Abstract

This study comprehensively examines the existence, service mechanisms, and Islamic legal assessment of the gold pawning practice (rahn al-dzahab) that is developing in modern Islamic financial institutions. The main focus of the study is directed at how the practice of gold pawning has transformed from a traditional model into a formal, structured financial product, as well as how its legal legitimacy is assessed within the normative framework of Islam. The research method used is qualitative with a normative-philosophical approach. Data were obtained through library research by reviewing primary sources in the form of Fiqh Muamalah literature, sharia texts, and regulations of Islamic financial institutions, and secondary sources in the form of scientific journals, books, and relevant previous research results. This study specifically examines the dualism of contracts in Islamic gold pawning products, namely the qardh contract as a non-profit loan and the ujrah contract as a service fee for the storage and security of collateral. The analysis shows that the existence of modern gold pawning plays a crucial role as a safe and secure liquidity instrument, especially within the framework of ḥifẓ al-māl (property protection). The research findings confirm that charging service fees (ujrah) in gold pawning practices is considered permissible under Islamic law under certain conditions. Ujrah must be determined based on actual calculations of the costs of storage (ḥifẓ) and security (ḥirāsah) of collateral, and should not be directly or proportionally linked to the principal loan (qardh). Thus, the practice of sharia gold pawning is considered to fulfill the aspects of legal certainty (tsubūt) and benefit (maṣlaḥah), as long as the separation of the contract is carried out firmly and the determination of ujrah is carried out transparently to avoid the potential for hidden usury. Abstrak Penelitian ini mengkaji secara komprehensif eksistensi, mekanisme layanan, serta penilaian hukum Islam terhadap praktik gadai emas (rahn al-dzahab) yang berkembang di lembaga keuangan syariah modern. Fokus utama penelitian diarahkan pada bagaimana praktik gadai emas mengalami transformasi dari model tradisional menjadi produk keuangan formal yang terstruktur, sekaligus bagaimana legitimasi hukumnya dinilai dalam kerangka normatif Islam. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan normatif-filosofis. Data diperoleh melalui studi kepustakaan (library research) dengan menelaah sumber-sumber primer berupa literatur Fiqh Muamalah, nash-nash syariah, serta regulasi lembaga keuangan syariah, dan sumber sekunder berupa jurnal ilmiah, buku, serta hasil penelitian terdahulu yang relevan. Penelitian ini secara khusus menelaah dualisme akad dalam produk gadai emas syariah, yaitu akad qardh sebagai pinjaman yang bersifat non-profit dan akad ujrah sebagai biaya jasa atas layanan penyimpanan dan pengamanan barang jaminan. Analisis menunjukkan bahwa eksistensi gadai emas modern memiliki peran yang krusial sebagai instrumen likuiditas yang aman dan terlindungi, terutama dalam kerangka ḥifẓ al-māl (perlindungan harta).  Hasil penelitian menegaskan bahwa pembebanan biaya jasa (ujrah) dalam praktik gadai emas dipandang halal menurut hukum Islam dengan syarat tertentu. Ujrah harus ditetapkan berdasarkan perhitungan riil atas biaya penyimpanan (ḥifẓ) dan pengamanan (ḥirāsah) barang jaminan, serta tidak dikaitkan secara langsung atau proporsional dengan jumlah pokok pinjaman (qardh). Dengan demikian, praktik gadai emas syariah dinilai memenuhi aspek kepastian hukum (tsubūt) dan kemaslahatan (maṣlaḥah), selama pemisahan akad dilakukan secara tegas dan penetapan ujrah dilaksanakan secara transparan guna menghindari potensi riba terselubung.

