Abstract

This study examines the existence of hadith as the second source of Islamic law after the Qur’an, as well as the methods employed to interpret and implement it in the formation of Islamic legal rulings. Hadith serves as an explanation of Qur’anic verses, a source of new legal rulings, and a guide for Muslim daily life. The research combines library study and field observation, employing the maqāṣid al-syarī‘ah approach to analyze the principles, methods, and both textual and contextual approaches in understanding hadith. Findings reveal that a comprehensive understanding of hadith requires verification of the chain of transmission, analysis of the text, and consideration of historical and social contexts. Accordingly, hadith not only reinforces its position as a source of Islamic law but also contributes to the development of relevant, applicable, and contemporary-oriented legal solutions.

Abstract

Abstrak Penelitian ini bertujuan memahami hukum Islam secara mendalam melalui wahyu Al‑Qur’an dengan dua focus padapendekatan-pendekatan tafsir-ushul yang mencakup hermeneutik mantuq mafhum, analisis struktur naratif‑retorik, serta pendekatan rasional-normatif berdasarkan maqāṣid dan ijtihād; serta tantangan serta relevansi pemahaman hukum Islam kontemporer melalui studi kasus fatwa digital, reformasi keluarga, dan perumusan hukum berbasis kemaslahatan. Menggunakan metode kualitatif-deskriptif, data diperoleh dari analisis teks Al‑Qur’an, literatur klasik & modern, dokumen fatwa, serta regulasi kontemporer. Temuan menunjukkan bahwa integrasi mazhab klasik dengan pendekatan ijtihād‑maḳāṣid mampu menjembatani kesenjangan antara teks wahyu dan kebutuhan hukum modern, khususnya dalam ranah gender, HAM, dan teknologi. Validasi dilakukan melalui triangulasi akademik (diskusi ahli, verifikasi teks, dan peer review). Rekomendasi penelitian ini mendorong pengembangan tafsir hukum yang responsif dan dinamis terhadap permasalahan kekinian. Kata Kunci: hermeneutik; ijtihād‑maqāṣid; fatwa digital; reformasi keluarga; maslahah   Abstract This study aims to deepen the understanding of Islamic law through the revelation of the Qur’an by focusing on two main areas interpretative methodologies including mantuq mafhum hermeneutics, narrative‑rhetorical text analysis, and rational‑normative approaches based on maqāṣid and ijtihād; and challenges and relevance of contemporary Islamic legal understanding through case studies of digital fatwas, family law reform, and benefit-based legal formulation. Employing a qualitative-descriptive method, data were collected from Qur’anic text analysis, classical and modern literature, fatwa documents, and contemporary legal regulations. The results demonstrate that integrating classical legal schools with ijtihād- maqāṣid approaches can bridge the gap between the revealed text and modern legal needs, particularly in areas of gender, human rights, and technology. Validation was conducted through academic triangulation (expert consultation, textual verification, and peer review). Abstract

Hakim adalah pejabat negara yang diberi wewenang oleh undang-undang untuk melaksanakan tugas kekuasaan ke- hakiman. Ia adalah ikon terpenting dalam institusi pengadilan. Karenanya, hakim selalu menjadi titik sentral perhatian masyarakat dalam penegakan hukum dan keadilan. Sebagai penyelenggara peradilan, hakim dipersyaratkan memiliki inte- gritas baik, jujur, profesional, dan berpengalaman di bidang hukum. Hal ini dimaksudkan agar hakim dalam melaksanakan tugas yudisialnya mampu melahirkan putusan yang adil dan benar menurut rasa keadilan masyarakat. Oleh karena itu pula, hakim dituntut berperan aktif melakukan tahapan-tahapan pemeriksaan perkara, menyimak dan meneliti secara seksama pernyataan, bukti-bukti, dan fakta-fakta persidangan, serta indikator penting lainnya, sehingga hakim dapat mengambil kesimpulan yang tepat dari setiap perkara yang diperiksanya

