Abstract

Dusun Dalam Village Government established a Village-Owned Enterprise (BUMDes) Karya Dermawan is a policy utilization. The main pillar was established BUMDes Karya Dermawan in accordance with the mandate of the objectives whose activities were oriented to encourage the welfare of the village community. Therefore, this study was conducted aimed at looking at the welfare provided by BUMDes Karya Dermawan Dusun Dalam village especially to the beneficiary community and compare the level of welfare before and after BUMDes Karya Dermawan was established. This study uses a descriptive quantitative approach, and data sourced from primary data by using Paired Sample t-Test as a data analysis tool. This study shows that BUMDes Karya Dermawan provides welfare to the beneficiary communities through businesses that have been established including Cooperatives; Alsintan; and Workshop, which is directly able to change or succeed in providing an increase in welfare for the beneficiary community after the establishment of BUMDes as evidenced by the results of the Paried Sample t-Test analysis. With this evidence of success, for all elements should give intensive attention; so that the development of BUMDes Karya Dermawan exists even more as a driver of community welfare. And also, integratedly invites and becomes a valuable lesson for existing villages to establish BUMDes or villages that already have BUMDes, but have not succeeded in providing a common thread for the welfare of their citizens.

Abstract

Penelitian ini dilatarbelakangi oleh fenomena menjamurnya pelaku usaha mikro yang melakukan kredit riba di lembaga keungan yang berbasis konvensional. BAZNAS Kabupaten Kerinci hadir untuk menjawab fenomena ini, dengan peluncuran program pendistribusian dana zakat bentuk pinjaman untuk bantuan modal bagi pelaku usaha mikro. Oleh karena itu, penelitian dilakukan bertujuan untuk melihat pendisitribusian zakat bentuk kredit dalam mengatasi pedagang usaha mikro dari kredit ribawi, sekalaigus melihat apa saja faktor pendukung dan penghambat pendistribusian kredit secar kredit. Penelitian menggunakan pendekatan deskriptif. Data penelitian menggunakan sumber data primer dengan menggunakan model Miles and Huberman sebagai alat analisis data. Penelitian ini menunjukan bahwa pendistribusian zakat bentuk kredit yang diberikan oleh BAZNAS belum mampu mengatasi semua pedagang mikro dari kredit ribawi. Di lihat dari sisi faktor pendukung dukungan zakat kredit adalah bergulir yang telah mencapai Rp. 1.820.000.000 dan pegawai BAZNAS yang profesional di bidang pengembangan pedagang, dan faktor penghambatnya antara keseimbangan dana yang tersedia dengan jumlah modal yang dibutuhkan pedagang, sehingga masih banyak pedagang yang memilih menggunakan pinjaman ribawi sebagai dana tambahan untuk modal usaha.

Abstract

This study aims to review and comprehensively explain the legality of Cryptocurrency based on a number of institutional and personal fatawa. To answer the research objectives, it was carried out using descriptive research with a qualitative approach. The research data comes from secondary data in the form of institutional and personal fatawa that have been published online, and are accompanied by supporting writings explaining these fatawa. The collected research data were analyzed by following the steps including material collection, discussion, and descriptive analysis. This research shows that a number of institutional and personal fatawa are divided into three decisions on the legality of Cryptocurrency, namely the first is Halal Cryptocurrency; on the grounds that it can be treated as a form of Maal (property), because it is based on social approval and general use so it is permissible to own;, trade;, transact;, etc. there is a clear decision), on the grounds of excessive gharar (speculation); security risk; can easily be used in illegal activities;. Third, Cryptocurrencies are illegal, for various reasons, they are not currency and are not legal means of payment; decentralized validation; excessive gharar (speculation); can easily be used for maysir (gambling);, and used to fund terrorists;. This research needs to be continued considering the limitations it has, such as seeing arguments against Cryptocurrency due to its properties (characteristics) so it is very good and it takes hard work to see it from various perspectives.

