Abstract

This study examines the phenomenon of document tracing, commonly referred to as doxing, as a growing legal and ethical challenge in Indonesia. It aims to analyze how national law, Islamic criminal law, and human rights frameworks respond to doxing, particularly in safeguarding privacy and protecting individuals from reputational and security harms. Employing a qualitative–empirical design, the research combines document analysis with case studies through a comparative approach. Data were collected via semi-structured interviews with academics, religious scholars, and activists, complemented by observation and a review of relevant laws, policies, and real-life instances of doxing. Triangulation was used to ensure credibility and comprehensiveness. The findings reveal that Indonesia has addressed doxing primarily through the Information and Electronic Transactions (ITE) Law, the Personal Data Protection Law, and provisions in the Criminal Code. From the perspective of Islamic criminal law, doxing is classified as al-jarā’im al-mahẓūrāt (prohibited acts) that violate privacy, with punishments potentially falling under hudūd or ta‘zīr. In both legal systems, doxing is recognized as a violation of fundamental human rights, particularly the right to privacy and dignity. Unlike prior studies that focus narrowly on either legal or technological dimensions, this research integrates national law, Islamic jurisprudence, and human rights principles into a unified analysis. It highlights the role of maqāṣid al-sharī‘a in developing privacy protections and in bridging classical legal concepts with contemporary digital realities. The study suggests that strengthening legal frameworks through both statutory reform and Islamic jurisprudential interpretation can provide more equitable protection for citizens. These findings contribute to broader debates on digital ethics, privacy, and the harmonization of religious and secular legal systems in addressing emerging cybercrimes.

Abstract

Islamic finance is an alternative economic system that is growing rapidly in Indonesia, based on Islamic principles such as the prohibition of usury, fairness in transactions, transparency, and social responsibility. This paper examines the main principles of the Islamic financial system, including the prohibition of usury and gharar, as well as the application of ethical and moral values ​​in financial activities. In addition, this article also discusses various innovative Islamic financial products such as sukuk, microfinance, and Islamic insurance, which are designed to meet the needs of the community while still upholding Islamic principles. Despite significant growth, this industry still faces a number of challenges, including limited regulations that support innovation, low public literacy, tight competition with conventional systems, and a lack of competent human resources. Through a descriptive-analytical approach, this study shows that consistent application of Islamic principles, adaptive regulatory support, and increasing human resource capacity are the keys to strengthening and sustaining the Islamic financial system in Indonesia. This research is expected to be an academic contribution to the development of more inclusive and sustainable Islamic economic theory and practice.

Abstract

Although the concepts of ‘ām and khāṣ expressions have been widely discussed in the literature on Ushul Fiqh, studies comprehensively analyzing their implications for the process of Islamic legal determination remain relatively limited. This study aimed to analyze the concepts of ‘ām and khāṣ expressions, the forms of their use in the texts of the Qur’an and Hadith, and their implications for the process of Islamic legal istinbāṭ. The study employed a qualitative approach using library research. Data were obtained through a documentation study of Ushul Fiqh texts, Qur’anic exegesis texts, books, and relevant scholarly journal articles and were subsequently analyzed using descriptive-analytical and content analysis methods. The findings showed that ‘ām expressions contain a general scope of legal application, whereas khāṣ expressions restrict the applicability of a law to certain objects, individuals, or conditions. The mechanism of takhṣīṣ serves to restrict the generality of an expression, thereby producing a more precise and proportional legal interpretation that is aligned with the objectives of Sharia. Understanding the relationship among ‘ām, khāṣ, and takhṣīṣ expressions also has important implications for the consistency and accuracy of the process of Islamic legal istinbāṭ. This study concludes that mastery of linguistic principles concerning general and specific expressions is an essential element in determining Islamic law methodologically. These findings contribute to the development of Ushul Fiqh studies, particularly by strengthening the methodology of Islamic legal determination based on linguistic analysis of Sharia sources. Abstract