Abstract

The Gowa Regency Government enforces Regional Regulation No. 2/2020 concerning Mandatory Masks and Implementation of Health Protocols in Preventing the Spread of Corona Virus Disease 2019 on September 21, 2020. The enactment of this regional regulation has drawn a lot of criticism and protests from the public, especially those who have been caught in the operation of law enforcement. The bylaw is interesting to study further for reasons. First, this regional regulation was born and enforced for people affected by Covid-19 who feel the impact in various aspects of life. Second, the spread of the 2019 corona virus disease is determined by the Central Government as a non-natural national disaster, therefore the regulations governing it are also stipulated by the Central Government. This study is viewed from two aspects, namely: 1) What is the legal position of Perda No. 2 of 2020 Gowa Regency according tao the laws and regulations in Indonesia? and 2) What is the saddu zari'ah perspective on the enforcement of the sanctions in the perda? This study is expected to provide insight regarding the legal position of Perda No. 2 of 2020, Gowa Regency, as well as revealing the saddu zari'ah perspective on the imposition of sanctions in the perda. This discussion uses a juridical-syar'iy approach. This study shows that Regional Regulation Number 2 of 2020 Gowa Regency is legal and binding in accordance with the applicable laws and regulations. The Perda fulfills the formal and material requirements in the formation of legislation in Indonesia. Meanwhile, the saddu zari'ah perspective on the imposition of sanctions in this regional regulation is in accordance with the Shari'a, because the imposition of sanctions leads people to comply with the obligation to wear masks and implement health protocols to avoid and control the transmission of covid-19.

Abstract

The aim of this research is to explore the implications of the practice of mobile court at the Majene Religious Court on the sense of justice of the parties, with a focus on studying Maslahah Murlah. The research method used is qualitative with a normative syar'i theological approach and a juridical-empirical approach. Data was collected through observation, interviews, and documentation, then analyzed by data reduction, data presentation, data editing, data analysis, and testing data validity by combining data. The research results show that the mobile court conducted by the Majene Religious Court is in accordance with the Maslahah Murlah concept by helping remote communities, spreading justice evenly, and maximizing services. The stages of the circuit court process include submitting a budget, determining the implementation time, determining the panel of judges, trial, and mediation. The implication of this research is the need for the Majene Religious Court to continue to provide the best service to the community, for the Supreme Court to pay attention to judicial institutions throughout Indonesia, and to find solutions to overcome the negative impacts of mobile courts.

Abstract

The main problem of this research is the Juridical Analysis of Land Ownership Disputes in Takalar Regency. This research is descriptive research using qualitative data, data obtained through field studies (Field Research). so that the data collection method is sourced from informant data from both the Plaintiff and the Defendant, the Takalar District Court, and from the government in this case the Lakatong Village. Data was collected through the methods of observation, interviews and documentation. Furthermore, the data obtained will be analyzed through a Juridical Sociology approach. The conclusions from the results of this study are: 1) the problem is that the land located in Kaporengeng, Lakatong Village, Manggarabombang District, Takalar Regency (the object of the current dispute) is the land owned by Samsu B Peleng based on the detailed letter of Pesil No. 8a D1 Kohir 30 covering an area of ​​± 10 acres (1000 m²) with boundaries according to the results of local inspections, 2) based on legal considerations for the petitum which basically states that ACCUSED I controls the Disputed Land I, Rinkik land with an area of ​​:±4Are(± 400M2 Lompo Kaponrengang Persil No. 8a D1 Kohir Number 30 is an unlawful act (onrechtmatige daad) and ACCUSED II is in control of Disputed Land II, detailed land with an area of ​​:±2Are (±200M2 Lompo Kaponrengang Persil No. 8a D1 Kohir Number 30 is an act Against the law (onrechtmatige daad), 3) ​​Dictum / Amar Decision is to partially grant the claim of the plaintiffs. Abstract

