal proceedings stage, to prevent excessive criminalization. This research analyzes customary values from four sultanates (Moloku Kie Raha), which may be integrated into criminal law policies as a form of legal reformation. Implementing ultimum remedium and restorative justice principles. This research employed a normative-empirical legal research method, drawing on approaches from legal sociology and legal pluralism. The analysis examined conflict-resolution mechanisms, with a focus on reconciliation in customary communities in North Maluku. Primary legal materials included the 1945 Constitution. Meanwhile, empirical data were obtained by identifying customary conflict resolution practices. Key Findings this research is North Maluku customary community’s local wisdom effectively functions as a pre-criminal conflict resolution through three main mechanisms which is orientation transformation from individual retaliation to the recovery of collective-spiritual balance, The use of customary oaths and rituals as instruments of moral evidence (such as in the Sopik tradition) as a moral evidencing instrument with a high level of compliance, and Deliberation through customary institutions, which emphasize reconciliation rather than the sanction of imprisonment. Implications of the findings for broader legal reform could address the sociological and philosophical aspects of customary conflicts. Thus, social harmony has been achieved, thereby strengthening restorative justice and the principle of ultimum remedium within Indonesia’s criminal justice system.

Abstract

The aim of this study is to describe the economic potential of Sargassum in supporting the maritime economy of coastal communities in Bima Regency and to conceptualize strategic legal policies for the sustainable management of Sargassum to enhance the economic competitiveness of coastal villages in Bima. The method used is an empirical legal study employing a mixed-methods approach, combining qualitative and quantitative methods. The study was conducted in the coastal village of Teluk Waworada, Bima Regency, using purposive sampling of relevant stakeholders. Data were collected through observation, interviews, questionnaires, and documentation. Analysis was conducted qualitatively through data reduction, presentation, and drawing of conclusions. The novelty of this study lies in the formulation of a legal governance policy model for Sargassum that has not been previously researched, integrating environmental protection, the empowerment of coastal communities, and the enhancement of maritime economic competitiveness in Bima Regency.  The results of the study indicate that Sargassum makes a tangible contribution to the income and economic resilience of coastal households; however, its utilization remains traditional, lacking downstream processing and legal certainty. The conclusion is that comprehensive local regulations are needed to ensure sustainability, added value, and the competitiveness of the Sargassum-based maritime economy.

Abstract

Marriage Law in Indonesia is regulated in Act Number 1 of 1974 concerning Marriage and undergoing changes to Act Number 16 of 2019, which regulates how the norms and principles of marriage are considered and recognized by the Indonesian state. The purpose of marriage in Indonesia as regulated in Act Number 1 of 1974 article 1 states that: "Marriage is an inner and outer bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the Almighty God. one". The problem that arises then is whether the existing and developing customary marriages before the enactment of the Marriage Law can be recognized by the Indonesian state. The types of customary marriages that are not in accordance with the objectives, norms, and principles of marriage according to the Marriage Law are one of them is the Merariq Traditional Marriage Tradition, which from this merariq marriage tradition results in many early marriages or child marriages according to the legal age threshold. Law Number 16 of 2019 which is the main discourse of this study looks at the dimensions of Marriage Law through the eyes of the Merariq Indigenous Marriage of the Sasak Tribe. This study uses a normative juridical approach where this approach is carried out by tracing the norms that live in Indonesian positive law. Whereas the cases raised by merariq traditional marriages have caused many legal problems, furthermore, the high level of child marriage is due to the absence of a social safety net for anyone who wants to carry out a merariq marriage so that there is no legal protection and certainty for the parties to the marriage, especially women who are in a vulnerable position, Therefore, the implementation and enforcement of national marriage law must be considered again in its enforcement and implementation so that there is no legal vacuum where national law is not present in the community.