Domestic conflicts triggered by emotional outbursts often lead to the utterance of statements that may have legal consequences for the continuity and stability of marriage. In Islamic law, divorce pronouncements (talaq) are classified into ṣarīḥ (explicit) and kināyah (implicit) expressions, each carrying distinct legal implications. A ṣarīḥ expression is understood as an explicit declaration that unequivocally indicates divorce and therefore does not require the presence of intention (niyyah) for its legal validity. In contrast, a kināyah expression consists of indirect or ambiguous wording whose legal effect depends on the existence of the speaker's intention to divorce. The legal issue arises when such expressions are uttered in a state of anger or emotional distress, raising questions regarding their validity and legal force. This study aims to analyze the concepts of ṣarīḥ and kināyah expressions in Islamic family law, examine the role of intention in determining the validity of divorce, and explore their relevance in contemporary family practices. This research employs a normative legal approach using jurisprudential, juridical, and conceptual perspectives. The data are analyzed descriptively and qualitatively based on the sources of Islamic law, statutory regulations, and relevant scholarly literature. The findings demonstrate that the distinction between ṣarīḥ and kināyah expressions serves as an important instrument in maintaining a balance between legal certainty and substantive justice in divorce cases. Furthermore, an emotional state does not automatically invalidate the legal consequences of a divorce pronouncement; rather, its legal effect should be assessed based on the level of awareness, the surrounding context, and the speaker's intention. Therefore, a comprehensive understanding of divorce expressions is essential to ensure that the determination of marital status is not based solely on the formal wording of the pronouncement but also takes into account psychological, social, and family welfare considerations.

Abstract

The Al-Qur'an is a holy book that is a guide for all mankind in living life on earth. The Qur'an is a book with extraordinary privileges and secrets, not least when viewed in terms of its pronunciation, such as the issue of muthlaq and muqayyad. This study discusses the concept of muthlaq and muqayyad expressions in Islamic legal theory (ushul fiqh) from the perspective of the scope of meaning and their influence on legal interpretation. The objective of this research is to analyze the meaning of muthlaq and muqayyad, examine their application in the Qur’an and Hadith. This research employs a qualitative method through library research by examining classical and contemporary literature of ushul fiqh. The study finds that muthlaq refers to a text with unrestricted meaning, while muqayyad refers to a text limited by certain attributes or conditions. In legal interpretation, scholars often apply the principle of haml al-muthlaq ‘ala al-muqayyad to harmonize legal texts and avoid contradictions. The understanding of these two forms of expressions significantly affects legal rulings and contributes to differences of opinion among Islamic jurists. Therefore, the study of muthlaq and muqayyad remains essential in understanding Islamic legal methodology and addressing contemporary legal issues.

Abstract

The study of linguistic expressions (lafaz) in Islamic legal theory (ushul fiqh) plays an important role in understanding the meanings of the Qur’an and Hadith as the primary sources of Islamic law. One of the linguistic aspects discussed by Muslim scholars is the use of meaning through haqiqah (literal meaning) and majaz (figurative meaning). This study aims to analyze the concepts of haqiqah and majaz, explain their position in understanding Islamic legal texts, and examine their implications for the process of legal deduction (istinbath al-ahkam). This research employs a library research method with a descriptive-analytical approach by reviewing relevant literature in ushul fiqh, Qur’anic exegesis, and academic journals. The findings indicate that literal meaning should be prioritized in interpreting a text, while figurative meaning may be applied when supported by clear contextual evidence.

Abstract

This study examines the dynamics of the Mombolosuako (elopement) tradition among the Tolaki ethnic group in Southeast Sulawesi, Indonesia, focusing on its practice in religiously diverse communities. This research specifically compares the implementation and acceptance of this tradition between the Muslim-majority Anggaberi District and Catholic-majority Puasana Village in Konawe Regency. Using a qualitative approach with a comparative case study design, data were collected through in-depth interviews with 16 key informants, field observations, and document analysis analyzed through Interpretative Phenomenological Analysis (IPA). The findings reveal that in Anggaberi, where Muslims and Tolaki are the majority, Mombolosuako is practiced as a non-normal marriage from cultural identity although some consider it contrary to Islamic teachings. This practice is supported by Regional Regulation No. 1 of 2018 concerning the Implementation of Sara Merapu Customary Law of the Tolaki Tribe. Conversely, in Puasana, where Muslims and Tolaki are minorities, this tradition is neither known nor practiced. This indicates that diversity can reduce the role of customs in social structures. This research emphasizes the importance of adaptive and contextual regulatory approaches in multicultural societies, so that customary policies can balance between preserving traditions and dynamic social needs. These findings provide insights for policymakers and academics in designing more inclusive customary policies and add to the literature on the interaction between customary law, religion, and formal regulations in plural societies.

