Abstract

Monogamy, as a form of marriage between one man and one woman, is widely considered the ideal norm in many cultures as it is associated with stability, commitment, and fidelity. In the Islamic context, monogamy is preferred as it is considered more manageable and conducive to domestic harmony. However, Islam also allows polygamy under certain conditions, which has led to an ongoing scholarly debate regarding its ethical and practical implications. While there has been much discussion regarding monogamy and polygamy in Islam, there has been little research using a maqashid sharia approach, particularly from the perspective of Jamaluddin Athiyyah. This research seeks to do so by assessing how monogamy aligns with the objectives of Islamic law compared to polygamy. This research uses a normative qualitative method with a conceptual approach. Primary data is obtained from Jamaluddin Athiyyah's works on maqashid sharia, while secondary data includes relevant journals, articles, and previous research on monogamy and polygamy. The qualitative analysis evaluates the role of monogamy in fulfilling the values of maqashid sharia, particularly in the domains of personal well-being, family stability, community harmony, and overall human well-being. The findings show that monogamy is more supportive of justice, tranquility, and well-being in family life than polygamy. From the perspective of Jamaluddin Athiyyah's maqashid sharia, monogamy significantly contributes to preserving the soul, reason, religion, honor, and. In addition, monogamy enhances social stability and promotes the welfare of the ummah, which is in line with the basic objectives of Islamic law, which are to achieve prosperity and prevent societal breakdown. Therefore, these findings will be useful for Muslim policymakers, academics, and society in understanding monogamy as a marriage framework that is more supportive of social justice and welfare.

Abstract

Social character is one of the traits that educators must instill in students as a means of self-adjustment in Islamic boarding schools. Mentors, acting as middle managers, play an active role in instilling social character in students at Sabilurrosyad Putra Gasek Islamic Boarding School in Malang. The aim of this research is to reveal the strategies employed by mentors in instilling social character in students. The research methodology used is descriptive qualitative through interviews, observations, and documentation. The results of this study indicate that mentors employ strategies to instill social character in students through a series of rules, learning activities, and guidance that emphasize providing guidance and advice, followed by setting direct examples in daily activities.

Abstract

The basic principles of Islamic Education Management contain various flexible general principles so that they are well in line with the progress and developments of the current era. These principles are what differentiates educational management in general from Islamic educational management. Regarding the principles of Islamic education management, many Islamic education experts have different opinions. Therefore, in this digital era, namely the Industrial Revolution Era 4.0, there is a need to revitalize studies regarding the principles of Islamic education management in order to realize strong and superior management. This type of research is qualitative research in library research. The approach uses a qualitative approach. The findings in this research are that the basic principles in Islamic education management and their relevance in life in the Era of Industrial Revolution 4.0 include the principles of sincerity, honesty, trust and fairness.

Abstract

Human rights objectively aim noble. It grants basic rights to human beings without distinction of origin, race, color, sex, language or religion. The concept of human rights in maqasid al syariah is Islamic sharia is prescribed in order to protect the human benefit by protecting the interests, safety and welfare of human beings both in life in the world and in the hereafter. The fundamental problem, if Islamic law is confronted with human rights is at least in family law. There arose some offers of methods of understanding nas in order to respond to human development. A verse of qatb'i is by analyzing a number of verses so that a unified understanding of the verses can be obtained. The collaboration of some of these verses shows that the understanding contained therein is definite and undeniable. then the tension in Islamic law, especially allegations of discrimination against women and non-Muslims can be avoided without any need to have allegedly left the Qur'anic verses. Hak-hak Asasi manusia secara obyektif bertujuan mulia. la memberi hak-hak dasar kepada manusia tanpa membedakan asal-usulnya, baik ras, warna kulit, jenis kelamin, bahasa maupun agama. Konsep HAM dalam maqasid al syariah yaitu syariah Islam disyariatkan dalam rangka melindungi kemaslahatan manusia dengan melindungi kepentingan, keselamatan dan kesejahteraan manusia baik dalam hidup di dunia maupun di akhirat. Problem yang mendasar, jika hukum Islam dihadapkan kepada HAM paling sedikit adalah pada hukum keluarga. Muncullah beberapa tawaran metode memahami nas dalam upaya merespon perkembangan kemanusiaan. Suatu ayat qatb 'i adalah dengan menganalisis sejumlah ayat sehingga bisa diperoleh suatu pengertian yang searah dari ayat-ayat tersebut. Kolaborasi sejumlah ayat tersebut menunjukkan bahwa pengertian yang terkandung di dalamnya bersifat pasti dan tak terbantah. maka ketegangan dalam Hukum Islam, khususnya tuduhan diskriminasi terhadap wanita dan non-muslim bisa dihindarkan tanpa perlu ada tuduhan telah meninggalkan ayat-ayat al quran.

