Abstract

Indigenous land disputes in Indonesia reflect the complexity of the relationship between national and customary legal systems that have not been fully integrated in resolving ownership conflicts. This research employs a normative juridical method to analyze the characteristics of customary land law, legal protection, and unlawful acts in indigenous land disputes in Huta Lumban Gambiri. The research findings indicate that Batak Toba customary land law is communal-spiritual in nature with ownership based on patrilineal lineage through customary symbols such as the Hariara tree, yet faces challenges from legal system dualism. Supreme Court Decision No. 435 K/Pdt/2021 acknowledges the legitimacy of customary rights and historical evidence from Register De Kampoengs, but rejects compensation for the destruction of the Hariara tree, reflecting a lack of understanding of the concept of immaterial loss in customary law.

Abstract

Incidents of unlawful transfer of inheritance rights still frequently occur in Indonesian societal practices. Although the inheritance law system has clearly regulated the mechanism for the transfer of inherited assets, in reality there are still many cases where certain parties attempt to control inheritance through illegal means. The method used in this writing is a normative juridical research method. Analysis of Supreme Court Decision Number 464 K/Pdt/2020 shows that the Panel of Judges was correct in qualifying the unilateral transfer of inheritance land certificates as unlawful acts based on Article 1365 of the Civil Code, but the decision still has weaknesses in providing clarity regarding proportional inheritance distribution mechanisms between adopted children and wives, and does not deeply consider the characteristics of the disputed inheritance property.

Abstract

Child adoption serves as an alternative for couples who have not been blessed with children; however, it raises legal issues, paticularly regarding the inheritance rights of adopted children. Under civil law, adopted children are entiled to inheritance rights equivalent to those of biological children,in contrast, islamic law does not grant adopted children direct inheritance rights;instead, they may recive inheritance through a wasiat wajibah (mandatory will). This disrepancy creates legal uncertaintly in juridical practice, as reflected in the palangkaraya Distric Court Decision No. 27/Pdt.G/2019/PN.PLK. This study employs a normative legal research method with descriptive analytical approach and Comparative legal. The findings reveal that although adopted children do not have automatic inheritance rights under either legal system, islamic law provides protection through the wasiat wajibah mechanism (up to one-third of the estate), while civil law relies on will and grants.

Abstract

The negative tendency positive land registration publication system in Indonesia, although designed to provide legal certainty, can in practice be misused by irresponsible individuals for personal gain while ignoring the rights of legitimate heirs. This creates legal uncertainty and harms parties who should be protected by the land registration system. The method used in this research is normative juridical research method, which refers to legal norms. The legal implications of issuing property certificates without heir consent in the negative tendency positive land registration system can lead to prolonged legal disputes, uncertainty in land ownership status, financial losses for heirs whose rights are violated, and can harm third parties acting in good faith, as occurred in the Supreme Court Decision No. 1404 K/Pdt/2019 case which created legal uncertainty and cascading losses for various parties.

Abstract

Land ownership disputes between local governments and heirs become increasingly complex when involving land that originally came from a loan arrangement. The case of Lapangan Akso Dano in Supreme Court Decision No. 3580 K/Pdt/2023. The research problems include: first, the legal certainty of land possession status by the local government; second, the legal Construction for protecting regional assets originating from loaned land that has been physically possessed for an extended period; and third, the legal analysis of the judges’ considerations in Supreme Court Decision No. 3580 K/Pdt/2023 regarding land ownership disputes involving loaned land to the local government. This research employs a normative juridical method. The study reveals that legal certainty over land possession by local government is comprehensively regulated through a legal hierarchy from the 1945 Constitution to Government Regulation No. 24/1997, reinforced by customary law recognition of long-term physical possession.

Abstract

This study aims to analyze the judges’ legal considerations in granting child custody to a father who is a drug addict, as reflected in Decision No. 1039/Pdt.G/2023/PA.Lpk Jo No. 89/Pdt.G/2023/PTA.Mdn Jo No. 103K/Ag/2024. Using a normative juridical method with statutory and case approaches, the research focuses on examining the conformity between the Compilation of Islamic Law (KHI) and Law No. 35 of 2014 on Child Protection in relation to judicial reasoning in hadhanah (child custody) cases. The findings reveal that the Child Protection Law emphasizes legal safeguards for children, while the KHI provides detailed provisions on parental rights and responsibilities in child care. At the first level, the court granted custody to the father based on the mother’s busy work schedule, referring to Supreme Court Jurisprudence No. 110K/AG/2007. However, the appellate court ruled that such reasoning contradicted Article 105(a) of the KHI, which clearly stipulates that custody of children who are not yet mumayyiz belongs to the mother. The Supreme Court subsequently rejected the cassation appeal, affirming that the appellate decision was consistent with the law. This study underscores the importance of upholding the principle of the best interest of the child as the primary consideration in all custody determinations.

