Abstract

Abstract: This research is based on the fact that interfaith marriages are not strictly regulated in Law No. 1 of 1974 concerning Marriage. This results in a legal vacuum. With the phenomenon of interfaith marriages in Indonesia, the government accommodates interfaith marriages through Law Number 23 of 2006 concerning Population Administration as a solution to fill this legal vacuum. Article 35 letter a states that marriage registration also applies to marriages determined by the court, namely marriages between people of different religions. This type of normative juridical research is supported by the results of interviews with sources, the research approach uses a statutory approach and a case approach to interfaith marriages which have become court decisions and have permanent legal force. The results of this research show that from an Islamic religious perspective, interfaith marriages are absolutely and absolutely prohibited, from a Christian religious perspective, interfaith marriages are prohibited in its teachings. From the Catholic perspective, interfaith marriages are an obstacle, interfaith marriages are possible with a dispensation, whereas in Buddhism there is no prohibition on interfaith marriages. Keywords: Development, Validity, Interfaith Marriage Abstrak: Penelitian ini di latar belakangi dengan tidak diaturnya perkawinan beda agama secara tegas dalam Undang-Undang No 1 tahun 1974 Tentang Perkawinan. Sehingga mengakibatkan adanya kekosongan hukum. Dengan adanya fenomena perkawinan beda agama di Indonesia pemerintah mengakomodir perkawinan beda agama melalui Undang-Undang Nomor 23 tahun 2006 tentang Administrasi Kependudukan sebagai solusi untuk mengisi kekosongan hukum tersebut. Dalam pasal 35 huruf a menyebutkan bahwa pencatatan perkawinan berlaku pula bagi perkawinan yang ditetapkan oleh pengadilan adalah perkawinan yang dilakukan antar umat yang berbeda agama. Jenis penelitian yuridis normatif dengan di dukung hasil wawancara dengan narasumber, pendekatan penelitian menggunakan pendekatan perundang-undangan dan pedekatan kasus terhadap perkawinan beda agama yang telah menjadi penetapan pengadilan dan telah berkekuatan hukum tetap. Hasil dari penelitian ini menunjukkan bahwa dalam perpektif agama Islam perkawinan beda agama dilarang dan mutlak, perpektif agama Kristen perkawinan beda agama dilarang dalam ajaranya. Perpektif agama Katolik perkawinan beda agama adalah suatu halangan, perkawinan beda agama dimungkinkan dengan adanya dispensasi, sedangkan dalam agama Buddha tidak ada larangan mengenai perkawinan beda agama.   Kata kunci: Perkembangan, Keabsahan, Perkawinan Beda Agama

Abstract

This study examines the legal considerations of the judges in resolving trademark disputes between Hongyunhonghe Tobacco (Group) Co. Ltd and PT Sumatra Tobacco Trading Company. The focus lies on the Supreme Court decision Number 76 K/Pdt.Sus-HKI/2024, which serves as a significant precedent in intellectual property rights law in Indonesia. The research aims to evaluate the legal protection provided for registered trademarks and analyze the dispute resolution mechanisms implemented in Indonesia, including the rationale behind the Supreme Court's decision. Using a normative legal research method, this study investigates primary and secondary legal sources to draw conclusions. The findings highlight that the proper registration and active use of trademarks are crucial in asserting ownership and protecting market rights. Furthermore, the court's decision reflects a strict application of the Trademark Law (Law Number 20 of 2016), emphasizing fairness for genuine trademark holders. This research contributes to understanding how trademark disputes are handled and offers insights into strengthening legal frameworks for trademark protection in Indonesia.

Abstract

Geographical indication is a sign that indicates the origin of goods and/or products that, due to geographical factors including natural factors, human factors, or a combination of both, impart specific reputation, quality, and characteristics to the goods and/or products produced. Terasi is one of the leading products in Langsa City that supports the local economy, but it has not yet been registered as a geographical indication, despite its potential to be recognized as such due to its distinct characteristics compared to other terasi products, thus warranting legal protection.This research uses an empirical juridical approach, with data sourced from primary, secondary, and tertiary legal materials. Data collection techniques include library research and field research, involving interviews and document studies. The data analysis used is qualitative analysis.The results of the research show that terasi meets the criteria for being classified as a geographical indication product under the Trademark and Geographical Indication Law, to receive legal protection once it is registered with the Directorate General of Intellectual Property. Given its unique characteristics, terasi is distinct from other terasi products. Efforts by local authorities to encourage the development of legal protection for geographical indications for terasi in Langsa City include coordination with local officials to plan socialization activities aimed at educating the community, especially terasi producers, on the importance of registering terasi as a geographical indication. Obstacles to providing legal protection include suboptimal roles by local government, a lack of understanding and awareness among the community about the importance of geographical indication protection, and the absence of community organizations that protect geographical indications.