Abstract

Islamic political parties play a crucial role in Indonesia's presidential system, channeling the political aspirations of Muslims and acting as actors in the dynamics of national power. However, the relationship between religion, Islamic political parties, and power often faces challenges due to political practices that tend to be pragmatic and oriented towards short-term interests. This study aims to analyze the position of Islamic political parties in Indonesia's presidential system and examine the relationship between religion and power in Islamic political practice. The study employed a qualitative method with a library research approach through analysis of various literature sources, scientific journals, and relevant references. The results indicate that Islamic political parties have not been fully able to substantively implement Islamic values ​​in political practice due to the persistent influence of power interests and temporary political coalitions. Nevertheless, religion still plays a role as an ethical foundation that emphasizes the values ​​of justice, trustworthiness, honesty, and the welfare of the people in the exercise of power. Therefore, strengthening the substantive implementation of Islamic values ​​in political activities is necessary so that Islamic political parties can contribute optimally to realizing a democratic, just, and welfare-oriented system of government. Abstrak Partai politik Islam memiliki peran penting dalam sistem presidensial Indonesia sebagai sarana penyaluran aspirasi politik umat Islam sekaligus aktor dalam dinamika kekuasaan nasional. Namun, hubungan antara agama, partai politik Islam, dan kekuasaan sering menghadapi tantangan akibat praktik politik yang cenderung pragmatis dan berorientasi pada kepentingan jangka pendek. Penelitian ini bertujuan untuk menganalisis posisi partai politik Islam dalam sistem presidensial Indonesia serta mengkaji hubungan agama dan kekuasaan dalam praktik politik Islam. Penelitian menggunakan metode kualitatif dengan pendekatan studi pustaka (library research) melalui analisis berbagai sumber literatur, jurnal ilmiah, dan referensi yang relevan. Hasil penelitian menunjukkan bahwa partai politik Islam belum sepenuhnya mampu mengimplementasikan nilai-nilai Islam secara substantif dalam praktik politik karena masih kuatnya pengaruh kepentingan kekuasaan dan koalisi politik yang bersifat sementara. Meskipun demikian, agama tetap memiliki peran sebagai landasan etis yang menekankan nilai keadilan, amanah, kejujuran, dan kemaslahatan umat dalam penyelenggaraan kekuasaan. Oleh karena itu, diperlukan penguatan implementasi nilai-nilai Islam yang substantif dalam aktivitas politik agar partai politik Islam dapat berkontribusi secara optimal dalam mewujudkan sistem pemerintahan yang demokratis, adil, dan berorientasi pada kesejahteraan masyarakat.

Abstract

This study examines how maqāṣid syarī‘ah are applied in judicial reasoning on child maintenance after divorce and how they support the protection of children's rights. Using the framework of al-kulliyyāt al-khams, namely the preservation of religion, life, intellect, lineage, and property, the study assesses whether religious court decisions place children's welfare at the center of legal consideration. The research uses a normative legal method, drawing on statutory and case law. It compares three decisions: Decision Number 2487/Pdt.G/2024/PA.Mks, Decision Number 1800/Pdt.G/2024/PA.Pas, and Decision Number 147/Pdt.G/2025/PA.Gtlo. The analysis uses content and comparative analysis to examine the five main objectives of Islamic law. The findings show a shift from formal legal reasoning toward substantive justice in child maintenance cases. The dominant maqāṣid dimensions are ḥifẓ al-nafs, ḥifẓ al-‘aql, and ḥifẓ al-nasl. These include protecting children's basic needs, education, psychological well-being, and continued parental responsibility after divorce. Each decision shows a different pattern. Decision No. 2487/Pdt.G/2024/PA.Mks emphasizes psychological protection and the quality of caregiving. Decision No. 1800/Pdt.G/2024/PA.Pas prioritizes education and living needs based on the father's stable income. Decision No. 147/Pdt.G/2025/PA.Gtlo balances children's needs with the father's financial capacity and regional living costs. However, maintenance awards still rely mainly on the father's financial ability rather than on objectively measured child needs. The study recommends measurable child maintenance guidelines based on age, education, healthcare, living costs, and verified parental income.

Abstract

This study aims to examine the position, role, and impact of community organizations (organisasi kemasyarakatan or ormas) in overseeing presidential power from the perspective of Islamic leadership. The issues addressed include the legal standing of ormas within the system of presidential oversight, the various roles they perform in monitoring government policies, and the effects of such oversight on governance. This research employs a normative legal research method using statutory, conceptual, historical, and comparative approaches. The data were collected through library research consisting of primary, secondary, and tertiary legal materials and were analyzed using a descriptive qualitative method. The findings reveal that ormas occupy a strong position as elements of civil society that possess both legal and moral legitimacy to supervise presidential authority. Their functions are carried out through social control, the articulation of public aspirations, public policy advocacy, political education, and efforts to strengthen constitutional accountability. From the perspective of Islamic leadership, such oversight is grounded in the principles of amanah (trustworthiness), justice, consultation (shura), and amar ma'ruf nahi munkar (enjoining good and forbidding evil). The impact of this oversight is reflected in increased transparency, accountability, and the overall quality of governance, while also serving as a mechanism to prevent the abuse of power. Therefore, the oversight conducted by ormas functions not only as an instrument of democracy but also as an embodiment of Islamic leadership values in promoting a just, trustworthy, and welfare-oriented government.

