Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana terhadap pelaku tindak pidana penyalahgunaan senjata tajam di Indonesia. Senjata tajam, meskipun sering digunakan dalam kehidupan sehari-hari seperti memasak dan bertani, juga dapat disalahgunakan untuk tindak pidana seperti pengancaman dan perampokan. Undang-Undang Nomor 12/Drt/1951 mengatur kepemilikan dan penggunaan senjata tajam, dengan ancaman hukuman penjara hingga sepuluh tahun bagi pelanggar. Meskipun demikian, peredaran senjata tajam masih sering terjadi, baik di pasar fisik maupun online, dan seringkali digunakan dalam kejahatan. Penelitian ini menggunakan studi kasus putusan Nomor 225/Pid.Sus/2024/PN Sby, di mana terdakwa dijatuhi hukuman empat bulan penjara karena melanggar Pasal 2 Ayat (1) Undang-Undang Nomor 12/Drt/1951. Studi ini mengevaluasi sejauh mana putusan tersebut mencerminkan keadilan dan efektivitas hukum dalam menangani penyalahgunaan senjata tajam. Hasil penelitian menunjukkan perlunya ketelitian lebih lanjut dalam proses hukum untuk memastikan bahwa pertanggungjawaban pidana sesuai dengan jenis dan tingkat kesalahan yang dilakukan. Selain itu, putusan yang terlalu ringan dapat mengurangi efek jera bagi pelaku. Oleh karena itu, penegak hukum diharapkan lebih serius dalam penyusunan dakwaan dan tuntutan, untuk memastikan bahwa putusan hakim adil dan efektif dalam mengatasi tindak pidana penyalahgunaan senjata tajam.

Abstract

Medicinal plants’ production systems in Indonesia’s rural Java play a crucial role in sustaining local livelihoods and healthcare needs. Medicinal plants are managed by locals independently based on household preferences and endowments through wild gathering and cultivation-based production systems. However, these situations create a continual problem of weak bargaining positions. Thus, this study aimed to assess local needs and potential in supporting medicinal plants production systems management in Java, Indonesia, with the view to advance local actors' perspectives in a multistakeholder platform. The Participatory Rural Appraisal (PRA) approach proved useful in incorporating local knowledge in the planning and development of strategies. We implemented PRA techniques, such as problem identification based on a cause-and-effect diagram, group discussion and brainstorming, preference ranking of priority species, and a Venn diagram based on stakeholders' classification. These were carried out with 150 local actors from four villages. Results reveal that Candlenut tree are the preferred species in the wild gathering system, while Javanese turmeric and Broadleaf plantain are preferred in the cultivation-based production systems. Urgent interests include more lucrative gathering and cultivation, a remunerative market, and a reliable local economic institution. The PRA results demonstrate that local actors' involvement is highly required in administering production systems to enhance medicinal plants’ sustainable production and management.

Abstract

The consideration of the person giving the decision, namely the judge, in handing down a decision regarding an act that tends towards child abuse which leads to a criminal offense is based on several elements to determine the final decision that will be taken. The judge considered that this case had several bases, namely the element of each person, the element of committing violence or threats of violence forcing the child to have sexual intercourse with him or another person, all of which had been explained in detail. Then regarding the judge's decision regarding the juvenile criminal justice system, there are no obstacles, where this choice is equivalent to the principles that speak about the Juvenile Law Enforcement Framework. One of the places in his choice, the judge chose to be imprisoned for a long time with a probationary period of half a year in prison, deducted from the period of imprisonment and a monetary fine of Rp. 2,000,000,- (two million rupiah) with the provision that if the fine cannot be paid, it will be replaced by detention for more than 90 days. In fact, article 71 paragraph (3) states that assuming the punishment is in the form of a financial fine, the total punishment will be imposed as detention and the fine will be replaced with work preparation. This implies that fines for children who are struggling with the law should be fixed on the assumption that they cannot meet the agreed fines, for example, work preparation. Abstract

