Abstract

This study examines two main issues, namely the method of measuring the Qibla direction used by the people of the Tamalatea and Rumbia Subdistricts, the accuracy of the Qibla direction for mosques and tombs at the village level in Tamalatea and Rumbia Districts, Jeneponto Regency. This type of research is categorized as field research, then data collection techniques are interviews and documentation. The research methodology uses the Qiblat Tracker method based on Sun Compass and the Google Earth application. So the results of this study show that of the 14 mosques and 5 cemeteries that have measured the Qibla direction, only 1 mosque has the correct Qibla direction. The cause of the deviation of the mosque and the tomb is because the people in the Districts of Tamalatea and Rumbia still use the method of looking at the cardinal directions, setting the sun and also a compass. The implication of this research is the need for socialization to provide understanding to people who are still unfamiliar with the knowledge of astronomy, especially in the Qibla direction in theory and in terms of using the Qiblat Tracker method based on Sun Compass and Google Eart

Abstract

This article examines the analysis of the views of the al-Shafi'i and Maliki schools on the talqīn of the dead before and after being buried. The type of research used by the author in this study is a qualitative research type, which is a type of research that brings library research data sources in the form of books or other scientific works. using a normative approach (shari'a), which is an approach to the problem that will be studied based on texts in the Qur’an, Sunnah, and Ijmak of the scholars and obtained from various literatures related to the problems that the author will discuss, both sourced from primary and secondary data. secondary data. The results of this study found differences in views between the scholars of the al-Shafi'i School and the Maliki School regarding the legal status of talqīn before and after burial, using the legal istinbath technique of each school. The al-Shafi'i school of thought is of the view that the law of talqin before being buried or in a state of death is sunnah as well as after being buried based on the arguments and istinbath of the school's law. Unlike the Maliki school of thought, the law of talqīn before burial is sunnah, and the law of talqīn after being buried is makruh, based on the legal argument that after burial it is considered weak. Abstract

AbstrakPokok masalah penelitian ini adalah bagaimana prespektif hukum Islam terhadap eksistensi Kasipalli pada Makassar di Romang Polong?. Pokok masalah tersebut dijabarkan menjadi sub masalah, yaitu bagaimana pandangan hukum Islam terhadap posisi, pemertahanan, dan muatan nilai pemali dalam kehidupan masyarakat Makassar di Romang Polong? Tujuan penelitian ini adalah untuk mendeskripsikan posisi Kasipalli, pemertahanan, dan nilai-nilai Kasipalli dalam sudut pandang hukum Islam. Penelitian ini adalah penelitian lapangan dengan analisis data kualitatif yang disajikan secara deskriptif-eksploratif. Pendekatan penelitian yang digunakan adalah pendekatan multidisipliner meliputi sejarah, antropologi, filosofis, dan ilmu syariat. Sumber data primer adalah masyarakat Makassar yang terpilih pada daerah perwakilan.  Sumber sekunder yaitu buku atau hasil penelitian yang terkait dengan pembahasan. Pengolahan data dilakukan dengan langkah observasi, wawancara, dan penelusuran referensi. Teknik pengolahan dan analisis data dilakukan dengan tahap reduksi data (kondensasi), display atau penyajian data, dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa eksistensi Kasipalli dalam masyarakat Makassar dapat ditemukan dalam posisinya sebagai kepercayaan kepada sumbernya yaitu orang tua atau leluhur dan keyakinan pada ancaman akibatnya. Demikian juga posisinya sebagai sistem kebudayaan atau pangadereng. Eksistensi Kasipalli masih bertahan karena memiliki faktor pemertahanan yang terkait dengan posisinya dalam budaya. Kata Kunci : Tradisi; Kasipalli;  Filosofi Mistik;  Hukum Islam;AbstractThe main problem of this research is how is the perspective of Islamic law towards the existence of Kasipalli in Makassar in Romang Polong ?. The subject matter is elaborated into sub-problems, namely how is the view of Islamic law on the position, retention, and content of the value of pemali in the lives of Makassar people in Romang Polong? The purpose of this study is to describe the position of Kasipalli, retention, and Kasipalli's values in the perspective of Islamic law. This research is a field research with qualitative data analysis which is presented descriptively-exploratively. The research approach used is a multidisciplinary approach covering history, anthropology, philosophy, and syariah science. The primary data source is the Makassar people selected in the representative area. Secondary sources are books or research results related to the discussion. Data processing is done by steps of observation, interviews, and reference tracing. Data processing and analysis techniques are carried out with the data reduction (condensation) stage, display or presentation of data, and drawing conclusions. The results of this study indicate that the existence of Kasipalli in Makassar society can be found in its position as a trust in its source, namely parents or ancestors and confidence in the threat of its consequences. Likewise its position as a cultural or pangadereng system. Kasipalli's existence still survives because it has a holding factor related to its position in culture.Keywords: Tradition; Kasipalli; Mystical Philosophy; Islamic Law.

