Abstract

Penelitian ini bertujuan untuk mengkaji, melalui pendekatan meta-analisis, peran Pancasila sebagai ideologi bangsa dalam membentuk karakter cinta tanah air pada siswa sekolah dasar, berdasarkan artikel-artikel ilmiah terakreditasi yang diterbitkan antara tahun 2020 hingga 2025. Analisis dilakukan terhadap 10 artikel dari berbagai jurnal nasional terakreditasi. Hasil meta-analisis menunjukkan bahwa nilai-nilai Pancasila secara konsisten diterapkan dalam pembelajaran melalui kurikulum, kegiatan kokurikuler, dan pembiasaan karakter di sekolah dasar. Nilai-nilai seperti persatuan, penghargaan terhadap keberagaman, dan penguatan semangat kebangsaan menjadi indikator utama dalam pengembangan karakter cinta tanah air. Artikel ini menyimpulkan bahwa penguatan nilai-nilai Pancasila dalam pendidikan dasar menjadi fondasi strategis dalam membangun karakter kebangsaan sejak usia dini.

Abstract

This study aims to determine the legality of interfaith marriage in Indonesia and its impact in terms of Law No. 16 of 2019 and Balinese Customary Law. The type of research used is normative legal research, namely research based on statutory regulations. In this study, a statutory approach was used by examining statutory regulations related to research and a conceptual approach taking into account the views or doctrines that developed in the science of law, and a case approach based on concrete cases. . The technique for collecting legal materials in this study is using library research techniques or documentary techniques, which are collected from archive studies or literature studies such as books, papers, articles, journals, newspapers or works of experts on law. The results of this study are that there is a conflict of laws and regulations between Law No. 16 of 2019 concerning Marriage and Law No. 24 of 2013 concerning Population Administration. Then interfaith marriages have an impact on the marriage itself, have an impact on the status of children and on future inheritance.

Abstract

This research aims to (1) find out how the position of boys and girls in the division of inheritance according to customary law in Sade Hamlet is related to the legal pluralism that exists in the Sasak tribe community. (2) To find out which laws apply in the distribution of inheritance according to customary law in Sade Hamlet. The type of research used is empirical legal research. The legal materials used come from legal, primary, secondary and tertiary materials. Data collection techniques use documentation study techniques, interviews and direct observation. The results and conclusions of the research show that the position of sons and daughters in the division of inheritance in the Sade traditional hamlet still adheres closely to and maintains the customary law that has been in force from the past until now in matters of distribution of inheritance according to the principle of the family system adhered to by children. Men as the successors of the lineage receive absolute inheritance of inheritance. The community in Sade Hamlet adheres to a patrilineal family system. This results in daughters not having the right to inherit property from their parents. The indigenous people in the Sade traditional hamlet are strictly subject to local customary regulations.

Abstract

The purpose of this study is to determine the management of parking levies by Transportation Departement in increasing local revenue (PAD) of Denpasar City at Kreneng Market and to find out the obstacles faced by Transportation Departement in managing parking levies at Kreneng Market in Denpasar due to the implementation of Denpasar Mayor Regulation No 11 of 2005. This study used empirical legal research with a descriptive research nature. This study is conducted at Kreneng market in Denpasar. Descriptive qualitative is used as a data processing and analysis technique in this research. The result of the study revealed that the management of parking leavis by Transportation Departement is quite effective, where the target number of parking levies on the of public roads in Denpasar is based on the large number in Denpasar. It is calculated from the number of vehicle capacities at each parking points and the number of vehicles that comes and go at the parking lot. The target setting for roadside parking levies has alsoe been distributes in each parking point. Meawhile, there are some obstacles face by Transportation Departement in managing parking levies at Kreneng Market in Denpasar that caused the effectiveness decreased such as user ignorance, revenue leakage, lack of society awareness, resusrance from certain parties, and the limitation of infrastructure and technology.

