Abstract

This paper presents a legal analysis of the quality of human resources of law enforcement and its impact on the effectiveness of eradicating drug crimes in Batam City. Using a normative legal approach, this study examines relevant laws, court decisions, and policies to assess the skills, training, and ethical behavior of law enforcement personnel. The study findings indicate that although Indonesia's legal framework provides a strong foundation, gaps in training, resource allocation, and ethical oversight limit the effectiveness of drug law enforcement in Batam. In addition, challenges such as interagency cooperation deficits, the complexity of drug crime networks, and corruption in law enforcement further undermine efforts to combat drug trafficking. The paper concludes by recommending improvements in law enforcement training, resource investment, interagency collaboration, and anti-corruption measures to improve the effectiveness of drug law enforcement in Batam City.

Abstract

Regarding Legal Justice in Restitution of Victims of Criminal Acts, further provisions regarding the procedure for carrying out conditional sentences (voorwaardelijke veroordeling) are regulated in Article 276 of the Criminal Procedure Code which states: "In the event that the court imposes a conditional sentence, its implementation shall be carried out with serious supervision and observation and in accordance with the provisions of the Law." According to Muladi, conditional sentences (voorwaardelijke veroordeling) are a form of humane criminal law, namely by prioritizing prevention, not only oriented towards actions but also towards people who commit crimes, which are tat-tatterstrafrecht, placing social welfare as the ultimate goal, oriented towards the future. The mechanism for applying compensation is also regulated in Article 275 of the Criminal Code which states: "If more than one person is convicted in one case, then the court costs and/or compensation as referred to in Article 274 shall be borne by them jointly in equal proportions". The explanation is explained as follows “Because the defendants in the case referred to in this article are jointly sentenced because they are accused of committing a crime in one case, it is reasonable if the court costs and/or compensation are borne jointly in equal proportions

Abstract

RSPAD Gatot Soebroto is a type A government hospital with the highest referral in the ranks of the TNI and serves as a health service for the general public and continues to strive to improve the quality of excellent health services for each patient. For this reason, the Gatot Soebroto Army Hospital always provides medical supplies generally stored in the material warehouse installation. The Gatot Soebroto Army Hospital's material warehouse installation consists of a general and Health material warehouse. For health services to run well, improving the quality of the material warehouse installation unit is necessary. The development of Radio Frequency Identification (RFID) technology is increasing rapidly from year to year; its benefits can be integrated into managing material warehouse installations to build orderly administration and distribution of material medical supplies needed in each installation unit at the Gatot Soebroto Army Hospital. Through the warehousing application with the RFID application, it is hoped that the process of procurement, receipt, storage, and distribution of material for medical supplies will be more easily controlled, both for evaluation of use, as well as evaluation of stock-taking of supplies which will later become the basis for material procurement for the following year. In addition, RFID also controls the material distribution designation and year of procurement. So that the distribution of material as hospital assets will be recorded accurately and the health services provided can also run well and have good quality.

Abstract

Tujuan dari penelitian ini pertama, untuk mengetahui bagaimana masyarakat Desa Sri Kuncoro, Kecamatan Pondok Kelapa, Kabupaten Bengkulu melakukan tradisi membayar padang langka. Kedua, belajar dari sudut pandang “Urf” bagaimana masyarakat Desa Sri Kuncoro di Kecamatan Pondok Kelapa, Kabupaten Bengkulu Tengah, melakukan prosesi adat untuk membayar padang langka tersebut.  Metode yang digunakan adalah pendekatan lapangan dengan pendekatan norma sosial. Kesimpulan dari penelitian ini adalah: Pertama, tradisi membayar padang langka yang dilakukan oleh masyarakat desa Sri Kuncoro adalah dengan membayar sejumlah uang kepada lembaga adat yang ada di desa tersebut sebagai simbol penghormatan dari pihak mempelai pria. Di luar desa Sri Kuncoro. Dasar hukumnya adalah Peraturan Kepala Desa Nomor 1 Tahun 2022 tentang Peraturan Desa dan Adat Istiadat Desa Sri Kuncoro. Pengantin pria akan melakukannya langsung sesuai adat desa setempat. Waktu pembayaran uang adalah sebelum penandatanganan akad nikah, yaitu pada saat pesta perkawinan. Dampaknya, jika tidak membayar, Anda dianggap sebagai pendatang yang tidak menghargai adat istiadat dan tidak mendapat perhatian sosial di masyarakat. Pernikahan akan ditunda sampai pengantin pria membayar uang tradisional Padang yang langka. Keistimewaan uang adat Langka Padang adalah melambangkan rasa hormat terhadap pendatang baru (laki-laki) yang akan mengawini gadis desa Sri Kuncoro. Hal ini merupakan simbol penerimaan masyarakat terhadap seorang pria yang menikah dengan warga Desa Sri Kuncoro. Kedua, hukum adat Pangkalan Padang dimasukkan ke dalam “urf Shahih” karena maksud dan tujuan didirikannya Rangka Padang adalah sebagai simbol penghormatan terhadap pendatang dan penerimaan laki-laki pendatang oleh masyarakat desa. Tujuannya agar keputusannya tidak bertentangan dengan hukum Islam dan hukum nasional yang ada di Indonesia.

Abstract

This research aims to analyze the legal aspects of business activities carried out by foundations, especially in the education and health sectors, which should be based on non-profit principles. Foundations, as legal entities with separated wealth, have the authority to participate in business activities to support the achievement of their goals in the social, religious and humanitarian fields. However, foundations are required to adhere to the non-profit principle and not pursue personal gain. The writing method in this research uses a normative juridical approach with descriptive analysis of laws and practices related to foundations. The novelty of this research lies in the legal study of foundations that establish or operate commercial businesses, particularly in the education and health sectors, which often contradict the basic principles of foundations as non-profit entities. Although foundations can generate economic benefits from their business activities, this raises serious legal challenges regarding the foundation's legal status. This research concludes that foundations that are more focused on economic and commercial objectives may be declared in violation of their founding principles and potentially receive legal sanctions, including dissolution, if proven to conduct activities that prioritize commercial aspects over their social mission. As such, this research provides an important contribution in understanding the legal consequences for foundations that deviate from the social, religious, or humanitarian purposes for which they were established.
