Abstract

Wawasan kebangsaan merupakan hal yang sangat penting untuk diketahui oleh generasi muda saat ini. Wawasan kebangsaan merupakan salah satu penyebab tumbuh dan terbentuknya karakter bangsa generasi muda. Generasi muda saat ini cenderung lebih mengenal tokoh film dibandingkan tokoh nasional. Fenomena ini menunjukkan bahwa kepekaan generasi muda terhadap budaya bangsa semakin melemah. Masalah ini harus diatasi dengan menghadirkan materi wawasan kebangsaan, juga identik dengan nilai patriotisme. Salah satu mata pelajaran yang dapat menanamkan pendidikan karakter adalah mata pelajaran ilmu sosial (IPS) dengan kompetensi esensial salah satunya adalah tokoh kepahlawanan. Tokoh heroik dihadirkan sebagai paket tematik tentang pahlawanku di kelas IV SD yang cenderung terlihat kurang menarik bagi siswa. Oleh karena itu perlu dibuat dengan kemasan yang lebih menarik berupa aplikasi berbasis android untuk membangkitkan minat belajar siswa. Metode pembangunan perangkat lunak yang digunakan adalah metode waterfall. Perancangan perangkat lunak menggunakan desain sistem model UML (Unified Modelling Language), meliputi Use Case Diagram, Activity Diagram, dan Sequence Diagram. Aplikasi yang menampilkan objek 2D bergerak dan informasi singkat tentang pahlamawanku ini dapat menjadi media pembelajaran yang interaktif dan mengasyikkan bagi siswa sekolah dasar. Memudahkan guru dalam menyampaikan informasi tentang tokoh kepahlawanan. Hasil pengujian UAT (User Acceptance Test) untuk pengguna menghasilkan persentase skor sebesar 94,7%. Perhitungan dengan skala Likert menunjukkan bahwa responden menyatakan sangat setuju menggunakan aplikasi ini.

Abstract

The relationship between science and religion in the practice of Islamic law (fiqh) is dilemmatic. On the one hand, science is in harmony with religion, and the two are mutually exclusive on the other hand. This article includes the last category by presenting evidence from two cases of Qibla direction calibration in Indonesia. The author focuses on the disagreement between fiqh and scientific results on the calibration of the Qibla direction at the Great Mosque of Demak and Baiturrahman Mosque in Semarang, Indonesia. Using literature research and content analysis, the author finds that fiqh’s rejection of science lies in the intersection of fiqh with Sufistic elements and the reality of social establishment. In the Qibla’s case direction at the Great Mosque of Demak, they believe that Sunan Kalijaga determined the direction of the Qibla in the mosque, and the mosque has a switched historic value. In contrast to the case of the Qibla direction at the Baiturahman Mosque in Semarang, which has no historical value and the Qibla direction was previously determined using a simple tool, they reasoned that changing the prayer lines in the mosque could cause discomfort and lack of stability for the congregation when carrying out prayer rituals. Thus, a scientific integration approach is needed in handling the gap between science and religion in religious practice in Indonesia.

Abstract

The relationship between state law and religion (Islamic law) is still problematic in its implementation. This problem occurs in practising divorce outside the court in Situbondo, Indonesia. Its case is interesting because it is still considered legal by the community and religious leaders according to religious law even though the divorce decision has not been received from the court. This legal phenomenon is contrary to positive law in Indonesia. This article aims to explain the practice of divorce outside the court in Situbondo and the authority problem between state law and Islamic law. After conducting intensive field research for three months with perpetrators of out-of-court divorce, religious leaders, and the Head of the Office of Religious Affairs, the authors found that the widespread practice of divorce outside the court was caused by the influence of religious leaders’ understanding and public understanding. This understanding becomes the doctrine that divorce in Islamic law is legal without having to await a divorce decision from the religious court. The authors stated that the dominance of the authority of Islamic law over state law in the practice of divorce in Muslim societies has negative implications for the rights of children and ex-wives.