Every land transportation accident always causes losses only to users, both moral and material. Especially accidents involving public transportation. Public transportation companies pay little attention to aspects of security, comfort, safety, affordability, equality and regularity of passengers. This research uses a normative juridical research type with a problem formulation, namely: How is the legal protection for public transportation consumers when a traffic accident occurs and what is the criminal liability of public transportation companies in the of a traffic accident. The research results are as follows: Legal protection for consumers/users of public transportation services is regulated in Law Number 8 of 1999 concerning Consumer Protection and in Law Number 22 of 2009 concerning Road Traffic and Transportation. In the context of the legal system in force in Indonesia, efforts or means that can be used to fight for people's rights can be achieved by implementing legal and criminal sanctions, in addition to This can also be done by filing a civil lawsuit with the court, or resolving the case through non-litigation channels, namely resolving disputes outside the court through the intermediary of other parties whose existence has been regulated in statutory regulations. Theoretically, public transport companies can be held criminally liable in the event of accidents caused by vehicle unfitness. However, this cannot be done in practice because the law does not clearly regulate in what cases and when a public transportation company can be said to have committed a criminal act. Abstract

Several instances of misconduct have occurred, wherein certain individuals have taken advantage of public interest surrounding the CPNS registration process. In 2018, Defendants AD and SH profited IDR 200 million. In 2019, Defendant HB gained a profit of up to 5.7 billion Rupiah through the CPNS Recruitment mode, and in 2021, (ON) amassed a profit of 9.7 billion Rupiah. This research aims to analyze the application of the law to cases of fraud perpetrated against Candidates for Civil Servants (CPNS), and propose preventive measures to curb instances of fraud under the guise of a special pathway. The study is conducted through both normative and sociological legal research, utilizing a sociological interpretive approach. The Statute Approach and Case Approach are employed in this study. Legal material is gathered using library techniques, and the analysis of legal materials is performed using qualitative methods. The study's findings reveal that: (1) CPNS registration is strictly free of charge, and any claims suggesting the availability of internal routes for assistance are baseless. Perpetrators of such acts are subject to charges under Article 378 of the Criminal Code, which involves deceiving and causing harm to others. (2) Candidates applying for CPNS positions need not seek any special means to pass the selection process, as the principle of Bureaucratic Reform within the state civil apparatus prohibits any form of illicit practice.

Abstract

This research aims to: 1) Analyze the pre-emptive law enforcement efforts of Community Policing in the prevention of terrorism crimes based on the value of justice; 2) Analyze obstacles in efforts to enforce the pre-emptive law of Community Policing in the prevention of terrorism crimes based on the value of justice. The research method used is sociological juridical. The results of the study show that pre-emptive law enforcement efforts in the prevention of terrorism crimes have not been based on the value of justice, especially from the economic aspect, because the regulation of the pre-emptive policy model of community policing (Polmas) which is regulated in the Regulation of the Chief of the National Police of the Republic of Indonesia Number 3 of 2015 concerning Community Policing (Polmas), has not regulated operational costs that should be allocated in order to carry out Polmas duties. Obstacles in the current pre-emptive law enforcement efforts to prevent terrorism crimes based on the value of justice are related to obstacles from legal substance, which include: unregulated operational costs, infrastructure, career path coaching, and reporting systems for Bhabinkamtibmas members.

Abstract

The importance of the bank in applying the precautionary principle contributes to ensuring a sound banking system and protecting the country’s economy. In lending, the precautionary principle was manifested in a standard agreement between the bank as the creditor and the customer as the debtor. Credit agreements can lead to disputes, where the debtor sues the bank for violating the principle of consumer protection because it applies standard clauses in the credit agreement. The research method used is legal research with a statute approach and a conceptual approach). The results state that the application of the precautionary principle in making standard agreements manifests itself in the prohibition of financial service business actors including exoneration clauses to the detriment of financial service consumers as stipulated in Article 18 paragraph (1) of the Consumer Protection Act and OJK Regulation No. 6/POJK.07/Tahun 2022 concerning Consumer and Community Protection in the Financial Services Sector.

