Abstract

AbstractThe use of firearms by police officers is a complex issue that intersects the necessity of maintaining public security with the obligation to uphold human rights. This study explores the legal and sociological perspectives on the use of force, particularly firearms, by law enforcement officers in controlling violence and addressing human rights concerns. The analysis employs a literature review method, examining various legal frameworks, academic studies, and case studies. The findings reveal that while regulations such as Chief of Police Regulation No. 1 of 2009 provide a legal foundation, implementation in the field often deviates from the principles of proportionality and human rights respect. This highlights the need for comprehensive reforms in policy, monitoring, and training to ensure that law enforcement actions align with justice and human rights standards. This study underscores the importance of integrating sociological insights into the legal framework to achieve balanced law enforcement practices. Keywords : Firearms; Sociology of law; Human rights; Violence control; Police regulation.

Abstract

This study aims to explore the legal awareness of MSME actors in business legalization under the guidance of the UMKM Juara program by the West Java Provincial Government in Kecamatan Cisalak-Tanjungsiang. The research adopts a juridical-empirical method with data collected through semi-structured interviews and literature studies to understand the perceptions and motivations of MSME actors regarding business legality. The findings reveal that although MSME actors generally understand the importance of business legality, they are often reluctant to pursue it, as it is perceived to provide no direct benefits. The primary motivation for legalization is driven by the need for halal certification, rooted in religious values. However, the lack of information on legalization procedures and limited support in guidance are the main obstacles. Social, cultural, and religious factors significantly influence legal awareness and the legalization process among MSMEs in the area.

Abstract

This qualitative study aims to identify the sociological construction of the implementation of legal principles in the inheritance system in Indonesia and its relevance to the Islamic inheritance system. The theory of receptio a contrario and the theory of structural functionalism as a legal sociology perspective are used to see how social construction is related to the implementation of the principle of justice, the principle of freedom of will, and the individual principle in the implementation of the inheritance system in a plural Indonesian society. This study finds the construction of social relations related to legal principles in the implementation of the national inheritance system with Islamic inheritance in Indonesia. The relational construction of these principles leads to the implementation of harmony between the implementation of the national inheritance legal system and the Islamic inheritance system so that both can run in an orderly and well-integrated manner. This study confirms that in sociological construction, the relationship between the principle of law enforcement and the social and cultural values of society cannot be dichotomized.

Abstract

The practice of polygamy is still a polemic to this day, with pros and cons both from human rights activists and from polygamy practitioners themselves. This research aims to examine the phenomenon of polygyny in Karawang Regency from the perspective of Islamic law and laws for justice; the social conditions that occur in Karawang further impact family welfare, such as household harmony, economic conditions, early marriage, and even polygamy. Polygamy has increased in Karawang in the form of polygyny. A lack of understanding about fairness in polygynous marriages in Karawang society supports the problems that arise from the occurrence of polygyny. The approach used in this research is an empirical juridical approach, or field research, examining applicable legal provisions and what happens in society. The results of the research show that the understanding of husbands and wives who practice polygyny in Karawang regarding Law No. 1 of 1974 regarding marriage varies, and some need help understanding the law, especially those relating to polygynous marriages. Some need help understanding law no. 1 of 1974, limited public understanding of Law no. 1 1974 concerning marriage is due to a lack of public interest. Also, because socialization regarding this law is uneven, especially regarding polygynous marriages, the public is more interested in using Islamic law.

Abstract

Community welfare is often a serious topic of discussion in terms of its management. The government has yet to find a glimmer of hope in addressing inequality, despite its continued efforts to find various ways to reduce it. The objective of this study is to analyze the extent of the implementation of village fund allocation management, in accordance with Law No. 3 of 2024 on villages, as well as the fiscal policy review in fulfilling the rights of the residents of Kurniabakti and Pasirhuni villages. The mitigation efforts carried out in Kurniabakti Village and Pasirhuni Village include implementing several development programs related to community welfare. It is hoped that these programs will bring benefits to the community and realize the government's desire to mitigate inequality. The villages of Kurniabakti and Pasirhuni have implemented development programs as part of the government's targets to improve the welfare of the community, with the aim of enhancing the well-being of the people in accordance with the principles of Islamic law (maqasid sharia), which prioritize the greater good and avoid harm. The principles of fiscal policy, which encompass trustworthiness and justice, determine how government officials exercise their authority in accordance with Islamic law, as referenced in the Quran and Hadith. Therefore, the review of fiscal policy is used as an analytical tool in this study in Kurniabakti Village and Pasirhuni Village because the research is deemed consistent with the principles of fiscal policy.

Abstract

Protection of the rights of persons with disabilities in Indonesia is generally regulated through various statutory regulations, one of which is Law Number 8 of 2016 concerning Persons with Disabilities. However, various challenges arise due to stigma, discrimination and a lack of public understanding of the rights of people with disabilities.. The aim of this research is to determine the factors that cause social stigma towards people with disabilities, to determine efforts to overcome social stigma towards people with disabilities and legal protection. The methodology used in this research is juridical-empirical law with a qualitative paradigm with a legal sociology approach. Factors that cause social stigma towards people with disabilities are not receiving support from their families, a lack of self-will to develop, as well as negative stigma from society. Efforts to overcome social stigma towards people with disabilities include that the families of people with disabilities must provide support, people with disabilities must have the self-confidence to develop, and the community is given education through outreach regarding the prohibition of discrimination against people with disabilities.