Abstract

Human Rights (HAM) are fundamental rights inherent in every human being from birth and guaranteed by national law and religious principles. In the context of Indonesia, where the majority of the population is Muslim, studying the relationship between Islamic law and human rights is crucial to understanding the intersection between the two. Islamic law places human dignity as a primary value through the principle of al-ḍarūriyyāt al-khamsah, which means safeguarding religion, life, intellect, lineage, and property. This principle aligns with the objectives of human rights, which emphasize the protection and respect of human dignity. Through the concept of Maqāṣid al-Syarī'ah, Islamic law aims to realize public welfare and prevent harm, thus making a real contribution to the implementation of human rights, both in social life and in the national legal system. In Indonesia, the influence of Islamic law is evident in the formation of legislation that aligns with the divine values of Pancasila. This demonstrates that Islamic law can serve as a moral and ethical basis for strengthening human rights, thereby creating a just and harmonious society. Abstract

This study discusses the problems of the shura principle in the governmental system in Indonesia. The principle of shura as a concept of deliberation in Islam has relevance to the democratic system implemented in Indonesia, particularly in decision-making processes that prioritize public participation. However, the implementation of the shura principle in governmental practices still faces various challenges, such as the dominance of political interests, oligarchic practices, weak representation of public aspirations, and the lack of orientation toward public welfare. This study aims to analyze the existence, implementation, and impact of the application of the shura principle in the Indonesian governmental system. The research method used is normative legal research with conceptual and statutory approaches. Data sources were obtained from the Qur’an, hadiths, legislation, as well as literature and scientific journals related to siyasah syar’iyyah and the Indonesian governmental system. The results show that the principle of shura has substantially been reflected in the Indonesian democratic mechanism, especially through representative deliberation and public participation. Nevertheless, its implementation has not run optimally due to the interests of political elites, corruption practices, and weak ethical values in governance. This condition has resulted in declining public trust in the government and the failure to establish a just government oriented toward public welfare. Therefore, strengthening the values of shura in the governmental system is necessary through increasing transparency, accountability, and public participation in policy-making processes.

Abstract

The modern era brings new complexities to the world of justice, thus facing new challenges that tend to be positivistic. In this case, substantive justice prioritizes the content and value of truth over the procedures of legal texts. This study aims to analyze and identify challenges in its implementation in the modern era. The form of substantive justice in this study is understood as the judge's effort to penetrate the rigidity of legal texts in order to achieve material truth and real benefits. Using normative legal research methods, the results show that the implementation of substantive justice faces significant challenges in the form of the dominance of judicial bureaucratic standardization, as well as limitations in the integrity and courage of judges' ijtihad. In the digital and globalized era, these challenges are further complicated by the emergence of new disputes that have not been explicitly accommodated in formal regulations. This study concludes that strengthening the intellectual and moral capacity of judges, as well as reorienting legal education beyond text-based to values-based, are key to ensuring that the judiciary produces decisions not only with legal certainty but also decisions that foster a sense of justice in society and protect rights, thus becoming solutions for justice and the benefit of the people.

Abstract

Pokok masalah penelitian ini adalah kekerasan dalam rumah tangga yang menyebabkan cerai gugat di Pengadilan Agama Sungguminasa. Penelitian ini menggunakan metode kualitatif, dengan mengambil data lapangan (Field Research) melalui penelusuran fakta-fakta di lapangan, dilakukan dengan pendekatan teologi normatif syar’i dan pendekatan yuridis empiris. Sumber data penelitian ini adalah wawancara Hakim, Panitera, dan Pihak. Metode pengumpulan data yaitu observasi, wawancara, dan dokumentasi. Teknik pengelohan dan analisis data yaitu reduksi data, penyajian data, editing data, analisis data dan penarikan kesimpulan/verifikasi. Pengujian keabsahan data yaitu perpanjangan pengamatan, meningkatkan ketekunan, triangulasi dan menggunakan bahan referensi. Hasil penelitian ini menunjukkan bahwa, cerai gugat akibat kekerasan dalam rumah tangga yang diadili di Pengadilan Agama Sungguminasa selama 3 (tiga) tahun terakhir masih menunjukkan angka yang cukup banyak, hal ini menunjukkan bahwa masih sering terjadi kekerasan dalam rumah tangga. 1) Bentuk-bentuk kekerasan dalam rumah tangga yang mengakibatkan cerai gugat di Pengadilan Agama Sungguminasa yaitu kekerasan fisik, psikis, seksual dan penelantaran. Faktor-faktor yang mengakibatkan terjadi kekerasan dalam tangga yaitu perbedaan prinsip, masalah ekonomi, judi, mabuk dan perselingkuhan diantara salah satu pihak, sehingga dampak yang terjadi yaitu rasa trauma namun juga ada rasa lega dan bahagia karena telah telepas dari perbuatan kekerasan dalam rumah tangga yang dialami selama perkawinan. 2) Hakim dalam memberikan pertimbangan putusan terhadap kasus cerai gugat akibat kekerasan dalam rumah tangga di Pengadilan Agama Sungguminasa berdasarkan peraturan Perundang-Undangan, Kompilasi Hukum Islam, serta dari sisi kemaslahatan dan mudharat. 3) Perkara cerai gugat akibat kekerasan dalam rumah tangga perspektif maslahah mursalah termasuk maslahah dharuriyah karena mengancam jiwa dan keturunan.

