Abstract

ABSTRACT Marriage under Article 1 of Law No. 1 of 1974 concerning Marriage of the inner birth bond between a man and a woman as husband and wife in order to form a happy and eternal family or household based on the One Supreme Godhead. One of the causes of marriage breakup is due to divorce. Divorce is the breaking up of a legal marriage before a court Judge. The consequences of the breaking of marriage will cause various problems that is against the child, the status of husband and wife, and to marital property. Article 37 of Law No. 1 of 1974 concerning Marriage when marriage is terminated due to a divorce, joint property is regulated according to their respective laws (religious law, customary law and court rulings). Speaking of marriage, divorce, sharing of common property and death is inseparable from the religious rules and customary rules for indigenous Batak Toba people. The classification of the distribution of common property in Batak Toba community registered in Pematangsiantar District Court Year 2011-2016 there are two decisions. The formulation of the problem in the thesis research is how the division of joint property due to divorce under the Act No.1 of 1974 on Marriage and based on customary law of Batak Toba. How is the application of Law No.1 of 1974 about Marriage to Toba Batak custom law related with division of joint property because divorce. What is the legal judgment made by the Judge of the decisions on the distribution of joint property due to a divorce in the Pematangsiantar District Court. The type of research in preparing the thesis is an empirical or sociological juridical research method. The nature of the thesis research is descriptive analytical. The results of the study when using the Law No. 1 of 1974 on Marriage regulate in Article 37 stating that if marriage is terminated due to divorce, property is regulated according to their respective laws (religious law, customary law, court decision). The division of joint property is then valued in amounts to be divided in half to the parties, referring to Article 128 of the Civil Code. The establishment of Law No. 1 of 1974 on Marriage gives effect based on the application of Marriage Law which is based on husband and wife position in marriage with shared shared property. The basis of judges' consideration is based on Articles 35, 36 and 37 of Law No. 1 of 1974 concerning Marriage of joint property shall act in agreement of both parties. Suggested in the distribution of common property for indigenous Toba Batak people in case of prior dispute with non litigation or custom lane. If it can not resolve it customarily then it can pass through litigation lane in State Pengadlilan in order to obtain equal distribution.   Keywords: Marriage, Divorce, Division of Joint Property, Judge's Decision, Customary Law of Batak Toba.

Abstract

ABSTRACT The issuance of Perda Medan No. 6/2003 on the Prohibition of Bums, Beggars and Prostitution in Medan consisting of 7 articles is related to legal studies made and is aimed at realizing Medan to be Bestari city which is capable of handling prostitution in Medan. Prostitution is contradictory to religious and moral norms in the society in Medan. The number of prostitutes in Medan is still very high. Prostitutes are easily found at road sides of Medan from early evening until dawn. The policy made by Medan Municipality to overcome practice of prostitutes in Medan since 2003 is that it has issued a Perda (Regional Government Regulation). Medan Municipality coordinates with Social Agency of Medan and Polisi Pamong Praja (Civil Servant Police) Unit. The prostitutes caught in the raids are sent to Rehabilitation Center of Parawasa, Brastagi to implement the policy. The obstacles encountered by Medan Municipality to overcome prostitution in Medan consist of many factors such as the essence of the Perda. Other obstacles are contributed by the law enforcers whose work is not yet optimal; the law enforcement is influenced by internal and external factors. Keywords: Handling, Perda, PSK (Prostitution)

Abstract

ABSTRACT Mandailing society using the system of kinship patrilineal people, who know and use the term clan groups. Clan name is in fact the forerunner of a group of relatives according to the lineage of the father. The implementation of customs and customary law in public life carried out based on the structure and Mandailing systems customary law called Dalihan Na Tolu. Mandailing society has a marriage exogami, therefore semarga under the terms of the marriage customs of the Mandailing is prohibited. The prohibition of marriage semarga is already washed out in the community due to the influx of Mandailing influence of Islamic law. Formulation of the problem in this research is how the provisions of the customs of the Mandailing about marriage semarga, how the implementation of semarga marriage in the village in Mandailing Manegen society, and whether the legal consequences over the violation of the prohibition of Mandailing society semarga marriage in the village of Manegen.This research is empirical juridical legal research with descriptive research analytical nature. Research location in the village of Padangsidimpuan Sub-district Manegen Southeast Padangsidimpuan Town with a population of 1,120 persons and a sample of 20 people doing marriage semarga. The data used the data of primary and secondary legal materials that consist of primary, secondary, and tertiary. Data collection tools and techniques performed with the study of librarianship and study the field by doing the interview. The data analysis done with the method of qualitative analysis. Abstract

