Abstract

Before the introduction of Islamic law, the Indonesian people adhered to customary law which had various systems and was very diverse in nature. In reality, the Islamic religion has had a big influence on the lives of Indonesian people to this day. Apart from that, the majority of the Indonesian population adheres to Islam, so it is natural that Islamic law always colors national law in Indonesia. The aim of this research is to find out the history of the implementation of Islamic law in Indonesia and the role of Islamic law in the development of national law in Indonesia using library research methods. The conclusion of this research is that Islamic law entered Indonesia at the same time as Islam entered Indonesia, which according to some circles began in the VII or VIII century AD. Meanwhile, Western law was only introduced by the VOC at the beginning of the seventeenth century AD and in the development of Indonesian national law, religious law ( Islamic law) is the most dominant basis, where Islamic law plays a very important role in shaping Indonesian human behavior. Abstract

Case No.135/Pdt.G/2022/MS/Ttn is a divorce case filed by the husband because it cannot be defended anymore. One of the consequences is that the husband is burdened to pay maintenance, namely madhiyah, iddah, and mut'ah. A wife can apply to the Panel of Judges to request payment of maintenance if the husband does not fulfill his obligation to provide. This research aims to find out the judge's consideration by not giving 1/3 of the salary to the ex-wife who is divorced by a husband who works as a civil servant. Whereas as in Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 the wife gets 1/3 of the salary of the husband who is a civil servant after the divorce. This research is a type of library research and uses a statutory approach (statue approach) case approach and uses an analytical descriptive method and uses a deductive mindset. Legal materials consist of primary legal materials, namely decision No.135/Pdt.G/2022/MS/Ttn, Marriage Law Number 1 of 1974, Compilation of Islamic Law, Government Regulation No.10 of 1983 jo Government Regulation No. 45 of 1990. The result of this research is that the Judge does not issue 1/3 husband's salary based on Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 to the divorced ex-wife. With consideration because the Respondent/wife is also a civil servant. The judge prioritizes the principle of justice for the community that is not a civil servant. Abstract

Penelitian ini membahas tentang hak imunitas advokat berdasarkan uu nomor 18 tahun 2003 tentang advokat secara tegas mengatur mengenai hak ini, memberikan perlindungan hukum kepada advokat dalam menjalankan tugas profesinya, Pendekatan normatif digunakan untuk menganalisis peraturan perundang-undangan yang berlaku, terutama UU Nomor 18 Tahun 2003 tentang Advokat dan peraturan terkait lainnya, Hasil penelitian menunjukkan bahwa pemahaman advokat mengenai hak imunitas mereka masih terbatas. Banyak advokat yang belum mengetahui secara detail mengenai ruang lingkup dan batasan dari hak imunitas tersebut. Hal ini menyebabkan advokat seringkali ragu-ragu dalam menjalankan tugasnya dan khawatir akan tuntutan hukum. Kesimpulan Penelitian Menegaskan bahwa Hak imunitas atau kekebalan hukum tidak hanya diatur dalam Pasal 16 Undang- Undang Advokat mengenai hak imunitas seorang advokat, Hak imunitas atau kekebalan hukum advokat bergantung dari itikad baik advokat tersebut, hak imunitas atau kekebalan hukum juga diatur dalam Pasal 50 KUHP yaitu “Barang siapa melakukan perbuatan untuk melaksanakan ketentuan undang-undang, tidak dipidana”akan tetapi pasal tersebut memuat tentang pengecualian hukum.

Abstract

The distribution of marital joint property after divorce in Indonesian Islamic family law is normatively regulated by Article 97 of the Compilation of Islamic Law (KHI), which mandates an equal division (50:50) between spouses. However, the rigid application of this provision often fails to achieve substantive justice, as it disregards actual contributions, power relations within marriage, and structural gender inequalities. This study aims to examine the legitimacy of contra legem judicial decisions in marital property disputes and to reconstruct a more just model of distribution based on the perspective of maqāṣid al-sharī‘ah. This research employs a normative legal method using statutory, conceptual, and case-based approaches. The analysis is grounded in John Rawls’ theory of distributive justice as the grand theory, Satjipto Rahardjo’s progressive law as the middle theory, and Yasser Auda’s maqāṣid al-sharī‘ah framework as the applied theory. The findings demonstrate that the mechanical 50:50 division of joint property represents formal equality rather than substantive justice and, in certain cases, perpetuates injustice against the economically and socially disadvantaged spouse, particularly women. The study further finds that contra legem judicial rulings in joint property cases possess strong juridical, philosophical, and ethical justification when based on factual contributions and contextual realities. From a maqāṣid perspective, the distribution of marital property must prioritize justice (al-‘adl), protection of wealth (ḥifẓ al-māl), and public welfare (maṣlaḥah), rather than mere numerical equality.