Abstract

This article analyzes changes in the reference system of the Jewish Calendar. Initially, the Jewish Calendar reference was based on the movement of the Sun. However, the calendar system used by the Jewish community worldwide now refers to two celestial objects, the Sun and the Moon. This study is literature research with a qualitative approach and uses the Book of Enoch and the Sefer Yetzirah as primary sources. The authors found that the first reference system of the Jewish Calendar, which was based on the movement of the Sun (Solar), follows the description in the Book of Enoch and the Sefer Yetzirah. These two books explain the calendar system used by Prophet Idris to Prophet Moses. The Solar Calendar reference system was later replaced with the Lunar Calendar in the second century BCE. Six centuries later, the Jewish Calendar returned to using a Solar Calendar combined with the Lunar Calendar, known as the Lunisolar Calendar. The latest reference system is a mathematical calendar with the Metonic cycle that refers to the movement of the Sun and Moon. The authors argue that the influence of the Greek civilization and the adjustment of the difference between the Lunar and Solar Year caused the changes in the reference system of the Jewish Calendar.

Abstract

Interfaith marriage is one of the controversial legal issues in Indonesia. Islamic Law and Indonesian Positive Law regulate the conditions and pillars of marriage differently, especially concerning the legitimacy of marriage between adherents of different religions. This research aims to compare the provisions of Islamic Law and Indonesian Positive Law regarding the conditions and pillars of interfaith marriage in Indonesia. The two main variables of the research are the valid conditions of marriage and the pillars of marriage. Through a normative juridical approach and comparative law analysis, this research examines primary legal sources such as the Qur'an, Hadith, fiqh books, and legislation, as well as secondary data from literature studies and court decisions related to the issue. The research results show convergence and divergence in these two legal systems. Islamic Law is stricter in limiting interfaith marriage, especially for Muslim women. At the same time, Indonesian Positive Law provides more flexible interpretation through administrative mechanisms such as marriage registration and temporary religious conversion. This research highlights the importance of synergy between religious law and state law in addressing interfaith marriage issues in Indonesia, as well as the social and legal impacts arising from the differences in regulations. Thus, this research contributes to developing more comprehensive marriage regulations in Indonesia.   Keywords: Interfaith marriage, Islamic Law, Positive Law, marriage requirements, pillars of marriage.

Abstract

This research aims to design and develop an advanced monitoring system for solar cells, incorporating solar tracking technology and equipped with an energy storage protection system. In Indonesia, the substantial potential of solar energy remains underutilized, despite the country's advantageous equatorial location, which provides a solar radiation intensity averaging 4.5 kWh/m² per day. The proposed system in this study seeks to maximize solar energy capture by employing a tracking mechanism that aligns the solar cells with the direction of sunlight throughout the day. Additionally, the system is designed with an integrated protection feature to prevent battery overuse, thereby extending the battery's lifespan and ensuring efficient energy storage. The research utilizes an Arduino Uno microcontroller, Light Dependent Resistor (LDR) sensors, and an INA219 sensor module as the primary components for accurate measurement and real-time monitoring. The system's effectiveness is evaluated based on its ability to optimize solar energy reception and maintain the longevity and efficiency of the energy storage system. Experimental results demonstrate that the developed system significantly improves the efficiency of solar energy capture by the solar cells and provides robust protection for the energy storage mechanism. This study contributes to the field of renewable energy by offering a practical solution for enhancing solar energy utilization in regions with high solar irradiance, thus promoting sustainable energy practices and reducing dependence on non-renewable energy sources.

Abstract

Supreme Court Circular Letter (SEMA) No. 2 of 2023 contains the latest regulation on interfaith marriage. This study examines the legal position of SEMA No. 2 of 2023 from juridical, sociological, and philosophical perspectives. In addition, this study also analyzes the application of SEMA No. 2 of 2023 based on the principle of legal certainty according to Gustav Radbruch. This research uses normative legal research methods with statutory and conceptual approaches. Data collection was conducted through a documentation study. The results showed that SEMA No. 2 Year 2023 is juridically recognized and has binding legal force based on Article 8 paragraph (1) of Law 12/2011 and Article 79 of the Supreme Court Law. Sociologically, SEMA No. 2 Year 2023 is following the social reality in the community. Philosophically, establishing SEMA No. 2 Year 2023 aims to create legal unity and certainty. However, the implementation of SEMA No. 2 Year 2023 is considered not optimal because it does not fulfill all aspects of the principle of legal certainty according to Gustav Radbruch. The aspects of legal certainty that are fulfilled in SEMA No. 2 Year 2023 include laws formulated based on facts and clarity in formulation. Meanwhile, the positive law aspect has been partially fulfilled, but the legal stability aspect, which requires the law not to be easily changed, has not been fulfilled. This research is expected to contribute to legal development in Indonesia, especially regarding interfaith marriages.