Abstract

The development of digital media has transformed how religious authority is produced, disseminated, and legitimized in contemporary Muslim societies. In this context, online fatwa platforms have become important spaces for producing and disseminating Islamic legal knowledge. Although scholarship on digital fatwas, Salafism, and women’s fiqh (Islamic jurisprudence) has expanded, limited attention has been given to how digital fatwas reproduce religious authority through legal reasoning. This article examines how KonsultasiSyariah.com (KS) reproduces Salafi authority through fatwas on women. It employs a qualitative approach based on content analysis of fatwas on women published between 2009 and 2019, complemented by interviews, observations, and documentary research. The findings show that the conservative tendency of KS’s fatwas cannot be attributed solely to ideological affiliation with Salafism or proximity to the Ḥanbalī school of law. Instead, this tendency is produced through three interrelated mechanisms: privileging transnational Salafi scholarly authorities, employing text-centered legal reasoning grounded in textual authenticity, and reconfiguring the diversity of fiqh opinions into a more uniform normative framework concerning women. Digital fatwas, therefore, function not only as a means of providing Islamic legal answers but also as mechanisms for constructing and reproducing religious authority, determining which sources of knowledge are regarded as legitimate, and defining the boundaries of female piety. This study contributes to scholarship on digital Islam, Islamic law, and Salafism by demonstrating that conservatism in digital fatwas should be understood not only through the substantive content of legal rulings but also through the epistemic mechanisms by which Salafi authority is produced, legitimized, and normalized in digital spaces. [Perkembangan media digital telah mengubah cara otoritas keagamaan diproduksi, disebarkan, dan dilegitimasi dalam masyarakat muslim kontemporer. Dalam konteks tersebut, platform fatwa daring menjadi salah satu ruang penting bagi produksi dan penyebaran pengetahuan hukum Islam. Meskipun kajian mengenai fatwa digital, Salafisme, dan fikih perempuan telah berkembang, perhatian terhadap bagaimana fatwa digital mereproduksi otoritas keagamaan melalui penalaran hukum masih relatif terbatas. Artikel ini menganalisis bagaimana KonsultasiSyariah.com (KS) mereproduksi otoritas Salafi melalui fatwa mengenai perempuan. Penelitian ini menggunakan pendekatan kualitatif berdasarkan analisis isi terhadap fatwa mengenai perempuan yang dipublikasikan sepanjang 2009–2019, yang dilengkapi dengan wawancara, observasi, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa kecenderungan konservatif dalam fatwa KS tidak dapat semata-mata dijelaskan oleh afiliasi ideologis terhadap Salafisme atau kedekatannya dengan mazhab Hanbali. Sebaliknya, kecenderungan tersebut terbentuk melalui tiga mekanisme yang saling berkaitan, yaitu pengutamaan otoritas ulama Salafi transnasional, penggunaan penalaran hukum yang berpusat pada teks dan bertumpu pada keautentikan dalil, serta rekonfigurasi keragaman pendapat fikih ke dalam kerangka normatif yang lebih seragam mengenai perempuan. Dengan demikian, fatwa digital tidak hanya berfungsi sebagai sarana pemberian jawaban hukum Islam, tetapi juga sebagai mekanisme untuk membentuk dan mereproduksi otoritas keagamaan, menentukan sumber pengetahuan yang dipandang sah, serta menetapkan batas-batas kesalehan perempuan. Penelitian ini berkontribusi pada kajian Islam digital, hukum Islam, dan Salafisme dengan menunjukkan bahwa konservatisme dalam fatwa digital perlu dipahami bukan hanya melalui substansi putusan hukumnya, tetapi juga melalui mekanisme epistemik yang memungkinkan otoritas Salafi diproduksi, dilegitimasi, dan dinormalisasi di ruang digital.]