Abstract

In the problem of femininity, fiqh has a very big role, because it is the science of fiqh that structuring the relationship of male women. This paper describes violence against women rooted in Fiqh al-Nisa 'However it is certainly not fair to judge Fiqh al-Nisa' with the present context. However fiqh is the product of his day. That in general in Fiqh al-Nisa ', women positioned as second actors or objects is due to several factors. First, some verses of the Qur'an and the Prophet's hadith present a patriarchal nuance, a view which places men as superior and inferior women. Secondly, the fiqh historic setting is generally a very patriarchal middle east region and the third, the fiqh writer is a man who is surely better presenting the superiority of men. Basically fiqh is the result of ijtihad miijtahid which is very good, relevant, dynamic in its era. The rigid is the thought of using the old work for the present religious rule. The rigid is the effort to develop new fiqh but still based on the methodology used in designing the old fiqh. Dalam problematika keperempuanan, ilmu fiqh memiliki peran sangat besar, karena ilmu fiqh-lah yang menstrukturkan hubungan laki-laki perempuan. Tulisan ini memaparkan kekerasan terhadap perempuan yang berakar pada Fiqh al-Nisa’ Namun demikian tentu tidak fair menghakimi Fiqh al-Nisa’ dengan konteks sekarang. Bagaimanapun fiqh adalah produk zamannya. Bahwa pada umumnya dalam Fiqh al-Nisa’, perempuan diposisikan sebagai pemeran kedua atau obyek adalah karena beberapa faktor. Pertama, beberapa ayat al-Qur’an dan hadis Nabi menghadirkan nuansa patriarkhi, suatu pandangan yang menempatkan laki-laki sebagai superior dan perempuan inferior. Kedua, setting kesejarahan fiqh itu pada umumnya adalah wilayah Timur tengah yang sangat patriarkhi dan ketiga, penulis fiqh itu adalah laki-laki yang tentu lebih mempresentasikan superioritas laki-laki. Pada dasarnya fiqh adalah hasil ijtihad miijtahid yang sangat baik, relevan, dinamis pada zamannya. Yang kaku adalah pemikiran untuk menggunakan karya lama itu untuk tata aturan keagamaan masa kini. Yang kaku ialah usaha menyusun fiqh baru namun tetap berpijak pada metodologi yang digunakan dalam merancang fiqh yang lama.

Abstract

Pernikahan dalam Islam memerlukan kesiapan lahir dan batin agar pasangan mampu membangun rumah tangga yang harmonis dan tanggung jawab. Dalam konteks perubahan sosial dan perkembangan generasi digital, program bimbingan pranikah menjadi sarana penting untuk membekali calon pengantin secara mental, spiritual, dan sosial. Penelitian ini bertujuan menganalisis efektivitas pelaksanaan bimbingan pranikah di Kantor Urusan Agama (KUA) Kecamatan Praya Barat dalam membentuk ketahanan keluarga di era digital. Pendekatan yang digunakan ialah yuridis-empiris dengan metode deskriptif kualitatif melalui wawancara, observasi, dan studi dokumen. Hasil penelitian menunjukkan bahwa pelaksanaan bimbingan belum optimal akibat rendahnya partisipasi peserta, kurang menariknya metode fasilitator, keterbatasan sarana pendukung, dan ketiadaan kebijakan remedial. Selain itu, karakter generasi Z sebagai digital natives menuntut inovasi dalam metode dan media pembelajaran. Optimalisasi program dapat dilakukan melalui peningkatan kompetensi fasilitator, pemanfaatan media digital, dan penguatan strategi penyampaian agar bimbingan lebih adaptif terhadap kebutuhan generasi muda. Kata Kunci: Efektivitas , Bimbingan Pranikah, Keharmonisan Rumah Tangga.

