Abstract

Legal protection for landowners holding land title certificates is a fundamental aspect of Indonesia's land system, which is normatively guaranteed through Law concerning Basic Regulations and Government Regulation, The research method employed is normative juridical approach conducted through literature study to obtain secondary data. certificates function as strong evidence. However, in practice, legal uncertainty still exists due to various factors such as land disputes, overlapping certificates, and weak supervision systems in the land registration process. Analysis of Supreme Court Decision Number 309 PK/Pdt/2021 shows that the Panel of Judges reinforces legal protection for certificate holders who registered legitimately and in good faith by applying the principle of registration time priority, where the party who registers first has stronger rights. This decision also affirms the rejection of overlapping certificates containing legal defects to strengthen legal certainty in the land system.

Abstract

Certificates serve as valid proof of ownership under Indonesian law with the primary objective of providing legal certainty’. However, why is it that a land certificate must sometimes be annulled? Such situations may lead to ambiguity in legal implementation and result in a lack of legal certainty and protection for certificate holders. This study raises several legal issues: How is the application of the negative publication system with a positive tendency in land registration able to ensure legal certainty over the status of land certificates issued by the Land Office? How should the legal reasoning of judges in annulling Certificate of Ownership No. 212/Pasar Pangururan through Decision No. 35/G/2020/PTUNMDN be analyzed in relation to the value of justice? What are the legal responsibilities of the Head of the Land Office of Samosir Regency in issuing Certificate of Ownership No. 212/Pasar Pangururan to the aggrieved party?. This study is a normative juridical research employing a descriptive analytical approach. he findings indicate that the implementation of the negative publication system with a positive tendency in land registration has not yet maximally provided legal certainty regarding the status of ownership certificates issued by the Land Office, as such certificates can still be subject to legal challenge

Abstract

The legal force of covernotes made by notaries in the granting of credit by banks is an important topic because of their vital role in banking and property transactions in Indonesia. Covernotes have become a common practice to speed up the credit disbursement process before all legal documents are processed, even though they are not authentic deeds. The status of covernotes raises serious questions about their legal force, because they are not explicitly regulated in the Notary Law. Cases of misuse of covernotes that have resulted in major losses for banks and customers increasingly emphasize the urgency of clarifying the legal status and limitations of the use of this instrument. The formulation of the problem in this study is, namely what is the function and legal position of covernotes made in the process of granting credit by banks, what is the authority of notaries in making covernotes in the disbursement of credit at banks, and what are the legal consequences of covernotes by notaries in the process of granting credit by banks. The research method used is empirical juridical, combining normative legal analysis with field research. Literature studies were conducted to examine legal regulations and literature, while field research included interviews with Notary Yetty Rosliana Sembiring and banking parties, as well as observations at notary offices. The data were analyzed qualitatively to understand the legal force of covernotes in bank credit practices. Covernotes in the bank credit process function as temporary collateral and instruments to accelerate credit disbursement, although they do not have the same legal force as notarial deeds. The authority of a notary to make a covernote is not explicitly regulated in the UUJN, but can be linked to the general authority of a notary in Articles 15 and 16 of the UUJN. The legal consequences of making a covernote that does not correspond to the facts can be very serious, including potential financial losses for the bank, criminal and administrative sanctions for notaries, civil lawsuits, and broader impacts on public trust in the notary profession and the banking system. This shows the importance of the integrity and caution of notaries in making covernotes, as well as the need for clearer regulations to regulate this practice in order to protect the interests of all parties involved and maintain the stability of the legal and banking systems.

Abstract

Land plays an important role in life, both as a place to live, a source of livelihood, and an economic asset. The transfer of land rights is often the subject of legal disputes, one of which is through grants regulated in Article 1666 of the Civil Code, where grants are the transfer of goods free of charge. Although it has been clearly regulated, grants often cause legal problems, especially if there is forgery of the deed of grant by the PPAT. For example, Supreme Court Decision Number 895 K/PDT/2023 and Decision Number 2268 K/PDT/2017 which discuss land disputes due to forgery of deed of grant. The problems raised in this thesis are: the validity of the transfer of land rights through a deed of grant by the PPAT, the process of making a deed of grant by the PPAT, and an analysis of the judge's legal considerations regarding fake deed of grant in several court decisions. The research method used is normative juridical with a descriptive analytical approach. The data used is secondary data, including primary, secondary, and tertiary legal materials. Data collection was carried out through literature studies and interviews. The analysis was carried out qualitatively by drawing deductive conclusions to answer the research problems. The results of this study show that the Deed of Grant Number 400/2006 and Number 34/2003 are fake. As a consequence, the sale and purchase of land that occurred on the basis of the deed is invalid and has no legal force. In Supreme Court Decision Number 895 K / PDT / 2023 it was proven that the Deed of Grant Number 400/2006 was fake. Therefore, the Deed of Sale and Purchase of Land that occurred on the basis of the deed of grant is invalid and has no legal force. Thus, the sale and purchase act is null and void. In Supreme Court Decision Number 2268 K / PDT / 2017 it has been proven that the Deed of Grant Number 24/2003 is fake and that the transfer of rights is invalid, making the deed of sale and purchase of the object of the dispute also invalid and has no binding legal force. In addition, the Supreme Court stated that the resistance of the fugitives was unacceptable because the resistance was filed after the auction of the disputed object was completed. The Supreme Court considered that the legal efforts made by the fugitives were formally flawed, so the cassation was granted and the resistance was considered unacceptable.

