Abstract

This article examines the relationship between societal development and law in the context of social change influenced by globalization and technological progress. Using classical theories such as Auguste Comte's "Law of Three Stages" and Karl Marx's historical materialism, as well as the legal positivism approach of Jeremy Bentham and Hans Kelsen, this article analyzes how law adapts to contemporary social challenges. Case studies in Indonesia, mass violence in Pati and Bekasi and violence against children in Tangerang. This research uses a normative juridical approach with literature study techniques and qualitative analysis to provide an understanding of the role of law in dealing with social change. The research results show that mass violence, which is often driven by distrust of the formal legal system, can be explained through Durkheim's theory of solidarity and anomie, as well as Marx's perspective on inequality.

Abstract

This study aims to analyze the concept of religious freedom in the 1945 Constitution of Indonesia and the Medina Charter from the perspective of Siyasah Dusturiyah (Islamic Constitutional Law). Using a comparative, normative, and juridical approach, this research examines the similarities and differences in the principles of religious freedom between these two constitutional documents. The findings reveal that both the Medina Charter and the 1945 Constitution guarantee religious freedom within the framework of national unity and integrity. The Medina Charter, as the first written political document in Islamic history, recognizes non-Muslims as part of the ummah (nation) and guarantees their right to practice their religion freely, as stated in Articles 1 and 25. Similarly, the 1945 Constitution affirms religious freedom in Article 29 paragraph (2) and Chapter XA Article 28E paragraph (1). From the perspective of Siyasah Dusturiyah, both documents reflect the principles of shura (consultation), justice ('adl), and maslahah (public interest) in regulating religious freedom. The study concludes that the principles of religious freedom in Islam, as manifested in the Medina Charter, are highly relevant to and compatible with the constitutional framework of modern Indonesia. This research contributes to the theoretical development of Islamic constitutional law and provides practical insights for strengthening religious freedom policies in Indonesia.

Abstract

This article examines the impact of social media as a primary instrument of globalization on the socio-legal norms of Islamic family law (fiqh al-usrah). It argues that digital platforms have created a new public sphere that significantly transforms the social construction and practice of Islamic marriage and family relations. Using a socio-legal research method that analyzes classical jurisprudence (fiqh) texts, contemporary legal compilations, and empirical phenomena from social media, this study focuses on three critical areas: the transformation of matchmaking (khiṭbah) into a digital "marriage market," the spectacularization of dowry (mahr) and wedding ceremonies (walimah) as displays of status, and the reconfiguration of spousal and parent-child relationships through the logic of online self-presentation and conflict airing. The findings indicate that social media acts as a disruptive force, generating tensions between static legal interpretations and evolving social realities. It necessitates a contextual reinterpretation of Islamic family law to address new challenges related to privacy, financial pressure, and digital literacy. The article concludes that navigating this digital landscape requires a balanced approach that upholds the core objectives of Islamic law (maqāṣid al-sharīʿah) while constructively engaging with the dynamics of the networked society.   Artikel ini menganalisis dampak media sosial sebagai instrumen utama globalisasi terhadap norma sosial-hukum dari hukum keluarga Islam (fiqh al-usrah). Argumen utama menyatakan bahwa platform digital telah menciptakan ruang publik baru yang mentransformasi konstruksi sosial dan praktik dari perkawinan dan relasi keluarga Islam. Dengan menggunakan metode penelitian sosio-legal yang mengkaji teks-teks fikih klasik, kompilasi hukum kontemporer, serta fenomena empiris dari media sosial, studi ini berfokus pada tiga area kritis: transformasi lamaran (khiṭbah) menjadi "pasar pernikahan" digital, spektakularisasi mahar (mahr) dan walimah sebagai pertunjukan status, serta rekonfigurasi relasi suami-istri dan orang tua-anak melalui logika presentasi diri dan pengungkapan konflik daring. Temuan penelitian menunjukkan bahwa media sosial berfungsi sebagai kekuatan disruptif yang menciptakan ketegangan antara interpretasi hukum yang statis dan realitas sosial yang terus berkembang. Hal ini memerlukan reinterpretasi kontekstual atas hukum keluarga Islam untuk menjawab tantangan baru terkait privasi, tekanan finansial, dan literasi digital. Artikel menyimpulkan bahwa navigasi di lanskap digital ini membutuhkan pendekatan seimbang yang menegakkan tujuan utama syariat Islam (maqāṣid al-sharīʿah) sekaligus secara konstruktif terlibat dengan dinamika masyarakat jaringan.

