Abstract

State life and governance cannot be separated from the rule of law. As a religious organisation, it is necessary to follow the rules set out in the teachings, just as Islam has rules and regulations that must be followed by its followers. This research aims to describe the Basic Sources of Islamic Law (Analysis of Al-Qur'an and Al-Hadis). This research is a qualitative research with literature review type. Information collection is carried out by looking for several important sources including primary sources from literature sources that discuss the Basic Sources of Islamic Law (Analysis of the Qur'an and Al-Hadith) and several other literature sources related to the research. The data collected was then analysed so as to obtain the results of the study which showed that the sources of law in Islam are the Qur'an and As-Sunnah, the words of God and the As-Sunnah of the Prophet which are the basic principles of Islamic teachings. Understanding these two sources of law is important because they are not separate, there is a connection between them in defining the laws that apply to Islam. Therefore, it is important to understand both legal texts, if there is a misunderstanding between the two, it will damage the existence of the legal cause. By understanding the two sources of law, namely the Qur'an and Hadith, one will get legal advice according to the guidance of the Sharia and the Sunnah of the Prophet Muhammad SAW. This article describes the existence of two sources of Islamic law in its application to the general public, using a thematic approach.

Abstract

It is interesting to re-discuss the controversy about something claimed as a prophetic tradition (al-Hadîth), especially when it is related to its explanatory-doctrinal function to al-Qur’ân and to its implication for essential Islamic doctrines. The account of Gharâniq claimed by some experts as a prophetic tradition is one of the models of old cases, but it remains to produce a religious discourse colored with pros and cons. Some experts believe in the existence and validity of the account of Gharâniq, some others reject it partly or with “notes”, and the others reject it totally. This article tries to analyze critically the account of Gharâniq by exploring literatures on exegesis and traditions in order to discuss and treat this topic more proportionally.

Abstract

PTKI (Perguruan Tinggi Keagamaan Islam) merupakan lembaga pendidikan tinggi di bawah naungan Kementerian Agama Republik Indonesia yang menyelenggarakan pendidikan berlandaskan nilai-nilai Islam. Jenis penelitian ini adalah kualitatif dengan metode deskriptif, sedangkan teknik pengumpulan data dilakukan melalui studi lapangan dan dokumentasi. Penelitian ini dilakukan di Subdirektorat Sarana Prasarana dan Kemahasiswaan Kementerian Agama Republik Indonesia. Hasil penelitian menunjukkan bahwa Subdirektorat Sarpras Kementerian Agama memiliki peran penting dalam peningkatan mutu PTKI melalui pengembangan sarana prasarana berbasis SBSN, program KIP Kuliah, dan pelatihan mahasiswa. Dukungan tersebut meliputi pengelolaan sarana pendidikan, penguatan akses bagi siswa yang kurang mampu, serta pengembangan karakter dan kepemimpinan. Dengan pemantauan dan evaluasi yang terpadu, Subdirektorat Sarpras memastikan program berjalan efektif, transparan, dan berkelanjutan, sehingga PTKI dapat menghasilkan lulusan yang kompeten, berdaya saing, dan berkontribusi bagi masyarakat. Implikasi dari penelitian ini dapat memberikan rekomendasi bagi Kementerian Agama untuk meningkatkan pengelolaan sarpras di PTKI. Hal ini diharapkan dapat meningkatkan kualitas PTKI sehingga dapat memberikan kontribusi bagi kemajuan bangsa.

Abstract

Madrasah is a religious-based educational institution that aims to provide religious and general knowledge. This research uses a qualitative approach with descriptive methods. The object of this research includes program implementation and its impact on madrasah facilities. Data were obtained through observation, field study, and documentation, while data analysis used data reduction, data presentation and conclusion drawing. The results show that the SBSN program for madrasah aims to improve educational facilities and infrastructure with the main requirements of legal land legality and proposal submission procedures involving documents such as land certificates, TOR, RAB, and recommendation letters from the regional Ministry of Religious Affairs. The program covers the construction of 7 types of buildings, including classrooms, laboratories, libraries, dormitories, and teachers' messes, with prototype designs that can be adapted to site conditions. The implications of this research can be used as input for related parties in improving the implementation of the SBSN program in a transparent, accountable, and sustainable manner to support the development of adequate infrastructure for madrasah education.