Abstract

Abstrak: Penelitian ini bertujuan menilai kesejahteraan masyarakat penerima manfaat BUMDes Karya Dermawan dalam ekonomi Islam. Ini didasari bahwa gagasan kesejahteraan ekonomi konvensional dipandang tidak sesuai, yang hanya meletakan dimensi kebutuhan materil (dunia) untuk menilai sejahteranya masayarakat. Karena itu, kesesuaian menilai sejahteranya masyarakat terletak dalam gagasan kesejahteraan ekonomi Islam, yang didilamnya terdapat penilaian dimensi kebutuhan spiritual (akhirat) dan materil (dunia), dengan mengacu lima prinsip tujuan syariat Islam (Maqasid Syariah). Penelitian ini mempergunakan pendekatan Mixed Method. Data penelitian dikumpul dari sumber primer, meliputi data kuantitatif dan kualitatif. Data kuantitatif berupa hasil kuesioner yang telah disebarkan/diisi oleh 100 responden yang diambil secara Purposive Sampling dan dihitung mengikuti teknik Slovin. Data kualitatif berupa observasi dan wawancara terhadap 6 responden yang diambil secara Snowball Sampling. Penelitian ini mempergunakan metode analisis deskriptif sebagai alat analisis data Mixed Method. Penelitian ini menujukan bahwa masyarakat penerima manfaat BUMDes Karya Dermawan sudah sejahtera dinilai dalam ekonomi Islam. Abstract

Excellent service is the main thing that must always innovate in meeting customer needs. In the competitive banking world, direct contact with service is very important because customer satisfaction is a reflection of the quality of service. This study describes excellent service to the elderly who have several obstacles such as hearing loss, low education levels, communication barriers, which must receive special attention in service. The method in this study uses a descriptive qualitative type, then the results of the study show that excellent service has been implemented for the elderly with various strategies that have been implemented such as using regional languages for elderly customers who have problems understanding banking terms in transactions.

Abstract

Purpose – This riset aims to review of recent riset on Takāful and highlight future riset directions..Methodology - This riset is descriptive qualitative, with the method used is a literature review. Riset data was collected or searched through the Emerald data base for the last 24 months (January 2022 – December 2023) by entering the keyword title in the search column "Takāful, Islamic Insurance", and by using content analysis as a data analysis tool.Findings - The study show that during the last 24 months there were 29 Takāful riset documents (in the form of journal articles) recorded in the Emerald data base. Riset has been analyzed and summarized into several sub-categories (streams), namely Takāful riset stream 1: policy, law, governance/performance, service, marketing, accounting. Takāful riset stream 2: Micro-Takāful. Takāful riset stream 3: creating a conceptual model. Takāful riset stream 4: basic human values/traditions and the application of behavioral theory to examine behavioral intentions. Finally, Takāful riset stream 5: effects of Takāful on economic development, inclusion and islamic finance. These findings also show an increase, especially in Takāful riset stream 1 and 4. Meanwhile in Takāful riset stream 2, 3 and 5 show the need for more efforts in this area, and the researchers have outlined the opportunities. Apart from that, very important riset, such as the application of digital technology to bring sharia issues and Takāful product innovation into practice and solutions have not been found in the Takāful riset stream so there is a gap and requires serious work for future riset.