Abstract

Abstract: The Indonesian legal system pays special attention to the protection of orphans' rights in the context of guardianship and inheritance rights through various legal instruments such as the Marriage Law, the Compilation of Islamic Law, and the Child Protection Law. This normative legal research examines three main issues, namely the legal provisions on the revocation of guardianship and transfer of guardianship, the judge's legal considerations in Decision Number 57/Pdt.G/2024/PA.Pspk, and the legal implications of the decision on the protection of orphans' inheritance rights, using a statutory approach and a case approach. The results of the study indicate that the Indonesian legal framework has comprehensively regulated the revocation and transfer of guardianship, where judges use multiple perspectives in considering the transfer of guardianship from the biological father to the grandmother based on the negligence of the guardian, the ability of the substitute guardian, and the best interests of the child in the management of inheritance and Taspen, which has implications in the form of legal legitimacy for the grandmother as the new guardian, the obligation to record the child's assets, and a monitoring mechanism by the court, so that it is necessary to harmonize regulations, develop more detailed substitute guardian eligibility assessment standards, and establish a monitoring system for the management of children's inheritance. Keyword: Guardianship, Revocation and Transfer of Guardian, Inheritance Abstrak: Sistem hukum Indonesia memberikan perhatian khusus terhadap perlindungan hak-hak anak yatim dalam konteks perwalian dan hak waris melalui berbagai instrumen hukum seperti UU Perkawinan, Kompilasi Hukum Islam, dan UU Perlindungan Anak. Penelitian hukum normatif ini mengkaji tiga permasalahan utama yaitu ketentuan hukum tentang pencabutan kekuasaan wali dan pengalihan perwalian, pertimbangan yuridis hakim dalam Putusan Nomor 57/Pdt.G/2024/PA.Pspk, serta implikasi hukum putusan tersebut terhadap perlindungan hak waris anak yatim, dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa kerangka hukum Indonesia telah mengatur secara komprehensif mengenai pencabutan dan pengalihan perwalian, dimana hakim menggunakan multi-perspektif dalam mempertimbangkan pengalihan perwalian dari ayah kandung kepada nenek berdasarkan kelalaian wali, kemampuan wali pengganti, dan kepentingan terbaik anak dalam pengelolaan harta warisan dan Taspen, yang membawa implikasi berupa legitimasi hukum bagi nenek sebagai wali baru, kewajiban pembukuan harta anak, dan mekanisme pengawasan oleh pengadilan, sehingga diperlukan harmonisasi peraturan, pengembangan standar penilaian kelayakan wali pengganti yang lebih rinci, serta pembentukan sistem monitoring pengelolaan harta waris anak. Kata kunci: Perwalian, Pencabutan dan Pengalihan Wali, Waris

Abstract

This research examines the issue of banks refusing to disburse joint deposits by analyzing Medan District Court Decision Number 201/Pdt.G/2018/PN Mdn through a normative juridical approach. The main findings indicate that the absence of explicit regulations in legislation regarding banking authority in disbursing joint deposits causes banks to implement varied internal policies. In the case studied, the bank refused disbursement due to incomplete requirements and unclear legal relationship between the plaintiff and the deceased customer, although heirs should legally receive protection as consumers of banking services. This research highlights the importance of clearer regulations to protect customer interests in banking transactions

Abstract

The industrial revolution in the era of globalization greatly influenced the authority and practice of notary in the future and became an interesting issue. Developments in technology (information) are the result of human intellectual works that have brought extraordinary change in human lifestyle. The purpose of this research to determine the impact of globalization regarding the authority of a notary and the responsibilities of a notary and the ideal authority in developing and completing the authority and services of a notary in the era of the industrial revolution 4.0. Notaries play a role in carrying out some of the public functions of the state in the field of civil law which carry out legal services to people/public who have responsibilities regarding authentic evidence in the form of letters, deeds or documents made in writing for various legal actions, agreements and stipulations law or other authorities based on the will and requests of the parties. The research method used is normative juridical by reviewing and analyzing legal materials in the form of notary regulations using library research. The results of this study are that currently notaries in Indonesia are still bound by Indonesian Notary Act namely Undang Undang Jabatan Notaris(shorten UUJN) which is no longer fulfill with the needs of the development of globalization. The authority of notary services and practices as a result of the impact of globalization is a challenge and opportunity for the development and improvement of the future of the profession and position of a notary with the support of information technology which must be regulated by the state through amendments to UUJN.

