Abstract

The purpose of this research is to look at how the rights and obligations of husband and wife are applied in the kinship system in Indonesia from the perspective of positive law. This research will also evaluate the extent to which positive law can ensure this equality and find obstacles that hinder it. The research in this article uses normative legal research methodology, it aims to find legal rules, principles, and theories to solve legal problems. The research approach of this article uses a statutory approach. The results show that in forming a fair and harmonious family, couples must have equal rights and obligations. Gender equality in the family sphere can be achieved with a strong commitment from the community, government, and law enforcement agencies. This will greatly benefit all Indonesian people. As a country that is rich in diversity and has various kinship systems such as patrilineal, matrilineal, and parental, the implementation of equal rights and obligations between married couples is what is aimed for in positive law. While each system has its own characteristics, the goal of Indonesian law is to ensure that both husbands and wives can lead equal and fair lives. This is part of a larger effort to create a society that respects and protects the rights of everyone regardless of gender, but it also shows how important it is for the understanding between adat and positive law to achieve the goal of equal rights and obligations between spouses by understanding and applying the principle in various contexts. The implications of this show that equal rights and obligations of husband and wife in the kinship system in Indonesia need an important role from the community, government, and law enforcers in harmony between adat and positive law

Abstract

The legal status of children's validity raises conflicts between das sein and das sollen, especially about religious values, children's interests, and legal developments in Indonesia and Malaysia. This research aims to analyze and compare the Decision of the Constitutional Court of the Republic of Indonesia No. 46/PUU-VIII/2010 and the Decision of the Rayuan Sivil Court of Malaysia No. W-01 (A) - 365-09/2016 regarding the legal status of children out of wedlock so that similarities and differences can be identified in terms of legal substance, legal considerations, and legal implications for the protection of the rights of children out of wedlock in Indonesia and Malaysia. The method used in this research is normative legal research with a comparative legal approach. The result of this research is that the validity of the status of children out of wedlock is legally recognized in Indonesia and Malaysia.  The Decision of the Constitutional Court of the Republic of Indonesia No.46/PUU-VIII/2010 explains that children out of wedlock have a civil relationship not only with their mother and mother's family but also with the man who is the father, provided that the relationship can be proven through science and technology or other evidence that is valid according to law. In Malaysia, based on the Rayuan Sivil Court Decision No W-01 (A) - 365-09/2016, children of Muslim couples born out of wedlock can now be attributed to their biological father. Although the two decisions have the same legal substance, the reasons underlying the birth of the two decisions are different. The Constitutional Court of the Republic of Indonesia made social justice, legal certainty, and protection of children's rights as citizens guaranteed by the constitution (UUD 1945) legal considerations. However, the Court of Civil Procedure is oriented towards administrative regulations based on the 1957 BDRA Deed Seksyen 13

Abstract

The scientific approach is a learning process that is designed in such a way, so that in the learning process students can actively participate. There are five stages in the scientific approach, namely observing, asking questions, gathering information, processing information, and communicating. This study uses qualitative research with direct and indirect field observations in several private kindergartens in Keruak District. Data collection techniques in this study include observation, interviews and documentation. The results of this study indicate that (1) In observing activities, students are expected to be able to ask questions about information that has not been understood even though the language is quite limited due to language skills that are still limited. (2) Children can collect information from activities carried out by students as well as simple experiments with the guidance and direction of educators. (3) Students are stimulated to be able to think logically and systematically to obtain conclusions in the form of knowledge. (4) Students can communicate what students get from the observations they have made. (5) Scientific learning is able to stimulate children's creativity because children are more independent, confident, dare to have opinions, and have high curiosity.

Abstract

This study aims to determine the effectiveness of using the SAVI Learning Model (Somatic Auditory Visual) learning model for the critical thinking skills of class VI students at MI NW Bagik Nyala in the 2021/2022 Academic Year. Data collection techniques using observation techniques and tests in the form of essays. Observation data on the implementation of learning reached 75% for the experimental class with good criteria and test scores were in the range of 75.005 < K with a very critical thinking category. While the control class is 58.33% with fairly good criteria and test scores are in the range of scores 58.335 < K < 75.005 with the category of critical thinking. Hypothesis testing using the t test and obtained t count = 10.80 and t table 1.6788 with dk 48 and a significant level of 5% so that the null hypothesis is rejected and the alternative hypothesis is accepted. So it can be concluded that it can significantly increase the effectiveness of the SAVI Learning Model (Somatic Auditory Visual) learning model on students' critical thinking skills.

Abstract

The scientific approach strongly supports children's cognitive and language development. Children's cognitive development is very closely related to reason and thought so that growth in this area has a very wide range. There are various abilities of children in the cognitive field that must be developed, one of which is science. Science is knowledge that is systematically arranged which is obtained from a series of experiments and observations that can be tested further. Science is currently a very important thing to introduce to young children because science can invite children to think logically and critically. This study aims to find out how the relevance of the scientific approach to the concept of science in early childhood. This research is descriptive qualitative. The research results show that there is a very significant relevance between the scientific approach and the concept of early childhood science, with the scientific approach raising children's motivation to learn through play.