Abstract

Whether we realize it or not, there is a role and results of the inspiration of fatwas of scholars (personally or collectively) in addition to laws and regulations in various Islamic countries on innovation and development of waqf objects. Dar al-Ifta Egypt is one of them, has issued many fatwas on innovation of waqf objects, including on stock waqf and distribution of benefits, which is contained in fatwa no. 3598 of 2006 on Waqf al-Ashumi wa Tasbil 'Awa'idiha. This study aims to determine the legal status and arguments in the fatwa of Dar al-Ifta. This study is a qualitative study, with research data sourced from primary data in the form of the fatwa, using content analysis as a data analysis tool. This study shows that Dar al-Ifta has determined in its fatwa that stock waqf and distribution of benefits are permissible. Dar al-Ifta's argument for allowing it is using the concept of analogy (equation) regarding the permissibility of cash waqf. Dar al-Ifta strengthens its fatwa argument by referring to several arguments, where the arguments are the opinions of the scholars of the School of Thought about the permissibility of cash waqf (dinar and dirham). By knowing the legal status and arguments of the Dar al-Ifta fatwa, shares are determined as something that has the same function and benefits as money so that it can be used as an object of waqf (such as in the category of movable objects). This fatwa has implications for efforts to reform Islamic law in the field of waqf, and also has practical implications for society and for the increasingly advanced development of Islamic economics and finance. Furthermore, it is an open area for further research, related to the impact on the spread and response of society after the fatwa is issued or determined. It is also interesting to study the practice of stock waqf in various Islamic countries that are currently taking place, by linking it to existing fatwas and connecting it from various perspectives.

Abstract

The development of gambling presents complexities within both positive law and Islamic law. In Indonesian positive law, gambling is strictly regulated to protect society, whereas in Islamic law, gambling is deemed haram due to its moral and economic harm to individuals and society. This study examines the claw machine game, which is often considered entertainment but raises questions about its legal status as gambling. This research employs a normative legal method with a comparative analysis to contrast the perspectives of positive law and Islamic law regarding the claw machine game. The results show that, under positive law, there is a classification for determining gambling, and this game is considered entertainment. In contrast, Islamic law does not classify entertainment as a factor in evaluating this game, and it is considered a form of gambling. [Perkembangan judi menghadapi kompleksitas dalam hukum positif dan hukum Islam. Dalam hukum positif Indonesia, perjudian diatur ketat untuk melindungi masyarakat, serta dalam hukum Islam, perjudian dianggap haram karena merugikan individu dan masyarakat secara moral dan ekonomi. Penelitian ini mengkaji permainan capit boneka, yang sering dianggap sebagai hiburan, namun dipertanyakan status hukumnya sebagai perjudian. Penelitian ini menggunakan metode hukum normatif dengan analisis komparatif untuk membandingkan perspektif hukum positif dan hukum Islam mengenai permainan capit boneka. Hasil menunjukkan bahwa dalam hukum positif terdapat klasifikasi dalam menentkan perjudian dan permainan ini dianggap sebagai hiburan. Sedangkan hukum Islam tidak mengklasifikassikan hiburan dalam menilai permainan ini dan dianggap sebagai bentuk perjudian].

Abstract

This study investigates the comparative levels of Riba literacy among male and female residents of Sebukar Village. Employing a quantitative approach, the research utilizes a questionnaire survey administered to 50 males and 50 females. Data analysis is conducted using the Mann-Whitney test to assess significant differences in Riba literacy between genders. Findings reveal no statistically significant disparity in Riba literacy levels between male and female respondents. This research contributes to the existing literature by demonstrating that gender does not appear to be a determining factor in Riba literacy within the specific context of Sebukar Village.

Abstract

The legal awareness of fast food MSMEs regarding halal certification in Kerinci Regency is an important topic with the majority of the population being Muslim. However, the low level of legal awareness regarding halal certification can hinder the progress of MSMEs. This study aims to examine the level of legal awareness of fast food MSME players regarding halal certification in Kerinci Regency. Testing the level of legal awareness in terms of knowledge, understanding, attitudes and behavior. This research uses quantitative descriptive method. The research data were collected from primary data in the form of questionnaires distributed and answered by 100 fast food MSME actors, using descriptive analysis as a data analysis tool. The results showed that the level of legal awareness of fast food MSME players in Kerinci Regency is very low, where it can be seen that the value or percentage in terms of knowledge, understanding, attitude and behavior is very low. The findings of this study underscore the need for an effort and method/strategy to increase the legal awareness of fast food MSME players regarding halal certification so that it can provide a breakthrough and at the same time have implications in supporting ongoing halal developments.