Abstract

Mutasi jabatan nondosen menjadi dosen di lingkungan Kementerian Agama RI merupakan isu penting dalam pengelolaan sumber daya manusia di sektor pendidikan tinggi. Penelitian ini bertujuan untuk menganalisis kebijakan dan prosedur mutasi pegawai nondosen menjadi dosen di lingkungan Kementerian Agama RI. Kajian ini berfokus pada analisis kebijakan, prosedur pelaksanaan, dan manfaat kebijakan mutasi. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi pustaka dan studi lapangan, yaitu pengumpulan data dari berbagai dokumen resmi, peraturan, pustaka terkait, serta wawancara dengan pihak-pihak terkait. Hasil penelitian menunjukkan bahwa kebijakan ini merupakan peningkatan kualitas tenaga pengajar di perguruan tinggi agama Islam negeri melalui mutasi pegawai negeri sipil nondosen yang memiliki kualifikasi akademik dan kompetensi yang sesuai. Proses mutasi melibatkan beberapa tahapan, mulai dari pengajuan usulan hingga penetapan pejabat oleh Menteri Agama. Prosedur ini meliputi verifikasi data, uji kompetensi, dan koordinasi antar unit kerja terkait, baik di pusat maupun daerah. Manfaat kebijakan ini antara lain untuk meningkatkan mutu pendidikan, memadukan teori dengan praktik mengajar, serta mengoptimalkan potensi sumber daya manusia. Oleh karena itu, dukungan lintas unit, pemenuhan persyaratan yang jelas, dan manajemen perubahan yang efektif adalah kunci keberhasilan penerapan kebijakan ini.

Abstract

Abstract: Dr. Ali Abdul Halim Mahmoud is one of the contemporary Muslim intellectuals who believes that there are noble tools in his book. Noble tools, The main source of human moral education is the Qur'an and the Sunnah. An Nur: 47-53 The concept of Islamic education in the letter of Ali Abdul Halim Mahmud aims to emphasize various aspects of Aqeedah (Tawhid), Shari'ah and Islamic Morality. The aspects of education contained in Surat An Nur: 47-53 are: the educator is Allah Subhanallahu Ta'ala and the Messenger of Allah Shollahu alaihi wassalam, and the learners are believers, hypocrites and Jews. Moral education, the way of education includes information, conditions, commands, and suggestions for understanding the form. Ali Abdul Halim Mahmud was a modern Sufi figure, even known as Al Ghozali in the 14th century. He suggested how to coordinate and integrate general education and Islamic religious education towards Allah Subhanallahu Ta'ala (Allah Subhanallahu Ta'ala). Abstract

The curriculum is a fundamental part of education that must be evaluated innovatively and continuously in accordance with the times and science and technology. The Merdeka Curriculum emerged as an innovation that supports learning that is more flexible and enjoyable for students, and emphasises the development of creativity and freedom of thought. This study aims to understand elementary school teachers' perspectives on the Merdeka Curriculum in the context of 21st century learning innovation. This research uses a qualitative approach by conducting in-depth interviews and focus group discussions (FGDs) with teachers in various primary schools. The data were analysed using thematic analysis to identify patterns and meanings that emerged from teachers' experiences and views on the implementation of the Merdeka Curriculum. The results showed that Merdeka Curriculum supports the development of learners' competencies through project-based learning that hones the soft skills and character of Pancasila learners. Teachers feel flexibility in teaching methods, which allows them to adjust to the abilities and needs of learners and local content. The implementation of Merdeka Curriculum in Indonesia is expected to support educational reforms that are adaptive to changing times, provide opportunities for schools to innovate according to local needs and culture, and create a pleasant learning atmosphere. This research emphasises the importance of the teacher's contribution in implementing the Merdeka Curriculum as a response to today's educational challenges.

Abstract

This study aims to examine the gender dynamics in the implementation of basadosa sanctions for adultery cases in Sintang Regency, West Kalimantan. The study uses a qualitative research methodology. A descriptive-analytical approach will be applied to explore how these sanctions are implemented on male and female offenders, with a focus on gender differences and their impacts. This research will analyze the distinctions in the application of basadosa sanctions and the social, psychological, and economic consequences experienced by male and female offenders. The findings of this study regarding the application of basadosa sanctions in adultery cases in Sintang Regency, West Kalimantan, reveal significant gender inequality, with women often receiving harsher social sanctions compared to men. Social ostracism and humiliation are more frequently experienced by women, leading to more severe psychological and social impacts for them. This occurs due to social norms that view women as the guardians of family honor, while men are more often given leniency or forgiveness. The implications of this research provide critical insights into the influence of basadosa sanctions in reinforcing or challenging gender inequality, as well as providing policy recommendations to promote gender equality in the application of customary law.