Abstract

This article discusses the law of carrying out online marriage during the pandemic (analysis of four schools of thought). In answering these problems and analyzing qualitative data, the author uses a normative juridical approach. This research is classified as library research, this type of research is to analyze the content (content analysis) that is in accordance with the problems discussed, then review and conclude it. Researchers found: online marriage is a form of marriage in which the consent transaction is carried out through circumstances or activities that are connected to a network or internet system (via online), between the prospective groom and the bride, the guardian and the witness are not in one place but in the same place. displayed is only a form of visualization from both parties through the help of electronic tools (online media). The implementation of online marriage in Indonesia according to the law and analysis of the four schools of thought is allowed on the condition that its implementation must be in accordance with the pillars and conditions of marriage in general and under certain (urgent) circumstances.

Abstract

Artikel ini membahas tentang wali Mujbir dalam pernikahan anak dibawah umur pandangan mazhab Syafi’I dan Hanafi. Kajian ini bertujuan agar membuka mata kita seputar penjelasan wali mujbir yang untuk saat ini mungkin masih tidak terlalu terekspos atau masih agak awam dimata masyarakat mengenai pengetahuan perwalian nikah dan menjadi problematika antar mazhab, khususnya Syafi’i dan Hanafi sebab kurangnya pemahaman masyarakat tentang wali Mujbir serta kencenderungan pengabaian terhadap sistem maupun syarat-syarat dalam perwalian untuk pelaksanaan sebuah pernikahan, dan masih banyak pernikahan seorang anak yang dibawah umur tanpa memahami kaidah-kaidah dasarnya. Jenis penelitian yang digunakan adalah Library Research atau penelitian Pustaka. Dalam hal ini, penulis menganalisis hukum, norma-norma hukum dan pendapat para ulama. Hasil dari penelitian ini ditemukan bahwa didalam Islam pernikahan memiliki kedudukan yang signifkan pada konsep kerukunan ummat dikarenakan ajarannya sangat memperhatikan perilaku umatnya untuk menjalani setiap kewajiban maupun sunnah. Begitupun juga halnya dengan wali disebuah pernikahan harus memperhatikan sistem-sistem yang telah ada demi keabsahan suatu pernikahan. Adanya seorang wali nikah merupakan salah satu rukun pernikahan dalam agama Islam disebabkan hal ini adalah syarat agar sahnya sebuah pernikahan. Mazhab Hanafi berpendapat bahwa, adanya wali mujbir sangat diperlukan. Sebab hal tersebut demi memberikan kemaslahatan dan mewakili orang yang berada di dalam perwaliannya. Begitu juga dengan mazhab Syafi’i bahwa wali mujbir merupakan hal yang sangat penting karena wali mujbir akan membantu anak gadisnya dalam hal pernikahan. Menurut pendapat mazhab Hanafi yang berhak menjadi wali mujbir adalah semua wali dari jalur ayah, sedangkan wali mujbir hanya bisa diberlakukan untuk anak perempuan yang belum baligh atau dewasa. Sedangkan persamaan diantara kedua Mazhab tersebut adalah tentang perwalian mujbir terhadap orang gila. Untuk Wali mujbir, sebaiknya sebelum menikahkan anak gadisnya apalagi anak tersebut dinikahkan entah dalam bentuk alasan apapun dengan calon suami pilihanya, anak perempuan tersebut wajib dimintai izin terlebih dahulu, serta diberi waktu untuk mengenal calon suaminya. Hal ini sangat penting agar rumah tangganya nanti tentram, penuh dengan cinta kasih, serta sakinah, mawaddah wa rahmah.

Abstract

Pandangan masyarakat terhadap amalan sholat, amalan zakat, amalan puasa dan amalan haji jamaah Tarekat Tajul Khalwatiyah pimpinan Puang La’lang yakni dalam amalan Sholat masyarakat menganggap sholat yang dilaksanakan pada Tarekat ini terlalu cepat seperti terburu-buru, kemudian dalam amalan Zakat sangat berbeda dengan sebagaimana yang dilaksanakan oleh masyarakat. Dalam Tarekat Tajul Khalwatiyah Amalan Zakat terbagi menjadi lima bagian diantaranya Zakat Fitrah, Zakat barang-barang, Zakat peternakan, Zakat tumbuh-tumbuhan dan Zakat badan. Selanjutnya Amalan puasa pandangan masyarat tentang amalan puasa ini tidak ada perbedaan hanya saja dalam penentuan awal Puasa kadang bersamaan dengan Muhammadiyah kadang juga Bersamaan dengan Nahdatul Ulama. Dan yang terakhir amalan Haji dalam Pandangan Masyarakat amalan haji pada Tarekat Tajul Khalwatiyah itu telah sesuai sebagaimana yang dilaksanakan oleh ketentuan-ketentuan syariah. Selanjutnya tinjauan hukum Islam tentang Amalan Tarekat Tajul Khalwatiyah Pimpinan Puang La’lang sebagai berikut Amalan Sholat dalam tinjauan Hukum Islam boleh melakukan sholat sunah atau wajib dengan cepat tetapi dengan kadar thuma’ninah (tenang), selanjutnya amalan Zakat menurut Hukum Islam terbagi menjadi dua bagian yakni Zakat Fitrah yakni zakat yang wajib dikeluarkan oleh setiap orang sedangkan Zakat Maal yang dikeluarkan seorang muslim yang berkecukupan seperti hasil perniagaan, pertanian, pertambangan, hasil laut, hasil peternakan, harta penemuan, emas dan perak masing-masing memiliki jenis perhitunganya sendiri begitupun dalam Tarekat Tajul Khalwatiyah Pimpinan Puang La’lang. kemudian Amalan Puasa yang diamalkan oleh Tarekat Tajul Khalwatiyah ini telah sesuai dengan ketentuan-ketentuan syariat Islam. dan yang terakhir amalan haji dalam ketentuan Hukum Islam terhadap amalan Tarekat Tajul Khalwatiyah sesuai pula dalam ketentuan Syariat.