This study aims to examine the provision of Hamlet-Based Capital Assistance and Community Associations in Bantaeng Regency. The writing method used is qualitative writing with a juridical and normative syar'i approach. The results showed that the Hamlet-Based Capital Assistance program and Community Pillars are regulated in Regent Regulation Number 20 of 2019, and the process starts from the stage of exploring dominant businesses in each hamlet /community harmony, deliberation at the hamlet / community harmony level, factual verification by the village / kelurahan government, deliberation at the village / kelurahan level, entrepreneurship training held by the Village Community Empowerment Office, and the last process is the distribution of funds carried out by the Cooperative Service. In the perspective of siyasah syar'iyyah, the program is a noble effort and Islam obliges the government to strive to alleviate poverty and unemployment, so that the program is very relevant and in line with the principle of benefit.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi pembagian harta warisan Adat Ampikale dalam konteks konsep Maṣlaḥah di kalangan masyarakat Bugis. Tiga submasalah yang diangkat meliputi: (1) pelaksanaan pembagian harta warisan Adat Ampikale dalam masyarakat, (2) pandangan tokoh masyarakat dan tokoh agama mengenai problematika yang muncul, dan (3) analisis konsep Maṣlaḥah terhadap praktik pembagian tersebut. Metode yang digunakan adalah kualitatif-deskriptif dengan pendekatan sosiologis dan teologis-normatif (syar’i), yang dilaksanakan di Kabupaten Bone. Metode yang digunakan adalah kualitatif-deskriptif, penelitian ini menemukan bahwa tradisi ampikale dilaksanakan sebagai bentuk penghargaan kepada ahli waris yang merawat pewaris, meskipun praktiknya sering kali tidak sejalan dengan ketentuan syariat, terutama dalam hal pembagian yang adil. Tokoh masyarakat dan agama berpendapat bahwa meskipun tradisi ini mengandung kebaikan, pelaksanaannya perlu disesuaikan untuk menghindari ketimpangan. Dalam perspektif maslahah, ampikale diakui sebagai kearifan local bugis yang sejalan dengan maqasid syariah yang mencakup pemeliharaan jiwa, keturunan dan harta. Hasil ini menunjukkan bahwa pembagian harta warisan ampikale merupakan tradisi yang perlu untuk dipertahankan nilainya dengan menyusun ulang pelaksanaannya sehingga tidak terjadi ketimpangan dikemudian hari oleh para ahli waris.

Abstract

The separation of powers is a fundamental principle for ensuring justice and preventing the abuse of authority within a governance system. In the context of Islamic history, particularly during the Rashidun Caliphate, the need to distinguish between executive and judicial authority emerged as essential to uphold legal integrity and the rule of justice. This study aims to analyze the early development (embryo) of the separation of powers during the Rashidun era, identify the socio-historical factors that influenced it, and evaluate its impact on the effectiveness and integrity of the Islamic judicial system. This research employs a socio-historical approach, utilizing content analysis of classical Islamic texts and historical documents, as well as historical comparison of governance practices of the period. The findings indicate that the institutionalization of judicial independence began under the leadership of Caliph Umar ibn al-Khattab through the appointment of independent qadis, provision of stable salaries, and the establishment of judicial oversight mechanisms. Factors such as urbanization, territorial expansion, increasing societal complexity, and the need for administrative efficiency were central to these reforms. The study concludes that the separation of powers in the Rashidun era was not only a pragmatic solution to governance challenges but also a reflection of core Islamic principles of justice. This historical model offers a valuable precedent for strengthening judicial independence and ethical governance, and remains relevant as a reference for contemporary judicial reform in Muslim-majority societies.

Abstract

This study explores the legal position and implications of forum selection clauses and alternative dispute resolution (ADR) mechanisms in contemporary sharia-based property disputes. Although statutory regulations have governed the forum for Sharia economic dispute resolution—generally designating Religious Courts or Sharia Arbitration—practical implementation still raises interpretative challenges, particularly in cases involving third parties or property rights. Using a qualitative method with statutory, comparative, and case study approaches, the research reveals that forum choice clauses in sharia contracts are legally valid and binding, as supported by Supreme Court Circular Letter (SEMA) No. 4 of 2016. However, in practice, disputes involving secondary agreements or third-party claims over property often shift jurisdiction from the Religious Court to the District Court. This occurs especially when the primary issue concerns ownership or property rights tied to sharia-based transactions, such as murabahah, ijarah, or rahn contracts. The findings underscore a dissonance between normative legal frameworks and judicial practice, leading to overlapping authorities and legal uncertainty. The study also identifies a tendency among judges to prioritize the object of dispute (e.g., property or collateral) over the contractual nature, thereby affecting the determination of appropriate forum jurisdiction. This research contributes academically by offering a clearer understanding of how forum selection clauses operate within Indonesia's dual court system and by advocating for a more integrated legal interpretation that aligns Islamic legal principles with national procedural law. Ultimately, it highlights the urgency of harmonizing jurisdictional boundaries to strengthen the enforcement and credibility of sharia economic law in resolving property-related disputes.