Abstract

This research examines the vital role of customary land for the Ende Lio indigenous community in Ende Regency, East Nusa Tenggara as a cultural identity and source of livelihood passed down through generations, yet facing challenges in the form of land tenure disputes by external parties as seen in the Supreme Court Decision Number 241 K/Pdt/2020. Using normative juridical research methods with descriptive characteristics and qualitative analysis through literature study, the research finds that legal regulations regarding customary land tenure in Indonesia are based on the 1945 Constitution Article 18B paragraph (2), Basic Agrarian Law Article 3, and ATR/BPN Ministerial Regulation No. 14/2024. The Ende Lio traditional leader (Mosalaki) holds multidimensional responsibilities and authority over Tana Nggoro, encompassing spiritual, legal, social, and ecological aspects as the highest guardian of ancestral land. Analysis of the Supreme Court Decision demonstrates prioritization of recognition and protection of Tana Nggoro land belonging to the Ende Lio indigenous community by affirming that the disputed object constitutes ancestral heritage land of the Plaintiffs as Mosalaki, and declaring that land possession by external parties without legal title and without approval from authorized customary leaders constitutes an unlawful act.

Abstract

In the Indonesian legal system, debt agreements that transform into ownership transfers can create serious legal problems, particularly regarding potential document forgery crimes. Generally, this issue arises when creditors unilaterally create transfer deed documents for debt collateral objects without valid consent from debtors, especially when done through public officials such as PPAT (Land Deed Making Officer) in the form of Sale and Purchase Deeds. Based on this normative legal research which analyzes various aspects ranging from the formulation of document forgery crimes in the Criminal Code, the relationship between creating land sale and purchase deeds with forgery crimes, to judicial considerations in concrete cases, it was found that perpetrators of sale and purchase deed forgery can be sentenced to a maximum of 8 years imprisonment, and to prove the existence of forgery in deed creation requires strong evidence in court proceedings, as seen in Decision No. 10/Pid.B/2019/PN.Lbj which was ultimately declared time-barred due to exceeding the prosecution time limit

Abstract

Indonesia is not a religious country but Indonesia is also not a secular country, Indonesia does not make any religion the basis of the state, but all activities and behavior of Indonesian citizens cannot be related to religious matters. As this is supported by the first principle, namely "Belief in One Almighty God", this means that even though Indonesia is not a religious country, all behavioral norms of Indonesian citizens must not conflict with the norms of God. The polemic about interfaith marriages has been going on for a long time. Apart from the fact that there is a feeling of love between men and women, it is also because society in Indonesia is heterogeneous. Article 10 paragraph (2) of the Human Rights Law states that a valid marriage can only be carried out with the free will of both parties. This article contains the principle of the free will of the partner in the marriage bond. The meaning of free will is a will that is born on the basis of sincere, holy intentions without any coercion, deception or pressure. The Human Rights Law only looks at the civil aspect that there is no element of religion that takes precedence in a valid marriage bond. Article 28B paragraph (1) of the 1945 Constitution states "Everyone has the right to form a family and continue their offspring through legal marriage". Interfaith marriages carried out secretly are still valid according to those who carry them out, but as long as they live in Indonesia the marriage must be registered so that it is recognized by the state. On the other hand, how can interfaith marriages be considered valid when there are several religions that prohibit it, such as Islam, Protestant Christianity, etc. The presence of Law Number 1 of 1974 concerning Marriage cannot yet be convincing as a prohibition on Indonesian people wishing to carry out interfaith marriages, even though it is quite clear that Article 2 paragraph (1) states that "Marriage is valid if it is carried out according to the laws of each religion and belief. That". Then the Constitutional Court required that people who wanted to carry out interfaith marriages must ask permission from their respective religious leaders, so that the presence of religious leaders here greatly influences whether or not the interfaith marriage is valid. Not only that, some time ago, on July 17 2023, the Supreme Court issued SEMA Number 2 of 2023 concerning Instructions for Judges in Adjudicating Applications for Registration of Marriages Between People of Different Religions and Beliefs. The issuance of SEMA Number 2 of 2023 has a fundamental spirit to provide certainty and unity in the application of the law, so that there are no more loopholes for Indonesian people who wish to carry out interfaith marriages in Indonesia.

Abstract

Various phenomena have emerged at the level of the practice of resolving Unlawful Acts and Defaults cases through litigation in court which have also attracted attention for research. Most studies discuss the merging and separation of Unlawful Acts and Defaults lawsuits in court. However, research that tries to criticize and offer a new concept of the rules on Unlawful Acts and Defaults in order to realize legal reform that provides certainty has not been widely carried out. This study will discuss how the concept of Unlawful Acts and Defaults in positive law in Indonesia, how to qualify it, and what are the weaknesses of the current rules. The study adopts normative legal research, also known as doctrinal legal research, supplemented by interviews with Judges from the Medan District Court and Advocates, using interview guidelines as a data collection tool. The results of the study indicate that the concept of rules in qualifying Unlawful Acts and Defaults in Indonesia is currently considered unable to realize legal certainty. Therefore, it is necessary to update the Civil Law regarding the rules for qualifying Unlawful Acts and Defaults in Indonesia which can create legal certainty.