Abstract

This study examines consumer protection concerning the quality of Pertamina’s fuel in the case of Pertamax adulterated with Pertalite, analyzed through the perspective of Wahbah Az-Zuhaili. The background of this research stems from the increasing allegations of fuel adulteration by individuals within PT Pertamina Patra Niaga and its subsidiaries, which have caused significant losses to both society and the state. The study aims to analyze the forms of consumer protection law violations in this case and to review the legal solutions from both positive law and Islamic law perspectives. This research employs a normative legal method with a qualitative approach, utilizing primary legal materials such as Law No. 8 of 1999 on Consumer Protection, alongside secondary materials including legal literature and academic journals. The findings indicate that the practice of mixing Pertamax and Pertalite violates Articles 7 and 8 of the Consumer Protection Law (UUPK) as it involves trading goods inconsistent with their labeling and quality standards. From the Islamic perspective, such an act constitutes tadlīs fī al-jawdah (deception in product quality), which is strictly prohibited, as emphasized by Wahbah Az-Zuhaili in al-Fiqh al-Islāmī wa Adillatuhu. The state holds both legal and moral responsibilities as waliy al-amr to uphold justice through effective supervision (hisbah) and firm law enforcement. In conclusion, the practice of fuel adulteration represents a violation of both national and Sharia law. Therefore, reform in energy distribution governance, transparency in monitoring, and consumer education are essential to prevent similar fraudulent acts in the future

Abstract

This study investigates the significance of professional ethics in fostering professionalism, integrity, and credibility within the Indonesian National Police as a law enforcement institution. The research highlights the persistent issues of ethical misconduct and abuse of power, which have contributed to the decline of public trust toward the police. The study is grounded in the urgency to strengthen the enforcement of the professional code of ethics as a means to develop an integrity-based, human-oriented police institution that gains public confidence. Using a normative legal approach, this research analyzes various legal frameworks, academic literature, and secondary data related to the implementation of professional ethics within the police force. The findings indicate that professional ethics play a vital role in aligning police conduct with the values ​​of justice, accountability, and humanity. Both internal factors, such as leadership and organizational culture, and external influences, including public oversight and media involvement, significantly affect the effectiveness of ethical enforcement. Furthermore, consistent moral development, ethical education, and fair disciplinary measures have been shown to enhance public trust in the police. In ethics conclusion, reinforcing professionals is essential for establishing a competent and integrity driven police institution. Sustained leadership commitment, proportional sanctions, and transparency to public scrutiny are key to ensuring accountability and fairness in Indonesia's law.

Abstract

Evidence in civil cases is an important aspect that determines the success of dispute resolution in court. This article discusses the definition of proof, the process of proof in civil trials, the types of evidence, the legal basis that regulates it, and the obstacles that are often faced in the implementation of proof. The research method used is normative legal research with a descriptive-analytical approach through literature study. The results showed that a good understanding of evidence and the support of an effective judicial system are needed so that the objectives of justice and material truth can be achieved. The evidentiary process in civil cases is an important part that determines the success of a lawsuit in court. Evidence aims to clarify the truth of the facts argued by the parties so that the judge can make a fair decision based on valid and convincing evidence. This article is expected to be useful for law students, legal practitioners, and the general public interested in civil law.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana proses  penyerahan barang dalam akad murabahah dilaksanakan oleh bank syariah berdasarkan aturan hukum yang berlaku di Indonesia dan praktik yang dilakukan dalam dunia perbankan. Penelitian ini dilatarbelakangi oleh bagaimana proses penyerahan barang (qabdh) dalam akad murabahah di perbankan syariah berdasarkan aturan di Indonesia dan kenyataan di lapangan, serta mengkaji pertimbangan hukum dalam putusan Pengadilan Agama Medan No. 14/Pdt.G/2024/PTA.Mdn terkait keabsahan proses penyerahan barang tersebut. Metode penelitian ini menggunakan metode kualitatif dengan jenis penelitian yuridis normatif  dengan pendekatan judicial case study yaitu case approach dan statute approach. Perbankan syariah terus berkembang dengan akad murabahah sebagai produk utama, namun masih ada masalah dalam proses serah terima barang, khususnya soal qabdh haqiqi dan qabdh hukmi, sehingga prosedur perlu diperbaiki agar sesuai syariah dan hukum serta melindungi hak nasabah, seperti yang ditegaskan dalam putusan Pengadilan Tinggi Agama Medan No. 14/Pdt.G/2024/PTA.Mdn. Putusan Pengadilan Tinggi Agama Medan No. 14/Pdt.G/2024/PTA.Mdn menegaskan bahwa akad murabahah baru sah kalau barang diserahkan langsung diserahkan ke nasabah sebelum pembayaran dimulai jika tidak bank dianggap melakukan kesalahan dan harus bertanggung jawab atas kerugian nasabah.