Abstract

The role of marriage witnesses for deaf individuals has been a subject of debate among various Islamic schools of thought. The Compilation of Islamic Law (Kompilasi Hukum Islam or KHI), as Indonesia’s codified Islamic jurisprudence, adopts the view of scholars who prohibit deaf individuals from serving as marriage witnesses. This article critically examines the KHI’s stance, arguing that it marginalizes deaf individuals in the marriage process. This study employs a normative approach, utilizing Auda’s maqāṣid al-sharī‘ah concept. The findings reveal that the exclusion of deaf individuals as marriage witnesses stems from the KHI’s restrictive interpretation, which is rooted in classical fiqh. As a legal product influenced by Shafi’i jurisprudence, the KHI maintains the requirement that marriage witnesses must have both auditory and visual capabilities. However, through the principles of openness and purposefulness in Auda’s maqāṣid al-sharī‘ah, this study argues that hearing-impaired individuals possess the necessary qualifications to serve as marriage witnesses. In contemporary society, deaf individuals effectively communicate through various means, including sign language and assistive technologies. Therefore, a legal reinterpretation based on universal Islamic values—particularly those emphasizing equality and justice—is both necessary and justified. [Peran saksi pernikahan bagi individu tunarungu telah menjadi perdebatan di antara berbagai mazhab fikih. Kompilasi Hukum Islam (KHI) mengadopsi pandangan ulama yang melarang individu tunarungu menjadi saksi pernikahan. Artikel ini secara kritis meninjau pandangan KHI, dengan berargumen bahwa ketentuan tersebut (sengaja) meminggirkan individu tunarungu dalam proses pernikahan. Penelitian ini menggunakan pendekatan normatif dengan memanfaatkan kerangka maqāṣid al-sharī‘ah ala Auda. Temuan penelitian ini menunjukkan bahwa eksklusi terhadap individu tunarungu sebagai saksi pernikahan berasal dari interpretasi KHI yang terbatas, yang berakar pada doktrin fikih klasik. Sebagai produk hukum yang banyak dipengaruhi oleh mazhab Syafi’i, KHI menetapkan bahwa saksi pernikahan harus memiliki kemampuan mendengar dan melihat. Namun, melalui prinsip keterbukaan dan ‘kebertujuan’ dalam maqāṣid al-sharī‘ah Auda, penelitian ini berpendapat bahwa individu dengan gangguan pendengaran tetap memenuhi kualifikasi untuk menjadi saksi pernikahan. Dalam masyarakat kontemporer, individu tunarungu dapat berkomunikasi secara efektif melalui berbagai sarana, termasuk bahasa isyarat dan teknologi pembantu. Abstract

The authority of the religious courts in Indonesia in cases of domestic violence is limited to the civil sphere as grounds for divorce. Conversely, the District Court is responsible for resolving cases with criminal elements. This legal fragmentation prevents victims from obtaining comprehensive justice due to the lengthy and complex legal process. This research highlights the legal gap by analyzing the need for reconstruction of the absolute authority of the religious court to handle the criminal aspects of domestic violence cases. This research is a normative legal statutory and conceptual approach. Analysis of legal materials is done by qualitative methods. The results of this research are legal reconstruction offered in the form of expansion of the absolute competence of the religious court in handling the criminal aspects of domestic violence with the authority to provide protection orders to victims during the judicial process and impose criminal sanctions on perpetrators of domestic violence. The success of this reconstruction, based on the analysis of Soerjono Soekanto's theory of legal effectiveness, depends on harmonizing regulations, increasing law enforcement's competence, providing adequate facilities, increasing public legal literacy, and cultural transformation that supports justice and equality. This legal reconstruction contributes to the efficient resolution of domestic violence cases in line with the principles of judicial power, namely the achievement of simple, fast, and low-cost justice.

Abstract

This research is driven by the fact that in Islamic inheritance law and civil law there are quite a lot of differences. This study aims to find out how the law of inheritance of legal children out of wedlock between Islamic inheritance law and civil law. This research uses a qualitative approach with library research data collection techniques, namely using books, journals, papers, theses, articles, and literature related to related problems that aim to underlie the theoretical basis of writing this journal. The results of the conclusions in this study, it was found that the first factor in terms of the rate of distribution of heirs from extramarital children; Then the second factor is to discuss inheritance rights if the child out of wedlock dies; And the third factor in Article 873 of the Law, an out-of-wedlock child is entitled to inherit the entire inheritance if one of the blood relatives dies.