Abstract

Menjadi Penyuluh Agama Islam merupakan pilihan profesi yang sangat membanggakan. Disebabkan karena selain memenuhi kewajiban agama untuk mengajak pada kebaikan dan melarang dari kemungkaran atau sering diistilahkan amar makruf nahi mungkar, juga untuk memenuhi tugas kedinasan sebagai Pegawai Kementerian Agama yang diberi tugas dan wewenang penuh untuk melaksanakan bimbingan dan penyuluhan agama serta konsultasi dan pembangunan dengan bahasa agama di tengah-tengah masyarakat. Sehingga dapat disimpulkan bahwa jabatan sebagai Penyuluh Agama Islam ini merupakan penghargaan dari pemerintah kepada tokoh-tokoh agama dengan harapan mereka dapat berperanserta mensukseskan program-program pemerintah dalam pembangunan di bidang agama. Dengan demikian, keberadaan Penyuluh Agama Islam di tengah-tengah masyarakat ini sangat signifikan dan diperlukan. Penyuluh Agama Islam menjadi inspirator, motivator, stabilisator, dan dinamisator pembangunan di tengah-tengah masyarakat dengan bahasa agama Islam. Hal ini disebabkan karena pembangunan nasional bangsa Indonesia bukan hanya dimensi fisik-material, tetapi harus diimbangi juga dengan pembangunan mental-spritual. Sebagaimana dengan lagu kebangsaan Indonesia Raya disebutkan “Bangunlah jiwanya bangunlah badannya untuk Indonesiaa Raya”. Dalam lagu ini terdapat bahasa bangunlah jiwanya di sinilah pentingnya peran dan fungsi Penyuluh Agama Islam untuk membangun jiwa spiritual masyarakat Indonesia yang agamis danmoderat. Peran dan fungsi Penyuluh Agama Islam untuk membangun jiwa keagamaan masyarakat yang moderat sangat dibutuhkan. Karena ancaman bangsa Indonesia sekarang ini adalah maraknya paham-paham keagamaan yang radikal dan liberal yang dapat memecah-belah umat Islam bahkan akan menghancurkan suatu bangsa.

Abstract

Arab Saudi merupakan negara yang menganut sistem pemerintahan monarki absolut atau kerajaan mutlak. Sebuah bentuk pemerintahan dengan kekuasaan tertinggi di tangan satu orang raja. Meskipun negara ini menganut monarki absolut, namun saudi juga memiliki lembaga-lembaga yang biasanya ada di negara republik. Lembaga tersebut adalah eksekutif, legislatif dan yudikatif. Satu hal yang menjadi pembeda dengan lembaga-lembaga yang ada pada negara republik adalah bahwa lembaga di Arab Saudi tidak memiliki fungsi independensi. Dalam satu dekade terkahir ini, gerakan Arab Spring massif dilakukan oleh masyarakat dibeberapa negara Arab yang merupakan bentuk protes terhadap rezim yang melanggengkan praktik otoriter dalam menjalankan pemerintahan. Protes mereka yang menginginkan peningkatan demokrasi den kebebasan berpendapat di negara-negara arab. Penelitian ini dilakukan untuk mengetahui bagaimana sistem demokrasi dapat diterapkan di negara Arab Saudi. dari hasil penelitian ini dapat dikemukakan bahwa evolusi sistem pemerintahan arab dari monarki absolut menuju demokrasi dapat diakukan. Mengingat bahwa salah satu prinsip demokrasi adalah musyawarah yang juga dianjurkan dalam islam. menemukan bahwa di negara Arab Saudi dapat diterapkan sistem demokrasi. adapun saran akademik bahwa diperlukan penelitian-penelitian selanjutnya untuk mengkaji lebih jauh terkait sistem demokrasi di negara Arab Saudi.