Abstract

The purpose of this research is to (1) determine and evaluate the responsibilities and authority of Satpol PP in enforcing Buleleng Regional Regulation Number 6 of 2009 concerning Public Order, especially with regard to street vendors in Buleleng Regency. (2) To find out and study obstacles and problems in implementing Regional Regulation Number 6 of 2009 concerning Public Order, especially regarding street vendors in Buleleng Regency. This research uses empirical legal research with descriptive-analytical research characteristics with primary and secondary data types. The results of this research show that (1) the duties and authority of Satpol PP refer to Government Regulation No. 16 of 2018 concerning Civil Service Police Units. In its operations, the Buleleng Regency Satpol PP carries out guidance, supervision and action against street vendors who violate Buleleng Regional Regulation Number 6 of 2009. (2) enforcement of the Buleleng Regional Regulation carried out by the Satpol against street vendors in Buleleng Regency is not yet optimal because there are still obstacles, namely the enforcement factor. The law is where there is a lack of Satpol PP members who are PPNS, the factor of infrastructure supporting law enforcement, as well as the community factor (PKL) in Buleleng Regency which is lacking in awareness of the law itself. To overcome these obstacles, efforts that can be made include providing strict sanctions against street vendors who continuously violate Buleleng Regional Regulation Number 6 of 2009, increasing the resources and professionalism of the Satpol PP's performance, increasing coordination from each related sub-district agency and operations. routinely, and carry out regular preventive and coaching measures considering the low level of public awareness (PKL) in order to create order and cleanliness.

Abstract

This study aims (1) to find out and analyze how the mechanism for implementing the death penalty according to current regulations in Indonesia, (2) to find out the inhibiting factors in the implementation of the death penalty after the judge's decision. The type of research used by researchers is normative legal research, namely through a statutory approach, and a conceptual approach. The sources of legal materials used are the 1945 Constitution, Presidential Regulation, and Regulation of the Chief of Police. The technique of collecting legal materials carried out is by reviewing or analyzing laws and regulations, the 1945 Constitution, and other regulations. The results showed that (1) From the regulations related to the procedures for the implementation of the death penalty in Law No. 2 / PNPS / 1964 has not regulated the deadline for the implementation of the death penalty. It only regulates the extent of notification before execution, which is 3 x 24 hours. This uncertainty certainly creates legal uncertainty and will have an impact on the psychology of the convict. In Indonesia itself, regarding the time span after the judge's decision until he will actually be executed, in fact, it takes quite a long time. Because in casu laws and regulations do not regulate this. Regarding when the convict will be executed depends entirely on the policy of the prosecutor as executor. This cannot be done because the law in Indonesia should regulate in terms of material, formal, and implementation laws. (2) Regarding the inhibiting factors of the death penalty after the judge's decision, there are many such as statutory factors, law enforcement, and facilities. Therefore, it is necessary to regulate the implementation of the death penalty. Because the absence of this rule causes its own confusion for the community and also convicts sentenced to death. In addition, it is hoped that through the new Criminal Code, it is explained what conditions must be met by convicts so that the death penalty can be changed to a life sentence. Because when viewed from the existing rules, it is only explained related to the perpetrator's remorse and the perpetrator's relationship in criminal acts. If you only pay attention to these two factors, it is feared that in the future it will cause repeat crimes.

Abstract

This research explains aims to (1) help provide understanding to the community in the Buleleng Regency regarding the duties and authority of State Prosecutor Lawyers in assisting the community to resolve civil cases and (2) assist in evaluating the performance of State Prosecutor Lawyers in providing civil legal assistance to the community. This research is an empirical and descriptive study, critically aimed at analyzing relevant legal facts and describing them in detail. The results of the research are (1) a lack of understanding about the duties and role of State Prosecutor Lawyers among the community leads to the ineffective implementation of Law Number 7 of 2021, especially regarding civil legal assistance provided by State Prosecutor Lawyers to the community. (2) Implementing Law Number 7 of 2021, State Prosecutor Lawyers encountered several obstacles such as the lack of community participation in consulting their civil issues with State Prosecutor Lawyers due to the community's ignorance about the legal assistance that State Prosecutor Lawyers can provide, thus the solution provided in this study is to increase socialization both directly and through electronic media such as television and radio. If the community has a better understanding of the legal assistance provided by State Prosecutor Lawyers, the result would be that the community finds it easier to resolve their civil issues and, of course, Law Number 7 of 2021, especially regarding the legal assistance that State Prosecutor Lawyers can provide to the community, can be effectively implemented for all segments of society in the Buleleng Regency.

