Abstract

The deed of statement and deed of power of attorney made by a notary must be based on the principle of fairness. The principle of fairness emphasizes that every activity of the government or state administration must pay attention to the values that apply in society, whether related to religion, morals, customs, or other values. This is intended so that the making of the deed does not conflict with religion, morals, customs, or other values that apply in society. The next problem is regarding the rights of children to the joint property. This paper discussed the deed of Statement and Power of Attorney No. 33 dated July 27, 1998 made before Defendant II and its derivatives each dated July 27, 1998 canceled by the court, what is the civil liability of the Notary for the deed of statement and deed of power of attorney 0p-=that was canceled by the Court and what are the consequences of further legal actions based on the Deed of Statement and Power of Attorney that was canceled by the Court in the Supreme Court Decision Number 188 K/Pdt/2013 Jo. Number 443 PK/Pdt/2015. The method used is normative juridical legal research, namely: used to provide an overview that law is written regulations in the form of statutes. The reason why the Deed of Statement and Power of Attorney No. 33 dated July 27, 1998 made before Defendant II and its derivatives each dated July 27, 1998 was canceled by the court in connection with the evidence is because the Deed of Statement and Power of Attorney which has been proven with the theory of positive evidence exceeds the rights and interests of Defendant I, even the Plaintiff feels that Defendant II also has an interest, because the actions of Defendant II above are not in good faith.

Abstract

The problem of inheritance distribution is one of the issues that often causes disputes in society, especially when it is related to assets that still have burdens or ties to other parties. One form of complexity in inheritance distribution occurs when the object of inheritance still has the status of debt collateral. This research is a normative legal research supported by interview data, descriptive nature of analysis using a legislative approach and a conceptual approach. The methodology of this research relies on secondary data. Data collection is done through library research, while data analysis uses qualitative methods. This decision has a significant impact as a new jurisprudence that changes the previous paradigm from rejection of the lawsuit (NO) to the concept of inheritance distribution that can still be implemented by paying attention to the protection of the rights of heirs and creditors, thus creating a new standard in religious court practice for handling similar cases in the future.

Abstract

Geographical indication is a sign that indicates the origin of goods and/or products that, due to geographical factors including natural factors, human factors, or a combination of both, impart specific reputation, quality, and characteristics to the goods and/or products produced. Terasi is one of the leading products in Langsa City that supports the local economy, but it has not yet been registered as a geographical indication, despite its potential to be recognized as such due to its distinct characteristics compared to other terasi products, thus warranting legal protection. This research uses an empirical juridical approach, with data sourced from primary, secondary, and tertiary legal materials. Data collection techniques include library research and field research, involving interviews and document studies. The data analysis used is qualitative analysis. The results of the research show that terasi meets the criteria for being classified as a geographical indication product under the Trademark and Geographical Indication Law, to receive legal protection once it is registered with the Directorate General of Intellectual Property. Given its unique characteristics, terasi is distinct from other terasi products. Efforts by local authorities to encourage the development of legal protection for geographical indications for terasi in Langsa City include coordination with local officials to plan socialization activities aimed at educating the community, especially terasi producers, on the importance of registering terasi as a geographical indication. Obstacles to providing legal protection include suboptimal roles by local government, a lack of understanding and awareness among the community about the importance of geographical indication protection, and the absence of community organizations that protect geographical indications.

Abstract

The main purpose of this study is to analyze and examine the position and aspects of legal protection for instrumental witnesses in making a notarial deed. In giving his testimony at trial on a deed made by a Notary, the witness has an obligation to provide information with actual facts, if a witness submits false information, he can be punished according to the Criminal Procedure Code. The role of the instrumental witness is currently not getting enough attention from law enforcement even though an instrumental witness plays a major role in revealing a problem that arises as a result of legal actions from a Notary act. The Regional Board of the Indonesian Notary Association of North Sumatera often hears about several problems regarding instrumental witnesses in the practice of notary positions. The method used in this research is normative juridical. The nature of the research used in this research is descriptive analysis by describing the problem systematically and comprehensively. The purpose of descriptive analytical research is to describe accurately the nature of an individual, a symptom, a situation or a particular group. The data collection method used in this writing is using library research methods. To further develop this research data, an analysis was carried out directly to the informants using interview guidelines that had been prepared in advance. Interviews were conducted with the Chairperson of the Regional Board of the Indonesian Notary Association of North Sumatera to obtain facts in the practice of Notaries in Medan City regarding instrumental witnesses. The position of the instrumental witness in the Notary act is certainly different from the position of the witness in general, who is a witness who has heard and/or witnessed an event that has occurred. The position of the instrumental witness as one of the formal requirements of a Notary act is stated in Article 38 paragraph (4) letter c of the UUJN, that at the end or closing the deed must contain the full name, place and date of birth, occupation, position, position and residence of each witness. In accordance with Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims, the legal protection provided for instrumental witnesses in making a Notary act in providing information is protected by the Witness and Victim Protection Agency (LPSK).

Abstract

Abstract: The Indonesian legal system pays special attention to the protection of orphans' rights in the context of guardianship and inheritance rights through various legal instruments such as the Marriage Law, the Compilation of Islamic Law, and the Child Protection Law. This normative legal research examines three main issues, namely the legal provisions on the revocation of guardianship and transfer of guardianship, the judge's legal considerations in Decision Number 57/Pdt.G/2024/PA.Pspk, and the legal implications of the decision on the protection of orphans' inheritance rights, using a statutory approach and a case approach. The results of the study indicate that the Indonesian legal framework has comprehensively regulated the revocation and transfer of guardianship, where judges use multiple perspectives in considering the transfer of guardianship from the biological father to the grandmother based on the negligence of the guardian, the ability of the substitute guardian, and the best interests of the child in the management of inheritance and Taspen, which has implications in the form of legal legitimacy for the grandmother as the new guardian, the obligation to record the child's assets, and a monitoring mechanism by the court, so that it is necessary to harmonize regulations, develop more detailed substitute guardian eligibility assessment standards, and establish a monitoring system for the management of children's inheritance. Keyword: Guardianship, Revocation and Transfer of Guardian, Inheritance Abstrak: Sistem hukum Indonesia memberikan perhatian khusus terhadap perlindungan hak-hak anak yatim dalam konteks perwalian dan hak waris melalui berbagai instrumen hukum seperti UU Perkawinan, Kompilasi Hukum Islam, dan UU Perlindungan Anak.

Abstract

This research examines the issue of banks refusing to disburse joint deposits by analyzing Medan District Court Decision Number 201/Pdt.G/2018/PN Mdn through a normative juridical approach. The main findings indicate that the absence of explicit regulations in legislation regarding banking authority in disbursing joint deposits causes banks to implement varied internal policies. In the case studied, the bank refused disbursement due to incomplete requirements and unclear legal relationship between the plaintiff and the deceased customer, although heirs should legally receive protection as consumers of banking services. This research highlights the importance of clearer regulations to protect customer interests in banking transactions