Abstract

Abstract:This study discusses breach of contract (wanprestasi) committed by retailers toward distributors in the context of product sales transactions using a term of payment system. The breach, specifically related to delayed or unfulfilled payments by the retailer, results in operational and cash flow problems for the distributor. This research adopts a normative juridical approach, utilizing literature review and document analysis as data collection techniques. The analysis reveals that the legal relationship between the retailer and the distributor in sales transactions under a term of payment system arises from a sales agreement mutually agreed upon by both parties. Dispute resolution options available to the distributor include both litigation and non-litigation legal efforts. In practice, when a breach of contract is committed by the retailer, distributors tend to prefer non-litigation dispute resolution. This preference is due to the lack of legal certainty regarding specific sanctions against breaching retailers, as well as considerations related to company image and the high costs associated with litigation.  Keyword:Breach of Contract, Dispute Resolution, Distributor–Retailer Relationship,  Term of Payment  Abstrak: Penelitian ini membahas wanprestasi yang dilakukan oleh pengecer kepada distributor dalam transaksi jual beli produk dengan sistem term ofpayment. Wanprestasi terkait pembayaran yang dilakukan pengecer yang bermula dari transaksi term ofpayment, mengakibatkan terjadinya permasalahan kegiatan operasional cashflow distributor. Penelitian ini menggunakan pendekatan yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan dan dokumentasi. Hasil analisis menunjukkan bahwa hubungan hukum Pengecer dan Distributor dalam transaksi jual beli dengan sistem term ofpayment timbul dengan adanya perjanjian jual beli barang yang disepakati kedua belah pihak. Penyelesaian sengketa dapat diupayakan distributor yaitu dengan menempuh upaya hukum litigasi maupun non litigasi. Dalam kasus wanprestasi yang dilakukan oleh pengecer biasanya distributor lebih mengutamakan penyelesaian sengketa non litigasi. Hal ini disebabkan oleh tidak adanya kepastian hukum sanksi yang secara khusus bagi pengecer yang melakukan wanprestasi dan pertimbangan imej perusahaan serta biaya yang dibutuhkan untuk upaya hukum secara litigasi.  Kata kunci: Distributor, Pengecer, Perjanjian, Wanprestasi

Abstract

Pengasuhan anak di bawah umur (hadhanah) yang merupakan salah satu akibat dalam perceraian dalam Pasal 105 KHI menyatakan bahwa pemeliharaan anak yang belum mumayyiz atau yang belum berusia 12 (duabelas) tahun adalah hak ibu kandung. Adapun permasalahan penelitian ini yaitu: Bagaimana konsep pemberian hak asuh dalam perspektif Undang-Undang No. 35 tahun 2014 tentang Perlindungan Anak dan Kompilasi Hukum Islam? Bagaimana pertimbangan hukum hakim dalam memberikan hak asuh anak yang masih di bawah umur kepada ayah pecandu narkotika pada Putusan No. 1039/Pdt.G/2023/PA. Lpk Jo Putusan Nomor 89/Pdt.G/2023/PTA.Mdn Jo Putusan Mahkamah Agung No. 103K/Ag/2024)? dan bagaimana implikasi dari putusan hakim yang memberikan hak asuh anak di bawah umur kepada ayah pecandu narkotika? Berdasarkan hasil penelitian ditemukan bahwa konsep pemberian hak asuh dalam perspektif Undang-Undang 35 tahun 2014 tentang Perlindungan Anak fokus utamanya adalah terletak pada perlindungan hukum anak, sedangkan konsep pemberian hak asuh dalam perspektif KHI mengatur secara rinci tentang kekuasaan orang tua terhadap anak. Pertimbangan hukum hakim dalam memberikan hak asuh anak yang masih di bawah umur kepada ayah pecandu narkotika pada Putusan No. 1039/Pdt.G/2023/PA. Lpk didasarkan pada keterangan yang disampaikan oleh Tergugat dan keterangan saksi dari Tergugat yang menyatakan bahwa Penggugat seorang ibu yang bekerja dan sering bepergian keluar kota. Pertimbangan hukum hakim tersebut didasarkan juga kepada Yurisprudensi Mahkamah Agung Nomor 110K/AG/2007. Majelis hakim di tingkat banding berpendapat pertimbangan di tingkat pertama telah menyimpangi ketentuan normatif Pasal 105 huruf a KHI. Pada Putusan Mahkamah Agung No. 103K/Ag/2024, majelis hakim menolak Kasasi yang diajukan oleh Tergugat, dengan pertimbangan bahwa putusan majelis hakim dalam tingkat banding tidak bertentangan dengan hukum.