Abstract

Abstract: The legal and economic systems in Indonesia continue to develop alongside the growing need to balance legal certainty with moral and religious values, particularly in the practice of debt collateral institutions. In this context, two systems coexistconventional pawn (pand) and Islamic pawn (rahn)which, although serving the same purpose as debt guarantees, differ in their legal principles and value orientation. This study aims to analyze and compare the regulation, utilization of collateral objects, risks, and execution mechanisms between rahn and pand as stipulated in the Indonesian Civil Code (KUHPerdata), the Compilation of Sharia Economic Law (KHES), and the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). Using a normative-comparative method with a qualitative descriptive approach through library research, the study reveals that while rahn and pand share similar objectives, they differ significantly in legal basis, economic orientation, and operational mechanisms. Rahn is founded on the principles of mutual assistance (tabarru) and sharia justice without interest, whereas pand is profit-oriented with an interest-based system. Overall, rahn reflects a more balanced integration of legal, moral, and socio-economic justice.Keyword: rahn, pand, KHES, civil code, DSN-MUIAbstrak: Sistem hukum dan ekonomi di Indonesia terus berkembang seiring dengan meningkatnya kebutuhan akan keseimbangan antara kepastian hukum dan nilai moral keagamaan, khususnya dalam praktik lembaga jaminan utang. Dalam konteks ini, terdapat dua sistem yang berjalan berdampingan, yaitu gadai konvensional (pand) dan gadai syariah (rahn), yang meskipun memiliki tujuan sama sebagai jaminan pelunasan utang, berbeda dalam prinsip hukum dan orientasi nilai. Penelitian ini bertujuan untuk menganalisis dan membandingkan pengaturan, pemanfaatan objek, risiko, serta mekanisme eksekusi antara rahn dan pand dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata), Kompilasi Hukum Ekonomi Syariah (KHES), dan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI). Metode yang digunakan adalah penelitian normatif-komparatif dengan pendekatan deskriptif kualitatif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa rahn dan pand memiliki tujuan yang sama sebagai jaminan utang, namun berbeda dalam prinsip hukum, orientasi ekonomi, dan mekanisme pelaksanaan. Rahn berlandaskan prinsip tolong-menolong (tabarru) dan keadilan syariah tanpa bunga, sedangkan pand bersifat profit-oriented dengan sistem bunga. Secara keseluruhan, rahn lebih mencerminkan keseimbangan antara aspek hukum, moral, dan sosial ekonomi yang berkeadilan.Kata kunci: rahn, pand, KHES, KUHPerdata, DSN-MUI

Abstract

Unregistered marriages remain a common phenomenon in Indonesian society and raise various legal issues, particularly regarding the status and protection of children born from such marriages. This study aims to analyze the regulation of unregistered marriages according to Law Number 1 of 1974 concerning Marriage, examine the resulting legal consequences, and examine the forms of legal protection for children resulting from unregistered marriages. This study uses a normative legal research method with a statutory, conceptual, and case approach, primarily through an analysis of statutory regulations, legal doctrine, and Constitutional Court Decision Number 46/PUU-VIII/2010. The results of the study indicate that although unregistered marriages can be considered valid according to religion, they do not have formal legal force in the eyes of the state, resulting in the failure to fulfill children's civil rights, such as the right to maintenance, inheritance, and legal identity. The Constitutional Court decision has expanded the recognition of civil relations between children and their biological fathers, but its implementation still faces legal and social obstacles. Therefore, it is necessary to strengthen regulations, increase public legal awareness, and reform marriage registration policies to ensure fair and comprehensive legal protection for children as subjects of human rights.