Abstract. The authority of the Regency / City Government in organizing investments in the field of tourism, Article 27 paragraph (1) of the Investment Law states that the Government coordinates investment policies, both coordination between Government agencies, between Government agencies and Bank Indonesia, between Government agencies and regional governments, as well as between regional governments, with delegation of authority from the central government to local governments. The role of districts / cities in controlling investment activities in the tourism sector, namely monitoring compilation, namely verification and evaluation of the Investment Activity Report (LKPM) and various other sources. Guidance by means of counseling on investment rules. Guidance is also carried out by providing investment consultations and guidance in accordance with the licensing provisions owned by investors. Implementation of investment supervision in the field of tourism at the North Tapanuli District Tourism Office, so far the North Tapanuli District Government has carried out oversight of investments in accordance with applicable regulations, but there are still several obstacles, namely the unavailability of how many PMA and PMDN companies are categorized as the planning stage , the development phase, and the commercial stage, the coordination function is still weak because the planning preparation process has not involved the investment / technical institutions in the Regency / City. Abstract

Abstract. The problems of this thesis is whether the provisions of the consignment in the procurement of land for the construction of public interest in accordance with the care that is mentioned in the BW / Civil Code, why legally consignment justified in the procurement of land for development in the public interest, and whether care compensation (consignment) of the land used for construction of the public interest is in conformity with the principles of the agreement. This type of research used in this research is a kind of normative juridical research, descriptive analysis. The data analysis was conducted using qualitative analysis. The survey results revealed that the care for damages (consignment) in different land acquisition or do not fit as well as the shift in meaning with care as in the Civil Code, as consignment in land procurement relationship between the government and community objections regarding the huge amount of compensation given, whereas in the Civil Code to repay debt due receivables arising under a contract in an engagement relationship.   Keywords: Custody Compensation (Consignment), Land Procurement,  Public Interest.

Abstract

Abstract. The implementation of the autonomy of the village led to the needs of a large Fund for each village to manage the Government's village. The construction of the rural area is a mix of development between villages in one district/city in an effort to speed up and improve the quality of service, development and empowerment of village community in the rural area through approach participatory development. Based on background. such research will be analyzed inaugural village Fund, channelling procedure mechanism budget funds from the state budget to the village village and barriers in the system of organizing the village Fund with the object of research done in the County Langkat. The implementation of village funds consists of original village income, Regional Budget and Expenditures (APBD) and State Budget (APBN). The administration of village government affairs which become village authority is funded from the Village Budget (APBDesa), central government assistance, and regional government assistance. Obstacles in the Village Fund Delivery System include the Low Synchronization Between Village and District Level Planning, the amount of Village Fund Allocation (ADD) as a support for government administration operations is still limited, Lack of intensity of Village Fund Allocation (ADD) socialization to the community, Village Government claims difficulties to prepare an Accountability that is in accordance with the specified standards.   Keywords: village development, village fund, local government, state finance

ABSTRAK KEBERADAAN MASYARAKAT HUKUM ADAT DALAM KEGIATAN INVESTASI DI KAWASAN HUTAN ADAT TERKAIT DENGAN PUTUSAN MAHKAMAH KONSTITUSI NOMOR 35/PUU-X/2012 Natasha Siregar* Mahmul Siregar** Rosnidar Sembiring*** Masyarakat hukum adat merupakan elemen dari Negara Republik Indonesia yang memerlukan perhatian khusus dari pemerintah. Sebagai mahluk sosial, masyarakat hukum adat memerlukan sumber-sumber kehidupan. Hutan adat yang dekat dengan masyarakat hukum adat itu menjadi skala prioritas bagi mereka dalam mendapatkan kehidupan. Untuk mendapatkan sumber kehidupan itu dapat dilakukan dengan berbagai cara, salah satunya melalui investasi pada hutan adat. Ide Investasi ini memiliki bermacam-macam persoalan diantaranya, bagaimana eksistensi dari masyarakat hukum adat dalam melakukan tindakan hukum, bagaimana pengaturan kegiatan investasi yang berada diwilayah hutan, dan bagaimana bentuk dari wujud keterlibatan masyarakat hukum adat dalam investasi tersebut. Hal ini menjadi sangat krusial untuk dibahas sejalan dengan muculnya Putusan Mahkamah Konstitusi Nomor 35/PUU-X/2012 tentang pengujian materi Undang-Undang Kehutanan terhadap Undang-Undang Dasar.          Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif. Sumber data yang digunakan dalam penelitian adalah data sekunder yang terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Keseluruhan data tersebut dikumpulkan dengan menggunakan metode pengumpulan data studi kepustakaan. Kemudian dalam menganalisis data penelitian digunakan analisis normatif kualitatif, dimana data disusun secara sistematis dan selanjutnya dianalisis secara kualitatif hingga akhir hasilnya tertuang dalam bentuk skripsi ini. Pengakuan hukum terhadap masyarakat hukum adat serta hak-hak tradisionalnya telah dilaksanakan oleh negara yang masih memerlukan pengkonkritan hak-hak tradisional masyarakat hukum adat. Pengakuan itu bila dilihat dari sudut investasi pada kawasan hutan terdapat perbedaan-perbedaan yang memerlukan unifikasi untuk memudahkan pengguna peraturan. Abstract

