Abstract

The principle of proportionality is based on the principle of balance between the interests of the perpetrator, the victim and the state (on behalf of the society) in relation to the suitability between the crime that has been committed and the sanctions imposed as an important part of the criminal justice system. The purpose of this study is to analyse the existence of the principle of proportionality, from the perspective of positive law and maqasid sharia in the criminal justice system. The type of the present study is a normative juridical research with a statutory approach, a case study approach, and a comparative approach by using primary legal materials, secondary materials, and tertiary legal materials, with qualitative analysis. The results of the study reveal that the existence of the principle of proportionality from the perspective of positive law and maqasid sharia in the criminal justice system is essential, especially in the criminal justice system by considering the objectives of the imposed punishment and the guidelines for imposing such punishment. Therefore, synchronisation of the criminal justice system is needed, namely substantial synchronisation, structural synchronisation and cultural synchronisation to realise the objectives of the fair and just law, in addition to the benefits and certainty for the interests of the perpetrator, the victim, and the state. The principle of proportionality must be well configured in the Positive Law, especially Criminal Law, as contained in the values of Pancasila as the philosophy and way of life of the Indonesian nation, in addition to the ideals of Islamic Law in maqasid sharia which reflects the intent or purpose of law as the philosophy of Muslims for the benefit of the universe ( rahmatan lil 'alamin ) such as hifdz ad-din , hifdz an-nafs , hifdz al-aql , hifdz al-mal and hifdz an-nasl which serve as the symbiotic paradigms.Keywords: criminal justice, maqasid sharia, proportionality, synchronization. AbstrakAsas proporsionalitas yang mendasarkan pada prinsip keseimbangan antara kepentingan pelaku, korban dan negara (masyarakat) berkaitan  adanya kesesuaian antara pidana yang telah dilakukan dengan sanksi yang diterimanya adalah bagian penting dalam sistem peradilan pidana. Tujuan penelitian ini adalah menganalisis eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana. Jenis penelitiannya adalah yuridis normatif dengan statute approarch, case approarch, comparative approarch dan menggunakan bahan hukum primer, bahan sekunder, bahan hukum tertier, serta analisis kualitatif. Hasil studi mengungkapkan bahwa eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana sangat penting, khususnya dalam sistem pemidanaan dengan memperhatikan tujuan pemidanaan dan pedoman pemidanaan. Oleh sebab itu, diperlukan sinkronisasi sistem peradilan pidana yaitu sinkronisasi substansial, sinkronisasi struktural dan sinkronisasi kultural untuk mewujudkan tujuan hukum yang berkeadilan di samping kemanfaatan dan kepastian bagi kepentingan pelaku, korban, dan negara (masyarakat). Asas proporsionalitas tersebut harus terkonfigurasikan dengan baik dalam hukum positif terutama Hukum Pidana yang terkandung dalam nilai-nilai Pancasila sebagai falsafah dan way of life bangsa Indonesia, di samping cita Hukum Islam dalam maqasid al syariah yang memuat maksud atau tujuan hukum sebagai falsafah Umat Islam demi kemaslahatan bagi alam semesta (rahmatan lil ‘alamin) seperti hifdz ad-din, hifdz an-nafs, hifdz al-aql, hifdz al-mal dan hifdz an-nasl yang merupakan paradigma simbiotik.Kata Kunci: Asas Proporsionalitas, Maqasid Sharia, Sinkronisasi, Sistem Peradilan Pidana.

Abstract

This article examines the criminal provisions stipulated in Chapter IX, Article 45 of Government Regulation No. 9 of 1975, concerning the Implementation of Law No. 1 of 1974 on Marriage, using the three elements of Lawrence M. Friedman's legal system: Legal Substance, Legal Structure, and Legal Culture. The research method combines a literature review with descriptive normative legal research. This study identifies the high rate of unregistered marriages in Indonesia, which contrasts with the decline in official marriages, reflecting the ineffectiveness of Article 45 of Government Regulation No. 9 of 1975 in enforcing criminal sanctions. Analysis of the Lawrence Legal System reveals that the substance of the law is flawed because criminalization is regulated through derivative regulations, contrary to the principle of nullum crimen sine lege. Institutionally, the Office of Religious Affairs (KUA) and the Civil Registry Office need to strengthen their functions, supported by consistent law enforcement by professional officials. Meanwhile, the low public awareness of marriage registration requires inclusive policies that integrate cultural approaches and context-based education. These findings contribute theoretically to the development of understanding regarding the effectiveness of criminal law enforcement in the context of marriage law while also suggesting the need for more decisive and comprehensive policy reforms to improve the implementation of the law and public legal awareness in practice

Abstract

The development of tourism potential in Padang Serai Village has great potential to increase local community income and preserve the environment and culture. However, the development of tourism potential in Padang Serai Village is still not optimal. Therefore, it is necessary to conduct socialization of the development of tourism potential in Padang Serai Village through training and mentoring for the local community. The purpose of this service is to increase the awareness and ability of the local community in managing and developing tourism potential in Padang Serai Village. The method used in this service is training and mentoring for the local community. The results of this service show that the awareness and ability of the local community in managing and developing tourism potential in Padang Serai Village increased after training and mentoring. Therefore, this service can provide benefits to the local community and increase tourism potential in Padang Serai Village.