Abstract

This study aims to examine the transformative leadership model implemented by a village head with a background as a former thug and its implications for the community empowerment process in Cikuya Village, Cicalengka District, Bandung Regency, Indonesia. Village leaders with non-conventional backgrounds are often perceived negatively and considered problematic in the context of village governance. However, in practice, such figures have the potential to bring about significant social change, particularly in village development and strengthening community participation. This study uses a qualitative approach with juridical-sociological methods to deeply understand the socio-political dynamics, leadership patterns, and the legitimacy of the village head's power from the perspective of constitutional law and Islamic values. Data collection techniques included in-depth interviews, participatory observation, and documentation, involving the village head, village government officials, community leaders, and residents of Cikuya Village as key informants. Data analysis was carried out using the siyasah dusturiyah theoretical framework as proposed by Ibn Taymiyyah, which emphasized that the legitimacy of leadership is not determined by a person's social background, but rather by the leader's capacity to carry out mandates, uphold justice, and create benefits for the wider community. Through this approach, research is expected to be able to reveal the process of social transformation from a thug figure to a formal leader who is recognized legally and socially. Apart from that, this research is also expected to show how leadership can form effective, responsive, and inclusive patterns, as well as to provide theoretical contributions to the study of village leadership and practical contributions to strengthening village governance.

Abstract

The issuance of Supreme Court Circular (SEMA) No. 2 of 2023 marks a paradigm shift in Indonesian family law, moving from judicial activism that allowed loopholes for interfaith marriages to strict administrative restrictions banning the practice. This study aims to analyze the juridical implications of the Circular by juxtaposing two diametrical perspectives: the doctrine of religious protection (Hifz al-Din) and constitutional rights. This is normative legal research employing statutory and conceptual approaches. The findings indicate that: (1) SEMA No. 2 of 2023 serves as a state manifestation of Sadd al-Dzarai (preventive measure) to maintain theological purity and prevent ambiguity in child lineage status (Hifz anNasl); (2) Within the Indonesian legal system, the right to form a family (Article 28B of the 1945 Constitution) is categorized as a derogable right, restricted by religious values as stipulated in Article 28J paragraph (2); (3) While the Circular establishes legal certainty and judicial uniformity, it potentially triggers legal resistance in the form of law smuggling (fraus legis) through overseas marriages or sham religious conversions. The study concludes that SEMA No. 2 of 2023 reaffirms Indonesia's position as a theistic nation-state that prioritizes theological validity as an absolute prerequisite for the administrative validity of marriage.

Abstract

The transfer of hajj quotas for deceased pilgrims is a legal and social issue that is relevant to the dynamics of the implementation of the hajj in Indonesia. This phenomenon arises as a consequence of the long waiting list for the departure of pilgrims, which causes many prospective pilgrims to die before having the opportunity to perform the worship. From the perspective of Islamic law, the hajj is personal (fard 'ain) and attached to individuals who have met the requirements of istitha'ah. However, in the context of state administration, the right to portion Hajj is seen as an administrative right that can be transferred to certain heirs in a regulatory manner. This study aims to examine the legal basis for the assignment of hajj quota based on the principles of sharia maqashid and review its implementation in the socio-anthropological context of the Indonesian Muslim community. The research method used is normative law with a conceptual and sociological approach, through the analysis of laws and regulations and developing social practices. The results of the study show that the transfer of the hajj quota does not contradict sharia principles as long as it brings benefits, guarantees justice, and avoids potential abuse. Socially, this policy reflects respect for the deceased's worship intentions, strengthens kinship values, and shows the adaptation of Islamic law in responding to the needs of contemporary Indonesian Muslim society.