Abstract

The modern demand for women to migrate for various reasons without a mahram, combined with the need for research on this issue, makes it necessary to examine. Consider that there is a hadith explaining the rule that women must travel with their mahram. This study will analyze maṣlaḥah mursalah regarding women's ability to migrate without a mahram, using literature review methods and the basic theory of maṣlaḥah mursalah researched from several books and journals. The research concluded that, in the context of maṣlaḥah mursalah, permitting women to migrate without a mahram is more beneficial because of certain positive impacts and potential negative impacts, along with other security measures besides the mahram that can ensure women's safety.

Abstract

This study aims to explore the phenomenon of begging in the social and economic context of Indonesia, focusing on the factors that influence the practice of begging, community responses, and solutions that can eradicate it. The research method used is qualitative with a descriptive approach, using data collection techniques through literature studies, observations, and in-depth interviews. Literature studies are used to gain a deep theoretical understanding of the phenomenon of begging, economic empowerment, and related religious values. Observations are conducted to observe direct interactions between beggars and the community, while in-depth interviews are conducted with relevant respondents such as beggars, religious figures, social activists, and policy experts. The results of the study indicate that the phenomenon of begging is influenced by complex factors such as low levels of education, minimal job opportunities, and community attitudes toward beggars. Community responses to beggars vary from empathy to ambivalence, with the perception that begging is not an effective long-term solution. In the context of religious values, the practice of begging is regulated within the framework of allowing begging in emergencies, but strongly encouraging independence and economic productivity through zakat, alms, and economic empowerment. The implication of this study is the need for an integrated approach from various sectors of society, including religion, social, and economic, in formulating more effective and sustainable policies to reduce the phenomenon of begging. Further research is suggested to expand the scope of the study, integrate cross-disciplinary approaches, and further evaluate economic empowerment programs that can change the paradigm of beggars towards a more independent and sufficient life

Abstract

The phenomenon of the integration of prayer in the management of Islamic boarding school education is an important topic to study in the context of the development of religious culture and spiritual leadership in Islamic educational institutions. This study aims to explore how the integration of prayer can build religious culture and spiritual leadership in Islamic boarding schools. A qualitative approach with a case study method is used to explore this phenomenon. Data were collected through in-depth interviews, participatory observations, and documentation in several Islamic boarding schools in Madura, East Java. The results of the study show that shalawat plays a significant role in the daily life of students and the management of Islamic boarding schools. The integration of prayer helps create a religious atmosphere, improve student discipline, and strengthen spiritual leadership in Islamic boarding schools. The implication of this study is the importance of adopting the integration of prayer as a managerial strategy in pesantren education to form religious character and effective leadership.

Abstract

Maqashid syariah sebagai tujuan pokok hukum Islam menempati posisi sentral dalam perkembangan ilmu ushul fiqh. Periode klasik, khususnya melalui pemikiran al-Juwaini (w. 478 H) dan al-Ghazali (w. 505 H), memberikan fondasi konseptual yang kemudian disempurnakan oleh generasi sesudahnya. Artikel ini menelaah secara komprehensif gagasan maqashid syariah dalam pemikiran kedua tokoh tersebut. Al-Juwaini menekankan pentingnya maslahat dan membaginya dalam tingkatan dharuriyyat, hajiyyat, dan tahsiniyyat. Al-Ghazali kemudian menyusun secara sistematis lima tujuan pokok syariah (al-dharuriyyat al-khams), yaitu hifz al-din, hifz al-nafs, hifz al-‘aql, hifz al-nasl, dan hifz al-mal. Melalui perbandingan dan analisis, artikel ini menunjukkan bahwa al-Juwaini adalah konseptor awal, sedangkan al-Ghazali merupakan formulator maqashid syariah. Keduanya menjadi landasan teoritis yang mempengaruhi pemikiran ulama sesudahnya, seperti al-Syatibi pada periode pertengahan, hingga teori maqashid kontemporer.