Abstract

Tradisi marosok merupakan praktik jual beli hewan ternak yang telah lama berkembang di kalangan masyarakat Minangkabau, termasuk di Nagari Campago Selatan Kabupaten Padang Pariaman. Ciri khas dari metode ini terletak pada proses tawar-menawar yang dilakukan secara tertutup dengan meraba tangan di balik kain, sehingga nilai transaksi hanya diketahui oleh penjual dan pembeli. Penelitian ini bertujuan untuk menganalisis praktik jual beli dengan metode marosok dari perspektif hukum Islam, serta menilai kesesuaiannya dengan rukun dan syarat sah akad jual beli dalam syariat. Metode penelitian yang digunakan adalah yuridis empiris dengan sifat deskriptif analitis, yaitu menggabungkan studi lapangan melalui wawancara dengan para pelaku marosok serta kajian normatif terhadap literatur hukum Islam. Hasil penelitian menunjukkan bahwa praktik marosok di Nagari Campago Selatan memenuhi unsur-unsur akad jual beli dalam Islam, antara lain adanya kerelaan dari kedua belah pihak (an-tarāḍin), objek yang diperjualbelikan jelas, serta tidak terdapat unsur penipuan, gharar, maupun keterpaksaan. Dengan demikian, jual beli hewan ternak menggunakan metode marosok dapat dikategorikan sah menurut hukum Islam. Di samping itu, keberadaan tradisi ini juga memperlihatkan peran kearifan lokal dalam memperkuat nilai-nilai syariat dalam kehidupan sosial-ekonomi masyarakat Minangkabau.

Abstract

Divorce is a complex problem in married life. Whatever problems occur in the household, whether in state law or religious law in force in Indonesia, divorce is the last way to solve them. Divorce can only be carried out before the court if the court fails to reconcile the two parties through mediation. Basically, civil servant divorce is the same as other communities, but the difference is that civil servants must first obtain permission from their superiors before carrying out the divorce. Civil servants must ask their superiors for permission through a hierarchical system, which takes a long time to get permission to divorce. If you look at these requirements for civil servants who are going to divorce, it is very difficult, but if divorce is the only way, then it is certain that the civil servant will receive sanctions. And in practice, permission from superiors as a requirement for civil servant divorce is difficult to issue from superiors who wish to divorce. So that in some cases the court gave divorce decisions to Civil Servants without a letter of permission from their superiors. Whereas in legal religious law in Indonesia, divorce can occur if the terms and conditions are met. This is the topic of the problem that the author wants to examine in this paper. What becomes the formulation of the problem is how is the superior's permission in civil servant divorce from the point of view of religious law? The legal research method used is normative juridical, namely a scientific research procedure to find the truth based on the scientific logic of law from a normative perspective. The approach used is a statutory approach related to the subject matter involved. If viewed from the point of view of religious law that is recognized in Indonesia (Islam and Non-Islam), divorce is indeed not recommended in the rules of religious law, but if circumstances demand this to happen then one must follow the rules and reasons determined by every legal religion in Indonesia. Because this concerns a person's right to determine a peaceful, secure and prosperous life. Through the research process above, it can be concluded that the decision in determining divorce is always given to the decision of each individual. Because freedom in determining life choices and being able to take responsibility for every risk of that choice. Every rule in the official religion in Indonesia considers divorce not a recommended action but if in reality divorce is the final solution, the rules in religion will not prevent it. This is the real basis for each individual, including State Civil Apparatus, in choosing a decision in their marriage, namely ending it in divorce. Permission from superiors is only an obstacle to solving problems in the household of an State Civil Apparatus. From this article, it is hoped that in the future, permission from superiors in the event of an State Civil Apparatusdivorce does not interfere in principled matters in the marital life of its employees, but is only administrative in nature. So that the goal of a peaceful and prosperous State Civil Apparatuslife can be carried out properly.

Abstract

This study aims to determine the scope of the element of deception in the cancellation of arbitration decisions after the Constitutional Court Decision No. 15/PUU-XII/2014. The type of research used in this study is normative legal research (normative juridical). The nature of the research is descriptive, which explains how to study problems in society, develop concepts, collect facts, but does not test hypotheses. The type of data used is secondary data in the form of legal materials. Legal materials are in the form of primary legal materials and secondary legal materials. Primary legal materials are authoritative legal materials. While secondary legal materials are in the form of all publications on law including textbooks, legal dictionaries, legal journals and comments on court decisions. By limiting the scope of the element of deception in the cancellation of arbitration decisions, it can provide justice for the disputing parties

Abstract

Penelitian ini mengkaji perlindungan hukum terhadap hak ulayat atas tanah Masyarakat Hukum Adat Batak Toba di Desa Simardangiang, Kecamatan Pahae Julu, Kabupaten Tapanuli Utara, dengan menggunakan metode penelitian yuridis empiris dan normatif yang menganalisis eksistensi masyarakat adat, eksistensi hak ulayat, serta peran pemerintah daerah dalam perlindungannya. Hasil penelitian menunjukkan bahwa Masyarakat Hukum Adat Batak Toba di Desa Simardangiang masih eksis sesuai kriteria Permendagri No. 52/2014, dengan sistem pemerintahan tradisional yang dipimpin raja huta, begitu pula dengan hak ulayat mereka yang memenuhi kriteria Permen ATR/BPN No. 18/2019, serta telah mendapat pengakuan dan perlindungan melalui Perda No. 04/2021 dan SK Bupati No. 457/2023, namun masih diperlukan penguatan kelembagaan dan sosialisasi untuk optimalisasi perlindungan hak ulayat tersebut.