Abstract

Abstract This study discusses the effectiveness of the trial on the application of simple, fast and low-cost principles (a case study of the settlement of the isbat marriage case at the Bulukumba Religious Court). This study aims to find out how effective the mobile court is in the marriage isbat case and how it is applied as a simple, fast and cost-effective case in the settlement of marriage isbat cases through a mobile trial at the Bulukumba Religious Court. This research is qualitative in nature where the data collection is in the form of field reports or according to facts in the field. The approach used is the Juridical Empirical approach with data collection methods, namely documentation and interviews. The results showed that the mobile court in the settlement of the isbat marriage case at the Bulukumba Religious Court was calculated in terms of distance, implementation procedures to settlement of cases and fulfilled the 5 indicators of effectiveness according to Soerjono Soekanto. The application of the principle of justice has been carried out well, starting from the implementation which is not complicated and the costs incurred are only the down-payment costs of the case. Abstract

The Office of Religious Affairs in Ujung Bulu Sub-District has started implementing a marriage registration system through the SIMKAH website by providing guidance to prospective couples to register their marriages in SIMKAH, hoping to facilitate the marriage registration process at the Office of Religious Affairs. This research employs a qualitative research method located at the Office of Religious Affairs in Ujung Bulu Sub-District, Bulukumba Regency, utilizing a juridical and normative Islamic approach based on field observations. Data sources used include observation, interviews, and documentation. The implementation of marriage administration services at the Office of Religious Affairs through the SIMKAH website provides easy access for prospective couples, and the process is relatively quick. The community feels that marriage registration now is very good, especially as it minimizes data falsification, a problem that occurs frequently, and allows for checking identity data errors of prospective couples. The issues or challenges felt by the community and employees at the Office of Religious Affairs in Ujung Bulu Sub-District include network-related problems that can slow down the verification of marriage registration documents.

Abstract

The main problem discussed in this research is the Pa'jukukang Tradition in Pa'jukukang District, Bantaeng Regency, al' Urf Perspective. The type of research used is qualitative research with a theological, sociological and syar'i approach. The data collection method is carried out through observation, interviews and documentation, so that it can describe and analyze phenomena, attitudes, beliefs and assessments of society individually and in groups. The research results show that the phenomenon of the Pa'jukukang tradition in Bantaeng Regency still exists among the community, becoming a culture that continues to be preserved and celebrated every year. However, looking at their daily habits, it turns out that there is deviant behavior related to this tradition, both in terms of intention and in terms of implementation. As in the belief that you will receive blessings/favor if you bring various types of food when you want to hold a celebration. If seen from al 'urf's point of view, of course deviant behavior is not justified because it contains elements that can damage a person's faith. The implication of this research is that it is important for the government and local religious leaders to collaborate and take firm steps in order to provide direction and guidance to all elements of society which will hopefully be able to reduce little by little activities that can lead to polytheism. Then turn it into an ordinary activity or tourist spot like tourist attractions in general.

Abstract

The aim of this research is to explore the implications of the practice of mobile court at the Majene Religious Court on the sense of justice of the parties, with a focus on studying Maslahah Murlah. The research method used is qualitative with a normative syar'i theological approach and a juridical-empirical approach. Data was collected through observation, interviews, and documentation, then analyzed by data reduction, data presentation, data editing, data analysis, and testing data validity by combining data. The research results show that the mobile court conducted by the Majene Religious Court is in accordance with the Maslahah Murlah concept by helping remote communities, spreading justice evenly, and maximizing services. The stages of the circuit court process include submitting a budget, determining the implementation time, determining the panel of judges, trial, and mediation. The implication of this research is the need for the Majene Religious Court to continue to provide the best service to the community, for the Supreme Court to pay attention to judicial institutions throughout Indonesia, and to find solutions to overcome the negative impacts of mobile courts.