Abstract

Artikel ini mengkaji kesejahteraan emosional santri penghafal al-Qur'an di Pesantren An-Nuqthah Tangerang dan dampaknya dalam proses menghafal al-Qur'an. Menggunakan pendekatan kualitatif dengan metode studi kasus, riset ini melibatkan wawancara mendalam dan observasi terhadap tujuh santri berusia 12-15 tahun. Pengumpulan data dilakukan melalui wawancara semi-terstruktur, observasi partisipan, dan analisis dokumen. Data dianalisis menggunakan teknik analisis tematik dengan proses pengkoden dan kategorisasi untuk mengidentifikasi pola-pola utama. Hasil riset menunjukkan bahwa kesejahteraan emosional santri tercermin dalam kemampuan mereka mengenali dan mengelola emosi, memotivasi diri, berempati, dan menjalin hubungan sosial. Faktor-faktor yang mempengaruhi kesejahteraan emosional meliputi keseimbangan afek positif dan negatif, strategi koping, dan dukungan sosial. Kesejahteraan emosional yang baik berdampak positif pada efektivitas menghafal al-Qur'an, meningkatkan konsentrasi, ketahanan terhadap stres, dan kualitas hafalan. Riset ini menyimpulkan, kesejahteraan emosional menjadi fondasi kuat bagi santri dalam menghadapi tantangan proses menghafal al-Qur'an, mempengaruhi cara mereka belajar, dan merespons permasalahan yang muncul.

Abstract

Penelitian ini mengkaji secara kritis problematika pembelajaran bahasa Arab dalam pendidikan Islam di Indonesia dan menawarkan strategi revitalisasi yang transformatif. Meskipun bahasa Arab memiliki posisi teologis sebagai bahasa wahyu, implementasi pembelajarannya di madrasah masih menghadapi tantangan dalam hal penguasaan fungsional siswa. Studi ini mengidentifikasi empat isu utama: kesenjangan imersi antara pesantren dan madrasah, fosilisasi kesalahan linguistik, siklus demotivasi struktural, serta ketidaksesuaian kurikulum dan evaluasi. Untuk mengatasinya, direkomendasikan pergeseran paradigma menuju pendekatan komunikatif yang bermakna, integrasi teknologi sebagai lingkungan imersif virtual, dan penerapan model Content and Language Integrated Learning (CLIL). Strategi ini didukung oleh pendekatan triangulasi sinergis antara kebijakan pusat, inovasi kelembagaan, dan kolaborasi lintas jaringan. Dengan demikian, pembelajaran bahasa Arab berpotensi menjadi sarana pembangunan intelektual sekaligus instrumen diplomasi budaya dan ekonomi syariah Indonesia secara global. Kata Kunci: Bahasa Arab, Pendekatan Komunikatif, CLIL.

Abstract

Pariwisata alam Ngawi, khususnya Watu Jonggol, memiliki potensi besar namun mengalami penurunan akibat minimnya pengelolaan dan partisipasi masyarakat. Sementara destinasi lain mengalami peningkatan, Watu Jonggol justru terbengkalai. Pendekatan Asset-Based Community Development (ABCD) dinilai relevan untuk memulihkan destinasi melalui pemanfaatan aset lokal dan keterlibatan komunitas, sehingga keberlanjutan pariwisata berbasis potensi desa dapat tercapai secara partisipatif dan berdaya guna. Penelitian ini bertujuan merancang model revitalisasi Watu Jonggol berbasis pendekatan ABCD untuk mengoptimalkan aset lokal, meningkatkan partisipasi masyarakat, serta mendorong pertumbuhan ekonomi dan kunjungan wisata berkelanjutan.Kegiatan pengabdian ini menggunakan metode kualitatif deskriptif dengan pendekatan fenomenologis serta lima tahapan ABCD, yaitu inkulturasi, discovery, design, define, dan reflection. Data dikumpulkan melalui observasi, wawancara, dan diskusi kelompok terfokus (FGD). Hasil kegiatan menunjukkan bahwa pendekatan sosial melalui kunjungan rumah dan partisipasi warga membangun kepercayaan awal. Pemetaan aset dan masalah dilakukan dengan observasi dan wawancara. Sembilan aksi prioritas disepakati dan dilaksanakan secara gotong royong. Promosi digital dilakukan melalui pelatihan Karang Taruna dan pengelolaan media sosial. Evaluasi menunjukkan peningkatan kondisi fasilitas dan jangkauan daring. Forum refleksi menetapkan mekanisme pasca-program, memperkuat keberlanjutan. Model ini membuktikan efektivitas pendekatan partisipatif dan digital dalam merevitalisasi destinasi berbasis potensi lokal. Revitalisasi Watu Jonggol berhasil membangun kemandirian warga melalui pendekatan ABCD dan promosi digital berbasis media sosial.