Abstract

This study discusses the review of siyasah dusturiyah on the implementation of the principle of balance of rights and obligations, as well as the professionalism of public services based on Article 4 of Cianjur Regency Regional Regulation Number 6 of 2013 concerning Public Services. The purpose of this study is to determine the implementation of the principle of balance of rights and obligations, as well as the principle of professionalism of public services in Integrated Administrative Services in Naringgul District, to determine government policies in overcoming obstacles to Integrated Administrative Services in Naringgul District, and to determine the review of Siyasah Dusturiyah on the implementation of the principle of balance of rights and obligations, as well as the principle of professionalism of public services in Integrated Administrative Services in Naringgul District based on Article 4 of Cianjur Regency Regional Regulation Number 6 of 2013 concerning Public Services. The method used is qualitative research method with descriptive type. As for the results of this study, the implementation of Integrated Administrative Services in Naringgul District is in accordance with the concept of siyasah dusturiyah, which is to regulate the interests of the people for the achievement of benefits.

Abstract

A leader is someone who has been chosen by a group who is given the mandate to lead the organization to achieve a goal, and is considered to have an influence on others and has an inherent leadership spirit. In Islam, the criteria for ideal leaders are in the Prophet Muhammad, but as ordinary humans, of course, we cannot equalize the criteria for leaders in the Prophet Muhammad, therefore in Islam there are criteria for imams according to Al-Mawardi which are based on the Qur'an and Hadith. In Indonesia, there are criteria for leaders according to the 1945 Constitution and Law No. 7/2017 on general elections. The two criteria certainly have different views, but if the two are compared whether it will be relevant or contradictory. This study will answer the relevance of the criteria of state leaders in Indonesia with the criteria of the Imam according to Al-Mawardi. This type of research belongs to the Qualitative category using descriptive analysis methods with data collection techniques, namely library research or literature studies. The 5 criteria for state leaders according to the 1945 Constitution and Law No. 7 of 2017 are relevant to the criteria for imam according to Al-Mawardi, namely according to the 1945 Constitution and Law No. 7 on elections (never betrayed the country and never committed corruption and other serious crimes, educated at least graduated from high school / vocational or other schools equivalent, spiritually able to carry out the duties of his obligations as President and Vice President and free from narcotics abuse, has a vision, mission, and program in implementing the government of the Republic of Indonesia, and the President is a native Indonesian) and according to Al-Mawardi (fair, healthy, knowledgeable, healthy limbs, have a vision and mission, and descendants of the Quraysh). So it can be concluded that the criteria for state leaders according to the 1945 Constitution and Law No. 7/2017 on elections when compared with the criteria for priests according to Al-Mawardi will be very relevant.

Abstract

Penelitian ini membahas tentang ketentuan tambahan pengalaman menjabat kepala Daerah dan syarat usia minimal Calon Presiden dan wakilnya dalam perspektif siyasah qadhaiyyah. Tujuan penelitian ini ialah untuk menganalisis Putusan Mahkamah Konstitusi Nomor 90/PUUXXI/2023 tentang ketentuan tambahan pengalaman menjabat kepala Daerah dan syarat usia minimal Calon Presiden dan wakilnya. Metode yang digunakan dalam penelitian ini adalah metode deskriptif analisis dengan pendekatan yuridis normatif. Perspektif Siyasah Qadhaiyyah tentang penetapan syarat usia minimal oleh Mahkamah Konstitusi berbeda dengan konsep politik Islam mengenai usia 40 tahun yang dipandang sebagai tonggak kematangan fisik, emosional, dan spiritual dalam kepemimpinan. Sementara itu, syarat pengalaman menjabat kepala daerah dianggap sejalan dengan prinsip-prinsip keadilan dalam Islam yang menekankan pentingnya keahlian dan pengalaman dalam memilih pemimpin. Penelitian ini juga menyoroti bahwa untuk melindungi hak politik masyarakat secara keseluruhan, yaitu dengan memastikan bahwa hanya calon yang benar-benar layak dan berpengalaman yang dapat mencalonkan diri tanpa mengabaikan hak asasi manusia individu.

Abstract

This research discusses the review of siyasah dauliyah on the role of the Republic of Indonesia in responding and providing policies on the war between Israel and Palestine, one of which is when the war heats up again in 2023. The occurrence of the war has caused enormous destruction in the Palestinian territories ranging from the economic, social, educational sectors, even public facilities, and infrastructures. The research method used the content analysis method with the technique of interpreting textual material and evaluating texts systematically from primary and secondary document data sources. The results showed that Indonesia and Palestine have established diplomatic relations for a long time, starting with educational relations conducted by Indonesian students while studying in the middle east, until Indonesia became one of the countries that recognised the independence of Palestine on 15 November 1988 in Algeria. The relationship continues until now as seen from Indonesia's policies that are always on the Palestine side in the midst of the Palestine-Israel conflict. Many policies and assistance provided by Indonesia for Palestine in the fight for Palestine rights and independence ranging from political, socio-cultural, humanitarian assistance, as well as education. In fact, Indonesia also voiced peace efforts for Palestine in various forums, one of which was in the UN forum.