Abstract

Although customary land rights are still recognized by the Basic Agrarian Law, in practice many land offices process such land through granting rights over state land, as occurred in Pargarutan Jae, Sialagundi, and Muara Tais Villages where this normative juridical research using descriptive qualitative methods shows that unregistered community land is categorized as state land by the South Tapanuli Regency Land Office, resulting in land rights transfer being conducted through the PHGR mechanism despite the fact that it should be processed through sale and purchase deeds and rights conversion in accordance with applicable legal provisions. The Land Office plays a role in conducting land registration through the PTSL program and socialization to provide legal certainty, but still faces obstacles of low public understanding about procedures and benefits of land certificates, thus requiring harmonization between statutory provisions and field practices so that customary land rights status remains recognized and can be registered through rights conversion mechanisms, as well as strengthening collaboration with village officials and expanding socialization to eliminate negative public perceptions regarding land registration.

Abstract

The marriage ceremony of the Karo tribe is a sacred ritual that must be performed before couples can participate in other traditional ceremonies, with an exogamy system that requires marriage outside the clan (berimpal marriage) but creates complexity in terms of inheritance distribution and property arrangements. This empirical juridical research in Padang Mas Village, Kabanjahe District, Karo Regency analyzes the inheritance distribution mechanism in berimpal marriages and legal protection for heirs through literature study and interviews with descriptive analysis. The research findings show that the Karo inheritance system is patriarchal in nature, granting exclusive rights to male children according to traditional customs, however its legal protection depends on local government recognition and the Karo customary system does not have positive legal force as evidenced by the Supreme Court decision that recognizes the inheritance rights of female children, while inheritance dispute resolution can be conducted through two approaches namely civil law that guarantees legal certainty and kinship system that prioritizes social harmony and maintenance of kinship relationships.

Abstract

Unregistered marriages create legal uncertainty for Indonesian society, particularly regarding marital status and civil rights. This research analyzes the legal consequences of itsbat nikah (marriage validation) decisions on unregistered marriages in Aceh Singkil Regency using descriptive analytical methods and empirical juridical approaches. The research findings indicate that unregistered marriages are caused by local cultural factors, economic conditions, geographical factors, and weak administrative roles. The itsbat nikah process at Mahkamah Syar'iyah Singkil follows Religious Court Law provisions, resulting in declaratory decisions that provide legal basis for registration at KUA (Office of Religious Affairs), state administrative recognition, and civil rights guarantees, although the status of children born before itsbat requires separate determination. The research recommends improving marriage registration socialization, inter-institutional coordination, and public awareness to avoid legal problems.

Abstract

Abstract Child adoption is a practice that has long been carried out by Indonesian society, generally by married couples who do not yet have children, and is implemented in accordance with customs and laws and regulations. This normative legal research with descriptive analytical nature examines the legal system of child adoption, court validation, and the legal consequences arising using statutory, conceptual, and case approaches with qualitative analysis. The research results show fundamental differences between customary legal systems that sever blood relations between adopted children and biological parents, Islamic law and Law No. 35 of 2014 which do not sever such lineage relations. Child adoption requirements are regulated in Government Regulation No. 54 of 2007 and Social Affairs Minister Regulation No. 110/HUK/2009, where applications are submitted through social institutions then to the court to obtain a court decree if the specified requirements are met. The legal consequences of child adoption through court decisions show that adoptive parents only replace the role of biological parents in caring for, educating, and nurturing without severing blood relations, so that according to the Compilation of Islamic Law (KHI), adopted children are not included as heirs of adoptive parents but are entitled to obligatory bequests according to Article 209 paragraph (2), adoptive parents cannot become marriage guardians for adopted daughters and are not entitled to inherit from each other but may obtain obligatory bequests based on Article 209 paragraph (1), while adopted children still have blood relations with their biological parents and are entitled to inherit from each other according to the provisions of Articles 176-193 KHI.
