Abstract

Sharia Economic Law develops in line with the development of Sharia Economics in Indonesia. This is certainly with the support of various stakeholders who handle it. It is interesting to discuss how DSN-MUI as an authority that issues fatwas related to sharia economics, especially in the field of financing, is able to balance the needs of Sharia Financial Institutions and customers until now the existence of Sharia Financial Institutions is getting better. This study is intended to examine the dynamics of sharia economic fatwas by DSN-MUI using analytical descriptive methods. It was found that DSN-MUI uses various methods and approaches in compiling fatwas that are in line with the needs of Sharia Financial Institutions while still adhering to the principles of Islamic law in the field of economics.

Abstract

Kafā’ah (equivalence) constitutes a fundamental principle in Islamic marriage law, aimed at ensuring compatibility between the bride, the groom, and their respective guardians. In East Java, this principle intersects with the cultural practice of calculating weton a Javanese astrological system used to predict harmony and marital success demonstrating how religion and local traditions converge in shaping marital norms. This study aims to analyze the integration of weton practices into the concept of kafā’ah within the socio-legal framework of Islamic marriage law in Indonesia. Employing a qualitative approach, it draws on socio-legal analysis of primary Islamic legal sources, local customs, and state regulations. The data were obtained through document analysis, literature review, and interviews with religious leaders and community figures in East Java. The findings reveal that weton calculation is widely regarded as a cultural expression of kafā’ah, reflecting communal efforts to preserve marital harmony. Although rooted in tradition, it is often interpreted through a religious lens, thereby shaping community perceptions of marriage readiness. This dynamic interplay between Islamic jurisprudence and Javanese wisdom not only sustains local traditions but also enriches the understanding of compatibility in Indonesian marriage law. The study emphasizes the importance of incorporating cultural context into legal development, illustrating how practices such as weton serve to bridge the normative framework of Islamic law with the socio-cultural realities of Indonesia.

Abstract

This research is motivated by the phenomenon of the implementation of digital village financial management which has various implications for transparency, accountability, and village financial governance. In the perspective of Siyasah Dusturiyah, digital village financial management must be carried out with the mandate and efforts of Hifzh Al-Mal (protection of state assets) which must be accounted for. The purpose of this research is to describe the implementation of digital village financial management in Darmaraja Village and assess its effectiveness based on Article 2 Paragraph (1) of the Regulation of the Minister of Home Affairs Number 20 of 2018 and analyze its compliance with the principles of Siyasah Dusturiyah. This research uses an empirical juridical method through field observation. Data were obtained through literature reviews, documentation, and interviews with village officials, BPDs, community leaders, the DPMD of West Java Province, and the Regional Government Bureau of the Secretariat of West Java Province. The results of the study indicate that the implementation of Darmaraja village financial management has succeeded in creating an administrative discipline system for village officials. However, from the community perspective, low digital literacy is still an obstacle, so billboards are a viable solution to bridge the information gap. From the perspective of Siyasah Dusturiyah, this shows that successful digital village financial management must be accompanied by a change in work culture that prioritizes community welfare, ensuring that Hifzh Al-Mal efforts are realized not only administratively but also tangibly through inclusive transparency.

Abstract

This study analyzes the Rereongan Sapoe Sarebu (Poe Ibu) Movement policy from a siyasah maliyah perspective and evaluates its effectiveness in enhancing community welfare. Employing a qualitative empirical juridical approach, it draws on in-depth interviews, field observations, and documentation from Batununggal District, Bandung City. Findings reveal strong normative legitimacy for Poe Ibu within Indonesian positive law and Islamic jurisprudence, embodying maslahah (welfare), distributive justice, and social solidarity. However, sub-district implementation falters due to administrative hurdles, poor inter-agency coordination, and technical misalignment. In contrast, educational institutions show notable success in boosting social participation and solidarity, despite community debates and obstacles. From a siyasah maliyah viewpoint, the policy is justifiable if voluntary, transparent, and supplementary to state welfare duties. Recommendations include strengthening regulations, transparency, and accountability to ensure optimal, sustainable implementation aligned with social justice.

