Abstract

The Balinese traditional community adheres to a patrilineal kinship system, which is a kinship system that draws lineage from the father's side. However, it becomes a problem when a family only has daughters as successors, so they have to do a nyentana marriage with a man who agrees that his status will change to pradana when doing a nyentana marriage with a woman whose status is elevated to sentana rajeg. Similar to the Patrilineal system in general, in terms of inheritance, the customary law of the Balinese customary community stipulates that only boys are entitled to inherit and will cover the rights of girls as beneficiaries of their parents. Based on this, the problems raised in this thesis research are how the nyentana marriage system is in Balinese traditional society, how is the legal position of men who carry out nyentana marriages as heirs in Balinese customary inheritance law, how is the legal analysis of the judge's decision in the Supreme Court Decision Number 2991K /PDT.2015. This research is descriptive analytical with the approach used is normative juridical. The data collected is then processed and analyzed qualitatively, using an inductive method to draw a conclusion. The position of a man who performs a nyentana marriage with a woman sentana rajeg is that he must leave the kinship line of his biological father, so that all relations with his family of origin are cut off, including the rights that he originally obtained as an heir on the basis of the consideration that he is considered to have left his ancestors and obligations so that he only has the right to inherit with the wife's family and is responsible in the customary community where the wife's family comes from.

Abstract

Purchase Binding Agreement on housing is a preliminary agreement between a seller and a potential buyer as it is stipulated in Article 42, paragraph 1 of Law No. 1/2011 on Housing and Residence and in Kemenpera (the Decree of the Minister of Low-Cost Housing) No. 9/1995 which become the basis for PPJB as the preliminary agreement. Even though PPJB is consensual, it is made by paying attention to good faith principle as it is stipulated in Article 1338, paragraph 3 of the Civil Code. this thesis attempted to analyze the legal consequence of PPJB. The research used judicial normative (doctrinal) with descriptive analytic and explanatory method. The result of the research showed that the legal consequence of PPJB was binding for the parties concerned and the legal ground of PPJB was Law No. 1/2011 on Housing and Residence, Kemenpera No. 9/1995 on the Guidance for Purchase Contract, and Article 1338, paragraph 1 of the Civil Code.

Abstract

Based on a case study on the construction of the Semarang-Demak Toll Road, this study aims to investigate and investigate land acquisition for the public interest for land that has been destroyed as a result of natural events and its legal certainty. The research method used is socio-legal with primary data in identification, field measurements, and other supporting data. Semarang-Demak Toll Road property acquisition demonstrated tidal inundation on the north shore. Subsidence exacerbates Semarang's flooding. On flooded land, sea dikes and retention ponds prevent tidal floods. If just for transportation, the Semarang-Demak Toll Road can be built in flood-free areas or over the sea, like Bali's Mandra Toll Road. Land acquisition concerns delayed the Semarang-Demak Toll Road. Lack of land limitations has delayed land purchases. In the Semarang-Demak Toll Road land acquisition, destroyed land is not a problem under Indonesian law. 2021's Regulation 18 defines destroyed land. Destroyed land will drive people to take better care of their land and be more concerned about global warming or land subsidence. Abstract

Procurement of land and land acquisition for the construction of the Pekan Baru-Dumai toll road in Siak Regency, is implemented in accordance with Law No. 2 of 2012 concerning the procurement of land and land acquisition for the public interest, the Public Works and Public Housing (PUPR) of the Republic of Indonesia, The National Land Agency of Siak Regency, and the Land Procurement Committee (P2T) determine compensation for landowners who have been released without consultation (the party entitled). Suwitno Lumban Batu and his colleagues filed a lawsuit against the Law, so that the formulation of the problem of the legal phenomenon is: 1) How to procure land and land acquisition rights in Siak Regency? 2) How are the laws and regulations on land acquisition and the release of land rights for public benefit? 3) How judicial judgments of the Siak District Court have been in conformity with the legal norms and principles of civil procedure law on the Decision of Article Number 23 / Pdt.G / 2017 / PN. Sak This research is a legal research. Legal research is carried out to find solutions to legal issues that arise, namely to provide a prescription of what should be the issue based on civil case verdict number 23 / Pdt.G / 2017 / PN.Sak. The type of data used includes primary data and secondary data. Methods of data collection through case chronology and copy of the Decision and library research both books, legislation, papers, previous research results, documents, etc.. The results of this study indicate that the discussion of land acquisition is an activity to obtain land by providing compensation to those who release or surrender land, buildings, and objects related to land where legal arrangements regarding land acquisition for public interest in Indonesia have undergone a process developments since the unification of the Basic Agrarian Law Number 5 of 1960 and Law number 12 of 2012 concerning land acquisition and the release of land rights in the public interest. "Lawsuit Against Lawsuit" conducted by Suwitno and friends at the District Court of the Civil Code number23/Pdt.G/2017/PN.Sak, the judge was unacceptable (Niet Ontvankelijke Verklaard) The decision of the Siak District Court Judge is categorized as "legal record", because it is not in accordance with the norms and legal principles of civil procedure. The Judge of the Siak District Court included the Supreme Court Regulation Number 3 of 2016 as its legal consideration. Supreme Court Regulation number 3 of 2016 took effect on April 19, 2016, for cases of land rights damages that took place in October 2015. It means that the Supreme Court Regulation is not retroactive (non Retroactive). In this case the verdict of the Siak District Court was wrong in making legal considerations in deciding a lawsuit against the law in accordance with Article 1365 of the Civil Code.