Abstract

Background:  The ongoing digital transformation in global political governance has exacerbated systemic vulnerabilities, including algorithmic manipulation, information asymmetry, and data opacity, which fundamentally challenge the efficacy of conventional public accountability mechanisms and the moral integrity of state officials. Although discourse on Islamic political ethics has expanded significantly, contemporary literature remains confined within theological-moralistic generalizations and often falls short of formulating technical-specific solutions to the complexities of digital disruption that mainstream secular governance theories have yet to address exhaustively. Purpose:   this research analyzes how core Islamic ethical principles—such as justice (‘adl), trust (amānah), accountability (mas’ūliyyah), transparency (shafāfiyyah), and public welfare (maṣlaḥah)—function as binding moral-legal standards for public office. Methods:  This research fills this crucial gap by employing a normative qualitative approach that operationalizes Maqāṣid al-Sharīʿah as the primary axiological framework to reformulate digital rights and obligations through the crystallization of the principles of Shafāfiyyah and Amānah within the domain of digital welfare (al-maslahah al-raqmiyyah) Results:   Research findings indicate that Islamic political ethics reconfigures public authority as a divinely witnessed mandate, wherein digital transparency is operationalized as a mandatory manifestation of spiritual and legal accountability or mas’ūliyyah to mitigate the abuse of discretion and structural corruption in cyberspace. Implication:  The study argues that Islamic political ethics offers an integrative governance model capable of addressing structural corruption and restoring public trust in state institutions within contemporary Muslim societies. Originality:  This study concludes that this integrative governance model offers an institutional restructuring framework capable of transforming individual moral values into digital codes of ethics and formal regulations, while simultaneously restoring public trust through the reinforcement of structural integrity in Muslim-majority countries during the digital era.

Abstract

Pendahuluan: Status gizi anak-anak di Indonesia merupakan masalah kesehatan masyarakat yang ditandai dengan tingginya angka malnutrisi. Faktor-faktor yang memengaruhi gizi anak antara lain pola tidur yang tidak teratur dan tingginya konsumsi makanan cepat saji (junk food). Penelitian ini mengkaji hubungan antara faktor-faktor tersebut dengan status gizi anak taman kanak-kanak di Makassar. Metode: Penelitian ini menggunakan desain cross-sectional yang melibatkan 151 anak taman kanak-kanak dari lima wilayah di Kota Makassar. Pengumpulan data dilakukan melalui kuesioner pola tidur Pittsburgh Sleep Quality Index (PSQI), kuesioner frekuensi konsumsi junk food (Food Frequency Questionnaire/FFQ), serta pengukuran status gizi berdasarkan indeks berat badan menurut tinggi badan (BB/TB). Analisis data menggunakan uji Chi-Square. Hasil: Hasil penelitian menunjukkan adanya hubungan yang signifikan antara pola tidur (p = 0,008) dan konsumsi junk food (p = 0,014) dengan status gizi anak. Anak dengan pola tidur yang memadai umumnya memiliki status gizi yang lebih baik, sedangkan kualitas tidur yang buruk berkorelasi dengan status gizi yang lebih buruk. Durasi tidur yang singkat dapat mengganggu pengaturan nafsu makan melalui perubahan hormonal pada ghrelin dan leptin, yang berdampak pada kesehatan gizi. Meskipun konsumsi junk food berkaitan dengan status gizi, hal ini bukan satu-satunya penentu malnutrisi, karena keseimbangan asupan makanan secara keseluruhan juga berperan penting. Kesimpulan: Temuan ini menyoroti bahwa pola tidur dan konsumsi junk food merupakan faktor krusial dalam menjaga status gizi anak usia dini, yang mengindikasikan bahwa penerapan pola tidur teratur dan pengendalian asupan junk food dapat mendukung pertumbuhan dan perkembangan yang optimal.   Introduction: The nutritional status of children in Indonesia presents a public health issue, characterized by high malnutrition rates. Factors affecting children's nutrition include irregular sleep patterns and high junk food intake. This study investigates the correlation between these factors and the nutritional status of kindergarten children in Makassar. Method: This study used a cross-sectional design involving 151 kindergarten children from five areas in Makassar City. Data collection was carried out through the Pittsburgh Sleep Quality Index (PSQI) sleep pattern questionnaire, the Food Frequency Questionnaire (FFQ) junk food consumption frequency questionnaire, as well as measuring nutritional status based on the weight for height (WFH) index. Data analysis used the Chi-Square test. Results: The study results indicate a significant relationship between sleep patterns (p = 0.008) and junk food consumption (p = 0.014) with children's nutritional status. Children with adequate sleep generally exhibit better nutritional status, whereas poor sleep correlates with poorer status. Short sleep duration may disrupt appetite regulation through hormonal changes in ghrelin and leptin, impacting nutritional health. While junk food consumption relates to nutritional status, it is not solely indicative of malnutrition, as overall food intake balance also plays a role. Conclusion: These findings highlight that sleep patterns and junk food consumption are crucial factors in maintaining the nutritional status of young children, suggesting that establishing regular sleep and controlling junk food intake can support optimal growth and development.