Abstract

Seawater intrusion significantly impacts groundwater quality in coastal areas, presenting a critical challenge for sustainable water resource management. This study aimed to map groundwater salinity in the southern coastal region of Jember Regency by employing simple physicochemical parameters, including Electrical Conductivity (EC), Total Dissolved Solids (TDS), and seawater fraction (fsea), which was determined using chloride (Cl-) concentrations. Fieldwork was conducted at 211 well sites across ten villages, and the sea-freshwater interface was analyzed using the Ghyben-Herzberg principle. Geostatistical analysis using Ordinary Kriging was applied to spatially map the salinity parameters. Results indicated that 83% of groundwater samples were classified as fresh, 16% as slightly saline, and 1% as moderately saline. Areas near Payangan and Watu Ulo Beaches exhibited higher seawater fractions, with fsea values up to 23%, indicating significant seawater mixing. These findings underscore the need for targeted groundwater management strategies to mitigate seawater intrusion in this region

Abstract

This study discusses legal protection for consumers in online buying and selling transactions and efforts to resolve disputes that occur due to default by business actors. In the digital era, online transactions are becoming increasingly popular because they are considered more practical and efficient. However, online shopping also has risks, such as goods that are not in accordance, late delivery, or even fraud. In Indonesia, legal protection for consumers in online transactions is regulated in Law Number 8 of 1999 concerning Consumer Protection and Law Number 1 of 2024 concerning Information and Electronic Transactions. Consumers who experience losses can file a lawsuit through the Consumer Dispute Resolution Agency (BPSK) or the court. This study uses a case study on the Shopee platform to analyze the effectiveness of BPSK in resolving consumer disputes. The results of the study show that BPSK is a more practical alternative than the courts in resolving consumer disputes. However, there are still many obstacles in its implementation, such as a lack of consumer understanding of the lawsuit filing procedure and the time-consuming and costly legal process. This study concludes that legal protection for consumers can be more effective if the government actively monitors online transactions and educates consumers about their rights. Efforts to resolve disputes through BPSK need to be improved to be more efficient and to meet consumer protection needs.

Abstract

Transportasi laut dan maritim sangat penting bagi perekonomian Indonesia karena garis pantai dan wilayah lautnya yang luas. Kapal sangat penting untuk perdagangan domestik dan internasional, yang menjadi dasar transportasi barang dan jasa. Kapal-kapal Indonesia yang terdaftar dapat berfungsi sebagai agunan pinjaman, terutama melalui hipotek kapal. Sementara itu di dalam praktek jaminan kebendaan  timbul lah permasalahan yang terhadab kekuatan hukum akta hepotek kapal laut dalam sistem hukum di Indonesia serta fungsi eksekutorial akta hepotek kapal laut itu sendiri dalam pelaksanaan sita jaminan. Adapun tipe penelitian hukum yang di gunakan yaitu metode penelitian normatif serta pendekatan penelitian ini memanfaatkan pendekatan Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach) yang dimana penelitian ini dilakukan dengan menelaah peraturan-peraturan yang berkaitan erat dengan pembahasan penelitian ini. Sesuai dengan Undang-Undang Pelayaran No. 17 Tahun 2008 Pasal 60 ayat (3) menegaskan bahwa setiap akta hipotek diterbitkan 1 (satu) grosse akta hipotek yang diberikan kepada penerima hipotek. Yang mana didalam akta hepotek serta grosse akta hepotek  memiliki irah-irah ”DEMI KEADILAN BERDASARKAN KETUHANAN YANG MAHA ESA” Sehingga menegaskan bahwa akta hepotek seta grosse akta ini mempunyai kekuatan eksekutorial yang sama dengan putusan pengadilan yang telah memperoleh kekuatan hukum tetap.
