Abstract

MABIMS is a method and concept in determining the initial Kamariyah and producing a decision, the Isbat session held by the Ministry of Religion plays an important role in this process where this paper will analyze the determination with a focus on the accuracy and decisions taken from the Isbat session, through the Maqasid as-Shariah approach. This research explores how the MABIMS criteria can fulfill Sharia objectives in maintaining the benefit of the people. This analysis includes an evaluation of the hisab and rukyat used, as well as their implications for the unity of Muslims in the Southeast Asia Region. The results of this research show that even though there are differences in views, the maqasid as-syariah approach can be a basis for reaching more accurate and widely accepted decisions. The method used in analyzing legally a determination made by the state, this approach is used that the initial determination of kamariyah in Indonesia is a complex process involving various aspects of law and regulation. So from the study it can be concluded that the policy of the state leader is something that has been thought about for the benefit of many people with the principle of fiqh rules, namely: tassharuf al-imam ala arra'iyyah manuthu bil mashlahah.

Abstract

This article examines the use of a hermeneutical approach in the process of istinbat (legal reasoning) by the National Sharia Council–Indonesian Ulema Council (DSN-MUI), with specific reference to Fatwa No. 77/DSN-MUI/V/2010 concerning non-cash gold trading. The fatwa has generated scholarly debate, as it permits transactions seemingly contrary to hadiths mandating immediate exchange for ribawi commodities. The study adopts Abdullah Saeed’s contextual hermeneutics, emphasizing implementational values and socio-historical context in interpreting Islamic legal texts. By integrating ethico-legal principles and the objectives of Islamic law (maqasid al-sharia), DSN-MUI engages in a structured hierarchy of values and applies usul al-fiqh methodologies to address contemporary economic challenges. While some critics argue that the fatwa diverges from a strict textualist reading of hadith, the DSN-MUI’s contextual approach demonstrates normative adaptability without compromising sharia principles. This approach responds to emerging financial realities, such as digital transactions, while upholding the public interest (maslahah). The study highlights the significance of hermeneutical methods in balancing the authority of religious texts with the evolving needs of society, and affirms the DSN-MUI’s strategic role in shaping progressive and globally responsive Islamic economic jurisprudence.

Abstract

Early marriage is a growing phenomenon in many countries, including countries with a Muslim majority. In the perspective of Islamic law, marriage is a part of worship that is highly valued, but there are provisions that must be considered so as not to harm the parties involved, especially in the context of early marriage. One approach used to assess whether early marriage is permitted or not in Islamic law is through the concept of maslahat mursalat, which is an effort to achieve public welfare that is not explicitly regulated in the Shari'a, but can be taken based on the goals and basic principles of Islam. This paper aims to analyze the application of the concept of maslahat mursalat in the context of early marriage, as well as its implications for the implementation of Islamic law. This study includes an analysis of the social, economic, and health impacts associated with early marriage, and discusses how Islamic law assesses young marriage by considering maslahat and mudarat (benefits and disadvantages). This study also seeks to examine how the orientation of maslahat mursalat can help align Islamic law with the needs of today's society, amidst the challenges of early marriage that often ignore the emotional, social, and physical readiness of individuals. The results of this study indicate that from the perspective of maslahat mursalat, early marriage is only permitted if it meets the criteria of greater welfare and does not bring harm to the parties involved. In addition, policy recommendations regarding early marriage need to consider various factors that support individual welfare, including education, mental readiness, and social and economic support. Therefore, the implementation of early marriage must be carried out carefully and wisely, ensuring that it does not violate the basic principles of Islamic law which emphasize the welfare of humanity.
