Abstract

This study critically examines the ineffectiveness of environmental criminal law policies in protecting Aceh’s customary forests from ongoing destruction. Although Indonesia has established a comprehensive legal framework for environmental protection, deforestation within customary forest areas in Aceh persists, indicating weaknesses in policy implementation and enforcement. This research aims to analyze the structural and normative factors that render environmental criminal law policies ineffective, particularly the lack of integration between state law and Aceh’s customary law. Employing a qualitative socio-legal approach, this study draws on statutory analysis, literature review, in-depth interviews, and field observations within customary forest areas in Aceh. The findings reveal that weak intergovernmental coordination, limited recognition of indigenous forest rights, inadequate law enforcement capacity, and minimal utilization of monitoring technology contribute significantly to forest degradation. Furthermore, the disconnect between formal environmental criminal law and customary forest governance undermines community participation and legal effectiveness. This study argues that current policies remain “unwise” because they prioritize punitive approaches without incorporating customary law values and restorative ecological justice. As a policy solution, the study proposes an integrative framework that harmonizes environmental criminal law with Aceh’s customary law, supported by restorative sanctions and technology-based forest monitoring systems. Strengthening indigenous participation and aligning national regulations with local legal traditions are essential to enhancing legal effectiveness and sustainable forest governance. This research contributes to environmental legal scholarship by offering a contextualized model of pluralistic environmental criminal law reform in Indonesia.

Abstract

This study examines two central issues concerning coastal women in cases of marine environmental destruction in East Aceh: (1) how environmental criminal law normatively constructs women as perpetrators, and (2) how law enforcement can incorporate substantive and restorative justice principles. Using a normative juridical method supported by analysis of legislation and judicial practice, the research finds that although the Environmental Protection and Management Law formally requires proof of fault (mens rea) for individuals, its application often remains formalistic and result-oriented. The law does not adequately differentiate between primary actors and structurally vulnerable participants, leading to the disproportionate criminalization of coastal women. The study argues that achieving genuine environmental justice requires a contextual and gender-sensitive approach, including proportional assessment of culpability and the selective application of restorative justice mechanisms. Legal reform is therefore necessary to align environmental protection with substantive justice and gender equality principles in coastal communities.

Abstract

The quality of early childhood education in Ethiopia faces significant challenges, particularly related to teacher training, resource availability, and parental involvement. This study aims to explore the key challenges in the Ethiopian early childhood education system and assess their impacts on both teacher effectiveness and student learning outcomes. The research employed a mixed-methods approach, combining quantitative data from surveys with qualitative interviews. Twenty education officials were interviewed to gather in-depth insights, and 200 instructors from various regions participated in the survey. Exploring the requirement for teacher training, determining the availability of resources, comprehending teacher motivation, analyzing the connection between class size and learning quality, and exploring the influence of parental engagement are the study's five main goals. The findings show a severe lack of educational resources and inadequate teacher preparation in rural areas. Additionally, learning outcomes were found to be adversely affected by large class sizes, and student achievement was significantly correlated with parental participation. The results emphasize the necessity of focused measures to close these inequalities, including bettering teacher preparation programs, allocating more funds, lowering class sizes, and encouraging family involvement in education. Tackling these issues will help Ethiopia's early childhood education level rise and promote a more efficient and equitable educational system.

Abstract

This study aims to analyze the legal aspects of aggravated theft and the concept of criminal liability under Indonesian criminal law. Aggravated theft, as regulated in Article 363 of the Indonesian Criminal Code (KUHP), involves specific circumstances that increase the severity of the offense and consequently result in heavier punishment. The study examines the elements constituting aggravated theft, the factors considered in the determination of criminal responsibility, and the application of legal principles by courts in relevant cases. Using a normative juridical approach, the research employs a qualitative analysis of legislation, legal theories, and judicial decisions related to aggravated theft. The findings indicate that determining criminal liability in aggravated theft is not only based on the actus reus (the criminal act) but also on the mens rea (the criminal intent) of the offender. Furthermore, the study emphasizes the importance of proportional punishment to ensure fairness and justice in law enforcement. This research contributes to a deeper understanding of how Indonesian criminal law upholds justice in handling aggravated theft cases

Abstract

This study aims to analyze the legal protection provided to victims of sexual violence in human trafficking crimes (Tindak Pidana Perdagangan Orang or TPPO) within the Indonesian legal framework. Sexual violence as a form of exploitation in human trafficking represents a severe violation of human rights that undermines the dignity and safety of its victims. Using a normative juridical approach, this research focuses on the examination of legal instruments, including Law No. 21 of 2007 concerning the Eradication of the Crime of Human Trafficking, Law No. 12 of 2022 on the Crime of Sexual Violence, and related provisions in the Criminal Code (KUHP). The study highlights that legal protection for victims of sexual exploitation under TPPO encompasses preventive, repressive, and rehabilitative measures. However, implementation remains constrained by weak law enforcement, lack of coordination among institutions, and inadequate victim recovery mechanisms. Findings indicate that strengthening victim-centered legal frameworks, ensuring comprehensive rehabilitation, and improving access to justice are crucial to achieving substantive protection for victims. This research contributes to a better understanding of how Indonesia’s criminal law should evolve to provide holistic protection and justice for victims of sexual violence in human trafficking cases, aligning with international human rights standards.