Tujuan penelitian ini untuk menganalisis politik hukum terhadap pembangunan untuk kepentingan umum atas tanah abrasi pasca hadirnya undang-undang yang memuat peraturan tentang cipta kerja. Berbagai macam pendekatan seperti pendekatan peraturan perundang-undangan dan pendekatan konseptual menjadi instrument pada jenis penelitian yuridis normatif yang digunakan sebagai metode dalam penelitian ini. Penemuan dari hasil penelitian yang dilakukan bahwa telah ditambahkan kepentingan umum seperti halnya termaktub dalam pasal yang mengatur tentang pengadaan tanah sebanyak 6 (enam) kegiatan meliputi kawasan industri, ekonomi khusus, pariwisata, ketahanan pangan, industri gas, industri minyak, dan pengembangan teknologi. Hapusnya hak atas tanah karena tanah musnah bersamaan dengan pemberian kesempatan kepada pemegang kuasa atas tanah untuk perlu membangun kembali dan merevitalisasi atas pendayagunaan tanah dan diatur di dalamnya tentang pihak lain yang dapat melakukan rekonstruksi dan revitalisasi berdasarkan pemberian dana kerohiman pada kuasa atas tanah atau kuasa pendayagunaan. Adanya perubahan-perubahan tersebut diatas akan menjadi sebuah langkah lebih dekat demi terwujudnya keadilan, kesejahteraan dan kemakmuran dalam pemberian kompensasi terhadap tanah musnah. The purpose of this research is to analyze the legal politics of development in the public interest on abraded land after the presence of a law that contains regulations on work creation. Various approaches, such as the statutory and conceptual approach, become instruments for the type of normative juridical research that is used as a method in this research. The findings from the results of research conducted that public interest has been added as stated in the article that regulates land procurement as many as 6 (six) activities covering industrial areas, special economy, tourism, food security, gas industry, oil industry, and technology development. The abolition of land rights because the land is destroyed simultaneously with the opportunity for the holder of the power over the land to need to rebuild and revitalize the utilization of the land and it is regulated in it by other parties who can carry out reconstruction and revitalization based on the provision of spiritual funds to the power over land or the power of utilization. With the changes mentioned above, it is seen that it will be a step closer to the realization of justice, welfare, and prosperity in providing compensation for the destroyed land.

Abstract

In general, the implementation of the binding sale and purchase agreement is carried out using an authentic deed made before an authorized public official, namely a notary. The implementation of the sale and purchase binding agreement does not always run smoothly, sometimes there are factors that make the binding deed unable to continue and even cause the deed to be canceled. One of the factors that caused the sale and purchase agreement to be canceled was due to a default as can be seen in the decision of the Supreme Court Number: 1650 K/pdt/2015. The defendant did not pay the third stage of payment for the object of sale and purchase, as previously agreed in the deed of binding sale and purchase agreement. As a result, the judge canceled the PPJB Deed and the payment for stage one and stage two which had previously been paid by the defendant to the plaintiff then became the right of the plaintiff and could not be reclaimed.

Abstract

Law Number 6 of 2014 concerning villages is the legal basis for the distribution and management of village funds. In its development, village funds are prone to corrupt practices. The lack of understanding of the village apparatus and the absence of policy instruments that are the parameters of success are crucial obstacles in village development. Law enforcement based on the restorative, corrective and rehabilitative paradigm is an effort made by the North Sumatra High Court in handling the crime of corruption in village funds. In minimizing the occurrence of irregularities in the distribution and management of village funds in the North Sumatra Province, the formation of the P3TPK Task Force, TP4D, the AKUR Program (Ayo Kawal Uang Rakyat), and the "JAKSA JAGA DESA" Program as well as optimizing the handling of corruption using the Corruption Impact Assessment (CIA)