Abstract

This study aims to analyze the marketing strategy related to PT. Natobin Tobacco Internasional in marketing recon tobacco in competition with pure tobacco in cigarette factories in Indonesia. As well as to determine the supporting and inhibiting factors of the marketing strategy at PT. Natobin Tobacco International. This type of research is descriptive. The population in this study are company owners and employees at PT. Natobin Tobacco International, with the sampling technique using purposive sampling method. Data was collected by questionnaire and analyzed by SWOT. The results of the research show that the main factor that becomes the strength of PT. Natobin Tobacco International has a wide distribution network with a large number of 0.60. The main weakness of the company based on the calculation of the IFAS Matrix is related to the increase in production costs which can affect company profits with a score of 0.32. PT. Natobin Tobacco Internasional is a company that can expand its market overseas with a score of 0.57, while PT. Natobin Tobacco International is competition with other tobacco companies that will emerge in the future, for example, large companies have started to get involved in tobacco, with a score of 0.33. The right alternative strategy to be implemented by PT. Natobin Tobacco International is a strategy of product differentiation and brand strengthening can help companies maintain market share and increase competitive advantage. Abstract

This article aims to present a digital visualization of the new moon (hilal) as a determinant of the beginning and end of Ramadan fasting, exploring the astronomical phenomenon of hilal visibility during the Prophet Muhammad's era using the Digistar 6 system in a planetarium. Several Islamic jurisprudence (fiqh) literatures discuss comparisons of fasting durations during the Prophet's time, ranging between 29 and 30 days. This study employs a qualitative research method based on library research, utilizing an astronomical approach and simulation observations in a planetarium. The data used include historical and astronomical data from the Prophet Muhammad's era, as well as related classical literature. The findings of the study include the integration of Digistar 6 technology with computational data to reconstruct the hilal phenomena of the Prophet’s time. For instance, the elevation of the hilal marking the beginning of Syawal in 8 AH was observed at a minimum Moon Altitude of 02°06’22” above the horizon, with an elongation of 04°55’56” and an atmospheric clarity of 9.52%. The Prophet Muhammad observed Ramadan fasting nine times, with six instances involving 29 days of fasting and the remaining three involving 30 days, as determined through simulated physical imagery of the hilal.

Abstract

Wawasan kebangsaan merupakan hal yang sangat penting untuk diketahui oleh generasi muda saat ini. Wawasan kebangsaan merupakan salah satu penyebab tumbuh dan terbentuknya karakter bangsa generasi muda. Generasi muda saat ini cenderung lebih mengenal tokoh film dibandingkan tokoh nasional. Fenomena ini menunjukkan bahwa kepekaan generasi muda terhadap budaya bangsa semakin melemah. Masalah ini harus diatasi dengan menghadirkan materi wawasan kebangsaan, juga identik dengan nilai patriotisme. Salah satu mata pelajaran yang dapat menanamkan pendidikan karakter adalah mata pelajaran ilmu sosial (IPS) dengan kompetensi esensial salah satunya adalah tokoh kepahlawanan. Tokoh heroik dihadirkan sebagai paket tematik tentang pahlawanku di kelas IV SD yang cenderung terlihat kurang menarik bagi siswa. Oleh karena itu perlu dibuat dengan kemasan yang lebih menarik berupa aplikasi berbasis android untuk membangkitkan minat belajar siswa. Metode pembangunan perangkat lunak yang digunakan adalah metode waterfall. Perancangan perangkat lunak menggunakan desain sistem model UML (Unified Modelling Language), meliputi Use Case Diagram, Activity Diagram, dan Sequence Diagram. Aplikasi yang menampilkan objek 2D bergerak dan informasi singkat tentang pahlamawanku ini dapat menjadi media pembelajaran yang interaktif dan mengasyikkan bagi siswa sekolah dasar. Memudahkan guru dalam menyampaikan informasi tentang tokoh kepahlawanan. Hasil pengujian UAT (User Acceptance Test) untuk pengguna menghasilkan persentase skor sebesar 94,7%. Perhitungan dengan skala Likert menunjukkan bahwa responden menyatakan sangat setuju menggunakan aplikasi ini.

Abstract

The relationship between science and religion in the practice of Islamic law (fiqh) is dilemmatic. On the one hand, science is in harmony with religion, and the two are mutually exclusive on the other hand. This article includes the last category by presenting evidence from two cases of Qibla direction calibration in Indonesia. The author focuses on the disagreement between fiqh and scientific results on the calibration of the Qibla direction at the Great Mosque of Demak and Baiturrahman Mosque in Semarang, Indonesia. Using literature research and content analysis, the author finds that fiqh’s rejection of science lies in the intersection of fiqh with Sufistic elements and the reality of social establishment. In the Qibla’s case direction at the Great Mosque of Demak, they believe that Sunan Kalijaga determined the direction of the Qibla in the mosque, and the mosque has a switched historic value. In contrast to the case of the Qibla direction at the Baiturahman Mosque in Semarang, which has no historical value and the Qibla direction was previously determined using a simple tool, they reasoned that changing the prayer lines in the mosque could cause discomfort and lack of stability for the congregation when carrying out prayer rituals. Thus, a scientific integration approach is needed in handling the gap between science and religion in religious practice in Indonesia.

Abstract

The relationship between state law and religion (Islamic law) is still problematic in its implementation. This problem occurs in practising divorce outside the court in Situbondo, Indonesia. Its case is interesting because it is still considered legal by the community and religious leaders according to religious law even though the divorce decision has not been received from the court. This legal phenomenon is contrary to positive law in Indonesia. This article aims to explain the practice of divorce outside the court in Situbondo and the authority problem between state law and Islamic law. After conducting intensive field research for three months with perpetrators of out-of-court divorce, religious leaders, and the Head of the Office of Religious Affairs, the authors found that the widespread practice of divorce outside the court was caused by the influence of religious leaders’ understanding and public understanding. This understanding becomes the doctrine that divorce in Islamic law is legal without having to await a divorce decision from the religious court. The authors stated that the dominance of the authority of Islamic law over state law in the practice of divorce in Muslim societies has negative implications for the rights of children and ex-wives.
