Abstract

The purpose of writing this scientific journal is to find out the regulations and legal protection for investors who suffer losses due to misleading information, which is one of the practices of market manipulation in stock trading in the capital market, viewed from the aspect of legal protection for investors from the perspective of DSN MUI fatwa No. 80 of 2011. Misleading information is a form of market manipulation that can harm investors and requires legal protection. Investors and the public need to know more clearly about market manipulation practices found in the capital market, especially in the Sharia capital market. In the capital market, there is fraud in the form of market manipulation, one form of which is the act of providing misleading information. The research method used in this writing is a normative juridical approach. The normative juridical approach is an approach carried out by examining theories, concepts, legal principles, and statutory regulations related to this discussion. The research results show that in most cases that occur in the capital market, the object is information that can influence securities prices and investment decisions for investors. The practice of misleading information is an activity used to create a false picture regarding buying and selling activities and prices on the stock exchange. This activity is usually carried out by individuals in the capital market with the aim of influencing securities prices and disseminating incomplete and misleading information. Legal protection that can be carried out is preventive and repressive protection. Preventive legal protection is carried out by providing education to the public and monitoring transactions carried out by the Financial Services Authority (OJK), while repressive legal protection includes litigation, non-litigation, and sanctions. Suggestions for future research are that researchers can find research results that lead to examples of preventive and repressive protection that have been implemented in Indonesia.

Abstract

This research aims to examine more deeply the level of divorce cases in young families during the COVID-19 pandemic in 2021 at the Binjai City Religious Court. Specifically, this research aims to answer two problem formulations: (1) the percentage rate of divorce in young families during the pandemic; and (2) the factors that influence the increase in divorce. This research includes qualitative research using a case approach. This type of empirical research uses primary data, namely data from the Religious Court of Binjai City regarding contested divorce in young families and data from the Supreme Court Decision Repository. Secondary data in the form of interviews with Binjai religious court employees, books, journals, and literature regulations related to this research. From this study, the researchers found that divorce cases in young families in 2021 increased compared to the years before the pandemic. The results showed an increase in the percentage of divorce in young families by 15%, namely 408 cases in 2021 compared to 2020, which was only 347 cases. The main factors are economic and psychological pressures due to the pandemic.

Abstract

Waqf as an integral part of Islamic teachings is a guideline for social worship which requires the separation and/or handover of part of the assets belonging to the waqf to be utilized in accordance with sharia, as regulated in Law Number 41 of 2004. The main purpose of waqf is devotion to Allah SWT and devotion. public. However, waqf practices often do not run in an orderly and efficient manner, as evidenced by the lack of data collection which causes many waqf assets to be poorly maintained and even transferred to third parties unlawfully. This research uses a descriptive method with a juridical-sociological approach. The focus is to understand the procedures, situations and views of the community regarding waqf practices, as well as measuring the effectiveness of the law in handling waqf disputes. It is hoped that the research results can provide further understanding of the challenges and solutions in managing waqf in society, as well as support efforts to advance the goals of waqf, which are actually for worship and general welfare in accordance with Islamic sharia. The aim of this research is to find out how Agrarian law works in the case of Waqf Land Disputes resulting from the Transition as Public Facilities.

Abstract

Before the introduction of Islamic law, the Indonesian people adhered to customary law which had various systems and was very diverse in nature. In reality, the Islamic religion has had a big influence on the lives of Indonesian people to this day. Apart from that, the majority of the Indonesian population adheres to Islam, so it is natural that Islamic law always colors national law in Indonesia. The aim of this research is to find out the history of the implementation of Islamic law in Indonesia and the role of Islamic law in the development of national law in Indonesia using library research methods. The conclusion of this research is that Islamic law entered Indonesia at the same time as Islam entered Indonesia, which according to some circles began in the VII or VIII century AD. Meanwhile, Western law was only introduced by the VOC at the beginning of the seventeenth century AD and in the development of Indonesian national law, religious law ( Islamic law) is the most dominant basis, where Islamic law plays a very important role in shaping Indonesian human behavior. Therefore, Islamic law is an absolute element for the development of Indonesian national law. Keywords: History of Islamic Law, Theory of Islamic Law, reception a complex

Abstract

Case No.135/Pdt.G/2022/MS/Ttn is a divorce case filed by the husband because it cannot be defended anymore. One of the consequences is that the husband is burdened to pay maintenance, namely madhiyah, iddah, and mut'ah. A wife can apply to the Panel of Judges to request payment of maintenance if the husband does not fulfill his obligation to provide. This research aims to find out the judge's consideration by not giving 1/3 of the salary to the ex-wife who is divorced by a husband who works as a civil servant. Whereas as in Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 the wife gets 1/3 of the salary of the husband who is a civil servant after the divorce. This research is a type of library research and uses a statutory approach (statue approach) case approach and uses an analytical descriptive method and uses a deductive mindset. Legal materials consist of primary legal materials, namely decision No.135/Pdt.G/2022/MS/Ttn, Marriage Law Number 1 of 1974, Compilation of Islamic Law, Government Regulation No.10 of 1983 jo Government Regulation No. 45 of 1990. The result of this research is that the Judge does not issue 1/3 husband's salary based on Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 to the divorced ex-wife. With consideration because the Respondent/wife is also a civil servant. The judge prioritizes the principle of justice for the community that is not a civil servant.