Abstract

The occurrence of divorce cases in sebongi marriages that occurred in the people of Southeast Aceh, namely the marriage age was so short that it was even only one night. So this study is intended to examine related to the problem of factors causing divorce in overnight marriages, legal protection for husbands due to divorce in a sebongi marriage according to Law No. 1 of 1974 concerning Marriage and KHI. As well as the basis for the judge's consideration in granting the divorce permit.The results of this study show that there are 4 (four) factors for the occurrence of divorce in a sebongi marriage in southeast Aceh society, namely the factor that the wife is no longer a virgin before marriage, the factor that the wife does not want to be invited to have sex, the factor that the wife has the intention to divorce before marriage and the factor of the bride's reluctance to return to the husband's house after the custom of winning. legal protection for the husband is the loss of the husband's obligation to provide a living to the wife due to the Nusyuz wife either living still in marriage or living iddah when there has been a divorce as explained in article 80 paragraph (7) and article 152 of the KHI

Abstract

The stipulation of the age limit for marriage is one of the very important pillars in the legal protection of underage marriages. Underage marriage is a marriage or contract that can guarantee that a man and a woman have each other and can have husband and wife relations, and the marriage is carried out by someone (prospective husband/prospective wife) whose age has not yet reached the age determined by law. currently in force in Indonesia that has been determined by the government. UU no. 16 of 2019 amendments to Law No. 1 of 1974 concerning marriage Article 7, namely "Marriage is only permitted if a man and a woman have reached the age of 19 (Nineteen) years. The method use in this research is normative legal research. The issues discussed are about how the pluralism of the marriage age limit according to positive law and customary law, regarding how to implement Law No. 16 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage, regarding how legal protection is related to age. marriage in which the parties contain Law Number 16 of 2019 amendments to Law Number 1 of 1974 concerning Marriage and customary law.

Abstract

Proses perceraian bagi Pegawai Negeri Sipil pada dasarnya sama dengan perceraian mereka yang bukan Pegawai Negeri Sipil. Perbedaanya, Pegawai Negeri Sipil baik laki-laki maupun perempuan yang bertindak sebagai penggugat atau pemohon, terlebih dahulu harus mendapat izin dari pimpinan. Sementara bagi Pegawai Negeri Sipil baik laki-laki muapun perempuan yang melakukan perceraian dan berkedudukan sebagai tergugat wajib memberitahukan secara tertulis adanya gugatan dari suami atau istrinya kepada pimpinan untuk mendapat surat keterangan. Berdasarkan latar belakang masalah diatas, penelitian ini mengetengahkan dua permasalahan yaitu pertama, bagaimana pengaturan perceraian bagi Pegawai Negeri Sipil? Kedua, apakah akibat hukum perceraian Pegawai Negeri Sipil tanpa seizin pimpinan? Tujuan penelitian ini untuk mengetahui prosedur perceraian bagi Pegawai Negeri Sipil dan untuk mengetahui akibat hukum perceraian Pegawai Negeri yang tanpa seizin pimpinan. Metode penelitian hukum yang digunakan adalah yuridis normatif yaitu suatu prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya. Pendekatan yang digunakan adalah pendekatan perundang-undangan yang berhubungan dengan pokok permasalahan yang terkait dengan perceraian Pegawai Negeri Sipil tanpa seizin pimpinan. Bahan hukum dalam penulisan ini mengunakan bahan hukum primer dan bahan hukum sekunder. Dari hasil penelitian disimpulkan bahwa pengaturan perceraian bagi Pegawai Negeri Sipil terdapat dalam Peraturan Pemerintah No. 45 Tahun 1990 Tentang Perubahan atas Perceraian Pemerintah No. 10 Tahun 1983 Tentang Perkawinan dan Perceraian Bagi Pegawai Negeri Sipil dan harus mendapatkan ijin dari pimpinan secara tertulis.

Abstract

Abstract

Sengketa merupakan perbedaan nilai, kepentingan, pendapat, dan atau persepsi antara orang per orang atau badan hukum (privat atau publik). Sengketa dapat terjadi antar individu, antar individu dengan kelompok, dan antar kelompok dengan kelompok. Sengketa terjadi antara warga dengan PT Rapala, masyarakat mengklaim 144 hektar dari 1.069 hektar HGU milik PT rapala berada di tanah dan lahan HGU juga berada dalam wilayah administrasi desa. Jenis penelitian adalah penelitian hukum normatif. Sifat penelitian ini adalah deskriptif analitis dimana penelitian ini berupaya untuk memberikan argumentasi dari hasil penelitian yang telah dilakukan. Hasil penelitian disimpulkan bahwa status kepemilikan tanah akibat saling klaim antara masyarakat dan PT. Rapala. Konflik pertanahan antara PT Rapala dengan masyarakat Kampung Perkebunan Sungai Iyu. Pelepasan hak garapan yang diperoleh PT Rapala dari masyarakat dinyatakan sah karena telah memenuhi persyaratan administrasi. Rapala. Penyelesaian sengketa lahan yang sudah dilakukan oleh masyarakat dan pihak perusahaan PT Rapala, upaya penyelesaian yang dilakukan mulai dari melibatkan pihak BPN yang dimana pihak BPN sudah turun langsung dilokasi sengketa lahan, melalui PEMDA Aceh Tamiang dan DPRD Aceh Tamiang. Upaya Pemerintah Kabupaten Aceh Tamiang dalam menyelesaikan sengketa tanah antara masyarakat dan PT. Rapala. Untuk menyelesaikan konflik yang terjadi dimasyarakat dengan PT Rapala pemerintah Kabupaten Tamiang dengan menggunakan cara mediasi yaitu dengan membentuk tim terpadu/ mediator yang dibuat sesuai dengan peraturan Bupati Aceh Tamiang.