Abstract

Kajian ini menganalisis peran fundamental al-qawaid al-fiqhiyyah sebagai prinsip universal dalam membentuk dan menerapkan fiqh munakahat (hukum keluarga Islam) dalam konteks hukum positif di Indonesia. Laporan ini secara spesifik membedah aplikasi dari lima kaidah fikih asasi (al-qawaid al-khamsah) dalam isu-isu kontemporer, seperti dispensasi nikah, sengketa perceraian, dan hak serta kewajiban suami-istri. Meskipun kaidah fikih sering dipandang sebagai ringkasan dari sejumlah permasalahan hukum, laporan ini menunjukkan bahwa kaidah-kaidah tersebut berfungsi sebagai fondasi intelektual bagi penalaran hukum (ratio decidendi) para hakim di Pengadilan Agama. Melalui studi kasus dan korelasi dengan Kompilasi Hukum Islam (KHI), analisis ini menunjukkan bahwa kaidah fikih memberikan fleksibilitas yang diperlukan bagi hukum Islam untuk tetap relevan, adaptif, dan mampu menyediakan keadilan substantif dalam menghadapi dinamika sosial modern. Oleh karena itu, kaidah fikih bukanlah sekadar konsep teoritis, melainkan kerangka kerja yang hidup dan esensial dalam praktik hukum Islam di Indonesia.

Abstract

Darussalam Islamic Boarding School in Sumedang Regency empowers local surau (prayer houses) to cultivate noble morals in children, preparing them for religious, national, and civic roles. Inappropriate guidance risks impeding comprehension and character formation; thus, drawing on Muhammad Utsman Khusyah's framework, efforts target personality development, monotheism, worship, muamalah, and Islamic culture, with surau as hubs for activity and internalization. Employing Participatory Action Research (PAR), the author co-designed and evaluated surau empowerment programs. Primary data derive from empowered surau teachers and child mentors. Findings reveal: (1) extensive surau development led by boarding school alumni trained as local educators; (2) multifaceted strategies, including Islamic Character Classes (honesty, discipline, responsibility, cooperation, politeness via lectures, discussions, games, modeling, simulations), integrated worship, moral fostering, social initiatives, and administrator training; and (3) enhanced surau functions yielding stronger Islamic character in children, revitalizing surau as centers for worship, ethics, and community engagement.

Abstract

Due to parental divorce, children become victims and require the husband as the father to pay for the child's living expenses until they are independent. However, the amount of living expenses is not regulated by law and there are no legal sanctions if the father violates the decision. This often harms the mother and child who have custody. This study aims to analyze: (1) Considerations of the Religious Court in determining the child's living expenses after divorce; (2) Implications of the Religious Court Decision regarding the child's living expenses; (3) Legal efforts of the wife against the ex-husband who does not comply with the decision; (4) Clarity and justice of the law in decisions regarding the child's living expenses. The theories used include the theory of legal benefit from Imam Al-Ghazali and the theory of legal principles from Gustav Radbruch. This study is qualitative with a descriptive analysis method, using data from the contents of the Religious Court decision. Data were obtained through observation, interviews, documentation, and content analysis. The results of the study show: (1) Variation in the amount of the child's living expenses; (2) Many violations of the father's actions in fulfilling the cost obligations; (3) Legal efforts taken by the wife; (4) The decision must regulate more property guarantees to facilitate the implementation of the child's living expenses. Legal development is needed regarding clauses in decisions and statutory regulations.

Abstract

Each ethnic community has a leader who controls its social and cultural communication. The leadership is equipped with its own territory, social norms, and traditional arts. The arts as a product of this culture are integrated with the community's belief in something metaphysical and supernatural, which is deified and believed to be the creator and ruler of the universe universally. Such as the “Ngalaksa” custom carried out by the Rancakalong community in Sumedang Regency every year. This custom is a symbol of gratitude to God for all the blessings that have been bestowed in the form of agricultural products. This research will answer about the symbolic meaning contained in the Ngalaksa custom and its contribution to the embodiment of traditional culture of the people in the archipelago as well as a religious understanding of the divine values contained in the Sundanese Ngalaksa custom. This research uses descriptive analysis method and anthropological approach with qualitative data collected by observing, interviewing, and participating with the implementation of Ngalaksa custom in Rancakalong, Sumedang. This research reveals that the Ngalaksa custom in Rancakalong, Sumedang, has a deep meaning in the context of empowering thinking, acting, and creating based on the teachings of Islam Nusantara. The cultural symbols of this custom are interpreted through Islamic values that strengthen the character and spirituality of individuals and communities, strengthening faith in God with practices that reflect the harmony of religion and local culture.