Abstract

Penelitian ini dilatarbelakangi oleh fenomena rangkap jabatan yang dilakukan oleh sejumlah Wamen sebagai komisaris pada perusahaan Badan Usaha Milik Negara yang dinilai mencederai prinsip negara hukum dan tata kelola pemerintahan yang baik. Anjuran penyelesaian ini sebenarnya sudah diselesaikan semenjak tahun 2019, akan tetapi pemerintah mengabaikan. Hingga sampai puncaknya dikeluarkannya putusan Mahkamah Konstitusi nomor 128/PUU-XXIII/2025 mengenai larangan rangkap jabatan oleh Wakil Menteri. Sehingga putusan ini harus segera dilaksanakan sampai kurun waktu 2 tahun lamanya. Tujuan utama penelitian ini adalah untuk menganalisis pertimbangan hakim, implikasi status jabatan, mekanisme pelaksanaan putusan dan dampak stabilitas politik disertai dengan kajian perspektif Siyasah Qadhaiyyah. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kualitatif melalui analisis teks dan norma hukum. Hasil penelitian menunjukkan bahwa implikasi putusan ini, terhadap posisi Wakil Menteri adalah keharusan bagi Wakil Menteri untuk melepaskan jabatannya, diantara melepaskan posisinya sebagai Wamen atau melepaskan posisinya sebagai komisaris pada perusahaan BUMN. Pasca dikeluarkannya putusan ini, pemerintah membutuhkan mekanisme secara terhubung baik secara regulasi maupun teknis antara Kementerian dan lembaga untuk melaksanakan putusan ini. Sedangkan secara substansial, pasca dikeluarkannya putusan ini pemerintah akan dihadapkan pada 2 sisi stabilitas politik. Pertama, dari sisi penguatan kelembagaan. Kedua, dari sisi menghadirkan ketegangan di antara para pejabat elit yang memiliki kepentingan terhadap urusan jabatannya. Putusan ini selaras dengan prinsip Siyasah Qadhaiyyah, dimana putusan ini masuk pada kategori menjaga nilai Maqashid Sharia terkhususnya dalam menjaga negara (Hifz al-Dawla) dari kerusakan yang terstruktur.

Abstract

The practice of nikah sirri in Indonesia often results in the husband’s absolute authority, which is detrimental to women due to the lack of state legal protection. This study aims to analyze the impact of such authority on women’s rights through the perspective of Maqāṣid al-Syarī’ah and to propose a reconstruction of family law. The method employed is normative legal research with an ecosentric approach, examining laws, legal concepts, and court rulings. The results of the study indicate that absolute authority in secret marriages disrupts the family justice ecosystem and violates the principles of Maqāṣid, particularly the protection of life (ḥifẓ al-nafs), lineage (ḥifẓ al-nasl), and property (ḥifẓ al-māl). Women face structural vulnerabilities in the form of the loss of maintenance rights, shared property, and the legal status of their children. In conclusion, this practice contradicts the spirit of substantive Islamic justice. A legal reconstruction is needed to strengthen the role of the state and judges as guardians of the balance of the justice ecosystem, as well as a reinterpretation of the concept of qiwamah based on consultation and gender justice. Marriage registration must be viewed as a Sharia instrument to guarantee human dignity, not merely an administrative formality.

Abstract

Despite the growing body of literature on Islamic economic dispute resolution, no study has systematically reconstructed the conceptual boundary between unlawful acts (perbuatan melawan hukum) and contractual default (wanprestasi) within the framework of sharia contract law. This gap produces legal inconsistency and undermines substantive justice in Indonesian Religious Courts. This study critically examines and reconceptualizes the application of unlawful act doctrine in sharia economic disputes, proposing a contract-centered legal reasoning model integrated with maqāṣid al-sharī'ah as a normative corrective framework. A juridical-empirical approach with qualitative case study design was employed. Data were drawn from Religious Court decisions on sharia economic disputes, supplemented by in-depth interviews with judicial officials and systematic documentary analysis of the Compilation of Sharia Economic Law (KHES) and DSN-MUI fatwas. Inductive thematic analysis followed the Miles and Huberman interactive model, with source and method triangulation to ensure validity. Judges consistently accepted unlawful act claims in contract-originated disputes without adequately examining the contractual structure as the primary legal foundation. References to KHES and DSN-MUI fatwas were marginal and non-systemic, resulting in significant inter-decision inconsistency across cases with substantively similar fact patterns. Practical flexibility in evidentiary standards emerged as a key driver of this misqualification. This study is the first to offer a conceptual reconstruction of unlawful act doctrine within sharia economic dispute law by positioning the contract as the primary analytical anchor and unlawful acts as a residual legal regime, applicable only when the disputed conduct falls entirely outside the contractual relationship. Unlike prior work focused on institutional or procedural dimensions, this study integrates modern contract law theory, socio-legal analysis, and maqāṣid al-sharī'ah into a coherent normative framework for religious court adjudication. The findings provide actionable guidance for judges, policymakers, and the Supreme Court in developing interpretive standards that strengthen legal certainty and sharia compliance in Islamic economic justice