Abstract

The objective of this research is to describe the types of expressive speech acts, the use of expressive speech act, and the effects of expressive speech in Coco’s Movie by Darla K. Anderson. This research employs descriptive qualitative research. The object of this research isCoco’smovie by Darla K. Anderson. The data are classified from kinds of expressive speech acts by Austin’s theory. The use of expressive speech acts by using Yule’s theory. Then, the effect of expressive speech act were categorized by using Herbert. The findings of research show that there are six types of expressive speech acts, they are;expressive for thank 2 data, expressive for apologize 4 data, expressive for congratulation 2 data, expressive for greeting 2 data, expressive for wishes 2 data, and expressive for attitudes 2 data. Expressive for apologize was mostly dominant used by all characters. The use of expressive speech acts consist of direct and indirect, there were 5 data in direct and 3 data in indirect and direct was mostly dominant used by all characters. There were three effects of expressive speech acts, they were 3 data for getting knowledge, 2 data for giving command, and 2 data for asking for information. Moreover, the dominant effect of expressive speech is for getting knowledge in Coco’s movie.

Abstract

Islamic Banks is a business entity that raises and distributes funds from the community and for the community. The study was conducted to analyze the macro variables and NPF (NonPerforming Finance) to ROA (Return on Assets) to determine the relationship between short-term and long-term between variables. The analysis model used is the Engle Granger ECM Stage Two test that uses secondary data from the serial data (time series). The results of this study indicate that NPF simultaneously, GDP, and interest rates affect the ROA. Partially GDP positive and significant effects in the long term and short term, NPF positive and significant effect in the long term, interest rate, and no significant positive effect on ROA.

Abstract

Guidance on Hajj rituals is an important part of organizing the pilgrimage as mandated by Law No. 8 of 2019 which aims to provide guidance, service and protection for pilgrims so that they can carry out their worship in accordance with the provisions of the Shari'a and realize the independence and resilience of pilgrims. Guidance on Hajj rituals is carried out by three institutions, namely Kemenag, KUA, and KBIH. The research method used is a comparative descriptive method with a qualitative approach. This study aims to determine the implementation of guidance on pilgrimage rituals at the Ministry of Religion, KUA, and KBIH in an effort to realize the independence of pilgrims. The results of the study show that from a comparison of the Hajj ritual guidance carried out by the Ministry of Religion, KUA, and KBIH it is known: First, the formulation of the strategy shows that the Ministry of Religion and KUA are government agencies while KBIH is the government's partner in guiding Hajj rituals, the challenge for the guidance of the Ministry of Religion and KUA comes from KBIH while KBIH challenges come from other KBIH. Second, the implementation of the strategy shows that the Ministry of Religion carries out guidance with a mass system while the KUA and KBIH use a group system, the Ministry of Religion and KUA are guided by the Kepdirjen PHU No 146 of 2022, KBIH is in accordance with the Kepdirjen PHU No D/799 of 2013, the cost of hajj guidance for the Ministry of Religion and KUA budget-based while KBIH is based on congregation costs. Third, the evaluation of the strategy shows that KBIH's guidance on Hajj rituals is seen as more important than government guidance, the guidance resource person lacks guidance techniques and the timing of implementation of the guidance from the Ministry of Religion and KUA is too close to departure, different from KBIH.

Abstract

This research aims to analyze the implementation of Arisan Artha Syar'i at BMT Syariah Sejahtera Boyolali from the perspective of Sharia Economic Law. Arisan Artha Syar'i is a rewarded arisan program run by sharia principles, where every transaction and mechanism applied must be in accordance with Islamic economic fatwas and regulations. The research method used is qualitative with a case study approach. Data were obtained through observation, in-depth interviews, and documentation from arisan managers and participants. The results show that Arisan Artha Syar'i has implemented sharia-compliant contracts, such as tabarru' (helping) and mudharabah (profit sharing) contracts in fund management. The prize draw is conducted transparently and in accordance with sharia principles, without any elements of maysir (gambling) and usury. The socio-economic impact of this program not only increases Islamic financial literacy but also strengthens social solidarity among BMT members. The program is able to assist participants in meeting urgent needs such as education costs and business capital. However, there are several challenges in its implementation, including ensuring transparency in fund management and providing adequate education to participants on the principles of Islamic economics. Periodic supervision and evaluation are needed to maintain the sustainability of the program in accordance with Islamic law. Arisan Artha Syar'i at BMT Syariah Sejahtera Boyolali is a sharia-based financial management model that not only provides economic benefits but also builds public awareness to invest halal.