Abstract

This research aims to determine the factors that cause someone to become a victim of online shop fraud and the steps and efforts to protect victims of online shop fraud in Buleleng Regency. The type of research that will be used in this research is empirical legal research. In examining this case, the research uses descriptive characteristics. The data used in this research are Primary Data and Secondary Data consisting of Primary Legal Material, Secondary Legal Material and Tertiary Legal Material. The conclusions from this research are 1) the factors that cause someone to become a victim of Online Shop fraud in Buleleng Regency, so it can be concluded that the factors that cause someone to become a victim of Online Shop fraud in Buleleng Regency are internal factors consisting of very high prices. cheap, because of the ease of transactions on Social Media and the lack of public insight and knowledge regarding the latest modes of fraud as well as external factors which include economic factors, education factors, cultural factors and environmental factors. 2) The steps and efforts to protect victims of Online Shop fraud in Buleleng Regency which have been carried out by the Buleleng Police Unit and the Buleleng Regency Communication, Informatics, Coding and Statistics Service are preventive legal protection consisting of providing Digital Literacy education and socialization and repression which consists of from settlement through legal channels by the Buleleng Police Unit. Furthermore, the Buleleng Regency Communication, Information, Coding and Statistics Service has also provided reporting for cellphone numbers and account numbers that are indicated to be fraudulent to help other people trace the history of these numbers.

Abstract

The implementation of effective learning resource models in Civic Education (PKn) in elementary schools is crucial. This study aims to explore in-depth the learning resource models that have been implemented in Civic Education at SD Negeri 5 Sukarara, focusing on the analysis of teachers' experiences, students' perceptions, and the understanding of the interaction dynamics between teachers, students, and learning resources within the context of implementing effective learning resource models in Civic Education classes. This research uses a qualitative phenomenological approach with a case study type, involving Civic Education teachers and students of SD Negeri 5 Sukarara as participants. Data were collected through in-depth interviews, observations, and document studies, and analyzed using a thematic approach to identify patterns, themes, and meanings from the collected data. The results show that: 1) Teachers at SD Negeri 5 Sukarara have positive experiences in using effective learning resource models, such as interactive methods like question and answer, TGT, STAD, and CTL. They utilize various learning resources, including the surrounding environment, teaching materials, information technology, and creative media, which enrich students' learning experiences, increase their engagement, and facilitate the understanding of Civic Education concepts. 2) Students respond positively to effective learning resource models, which enhance their engagement and understanding. They find environment-based learning and information technology interesting and relevant, and they enjoy the variety of teaching methods that make learning more interactive and motivate them to learn. 3) The implementation of effective learning resource models creates positive interactions between teachers, students, and learning resources, with teachers acting as facilitators guiding students to interact with various resources. In conclusion, the implementation of effective learning resource models in Civic Education in elementary schools can increase student engagement, peer collaboration, and active participation in discussions, creating a dynamic learning environment that supports better learning outcomes and develops students' social and emotional skills.

Abstract

Penelitian ini bertujuan untuk mengetahui: (1) bagaimana proses pelaksanaan pemilihan Kepala Desa tahun 2019 di Desa Baluk, (2) tingkat partisipasi masyarakat Desa Baluk dalam pemilihan Kepala Desa, (3) factor-faktor apa saja yang mengpengaruhi tingkat partisipasi masyarakat di Desa Baluk. Pengumpulan data dilakukan dengan metode wawan cara, kepustakaan dan dokumentasi. Hasil penelitian ini menunjukan bahwa: (1) Proses Pelaksanaan pemilihan Kepala Desa Baluk dimulai dari tahap persiapan, pencalonan, pemungutan suara, dan penetapan telah berjalan dengan aman, tertib dan sesuai dengan Peraturan Undang-Undang No. 6 Tahun 2014 tentang Desa, Pengangkatan dan Pemberhentian Kepala Desa. (2) tingkat partisipasi masyarakat Desa Baluk sangatlah rendah dimana dalam hasil penelitian peneliti menemukan bahwa ketidak tahuan adanya informasi tentang rekam jejak masing-masing calon dan banyaknya msayarakat yang merantau. (3) factor-faktor yang mempengaruhi tingkat partisipasi rendah dapat penulis simpulkan bahwa ada 3 faktor yang dimana dari Usia, Pekerjaan, Pendidikan dan kurangnya sosialisasi baik secara media sosial tentang calon kepala desa.
